CITY OF MERRITT
BYLAW NO. 2081, 2009
A BYLAW TO REGULATE THE OPERATION OF MOBILE FOOD
CONCESSION BUSINESSES LOCATED ON PUBLIC LAND
WHEREAS the Community Charter grants authority to a local government
to regulate the operation of mobile food concession businesses located on
public land;
NOW THEREFORE the Council for the City of Merritt in open meeting
assembled enacts as follows:
1.
This bylaw shall be cited as "City of Merritt Mobile Food
Concession Business Regulation Bylaw No. 2081, 2009"
2.
That City of Merritt Mobile Food Concession Business Regulation
Bylaw No. 1414, 1993 is hereby repealed.
3.
That a "Mobile Food Concession Business" be defined as any
business holding a valid and subsisting licence as required by City
of Merritt Business License Bylaw which is mobile and serves or
offers for sale any food.
4.
That the following regulations APPLY to mobile food concession
businesses:
a)
No operator/corporation shall serve or offer for sale any food
from a mobile food concession business from a sidewalk for
more than a three (3) hour period in any one (1) location.
The location must be in a Commercial (C) Zone as defined in
the City of Merritt Zoning Bylaw. The location shall not
impede pedestrians or vehicular traffic.
b)
The operator/corporation shall be required to maintain
comprehensive liability insurance in the amount of two
million ($2,000,000) dollars. The City of Merritt shall be
included
as
an
additional
named
insured.
The
operator/corporation shall hold the City of Merritt harmless
against any claims, actions for injury, damage loss or death
arising out of the operation of a mobile food concession
business.
c)
Proof of insurance and a signed liability waiver form shall be
submitted to the City of Merritt and be in a form acceptable
to the City of Merritt prior to issuance of a business license.
d)
No service or sale from a mobile food concession business
shall take place between the hours of nine (9:00 o'clock) p.m.
and nine (9:00 o'clock) a.m. of any day of the year.
e)
Service or sales from a mobile food concession business in
City
of
Merritt
parks
shall
only
occur
upon
the
operator/corporation first applying and obtaining the
authorization of the City of Merritt Leisure Services Manager.
f)
Mobile food concession businesses which are continuously
mobile (i.e. ice-cream carts) shall only operate in a
residential (R) Zone as defined in the City of Merritt Zoning
Bylaw and in City of Merritt parks with the appropriate
authorization.
