SUMMARY: The Fees and Charges bylaw is to display the charges for various services and products including Planning Services, Fire & Rescue and Traffic and Penalty fees. This bylaw is a "consolidated" version and includes amendments up to the date listed in the bylaw heading. THE CORPORATION OF THE CITY OF NELSON BYLAW NO. 3092 REVISED: April 28, 2026 BEING A BYLAW TO AUTHORIZE CHARGING FEES FOR VARIOUS SERVICES AND PRODUCTS WHEREAS the Council of the Corporation of the City of Nelson considers it desirable and expedient to authorize the charging of fees for various municipal services and products; NOW THEREFORE, in open meeting assembled, the Council of the City of Nelson enacts as follows: 1. REPEALS 1.1 Schedule "E" of the "Development Approval Procedures Bylaw No. 2706, 1995 is hereby deleted in its entirety. 2. CITATION This Bylaw may be cited as "The Corporation of the City of Nelson Fees and Charges Bylaw No. 3092, 2008". 3. DEFINITIONS "City" shall mean the "Corporation of the City of Nelson"; "Council" shall mean the duly elected council for the Corporation of the City of Nelson; "Customer" means any natural person or Person who has a Nelson Hydro account; "Participant" means a Customer who has successfully applied for services under the Program; "Person" means any sole proprietorship, partnership, corporation, trust, joint venture, or any incorporated or unincorporated entity or association of any nature; 4. APPLICATION This Bylaw shall apply to any person who requires goods or services supplied by the City and provided for in this Bylaw. TAXES Fees and Charges in this Bylaw do not include Federal or Provincial taxes and are therefore subject to the addition of these taxes as applicable. 7. SEVERABILITY If any part of this Bylaw is for any reason held invalid by a Court of competent jurisdiction, the invalid portion shall be severed and the severance shall not affect the validity of the remainder. 8. EFFECTIVE DATE This Bylaw shall come into force and effect upon its adoption. In addition to the above application fees for Official Community Plan or zoning/land-use amendment applications that are required to go before additional public hearings, the applicant shall pay for the advertising costs ($600.00 per additional public hearing). 3. In addition to the above application fees, the applicant shall pay for any legal and/or surveyor fees required by the Director of Development Services to process or approve an application. 4. The number of dwelling units and/or parcels for a zoning/land-use bylaw amendment shall be determined by either using the maximum density of dwelling units permitted per hectare of land in the proposed zone or designation, or by dividing the area of the land proposed to be re-designated or zoned by the minimum parcel size requirement of the proposed zone or designation, whichever yields the greatest number. 5. Refunds of application fees listed under the "BUILDING" or "PLUMBIING" Development Categories are subject to the following conditions: (a) No refunds shall be issued for application fees of $200 or less. (b) Refunds sought prior to review of an application by the Building Official but after initial receipt and processing are eligible for a 90% refund. (c) Refunds sought prior to issuance of a permit, but after review of an application by the Building Official are eligible for a 50% refund. (d) Refunds sought after issuance of a permit but prior to any construction work or inspections being conducted are eligible for a 25% refund up to 60 days from date of issuance of a permit, and thereafter no refund. (e) Refunds sought once construction work has begun are not eligible for any refund. 6. Refunds of application fees listed under the "PLANNING" Development Category are subject to the following conditions: (a) No refunds shall be issued for application fees of $300 or less. (b) For a Development Permit or Preliminary Layout Approval for Subdivision/Strata, refunds sought: i. prior to preliminary review of the application are eligible for a 90% refund; ii. prior to the initiation of the full review of the application (following the referral to other departments), are eligible for a 75% refund. iii. following review of the application but prior to the preparation of the permit or Preliminary Layout Approval document, are eligible for a 25% refund. (c) Refunds sought for an Encroachment Agreement application prior to staff review of the application are eligible for a 90% refund. (d) For application types that are considered by Council and/or require a neighbourhood notification and/or newspaper notifications, refunds sought: i. prior to preliminary staff review of the application are eligible for a 90% refund; ii. prior to the initiation of the full review of the application (following the referral of the application to other departments), are eligible for a 75% refund; iii. following review of the application but prior to preparation of the Council/Advisory Planning Commission report and/or the neighbourhood notification, are eligible for a 50% refund. (2) The onus of establishing that the vehicle was in the possession of some person other than the owner rests with the owner. Facilities are open early May and close late September, depending on weather conditions. DEFINITIONS: In this schedule: "Large Event" means any event with one-hundred (100) attendees or more, or meets any of the following criteria: 1) is held on any public street or parking area, 2) has any road or parking impacts, 3) has any temporary structures, 4) serves or sells any commercial food or beverage, 5) has open flames, 6) has sales of any kind, 7) has any amplified sound, 8) has any electricity, or 9) serves or sells liquor. "Not for Profit" means an organization that operates without the intention of making a profit for its owners or stakeholders. "Private Event" means an event that is closed to the general public for private occasions such as birthday parties. "Public Event" means a community, cultural or other type of unique event that is open to all members of the public to attend. "Hall Street Pier" means the park, and platform structure supported on pillars leading out from the shore into a body of water, located on the property described as "District Lot 2384 and District Lot 15815, Kootenay District". "Small Event" means any event with up to ninety-nine (99) attendees, and: 1) is not held on any public street or parking area, 2) does not have any road or parking impacts, 3) does not have any temporary structures, 4) does not serve or sell any commercial food or beverage, 5) does not have any open flames, 6) does not have any sales of any kind, 7) does not use any amplified sound, 8) does not require any electricity, or 9) does not serve or sell liquor.
