STREET AND TRAFFIC BYLAW NO. 7664, 2015
A Bylaw for the regulation of Traffic and the use of Streets
and other Public Places within the City of New Westminster.
(Adopted November 21, 2016)
This is a consolidation of the bylaws listed below. The amendment bylaws have
been combined with the original bylaw for convenience only. This consolidation is
not a legal document. Certified copies of the original bylaws should be consulted
for all interpretations and applications of the bylaws on this subject.

BYLAW NO. 7664, 2015
A Bylaw for the regulation of Traffic and the use of Streets
and other Public Places within the City of New Westminster.
WHEREAS the Community Charter SBC 2003, Chapter 26, Transportation Act,
SBC 2004, Chapter 44 and the Motor Vehicle Act, RSBC 1996, Chapter 318
authorizes a local government to regulate, prohibit and impose requirements in
relation to Streets and Traffic;
NOW THEREFORE the City Council of the Corporation of the City of New
Westminster in open meeting assembled HEREBY ENACTS AS FOLLOWS:

SECTION 1 INTERPRETATION AND AUTHORITIES
1.1
This Bylaw may be cited as "Street and Traffic Bylaw No. 7664, 2015"
1.2
Street Traffic Bylaw 6027, 1991 Bylaw and amendments thereto are
hereby repealed.
Exemptions
1.3
This Bylaw does not apply to Emergency Vehicles.
1.4
Notwithstanding anything elsewhere contained in this bylaw, the
provisions relating to the Stopping or Parking of Vehicles shall not apply
to:
i.
Vehicles used in conjunction with the servicing of public utilities
including telephone systems, electric systems, natural gas systems
and cablevision systems;
ii.
municipal and other government Vehicles;
iii.
towing service Vehicles; or
iv.
armored carriers;
while such Vehicles are actually engaged in works of necessity on a Street
requiring them to be Stopped or Parked.
1.5
Drivers of Vehicles referred to in section 1.4 shall take reasonable
measures to provide caution to the public when those Vehicles are Parked
or Stopped on the Street.
1.6
This bylaw does not apply to provincial public highways as defined in the
Transportation Act.
Offences and Penalties
1.7
Every person who violates any of the provisions of this Bylaw or who
suffers or permits anything to be done in contravention or violation of this
Bylaw, or who neglects or refrains from doing anything required to be
done under the provisions of this Bylaw shall be guilty of an offence
punishable on a summary conviction and liable to a fine not exceeding
$10,000.00 or imprisonment for not more than 6 months or both.

Each day that the violation is permitted to exist shall constitute a separate
offence.

Severability
1.9
If any court of competent jurisdiction declares any phrase, sentence or
section of this Bylaw invalid, the invalid portion shall be severed and the
severance shall not affect the validity of the remainder.
References to Enactments
1.10 A reference to a statute in this bylaw refers to a statute of the Province of
British Columbia unless otherwise indicated, and a reference to any
statute, regulation code, or bylaw refers to that enactment as it may be
amended or replaced from time to time.
1.11 Except as otherwise indicated in this bylaw, words and phrases herein are
to be construed in accordance with their meanings in the Community
Charter, the Motor Vehicle Act, Transportation Act, Commercial Transport
Act, Interpretation Act and the Offence Act as the context and
circumstances require.

SECTION 2 DEFINITIONS
2.1
In this bylaw, unless the context otherwise requires:

Accessible Parking
Meter
means a Parking Meter reserved for the use of
Persons with a Disability and identified by a sign
and/or decal;
Accessible Parking
Permit
means a Permit issued under the authority of the City
Engineer which exempts eligible Vehicles from
depositing payment at a Parking Meter or in a Pay
Parking Zone;
Accessible Parking
Zone
means a Parking zone on a Street identified by a
disabled Parking sign or marking;
Angle Parking
means the Parking of a Vehicle other than parallel to a
Curb or the lateral lines of a roadway;

Arterial Road
means any arterial road listed in Schedule D to this
Bylaw
Block Face
one side of a Street between two consecutive features
intersecting that Street, such as one side of a City
block. The features can be either named Streets or
boundaries of standard geographic areas, as outlined
in Schedule A;
Boulevard
means the area between the Curbs, lateral lines, or
the shoulder of a Street and the adjacent property line,
including Sidewalks;
Building Official
Means a person or persons designated by the City as
a building inspector, plan checker, plan reviewer or
plumbing inspector;
Bus
means a motor Vehicle designed to carry more than
ten persons, including the Driver; that is operated for
public transit;
Bus Zone
means a space on a Street provided for Buses to Stop
for the purpose of loading or unloading passengers,

either marked by traffic control devices or a Bus Stop
Sign or within 7.5 meters of a Bus Stop Sign where no
other traffic control devices are in place;
Bus Stop Sign
means a sign designating where Buses may Stop to
allow passengers to embark or disembark;
Bylaw Officer
means a member of the New Westminster Police
Department, Special Constable, or such person
appointed by Council as a Bylaw Officer, Animal
Control Officer, or Parking Patrol Officer;
Chattel
means a moveable item of personal property
including, without limitation, a Vehicle, a leased or
rented dumpster, Disposal Bin or container,
merchandise, fuel, wares of any nature, a Cycle, a
Shared E-Bike, Shared Electric Kick Scooter or
signage;
Chief Constable
means the Chief Constable of the New Westminster
Police Department and includes his or her authorized
Deputy;
City
means the Corporation of the City of New
Westminster;
City Engineer
means the person appointed as Director of
Engineering Services of the City or his or her
designates;
Class B Motorhome
means a Vehicle as defined as such by Transport
Canada and has been manufactured from a complete
van into a camper van with modifications which may
include: raised roof, lowered floor, customized seating,
washroom facilities, kitchen installation;
Collection Cart
means a garbage, recyclable material, yard trimmings
or food scraps container identified for its appropriate
use and equal to or less than 360 L in volume,
supplied by the City or the City's agent, that is
specially designed for automated collection;

Collector Road
means any collector road listed in Schedule D to this
Bylaw

Commercial Trailer
means a Trailer having a Gross Vehicle Weight of
more than 1400 kg, but does not include a
Recreational Trailer;
Commercial Vehicle
Includes:
i.
any motor Vehicle having a Gross Vehicle
Weight over 5500 kg;
ii.
any motor Vehicle bearing a commercial
license plate or decal;
iii.
any motor Vehicle having permanently attached
to it a Truck or delivery body;
iv.
a casket wagon, limousine, hearse, motor Bus,
tow Vehicle, road building machine, taxi and a
tractor;
v.
any combination of Truck, Truck tractor, semi-
Trailer and Trailer;
vi.
a motor Vehicle having an engine valve
retardant braking system installed or employed
in addition to the standard braking systems;
and
vii.
other Vehicles as specified by regulation of the
Lieutenant Governor in Council pursuant to the
Commercial Transport Act;
Commercial Loading
Zone
means an area on a Street, for the exclusive use of
Commercial Vehicles, designated for the loading or
unloading of goods or merchandise;
Construction
Vehicle
means a Vehicle that is at any time used to deliver
construction materials or equipment or employed for
the purposes of construction work;
Council
means the Municipal Council of the City;
Crosswalk
means:
i.
a portion of the Street distinctly indicated for
Pedestrian crossing by signs or by lines or
other markings on the surface; or

ii.
the portion of a Street at an Intersection that is
included within the connection of the lateral
lines of the Sidewalks on the opposite sides of
the Street, or within the extension of the lateral
lines of the Sidewalk on one side of the Street;
or
iii.
in the absence of a Sidewalk, the portion of a
Street at an Intersection that is included within
the extension of the lateral edge of the Street
and the adjacent lateral property line;
Curb
means the portion of any Boulevard that borders on
the Street;

Custom Transit
Vehicle
means a vehicle used primarily for the transport of a
Person with a Disability, operated by an agency
approved by a government authority responsible for
providing transit services for a Person with a Disability,
and identified in a manner specified by the City
Engineer.
Cycle
means a device having any number of wheels that is
propelled by human power and on which a person
may ride and includes a Motor Assisted Cycle, but
does not include any device that is gas powered, a
skate board, roller skates or inline roller blades;

Cycle Network
means Multi-Use Pathways, Protected Cycle Lanes
and Shared Cycle Routes as identified in Schedule E
to this Bylaw;
Day-Use Parking
Permit
means a Parking Permit issued under the authority of
the City Engineer to a Resident in respect of their
address for use on a single day by Visitors or
Residents;

Derelict Vehicle
means a Vehicle that:
i.
is not capable of being moved by its own
motive power; or
ii.
is reduced to parts, frames, or bodies of a
Vehicle; or
iii.
is discharging oil, gas or other fluids dangerous
to the environment, onto a Public Place;
Disability Permit
means a Parking Permit issued by the Social Planning
and Research Council of British Columbia;
Disposal Bin
means a large watertight, lidded, lockable container
supplied by the City, the City's agent, or a private
waste hauler for the purpose of storing solid waste
from multiple residential or non-residential units;
Driver
means a person who drives, operates, propels or is in
actual physical control of a Vehicle;
Driveway Crossing
means the improved portion of the Boulevard or
Sidewalk specifically designated and improved to
provide vehicular access to a parcel of land, and shall
include the widest extent of the driveway flare, as
outlined in schedule A, or variations thereof;
Electric Kick
Scooter
means an Electric Kick Scooter as defined and
described in the Electric Kick Scooter Pilot Project
Regulation, B.C. Reg. 247/2023;
Electric Kick

means the Electric Kick Scooter Pilot Project

Markings
means two lines of painted intermittent squares that
indicate where crossing a Street is permitted for
Cycles
Emergency Vehicle
means:

i.
a Vehicle or Cycle carrying rescue or first aid
equipment if there is an urgent emergency
justifying a rate of speed in excess of any
maximum rate of speed provided for in the
Motor Vehicle Act;
ii.
a Vehicle or Cycle driven by a member of a fire
department in the discharge of his or her duties;
iii.
a Vehicle or Cycle driven by a Peace Officer,
constable or member of the police branch of
Her Majesty's Armed Forces in the discharge of
his or her duty;
Fire Lane
means a right of way designated for passage of
Emergency Vehicles;

Great Street
means any Great Street listed in Schedule D to this
Bylaw
Gross Vehicle
Weight (GVW)
means the Gross Vehicle Weight for which a Vehicle
is licensed;
Heavy Truck
Bylaw No. 8160,

means a Vehicle which:
i.
has a Gross Vehicle Weight in excess of eleven
thousand eight hundred (11,800) kilograms; or
ii.
comprises a Truck tractor towing one or more
Trailers or semi-Trailers;
Highway
means the same as defined in the Transportation Act;
Idle
means the running of the engine of a Vehicle while the
Vehicle is not in motion;
Intersection
means the area created by the extension of the lateral
lines of Streets which join one another whether such
Streets at the junction cross each other or meet at an
angle without crossing each other;

Lane
means a Street that is intended to provide direct
access to a property and is not intended to provide
legal frontage
Loading Zone
means an area on a Street designated for the loading
or unloading of persons, goods or merchandise;

Local Road
means a Street which primarily provides internal
circulation within the neighbourhood in addition to
direct access to a property

Lot
means the smallest unit in which land is designated as
a separate and distinct parcel on a legally recorded
subdivision plan or description filed in the Land Title
Office

Major Road Network
means any major road network shown in Schedule D
to this Bylaw
Median
means an area that is painted, Curbed or raised and is
located between Traffic lanes of a Street;
Mobile Workshop
means:
i.
a Vehicle containing equipment that must be
operated inside or in association with the
Vehicle; or
ii.
a Vehicle serving as a facility for taking
measurements or making observations or
conducting maintenance or construction
operated by or on behalf of a municipality,
public utility or police, fire or emergency
service;
Mobility Assistive
Device
means a wheeled device powered by an electric motor
intended for transporting disabled persons;
Motor Assisted
Cycle
means a device:

i.
to which pedals or hand cranks are attached
that will allow for the Cycle to be propelled by
human power,
ii.
on which a person may ride,
iii.
to which is attached a motor of a prescribed
type that has an output not exceeding the
prescribed output, and
iv.
that meets the other criteria prescribed under
section 182.1 (3) of the Motor Vehicle Act as
amended from time to time;

Multi-Use Pathway
means a Street, or portion of a Street, designed for
use by Pedestrians, Cycles, Electric Kick Scooters,
and other non-motorized rolling conveyances,
physically separated from a roadway used for
Vehicles;
Neighbourhood Zero
Emission Vehicle
means a Vehicle that travels on 4 wheels and is
powered by an electric motor that is designed to allow
the Vehicle to attain a speed of 32 kilometers per hour
but not more than 40 kilometers per hour in a distance
of 1.6 kilometers on a paved level surface, and which:
i.
meets or exceeds standards of the Motor
Vehicle Safety Act (Canada) for a low-speed
Vehicle and bears a compliance label for a low-
speed Vehicle in accordance with that Act; or
ii.
if imported to Canada, has been imported as an
admissible low-speed Vehicle in accordance
with the Motor Vehicle Safety Act (Canada)
requirements; and
iii.
bears a compliance label for a low-speed
Vehicle in accordance with that Act; or
iv.
meets applicable federal United States laws in
accordance with the Motor Vehicle Safety Act
(Canada);

Parade
means any procession or body of Pedestrians,
standing, marching or walking on any Street or
Sidewalk, or any group of Vehicles, except funeral
processions, standing or moving on any Street where
Traffic control is required;

Park
means the standing of a vehicle, whether occupied or
not;
Parking Lot
means a portion of City-owned land set aside, used or
intended to be used for the Parking of Vehicles;
Parking Meter
means any automatic or other mechanical device
placed on any Street, in a Pay Parking Zone, to
measure and record the duration of Parking;
Parking Permit
means a Resident Parking Permit, Visitor Parking
Permit, Day-Use Parking Permit, or Shared Vehicle
Parking Permit issued under the authority of the City
Engineer which exempts eligible Vehicles from posted
Parking restrictions within a Resident Permit Parking
Zone;
Passenger Loading
Zone
means a portion of a Street set aside adjacent to a
Curb designated for the exclusive use of Vehicles for
the loading or unloading of passengers;
Pay-by-Plate
means a system established by or on behalf of the
City under which the operator of a Vehicle may pay
the fee for Parking a Vehicle in a pay parking zone
remotely at a pay station in accordance with the
requirements of that system as indicated on or at the
pay station;
Pay-by-Phone
means a system established by or on behalf of the
City under which a person may:
i.
set up a cash or credit card account; and
ii.
pay the fee for Parking a Vehicle in a metered
space remotely by telephone in accordance
with the requirements of that system;
Pay Parking
Station
means a device operated and maintained by or on
behalf of the City for collecting Parking fees for

Parking in, and controlling the use of Pay Parking
Zones;
Pay Parking
Zone
means one or more Streets, or a portion of one or
more Streets, designated as such under this Bylaw
where Parking is permitted subject to payment of a
fee;
Peace Officer
means a member of the New Westminster Police
Department, Special Constable, Bylaw Officer, Animal
Control Officer, Parking Patrol Officer, or other person
so employed for the preservation and maintenance of
public peace;
Pedestrian
means a person on foot, in a wheelchair or Mobility
Assistive Device;
Permit
means a Permit issued under this Bylaw;
Permit Holder
means a person holding a valid Permit under this
Bylaw;

Person with a
Disability
means a person whose mobility is limited as a result of
a permanent or temporary disability;

Protected Cycle
Lane
means a portion of a Street designated for the use of
Cycles and Electric Kick Scooters, which is separated
from Vehicle traffic by physical elements, signing,
striping, and/or pavement markings;
Protected Cycle
Lane Buffer
means a measure to physically separate and protect a
bicycle lane from motor vehicle traffic, including curbs,
planters, landscaping, bollards or similar measures or
materials;
Public Place
means a Highway, Street, lane, Boulevard, Park, right
of way or any other real property owned, held, vested
in, or operated, managed or administered by the City
or by a school located within the City;
Recreational Trailer
means a Trailer used primarily for accommodation
during travel or recreation or utilized specifically to

transport pleasure craft not exceeding 10 meters in
length;
Recreational Vehicle
means a Vehicle used primarily for accommodation
during travel or recreation or a Recreational Trailer
attached to a Vehicle, but does not include Class B
Motorhomes;
Resident
means a person who resides in the City of New
Westminster;
Resident Permit
Parking Zone
means a portion of a Street in a residential
neighbourhood where a Traffic Control Device
prohibits or time restricts Parking for any Vehicle
without a valid Parking Permit;
Resident Parking
Permit
means a Parking Permit issued on an annual basis
under the authority of the City Engineer to a Resident
in respect of a specific Vehicle registered to that
Resident's home address;

Shared Cycle Route
means a Street or a portion of a Street designated for
shared use of Cycles and Vehicles
Shared E-Bike
means a Motor-Assisted Cycle that is publicly-
accessible and owned by a Shared Micromobility
Service;
Shared Electric Kick
Scooter
means an Electric Kick Scooter that is publicly-
accessible and owned by a Shared Micromobility
Service;
Shared
Micromobility
Device
means a Shared Electric Kick Scooter or Shared E-
Bike;
Shared
Micromobility
Parking Zone
means the area or space on a roadway designated by
a Traffic Control Device and established for the
exclusive use of a specified Shared Micromobility
Service and the parking of its Shared Micromobility
Devices;

Shared
Micromobility
Service
means a legal entity whose business is to provide
access to a fleet of Shared E-Bikes and/or Shared
Electric Kick Scooters for a fee;
Shared Vehicle
means a four-wheeled automobile, van, or pick-up
truck owned and operated by a Shared Vehicle
Organization;
Shared Vehicle
Organization
means a legal entity whose principal business
objective is to provide its members, for a fee, with a
car-sharing service by which such members have
access to a fleet of Shared Vehicles which they may
reserve for their use;
Shared Vehicle
Parking Permit
means a Parking Permit issued on an annual basis
under the authority of the City Engineer to a Shared
Vehicle Organization in respect of a specific Shared
Vehicle;
Sidewalk
means that portion of the Boulevard, running parallel
to the Street that has been improved for the use of
Pedestrians;
Stop
means:
i.
when required, a complete cessation from
movement; or
ii.
when prohibited, the Stopping or standing of a
Vehicle, whether occupied or not, except when
necessary to avoid conflict with other Traffic or
to comply with the directions of a Bylaw Officer
or Traffic Control Device;
Street
means a road, lane, bridge, viaduct, and any other
way open to public use, other than a private right of
way on private property;
Street Occupancy
Permit
means a Permit issued under the authority of the City
Engineer to allow for the exceptional use of a Public
Place;
Taxi Zone
means a space on a Street provided for taxis to Stop
for the purpose of loading or unloading passengers
marked by a Traffic Control Device;

Traffic
includes Pedestrians, Vehicles, Cycles and other
conveyances, either singly or together, while using a
Street to travel;
Traffic Control
Device
means a sign, signal, Parking Meter, Pay Parking
Station, road marking, barrier or device, placed or
erected by authority of the City Engineer or the
Province of British Columbia.
Trailer
means a Vehicle that is at any time drawn on a Street
by a motor Vehicle, which includes but is not limited to
a Utility Trailer, Recreational Trailer or Commercial
Trailer;

Transportation
Management Plan
means a detailed plan acceptable to the City Engineer
addressing all activities, needs and impacts
associated with occupancy on a Street or Boulevard,
whenever work contemplated in a Street Occupancy
Permit may impact the movement of Vehicles,
Pedestrians, and/or Cycles
Truck
means a Vehicle, other than a Bus, station wagon,
Recreational Vehicle, passenger van, or car that is
either permanently fitted with special equipment, or is
designed to, and normally used to, convey a load, and
that may operate as a single unit or may pull a full
Trailer or pony Trailer;
Truck Route
means any Street depicted in Schedule C of this
Bylaw;
Utility Trailer
means a Trailer having a licensed Gross Vehicle
Weight of 1400 kg or less, but does not include a
Recreational Trailer;
Vehicle
means a device in, on or by which a person or thing is
or may be transported or drawn on a Street, but does
not include a device designed to be moved by human
power, a device exclusively on stationary rails or
tracks, Mobility Assisted Device, Electric Kick Scooter,
or a Motor Assisted Cycle;

Vehicular Access
means access to or egress from a Lot by a Vehicle
Veteran Plate
means a British Columbia Veterans Licence Plate
issued under the Motor Vehicle Act;
Visitor
means a person primarily engaged in an activity at the
home of a Resident residing within a Resident Permit
Parking Zone;
Visitor Parking
Permit
means a Parking Permit issued on an annual basis
under the authority of the City Engineer to a Resident
in respect to their address for use by Visitors or
Residents;

SECTION 3 GENERAL REGULATIONS
General Powers of the City Engineer
3.1
The City Engineer may make and amend orders and Permits in respect to
the matters comprised in this Bylaw.
Power to Order the Erection of Traffic Control Devices
3.2
The City Engineer may locate, establish and maintain upon any Street or
Boulevard such Traffic Control Devices as may be deemed necessary for
the regulation, direction and control of Traffic on any Street or Boulevard.
Power to Temporarily Close Streets and Issue Street Occupancy Permits
3.3
The City Engineer may:
3.3.1
temporarily close any Street;
3.3.2
issue a Street Occupancy Permit to any applicant to
temporarily occupy a Public Place, other than as permitted
by a sign or a meter;
3.3.3
require the construction of buildings and/or hoarding on
abutting properties if it is necessary to protect the public
during such construction.
3.4
The City Engineer may refuse, suspend, amend or revoke any Permit if
the City Engineer considers that the activities proposed or contemplated
under the Permit cannot be or are not being carried out safely and with a
minimum risk of injury to persons, damage or loss to property,
inconvenience to others using the Public Place, or to Residents or
Businesses in the vicinity or to the public generally.
Power to Restrict Use of Streets
3.5
Where construction, reconstruction, widening, repair, or other work is
being carried out or is to be carried out on any Street, the City Engineer
may:
3.5.1
prohibit use of the Street; or
3.5.2
restrict the width, length, height, or weight of Vehicles using
the Street.

Power to Order the Placement of Temporary "No Stopping" Signs
3.6
Where construction, reconstruction, widening, repair, or other work is
being carried out or is to be carried out on any Street, or where required
for the purpose of public safety the City Engineer may order:

3.6.1
that Stopping on the Street be prohibited; and

that temporary "no Stopping" signs be placed on that Street.

3.7
The placement of temporary "no Stopping" signs does not affect other
previous lawful occupancy of the Street.
Power to Designate Disabled and Reserved Parking Zones
3.8
The City Engineer may reserve Parking zones for persons with a disability,
Buses, taxis, Shared Micromobility Services, Commercial Vehicles or
other types of Vehicles, for use by persons other than the general public.
Compliance with Directions of Bylaw Officers, Building Officials and City
Engineer
3.9
Every person shall comply with an order, direction, signal or command
made or given by a Bylaw Officer, Building Official or City Engineer in the
lawful performance of their duties.
3.10 Every person is guilty of an offense under this bylaw if that person:
3.10.1
interferes with, obstructs, or impedes a Bylaw Officer in the
lawful performance of their duties; or
3.10.2
takes any Chattel, or attempts to take any Chattel, that is
lawfully in the custody of a Bylaw Officer in the lawful
performance of their duties.
3.11 Service of an order made under the authority of this bylaw will be sufficient
if the order is:
3.11.1
served personally, either verbally or written, on the person
responsible for compliance with the order;

mailed by prepaid registered mail to the last known address
of the person responsible for compliance; or
3.11.3
in the case of service on a company, is:
3.11.3.1
served personally on a director, officer or
manager of the company; or
3.11.3.2
left at or mailed it by registered mail to the
registered office of the company.
Identification on Request
3.12 Every person shall, at the request of a Bylaw Officer:
3.12.1
produce identification and state correctly his or her name
and address; or
3.12.2
state correctly his or her name and address and date of birth
if that person cannot produce identification.
3.13 Every Driver shall:
3.13.1
have his or her Driver's license and Driver's certificate and a
motor Vehicle liability insurance card or financial
responsibility card, issued for the motor Vehicle he or she is
driving or operating, in his or her possession at all times; and
3.13.2
produce the license, certificate and card for inspection on
demand of a Bylaw Officer.

SECTION 4 STOPPING AND PARKING REGULATIONS
Manner of Parking
4.1
Where signs or markings indicate that Angle Parking is permitted, a
person shall Park the Vehicle at the angle to the Curb indicated by such
signs or markings.
4.2
Except where signs or markings indicate that Angle Parking is mandatory,
no person shall Stop or Park a Vehicle other than:
4.2.1
parallel to the Curb on a Street;
4.2.2
with wheels nearest the Boulevard positioned parallel to the
Street; and
4.2.3
where there is a Curb, within 0.3 metres of the Curb or,
where adjacent to a Protected Cycle Lane and permitted by
signage, within 0.3 meters of the outside of the Protected
Cycle Lane Buffer.
4.3
No person shall Park a Vehicle in such a manner that any part of the
Vehicle extends into the Street beyond the lines or markings indicating the
limit of the Parking spaces on that section of the Street.
4.4
No person shall Stop or Park a Vehicle on the left side of the Street:
4.4.1.
except where travel is in a single direction; and
4.4.2
where applicable, in accordance with a Traffic Control
Device.
4.5
Where a Traffic Control Device indicates that Angle Parking is in place no
person shall:
4.5.1
Park in any manner other than as directed by the Traffic
Control Device; or
4.5.2
reverse a Vehicle into a space, unless otherwise indicated.
4.6
An owner, registered owner, lessee or operator of a Vehicle must not
cause, allow or permit that Vehicle to stand unattended on any perceptible
grade on any Street unless the front or rear wheels are turned to the Curb
or side of the roadway.

4.7
A person shall ensure that a Vehicle is locked and made secure in a
manner that prevents its unauthorized or unintended use.
Stopping and Parking of Vehicles
4.8
No person shall Stop or Park a Vehicle:
4.8.1
within 6 meters of the approach side of a stop sign;
4.8.2
within 5 meters of a fire hydrant, measured either side from
the point at the Curb or, if no Curb exists, the edge of the
roadway which is closest to the hydrant;
4.8.3
on a Street so that it impedes the normal flow of traffic;
4.8.4
opposite to, or in such close proximity to, another Vehicle
already legally Parked on the Street in a manner which:
4.8.4.1
obstructs or unduly restricts the free movement
of Vehicles on the Street; or
4.8.4.2
leaves less than 3 meters of the travelled
portion of a Street available for the free
movement of Vehicles;
4.8.5
on a Street so as to obstruct the free movement of Vehicles
into, or out of, any driveway, private road or garage adjoining
such Street;
4.8.6
in front of or within 1 meter of a Collection Cart or Disposal
Bin;
4.8.7
alongside or on a Median, traffic island or traffic circle;
4.8.8
in front of or within 1.5 meters of the widest point of a
driveway where it intersects with the continuous edge of the
roadway;

4.8.9
on or within 6 meters of either side of a Crosswalk
4.8.10
on a Sidewalk or Boulevard;
4.8.11
within an Intersection except at a T-Intersection except
where regulated by a Traffic Control Device.

within 6 meters of the nearest edge of the closest Sidewalk
of an intersecting Street or within 6 meters of the nearest
edge of the pavement of an intersecting Street where no
Sidewalk exists;
4.8.13
within 6 meters of a Stop line at a signalized Intersection;
4.8.14
within 15 meters of the nearest rail of a railway crossing;
4.8.15
in contravention of a Traffic Control Device;

4.8.16
that does not display current and valid number plates
registered to the vehicle for which they are displayed, as
required by the Motor Vehicle Act;
4.8.17
within a designated Fire Lane;
4.8.18
on any portion of a Street for a longer period of time than
indicated on any Traffic Control Device;
4.8.19
on a City block controlled by a Parking time limit regulation:
4.8.19.1
on any block at which it was previously Parked
until the next calendar day since the Vehicle
last occupied that block; or
4.8.19.2
in a different location on the same Block Face
in the same calendar day.
4.8.20
in a Shared Micromobility Parking Zone except for the
purpose of loading or unloading persons or materials by the
City, Shared Micromobility Service, or an individual using a
Shared Micromobility Device.
Parking of Vehicles
4.9
No person shall Park a Vehicle:

upon any Street for any continuous period exceeding 72
hours
4.9.2
overnight in any City-owned Parking Lot unless proper
Permits are in place;

4.9.3
that is Derelict in any Public Place;
4.9.4
overnight in any Park as defined by the Parks Regulation
Bylaw No. 3646, 1959;
4.9.5
on a Street so as to obstruct the free movement of
Pedestrians into, or out of, any walkway, stairway or
Sidewalk letdown adjoining such Street; or
4.9.6
at a Vehicle charging station, in a Public Place, for longer
than 2 consecutive hours.

4.9.7
on a Lane so as to obstruct or unduly restrict the free
movement of Vehicles on the Lane.

4.9.8
Despite Subsection 4.9, a person may;
4.9.8.1
Park a vehicle for no more than five minutes,
while loading or unloading persons or
materials; and
4.9.8.2
Despite subparagraph 4.9.8.1, Park a Custom
Transit Vehicle or a Vehicle that displays a
Disability Permit for Persons with a Disability,
for no more than 30 minutes while loading or
unloading persons or materials.
Bus Zones
4.10 No person shall Stop or Park in a Bus Zone except when operating a
public transit or transit utility Vehicle
Loading Zones
4.11 No person shall Stop or Park:
4.11.1
in any Loading Zone unless:
4.11.1.1
actively loading and unloading passengers or
materials; and
4.11.1.2
in any case to a maximum of 30 minutes.

4.11.2
in any Commercial Loading Zone unless:
4.11.2.1
the Vehicle bears a valid commercial decal or
plate;
4.11.2.2
actively loading and unloading of passengers
or materials; and
4.11.2.3
in any case to a maximum of 30 minutes.
4.11.3
in any Passenger Loading Zone unless:
4.11.3.1
actively engaged in the loading and unloading
of passengers; and
4.11.3.2
in any case to a maximum of 5 minutes.
Commercial Vehicles
4.12 No person shall:
4.12.1
Stop or Park a Commercial Vehicle, having a Gross Vehicle
Weight of 5,500 kg or over, on any Street for more than two
consecutive hours;

4.12.2
Stop or Park a Heavy Truck or Trailer on any Street except
when actively and visibly engaged in loading or unloading
the Vehicle or Trailer of commercial goods; or
4.12.3
Stop or Park a Heavy Truck on any Street which forms part
of a Truck Route, as described in Schedule C attached to
and forming part of this Bylaw, for more than two
consecutive hours, except when actively and visibly engaged
in loading or unloading the Vehicle or Trailer.
Taxi Zones
4.13 No person shall Park a Vehicle, which is not a taxi, in a Taxi Zone.
4.14 No person, being the owner or operator of a taxi, shall leave a taxi
unattended in a Taxi Zone for longer than ten minutes.

Accessible Parking Zone
4.15 No person shall Stop or Park a Vehicle in an Accessible Parking Zone or
Accessible Parking Meter space unless:
4.15.1
the Vehicle displays a valid Disability Permit;
4.15.2
Accessible Parking Permit; or
4.15.3
a Vehicle with an out of Province license is bearing a valid
identification issued by the authority having jurisdiction in
that Province to authorize access to accessible parking.
Pay Parking Zones
4.16 No person shall Park a Vehicle in a Pay Parking Zone:
4.16.1
when the meter indicates that the time has expired;
4.16.2
if the meter does not function;
4.16.3
for a period in excess of the maximum time permitted for the
Pay Parking Zone;
4.16.4
unless the Parking fee applicable for the Pay Parking Zone
has been paid; or
4.16.5
unless a valid Permit for that Pay Parking Zone that is
registered to that Vehicle is prominently displayed and
clearly visible through the front windshield.

4.17 Section 4.16 does not apply to:
4.17.1
A Vehicle that is Parked in a Pay Parking Zone outside of
the posted hours of operation; or
4.17.2
A Vehicle displaying a valid Veteran Plate, except that such
Vehicle may not Park in a Pay Parking Zone for a period in
excess of the maximum time permitted for that Pay Parking
Zone.

4.18 Unless a Vehicle is exempted under section 4.17, every Pay Parking
Station record which indicates that the period for which the prescribed fee
has been paid for the Parking of a Vehicle in a Pay Parking Zone has
expired shall be taken as conclusive evidence that the Vehicle found
Parked in the Pay Parking Zone is illegally Parked and in breach of the
provisions of this Bylaw.
Pay-by-Phone
4.19 A person who chooses to use the Pay-by-Phone system must enter the
license plate number of the vehicle being Parked and comply in every
other way of the City's requirements regarding the Pay-by-Phone system.
Vehicles for Habitation
4.20
No person shall use a Vehicle for habitation while it is Parked on or in any
Public Place.
Idling
4.21 No person shall cause or permit a Vehicle to Idle for more than 3 minutes
in a 60 minute period.
Idling Exemptions
4.22 Section 4.21 does not apply to:
4.22.1
a Mobile Workshop while such a Vehicle is being used as a
Mobile Workshop;
4.22.2
Emergency Vehicles while engaged in an emergency and
training activities;
4.22.3
Vehicles for which idling is required as part of a repair or
regular pre-check maintenance process;
4.22.4
armoured Vehicles in which a person remains inside the
Vehicle while guarding the contents of the Vehicle or while
the Vehicle is being loaded or unloaded;
4.22.5
Vehicles required to remain motionless because of an
emergency, Traffic or mechanical difficulties over which the
Driver has no control;

4.22.6
Vehicles engaged in a Parade, race or other event
authorized by the City;
4.22.7
Vehicles required to use heating or refrigeration systems
powered by the motor or engine for the preservation of
perishable cargo; or
4.22.8
Vehicles for which weather conditions:
4.22.8.1
make driving hazardous; or
4.22.8.2
are such that the ambient outside temperature
is more than 30ºC or less than 0ºC.
Parking of Shared Micromobility Devices
4.23 No person shall Park a Shared Micromobility Device in any place, except
within a Shared Micromobility Parking Zone.
SECTION 5 - PERMITS
Resident Parking Permit Zone Regulations

5.1
No person may Park in a Resident Parking Permit zone unless the Vehicle
has a valid Parking Permit for that zone or if a Traffic Control Device
states otherwise.
5.2
Vehicles displaying a Disability Permit are permitted to Park up to a
maximum of two hours within all Resident Parking Permit Zones
throughout the City.
5.3
Vehicles registered with the City and displaying an authorized car share
decal are permitted to Park in Resident Permit Parking Zones within the
block of their designated spot.
5.4
No holder of a Parking Permit authorizing Parking in an area specified in
the Parking Permit shall sell, assign or otherwise transfer that person's
interest in the Parking Permit.
5.5
All Parking Permits are void if misused, illegible or displayed improperly
and are not re-useable.
5.6
A person Stopping or Parking in a Resident Parking Permit zone shall
comply with this Bylaw and all Traffic Control Devices.

Street Occupancy Permits
Activities Requiring a Street Occupancy Permit
5.7
Except as authorized by a Street Occupancy Permit no person shall:
5.7.1
throw, leave, place, or otherwise cause, permit or allow the
deposit of any earth, refuse, debris, gravel, rocks, stones,
fuel, logs, stumps, lumber, blocks, merchandise, Chattel or
other debris to cave, fall, crumble, slide, or accumulate onto
a Public Place;
5.7.2
throw, leave, place, or otherwise cause, permit or allow any
excavation or other obstruction on a Public Place;
5.7.3
dig up, break up or remove any part of a Public Place;
5.7.4
excavate in or under a Public Place;
5.7.5
make any alteration to a street that will result in the
interruption of the flow of water through any drain, sewer or
culvert on or through a Public Place;
5.7.6
mark, imprint or deface in any manner whatsoever a Public
Place or structure thereon;
5.7.7
ride, drive, move or propel any Vehicle over or across a
Boulevard, including any Curb, Sidewalk or ditch therein,
unless such Boulevard has been constructed or improved to
form a suitable crossing;
5.7.8
cause damage to, cut down or remove trees, shrubs, plants,
bushes and hedges, fences, irrigation, bollards or other
things erected by the City on a Public Place;
5.7.9
operate a Vehicle while sounding a loudspeaker or other
noise making device, unless the Vehicle is being operated
as an ice cream vendor Vehicle for which there has been
issued a valid Business license and in accordance with that
license;
5.7.10
conduct construction on a Public Place or provide Traffic
control relating to such construction;

5.7.11
conduct construction on land adjacent to a Street where
access from the Street to the land is required for that
purpose;
5.7.12
block or redirect Traffic on a Public Place using barricades,
Traffic cones, or other means;
5.7.13
occupy any portion of a Public Place to maintain, clean,
construct, alter, repair, demolish, or move a building,
structure, sign, awning, or part thereof, or any other structure
or thing on a Public Place;
5.7.14
occupy any portion of a Public Place or the airspace above a
Public Place to maintain, clean, construct, alter, repair,
demolish, or move a building, structure, sign, awning, or part
thereof, or any other structure or thing on a Public Place;
5.7.15
install, erect, or cause to be installed or erected a Traffic
Control Device, or the likeness thereof, on a Public Place;
5.7.16
damage, obstruct, deface, remove, replace or in any way
interfere with a Traffic Control Device on a Public Place;
5.7.17
construct an access over a Curb, ditch, Boulevard or
Sidewalk crossing;
5.7.18
use a crane or forklift to pick up or carry a load on or over a
Public Place;
5.7.19
blast or use explosives on or over a Public Place;
5.7.20
hold a festival, block party or similar event in a public place;
5.7.21
hold any activity connected with the production of a film in a
public place;
5.7.22
hold a Parade;

5.7.25.1
A Trailer is considered to be attached if
connected to a motor Vehicle as per the Motor
Vehicle Act Regulations, Division 7, Paragraph
7.07 as amended from time to time.
5.7.26
Park a Recreational Vehicle on a Public Place for a period
longer than 48 consecutive hours;
5.7.27
install, maintain or remove public or private utilities;
5.7.28
obstruct or interfere with the free flow of Traffic or attempt to
control or detour Traffic on any Public Place, whether by use
of signs or Traffic control personnel or by barricades or other
physical obstruction on the road, unless the person:
5.7.28.1 is a Bylaw Officer or firefighter acting in the normal
course of his or her duties;
5.7.28.2 is a student or adult school patrol acting under the
authority of the Public Schools Act or as approved
by the Chief Constable;
5.7.28.3 is operating an Emergency Vehicle during an
emergency;
5.7.28.4 is carrying out a lawful purpose of a public utility;
5.7.28.5 is an officer, employee, servant, contractor or
agent of the City acting in the course of their duty;
or
5.7.28.6 has Parked their Vehicle lawfully on a Street in
accordance with a Traffic Control Device or the
direction of a Bylaw Officer;
5.8
The provisions relating to specific Stopping and Parking regulations of
Vehicles in this bylaw shall not apply where a Street Occupancy Permit
has been granted and given an exemption from those provisions.
5.9
The City Engineer may not approve an application for a Street Occupancy
Permit for a matter referred to section 5.7.14 unless the council of the City
has granted a written license authorizing the occupation or encroachment
pursuant to section 35(11) of the Community Charter.
5.10 A Street Occupancy Permit must:

be kept at the site, or in the Vehicle, for which the Permit was
issued; and
5.10.2
must be produced at the request of the City Engineer, Building
Official or a Bylaw Officer.
5.11 The effective period of a Permit shall be as stipulated on the Permit and
shall not exceed 12 months.

5.12 A person to whom a Street Occupancy Permit is issued must comply with
the terms and conditions of the Permit, including the terms and conditions
of the Transportation Management Plan.
5.13 A contravention of a term or condition of a Street Occupancy Permit
renders the Permit void.
5.14 The City Engineer may:

impose terms and conditions in a Street Occupancy Permit
requested by an applicant to occupy a Public Place

amend, vary, suspend, or revoke a Street Occupancy Permit:
5.14.2.1
for reasons of public safety; or
5.14.2.2
where a person to whom a Street Occupancy
Permit is issued fails to comply with the terms
and conditions of the Permit.

5.14.3
establish specifications and requirements for a Transportation
Management Plan to be provided by the applicant as a
condition of the Street Occupancy Permit.

5.14.4
require from the Street Occupancy Permit applicant as a
condition of approval:
(a)
damage deposit for any work that has the potential to
damage any City infrastructure, in an amount to be defined by
the City Engineer;

(b)
insurance for any work which has the potential to
cause injury or damage of a value greater than the damage
deposit, with the City of New Westminster named as
additionally insured, in an amount to be defined by the City
Engineer;
(c)
payment of applicable fees for a Street Occupancy
Permit, as set out at the "Engineering Fees and Rates Bylaw
No. 7553, 2013", as amended from time to time, unless
waived or reduced by the City Engineer after an application.
Oversize and Overweight Permits
5.15 No person shall drive or operate a Vehicle on any Street, either unladen or
with load, exceeding any of the limitations contained in Section 10 of this
Bylaw, without an Oversize and Overweight Permit in writing issued with
respect to the Vehicle by the City Engineer.
5.16 No person shall operate or drive a Vehicle with respect to which an
Oversize and Overweight Permit has been issued, except in conformity
with the conditions stated therein.

Shared Vehicle Parking Permits
5.17 Shared Vehicles that have received a Shared Vehicle Parking Permit are
permitted to Park within all Residential Parking Permit Zones throughout
the City.

SECTION 6 - USE OF STREETS
No Stunting
6.1
A person must not perform or engage in an activity in a Public Place that
is likely to distract, startle or interfere with other users of the Public Place.

Work in Streets
6.2
No person shall
6.2.1 Stop or Park any Vehicle on any Public Place for the purpose
of greasing or repairing such Vehicle except repairs
necessitated by an emergency such as changing a flat tire, or
requiring a battery boost or change;
6.2.2 use any Street for the purpose of performing any work or
doing any act not associated with the normal use of any such
Street for Traffic purposes;
6.2.3 use any Street in a manner which would in any way impede or
interfere with Traffic; or
6.2.4 use any Street in a manner which could deface or injure any
such Street.
Pedestrians
6.3
No person shall stand or assemble on any Street or Sidewalk so as to
obstruct or prevent other persons from using the Street or Sidewalk for the
passage of Vehicles or Pedestrians.
6.4
When crossing a Street at other than a Crosswalk, a Pedestrian must yield
the right of way to a Vehicle.
6.5
The Driver of a Vehicle must yield the right of way to a Pedestrian where
Traffic control signals are not in place or not in operation when the
Pedestrian is crossing the Street in a Crosswalk and the Pedestrian is on
the half of the Street on which the Vehicle is travelling, or is approaching
so closely from the other half of the Street that he or she is in danger.
6.6
A Pedestrian must not cross a Street in contravention of a Traffic Control
Device.

6.7
A Pedestrian must not cross a Street, other than a lane, at any place that
is not within a Crosswalk.
6.8
If there is a Sidewalk that is reasonably passable on either or both sides of
the Street, a Pedestrian must not walk on the Street.
6.9
If there is no Sidewalk, a Pedestrian walking along or on a Street must
walk only on the extreme side of the Street or on the shoulder of the
Street.
6.10 No person shall:
6.10.1
stand in the portion of a Street travelled by vehicles; or
6.10.2
solicit a ride, employment or business with an occupant of a
Vehicle on a Street.
Regulation of Cycles
6.11 Unless the context otherwise requires, a person operating a Cycle on a
Street has all the rights and is subject to all the duties of a Driver.
6.12 A person must not operate a Cycle:
6.12.1
while on a Street without due care and attention or without
reasonable consideration for other persons using the Street,
or;
6.12.2
while on a Sidewalk, footpath, walkway or Multi-Use
Pathway without due care and attention or without
reasonable consideration for other persons using the
Sidewalk, footpath, walkway or Multi-Use Pathway.
6.13 No person on a Cycle shall operate the Cycle on any Sidewalk, footpath or
walkway set out in Schedule B attached to and forming part of this Bylaw.
6.14 A person operating a Cycle:

6.14.1
may ride on a Crosswalk when crossing a Street if:
(a)
directed by a Traffic Control Device.
(b)
that person is riding on a Sidewalk, footpath or
walkway where cycling is not prohibited, subject to
subsection 6.13; or

(c)
the Crosswalk is marked by or is bordered by
Elephants' Feet Markings;
6.14.2
must not ride abreast of another person operating a Cycle on
the Street;
6.14.3
must ride as near as practicable to the right side of the
Street;
6.14.4
must keep at least one hand on the handlebars;
6.14.5
must not ride other than on or astride a regular seat of the
Cycle;
6.14.6
must not use the Cycle to carry more persons at one time
than the number for which it is designed and equipped;
6.14.7
must not ride a Cycle on a Public Place where signs prohibit
their use;
6.14.8
must use from 1/2 hour after sunset and 1/2 hour before
sunrise; and must have the following equipment:
6.14.8.1
a lighted lamp mounted on the front;
6.14.8.2
a red reflector; and
6.14.8.3
a lighted lamp, mounted and visible to the rear,
displaying a red light.

6.14.9
shall, when riding on a Crosswalk, subject to subsection
6.14.1, yield the right of way to Pedestrians who are entering
into, walking in, or walking out of the Crosswalk.
6.15 A parent or guardian of a person under the age of 16 years must not
authorize or knowingly permit that person to operate or ride as a
passenger on a Cycle on a Public Place if that person is not properly
wearing a Bicycle Safety Helmet.
6.16 A person must not ride a Cycle, coaster, inline roller blades, roller skates,
sled, play Vehicle or other similar means of conveyance while the person
is being drawn, pulled or propelled by a Vehicle on a Street.

6.17 A person must not place a Cycle upon any Public Place for any
continuous period exceeding 72 hours without movement.
Regulation of Roller Skates, Inline Roller Blades, Skateboards and
Longboards
6.18 No person shall slide, inline roller blade, roller skate, sleigh, ice skate,
skate board, longboard, ski or use any other similar means of conveyance
on a Street, or use such conveyances in a Public Place contrary to a
Traffic Control Device.
6.19 A person on inline roller blades, roller skates, skateboards, longboards or
other similar means of transportation must not operate such conveyance:
6.19.1
while on a Street without due care and attention or without
reasonable consideration for other persons using the Street,
or;
6.19.2
while on a Sidewalk, footpath, walkway or Multi-Use
Pathway without due care and attention or without
reasonable consideration for other persons using the
Sidewalk, footpath, walkway or Multi-Use Pathway.
6.20 No person on inline roller blades, roller skates, skateboards, longboards or
other similar means of transportation must not operate such conveyance
on any Sidewalk, footpath or walkway set out in Schedule B attached to
and forming part of this Bylaw.
6.21 A person on inline roller blades, roller skates, skateboards, longboards or
other similar means of transportation, shall ride in such a way that it will
not interfere with a Pedestrian lawfully on or using a Sidewalk, footpath or
walkway.
Parades and Processions
6.22 An application for a Street Occupancy Permit for a Parade must be
submitted to the City Engineer at least 180 days prior to the proposed date
of the Parade.
6.23 The City Engineer shall not approve an application for a Street Occupancy
Permit for a Parade unless it is accompanied by:
6.23.1
A letter of consent from the Chief Constable;
6.23.2
A map of the Parade route; and

6.23.3
An explanation of the nature of the Parade, the day and hour
on which such Parade is to be held, the place or places of
formation and disbandment of the Parade.
6.24 In giving consent to a Parade, the Chief Constable may determine such
conditions as deemed appropriate for the orderly regulation of the Parade
and may require the applicant to publish whatever notices of the Parade
as in the opinion of the Chief Constable are necessary for the purpose of
the diversion of Traffic from the parade route.
6.25 A letter of consent for a Parade must be issued to the organizer by the
Chief Constable as hereinafter provided and is accompanied by a Street
Occupancy Permit issued by the City Engineer.
6.26 No person shall:
6.26.1
drive a vehicle through or across any Parade at rest; or
6.26.2
in any way obstruct, impede or interfere;
6.26.2.1
with a Parade; or
6.26.2.2
any person n lawfully taking part in such a
parade.
Displaying Advertising Matter
6.27 No person shall:
6.27.1
paint, paste, stick or affix any sign, bill, notice, substance or
thing on any Street furniture, light standard, electric light,
telephone or other pole located on or about any Public
Place;
6.27.2
deface or disfigure Street furniture, light standard, electric
light, telephone or other pole located on or about any Public
Place, or permit, suffer or allow any person to commit the
acts on their behalf; or

Park a Vehicle or Cycle upon any Public Place for the
purpose of displaying signs.

Removal of Snow, Ice and Rubbish From Sidewalk
6.28 A person being the owner or occupier of real property shall:
6.28.1
remove rubbish from the full width of any Sidewalk, transit
landing, and foot path bordering that person's real property,
for a distance that coincides with the property line of that real
property;
6.28.2
remove snow and ice from the full width of any Sidewalk,
transit landing, curb letdown, and foot path bordering that
person's real property, for a distance that coincides with the
property line of that real property and down to the bare
concrete, not later than 10:00 a.m. of the day after the snow
or ice was deposited thereon; and
6.28.3
remove snow and ice from the roof and other part of a
structure on that real property that is adjacent to or abutting
on any portion of the Street, not later than 10:00 a.m. of the
day after the snow or ice was deposited thereon.
6.29 If an owner or occupier of any parcel of real property fails to remove
rubbish, snow, and ice as required by section 6.28 of this bylaw, the City
Engineer may authorize the removal by another person and the costs of
such removal shall be at the expense of the owner or occupier, as the
case may be, and the City may recover the costs of such work as a debt.
Boulevards
6.30 An owner of land shall:
6.30.1
cut grass and weeds on the Boulevard abutting that owner's
property;

remove trash and litter from Boulevards, including ditches
and Multi-Use Pathways, abutting that owner's property; and
6.30.3
keep in good repair and up to City standards, driveways and
walkways crossing the Boulevard abutting that owner's
property.

6.30.4
keep shrubs and other vegetation that are less than two (2)
meters distance from intersections and driveways from
exceeding one (1) meter height.

Vehicular Access and Driveway Crossings
6.31 A maximum of one Vehicular Access is permitted per Lot:
6.31.1
Where a Lot abuts both a Lane and a Street, or where a Lot
abuts two Streets with different classifications, the Driveway
Crossing must be located to access the Lane or the Street
with the lower classification, unless otherwise approved by
the City Engineer.
6.31.2
Driveway Crossing must meet the minimum widths, as
specified in the Subdivision and Development Control Bylaw
No. 7142, 2007, as amended from time to time.

6.32 Vehicular Access from a residential Lot to an Arterial Road, Collector
Road, Great Street or Major Road Network listed in Schedule D, or the
Cycle Network identified in Schedule E, shall not be permitted, unless:
6.32.1
the Lot is not able to have or obtain Vehicular Access to a
Lane or a Local Road that is not part of the Cycle Network;
6.32.2
a permit issued for the construction of a new building,
garage or carport exempts the Lot owner from providing
access to a Lane or a Local Road at the time of occupancy;
6.32.3
due to a catastrophic incident, the City Engineer allows for
the reconstruction of a pre-existing Vehicular Access.

Conditions of Driveway Crossings
6.33 Repairs or modifications at existing Driveway Crossings on an Arterial
Road, Collector Road, Great Street or Major Road Network listed in
Schedule D, or located on the Cycle Network identified in Schedule E, are
prohibited if a Lot is adjacent to a Lane or a Local Road that is not part of
the Cycle Network.
6.33.1
Repairs or modifications at existing Driveway Crossings at
such locations are allowed if requested by the City Engineer

to meet specifications of the "Subdivision and Development
Control Bylaw No. 7142, 2007", as amended from time to
time.

6.34 The use of Vehicular Access to a Lane or a Local Road that is not part of
the Cycle Network, from a Lot abutting an Arterial Road, Collector Road,
Great Street, Major Road Network or located on the Cycle Network
identified in Schedule E, becomes mandatory when:
6.34.1
the City builds new curb and gutter or otherwise alters the
streetscape to improve walking and cycling conditions on an
Arterial Road, Collector Road, Great Street, Major Road
Network or Cycle Network Street;
6.34.2
a conforming new curb and gutter or otherwise alters the
streetscape to improve walking and cycling conditions on an
Arterial Road, Collector Road, Great Street, Major Road
Network or Cycle Network Street;

6.35 Where the use of Vehicular Access to a Lane or a Local Road has
become mandatory, Driveway Crossings located on a road listed in
Schedule D, or located on the Cycle Network identified in Schedule E,
shall be removed to comply with the single access limit and that portion of
the Street shall be reinstated at the property owner's cost to a condition
similar to that of the Street in the immediate vicinity.

6.36 The City Engineer may vary provisions regarding Vehicular Access and
Driveway Crossings, as defined in this Bylaw, to ensure access to a
residential lot is deemed safe where existing driveways, garages, or
carports are non-conforming.

6.37 The City may remove a Vehicular Access or Driveway Crossing
constructed, maintained, or used in violation of any Bylaw of the City, at
the expense of the property owner.

Vegetation Adjacent to Streets and Boulevards
6.38 No person being the owner or occupier of real property adjacent to a
Street or Boulevard shall permit a tree, shrub, hedge or bush growing or
standing on that land to:

6.38.1
Damage the Street or Boulevard or any works owned or
controlled by the City located in the Street or Boulevard;
6.38.2
Encroach on or over any portion of the Street or Boulevard
to the extent that it impedes the passage of the public over
the Street or Boulevard or impedes sight lines for vehicular
or pedestrian traffic;
6.38.3
Encroach on or over a Street at a height less than 3 meters
above the surface of the Street; or
6.38.4
Encroach on or over any portion of a City sign.
6.39 Where an owner of property fails to comply with an order made pursuant
to section 6.33, within 30 days, the City Engineer may fulfill the
requirement at the expense of the property owner and the cost of the work
is recoverable as a debt.
Regulation of Electric Kick Scooters
6.40 A person must not operate an Electric Kick Scooter:
6.40.1
while on a Street without due care and attention, or without
reasonable consideration for other persons using the Street;
6.40.2
in contravention of the Electric Kick Scooter Pilot Project
Regulation; or
6.40.3
on a Major Road Network or Arterial Road, except along a
Protected Cycle Lane, or Multi-Use Pathway that is located
within or adjacent to a Major Road Network or Arterial Road.
SECTION 7 - VEHICLE REGULATIONS
Obeying Traffic Control Devices
7.1
No person shall drive or operate any motor Vehicle in contravention of a
Traffic Control Device.
Driving on a Sidewalk
7.2
No person shall drive on a Sidewalk, walkway or Boulevard, except:

7.2.1
when entering or leaving a driveway or lane or when entering
or leaving land adjacent to a Street; or
7.2.2
under the authority of a Street Occupancy Permit.
Driving Over Curbs
7.3
No person shall move, drive, run, or propel any Vehicle over or across any
Curb or Boulevard unless:
7.3.1
such Curb or Boulevard has been lowered or otherwise
constructed or reconstructed to form a suitable crossing; and
7.3.2
under the authority of a Street Occupancy Permit.
Gas Powered Devices
7.4
No person shall drive or operate a gas powered device, other than a
Vehicle, on a Public Place.
Neighbourhood Zero Emission Vehicles
7.5
A person may drive or operate a Neighbourhood Zero Emission Vehicle
only:
7.5.1
On a Street that has a speed limit of 50 km/hr or less;
7.5.2
In the lane of the Street closest to the right hand edge or
Curb of the Street that is available for:
i.
general Traffic; or
ii.
high occupancy Vehicles in circumstance where
the Neighbourhood Zero Emission Vehicle is being
used as a high occupancy Vehicle;
Except where necessary to make a left hand turn or to pass
another Vehicle.
7.6
Except to the extent that they conflict with section 7.5, all of the provisions
of this Bylaw applicable to Vehicles and motor Vehicles and the use and
operation thereof shall apply to Neighbourhood Zero Emission Vehicles.

Engine Brakes
7.7
No person shall, except in the case of an emergency, use an engine brake
of any kind to slow or Stop a Vehicle in the City.
Construction Vehicles
7.8
Notwithstanding section 5.7, no person shall operate a Construction
Vehicle on a Street without a Street Occupancy Permit, unless that
Construction Vehicle is delivering or picking up goods, merchandise,
equipment or other things to or from a residence or business premise
located within that block.
Inclement Weather Driving
7.9
No person shall drive any motor Vehicle on a Public Place having any
device designed to increase traction, such as studs, cleats or spikes,
which extend beyond the tread or traction surface of the wheel or track
except tire chains or winter studded tires and then only:
7.9.1
between October 1 and April 30 of the calendar year; and
7.9.2
when required for safety.
Speed Limits on Cycling Routes

7.10 No person shall drive or operate a Vehicle at a rate of speed greater than
30 km/h when a Traffic Control Device displays such indication, upon:
7.10.1
any Street identified in Schedule B, where Cycling, Inline Roller
Blading, Roller Skating, Longboarding, and Skateboarding is
prohibited on any Sidewalk, footpath or walkway; or
7.10.2
any Street located on the City's Cycle Network as identified in
Schedule E.
Speed Limits on Lanes
7.11 No person shall drive any Vehicle upon or along a Lane at a rate of speed
greater than 20 kilometers per hour.

SECTION 8 - IMPOUNDMENT AND DISPOSAL OF CHATTELS
8.1
A Bylaw Officer may seize, remove and impound any Chattel Parked,
stored or placed on a Public Place in contravention of this bylaw.
Chattels of a value under $100.00
8.2
Where a Chattel is impounded that has, in the opinion of the Bylaw
Officer, a value of less than $100.00, the Bylaw Officer may dispose of the
Chattel in a manner deemed fit by the Bylaw Officer.
Notice and Disposal of Chattels
8.3
Where a Chattel is impounded which has, in the opinion of the Bylaw
Officer, a value over $100.00 the Bylaw Officer shall make reasonable
attempts to notify the owner of the Chattel.
8.4
Where a Chattel is claimed by the owner, the Chattel shall be released to
the owner upon:
8.4.1
the provision of proof of ownership satisfactory to the City
Engineer; and
8.4.2
the payment of the costs of fees, costs, and expenses for
seizure, removal, impounding and storage of the Chattel, as
per the Engineering Fees and Rates Bylaw No. 7553, 2013.
8.5
After the expiration of 30 days from the date of seizure of a Chattel to
which Section 8.3 applies and where no person has claimed the Chattel,
or where the owner fails to comply with the provisions of section 8.4, the
City Engineer is authorized to sell the object by auction and the proceeds
of the sale shall be the property of the City.
8.6
Where, in the opinion of the City Engineer, it is impractical to dispose of a
Chattel by public auction, the City Engineer may dispose of the Chattel in
a manner deemed fit by the City Engineer.
8.7
Where a Chattel has been disposed of pursuant to Section 8.6 or where
the sale of the Chattel under Section 8.5 does not cover the fees, costs,
and expenses for seizure, removal, impounding, storage and sale of the
Chattel the City may recover those amounts from the owner of the Chattel
in a court of competent jurisdiction.
Depositing Materials on Streets or Boulevards
8.8
Where material has been deposited in a Public Place without a Street
Occupancy Permit or in contravention of the terms of conditions of a

Street Occupancy Permit, the City Engineer may order the person
responsible to remove the material.
Notice and Disposal of Chattels
8.9
Where the person responsible for removing material deposited in a Public
Place in contravention of this bylaw fails to comply within the time set out
in the order made pursuant to section 8.8, the City Engineer may remove
and dispose of the material at the expense of the person responsible and
the cost of the work is recoverable as a debt from the person to whom the
order was given.
Damage to a Public Place
8.10 No person shall:
8.10.1
significantly alter a Boulevard without the consent of the City
Engineer; or
8.10.2
damage a Public Place in any way.
8.11 Where a person contravenes section 8.10, the City Engineer may repair
the Boulevard or the Public Place at the expense of the person
responsible for the alteration or damage and the cost of the work is
recoverable as a debt.

SECTION 9 - COMMERCIAL VEHICLES
9.1
A Bylaw Officer may, without a warrant, search a Commercial Vehicle on a
Public Place to determine whether this Bylaw is being complied with in the
operation of the Commercial Vehicle, and for that purpose may require the
Driver of the Commercial Vehicle to Stop the Commercial Vehicle and
permit the search to be made.
9.2
The Driver or other person in charge of a Commercial Vehicle on a Public
Place who is required by a Bylaw Officer, by signals or otherwise, to Stop
the Commercial Vehicle or to Permit it to be searched for the purposes of
this Bylaw, and who refuses or fails to Stop the Commercial Vehicle or to
permit it to be searched, commits an offence against this Bylaw.

10.3 No person shall operate, or permit the operation of, a vehicle in a Public
Place
contravention of subsection 19.02(3) of Motor Vehicle Act Regulation, B.C.
Reg.
26/58 unless:

a permit in writing has been issued with respect to the Vehicle
by the
City Engineer pursuant to section 3.1 of this bylaw; and
10.3.2
all required provincial approvals have been obtained and are
available for inspection by a Bylaw Officer.
10.4 For the purposes of this bylaw, whenever in the sections of the Motor
Vehicle Act Regulation incorporated by reference into this Bylaw the term
"Minister" or "Minister of Transportation and Highways") appears, the term
"City Engineer" shall be substituted and where the term "Act" appears, the
term "bylaw" shall be substituted except in section 19.03, 19.06 and
wherever the context indicates otherwise.
10.5 No person shall operate or permit the operation of, a vehicle in a Public

Truck Routes
10.6 No person shall operate, or permit the operation of:

10.6.1
a Heavy Truck, having a licensed Gross Vehicle Weight of
over 11,800 kilograms; or
10.6.2
a Vehicle having an overall length inclusive of load in excess
of 12.5 meters, or combination of Vehicles having an overall
length inclusive of load in excess of 14.65 meters
on a Street not forming part of a Truck Route as described in Schedule C
of this bylaw.
10.7 Section 10.6 does not apply where the Vehicle is:
10.7.1
delivering or picking up goods, merchandise or other things to
or from a residence or Business premise in the City and is
traveling by the nearest and most direct Truck Route; or
10.7.2
Permit has been issued pursuant to section 3.1 of this bylaw.
10.8 The maximum height, length or width of a Vehicle or load allowable on a
Street or portion of a Street that is expressly limited as to maximum
height, length or width of a Vehicle or load by a sign erected by the
Minister of Transportation and Infrastructure or the City Engineer shall be
that set out on the sign.
10.9 No person being the Driver or operator of a Vehicle, shall in the event that
any article, substance or material, due to any cause whatsoever, becomes
loose or detached or blow, drop, spill or fall from the Vehicle onto any
Street, fail to take all reasonable precautions to safeguard Traffic from the
consequences thereof or fail to remove such material from such Street.
10.10 No person being the Driver or operator of any Vehicle carrying loads shall
fail to transport any loads unless such loads are stripped in conformity with
the stripping regulations contained in the General Accident Prevention
Regulations of WorkSafe BC.

SECTION 11 - SHARED MICROMOBILITY SERVICES
Power of the City Engineer to Regulate Shared Micromobility Services
11.1 The City Engineer may establish and designate signed and geo-fenced
areas for use by a Shared Micromobility Service.
11.2 The City Engineer may regulate and control the operation of Shared
Micromobility Services within a geo-fenced area, including the speed of
Shared Micromobility Devices and the regulation of parking of any Shared
Micromobility Devices.
11.3 A Shared Micromobility Service may deploy a fleet of Shared
Micromobility Devices in any location where parking is permitted and
where authorized by the City Engineer, in accordance with any
agreements, for the purpose of making E-Bikes and/or Electric Kick
Scooters available to reserve for use.
