- ## CORPORATION OF THE CITY OF NEW WESTMINSTEK ## BY-LAW NO: 4K71 · By-law relatino to the prescrvation o ublic health and the malnconanco of sanitar conditions in the City rana mesm. ## WHEREAS the Council may by by-law; - municipality. - (b) Make regulations to prohibit the creation of Insanitary conditions. - (c) Require any person to icmedy or romove any insanitary condition for which he is responsible, or which existo on property owned, occupied, or controlled by him. NOW THEREFORE THE COUNCIL of the City of New Westminster ENACTS ## AS FOLLOWS: 1. This by-law may be cited as 'PUBLIC HEALTH BY-LAW, 1967'. 2. DEFINITIONS - The following words, when used in chis By-law, have t che meanings hercinafter asslened to them. 3. "Animals" - Means and includes cows, calves, goats, sheep, horses ard mules. 4. 'Health Officer' - Means the Medical Icalth Officer appointed under the "lealth Act" for the Ciry of Now Westminster. 5. "Inspector" - Means any Public Healch Inspector appointed to adminicter and enforce chis By-law and any Act of the Province relating ço public health. "Pon)try" "Stro" - Means and includes live ducko, goose, turkeys, chickens, pigcons and pheasants. - Means an area consisting of one registered paicel of land. 3. The Inspectors shall assist the Health Officer in performing his duties and shall perform such other duties ao are from time to time assigned to them by the Local Board of Health, or Ciry Councll. 6. The Inspectors shall keep a vigilant supervision over all streets, lanes, lots and premises for deposits or accumulations of retuse, vegetable or animal matter and ony ocher matter or thing that may endanger the public hoalth and shall, immedlately upon discovery of such deposit oi accumulstion, notify the person or persons who own or occupy such lots or promisca or who have deposited such natter or thing to remove rhe matter of thing and cleanse the area in which it was found. 7. The Inspoctors shall at intervals, as directed by the Locul Board of Health of Health Officer, Inspect all premises occupied by persons residing wichin the City and shall report co the Board his or their findings at such regular intervals as designated by the Health Officer. ## 8. KEEPING OF ANIMALS - The keoping of swine lo hereby prohibited in the City of New Westminster. - No animal shall be kept in any shed, pen of other enclosure situated at a lesser distance than 150' from the neaxest dwelling placo or house, nor less than 25' from any road, street or lane, - No animal shall be allowed on less than 1 acre which shall be üxclusive of land occupied by dwellings, outbulldings and garden. - et land occupied by duellings, outbulldings and sardon. Any person owning or in possescion of any animal affected with an infectious or contagious disease shall immedlacely report the animal's condition to the Manith Officer and dispose of the carcass of the animal in che manner direcced by him. 12. When any animal shall dis within the limits of the City ot New lostminster, the owner or person in possession of et at che time of its death shall cause the carcass to be removed from the City to a designated disposal ground. 13. No animal suffering from any communicable diseaso shall be brought into or kept within the City, except with the written permission of the Icalth Officer. 14. owners or occupicks of real property, or cheir agents, chall allow any condilion to exist or continuu shercon that is conducive to fly brceding or rodent infestation, and shall not fail to report any fly brooding or rodent infestation condition on the rcal property or in the vicinity. - 1,5. (a) No owners or occupiers of real property, or their agents, shall allow infostacion by caterpillars and ocher noxious or dogtructive inscelo, and shell clent auch property of caterpillars and other noxlous or destructive insecty from the rcal property. - No owners or occupicis of real property, or thoir nguru chall allow infestarion by caterpillars and ocher noxious or destructive insects to remain upon his properly beyond a period of forty-cight (48) hours after she owner's knowiedge of infuutation or after forcy-cight (48) hours from che time the Inspeccor shall have given nocice to him of such infestatlon, whichever is the carlicr. - In dufault of such destruction and clearing, the City, by its workmen and others, may enter and effect such destruccion and clearing at the expense of the person so defaulting and the charges levied by the City for so doing, alcer norico to the owner, and demand for payment unpaid on the 31sc day of December, shall be added co and form part of che taxes payable In respoct of that land da taxes in aricar. ## 16. INSBECTION The Wealth Officer and Inspector and anyone under theit authority art hereby authorized and empowered to entor al all reasonable címen upon any property in ordu to ascertain that che provinions conceined in chis By-law are being carricd out. 17. Wherever in any of the provisions of this By-Law, purmission is granted to do any act of chine according to ocrtuin regulations, or in a certain manner or mode prescribed hercin, any person failing, neglecting or refusing to comply with such rugulations, condicions or inquirumunes, or failing, noglecting. or refusing co do or perform any act or thing in accordance with the permission thereby granted, shall be docmed to be guilty of an infraction of the provisions of this By-law and shall be liable ro the penalty hercby imposed. 18. Every person who violates any of the provisions of thru By-law, or who sufters or permits any act or thing to be done in contravention or in violacion of any of the provistons of chia By-law, or who neglects to do or rofrains from doing anything tequired to be done by any of the provisions of this By-law, or who does any act ot thing which violates any of the provisions of Chin Byaliw, shall be deened to have commicted an offence against this By-liw and shall bo liable to the penalties hereby imposed. ## 19. PENALTY UPON CONVICEION Every percon who commits an offence against this By-law shall upon conviction be liable co i fine not exceeding the sum of One Hundred Dollars ($100.00) and costs (including che coots of the comiccol and conveyanco to tho place of imprisonment) tor cachi oftence, and in defauli of paynent therefor, to imprisonment to a Gorm nul exccuding thirty days. 20. By-law No. 132, buing "Saricary By-law, 1912" and By-Law No. 394, being "Caterpillar By-law, 1921", and all amending By-laws thereen, are hereby copraled.
