CORPORATION OF THE CITY OF NEW WESTMINSTER
BYLAW NO. 7277, 2008
A Bylaw to regulate light intrusion onto residential properties.
WHEREAS sections 8(3)(h) and s. 64(b) of the Community Charter authorizes a local
government to regulate illumination that is liable to disturb the peace, rest, enjoyment,
comfort, or convenience of individuals or the public.
NOW THEREFORE the Council of the Corporation of the City of New Westminster
ENACTS AS FOLLOWS:
1.
This Bylaw may be cited for all purposes as "Light Intrusion Bylaw No. 7277, 2008".
2.
No owner or occupier of real property shall allow or permit an outdoor light to shine
directly into the living or sleeping areas of an adjacent residential property in such a
way as to disturb the quiet, peace, rest, enjoyment, comfort or convenience of an
occupant of the premises.
3.
The provisions of this Bylaw do not apply to:
a. Street lights, traffic lights and other lights on City property;
b. Lighting required by law enforcement or emergency services personnel; and
c. Lighting used to illuminate schools, public parks or playing fields.
4.
City Bylaw Officers are authorized to enforce this Bylaw and, for that purpose, may
enter at all reasonable times upon any real property in order to ascertain whether the
provisions of this Bylaw are being observed.
5.
Every person who violates any of the provisions of the Bylaw shall be guilty of an
offence punishable on summary conviction and shall be liable to a fine not exceeding
$2,000.00.
