CORPORATION OF THE CITY OF NEW WESTMINSTER BYLAW NO, 7892, 2017 A Bylaw respecting Freedom of Information and Protection of Privacy WHEREAS, the Freedom of Information and Protection of Privacy Act S.B.C. c. 61 is applicable to local government; AND WHEREAS Section 77 of the said Act authorizes a local public body by bylaw to appoint a head for purposes of information requests and privacy management; NOW THEREFORE THE CITY COUNCIL of the Corporation of the City of New Westminster in open meeting assembled ENACT AS FOLLOWS: 1. This Bylaw may be cited for all purposes as Freedom of Information and Protection of Privacy Bylaw No. 7892, 2017. 2. The Chief Administrative Officer is designated as the Head for the purposes of the Freedom of Information and Protection of Privacy Act, and in collaboration with the Director of Finance and Information Technology and the City Clerk shall form the FOI and Privacy Committee. 3. The Head is authorized to delegate to any person any duty, power or function of the Head except that the delegation: (a) must be in writing and (b) may be subject to such conditions or restrictions as the Head considers appropriate; and (c ) must comply with Section 66 of the Act. 4. The applicable FOI and Privacy fees and charges are to be incorporated into the City wide Fees and Charges Bylaw No. 6186, 1994. 5. Council repeals bylaws a. 6226, 1994 b. 7605, 2013 c. 7628, 2013 6. A decision by a court that any part of this bylaw is illegal, void or unenforceable severs that part from this bylaw, and is not to affect the balance of this bylaw. 7. This bylaw is to come into force and take effect on the date of adoption. Adopted February 6, 2017
