THE CORPORATION OF THE DISTRICT OF OAK BAY BYLAW NO. 3416 (**amended by Bylaws No. 3587, 3649, 3679, 3709, 3747, 3808, 3991, 4120, 4150, 4184 4224, 4316, 4362, 4466, 4540, 4560, 4641, 4664, 4694, 4711, 4729, 4754, 4794, 4813, 4835, and 4866) A Bylaw to levy a frontage tax to defray a portion of the annual cost of maintaining certain boulevards CONSOLIDATED FOR CONVENIENCE ONLY TO MAY 13, 2024. The Municipal Council of The Corporation of the District of Oak Bay, in open meeting assembled, enacts as follows: 1 In this Bylaw, "BOULEVARD" means that portion of a street other than a roadway or sidewalk. 2 The Boulevard Roll established under Bylaw No. 3032, being the "Boulevard Rate Bylaw, 1974", is hereby continued. 3 For each street or portion thereof named in Schedule "A" hereto, the annual charge set out therein for cutting grass and weeds, trimming trees and shrubbery, and watering of the boulevard shall be levied against the parcels of land abutting the boulevard. 4 For each street or portion thereof named in Schedule "A" hereto, the portion of the annual charge payable by each parcel of land abutting the boulevard shall be determined by multiplying the taxable frontage of the parcel, as recorded on the Boulevard Roll, by the rate shown in the appropriate column opposite the name of that street in Schedule "A". 5 (a) In respect of a corner parcel of land where the lot line abutting the boulevard maintained under this Bylaw is a side line rather than a front line, the taxable frontage recorded on the Boulevard Roll shall be one-half of the actual distance which the parcel abuts the boulevard. (b) For the purpose of this section, "SIDE LINE" means the longer of the street boundary lines of the corner parcel of land. 6 Except as provided in section 5 hereof, any difference between taxable frontage and actual frontage shall be determined in accordance with s.481(4) of the Municipal Act, R.S.B.C. 1979, c.290. 7 There is hereby established a Local Court of Revision consisting of not less than three (3) and not more than five (5) persons, who shall be appointed by the Municipal Council at the inaugural meeting on the first Monday after December 1 in each year. 8 Every revision of the Boulevard Roll shall be considered and dealt with by the Local Court of Revision. 9 The procedure of the Local Court of Revision shall be governed by ss.484, 485 and 486 of the Municipal Act, R.S.B.C. 1979, c.290. 10 The following Bylaws are hereby repealed: Bylaw No. 3416 2 (a) Bylaw No. 3032, Boulevard Rate Bylaw, 1974 (b) Bylaw No. 3202, Boulevard Rate Bylaw Amendment Bylaw, 1977 (c) Bylaw No. 3288, Boulevard Rate Bylaw Amendment Bylaw, 1979 (d) Bylaw No. 3320, Boulevard Rate Bylaw Amendment Bylaw, 1989, and (e) Bylaw No. 3360, Boulevard Rate Bylaw Amendment Bylaw, 1981. 11 This Bylaw may be cited as the "BOULEVARD FRONTAGE TAX BYLAW, 1982".
