BYLAW AMENDMENT 1180.12, 2024 BYLAW AMENDMENT 1180.08, 2010 TOWN OF OSOYOOS BYLAW NO. 1180, 2002 A Bylaw for the purpose of establishing fees and charges for recreation services. WHEREAS the Town of Osoyoos, pursuant to Section 363 of the Local Government Act, is empowered to establish fees and charges in respect of all or part of a service of the municipality; AND WHEREAS the Town of Osoyoos deems it desirable to set new fees for recreation services; NOW THEREFORE the Council of the Town of Osoyoos in open meeting assembled enacts as follows: 1. This Bylaw may be cited for all purposes as the "Recreation Services Fees and Charges Bylaw No. 1180, 2002". 2. That Schedule "A" of the Recreation Services Fees and Charges Bylaw attached hereto and forming part of this bylaw. DEFINITIONS "Adult" means any person age of nineteen (19) years or greater. "Arena Parking Lot" means partial or entire parking lot at arena utilized for events not associated with the arena. "Cleaning Fee" means staffing wages per hour. "Commercial" means a business or group that operates not as a non-profit organization and has paid employees, instructors, coaches, or other paid personnel. "Commercial Event" means an event where tickets are taken, admission is charged and alcohol is sold. "Court Rentals" means any activity court rented by a user. "Desert Park Parking Lot" means partial or entire parking lot at Desert Park Recreation building for events not associated with the building. "Equipment Damage Deposit" means a fee is collected when equipment is loaned out. Fees will range from $200 per item to $500 per item at the discretion of the Town. "Facility Allocation" means regular user groups for the Sun Bowl Arena, will have free access to the mezzanine if the mezzanine is booked. "Family" means two adults and their children who are under the age of 19 and live full- time with their parents. "Film Permit" means a permit authorized by the Town for utilizing an area or facility for filming. "Non-Commercial Event" means no tickets are taken, no admission is charged and no alcohol is sold. "Non-Profit Group" means organizations that hold non-profit status as designated by the province of British Columbia and/or the Federal Government. "Rental Cancellations" means a refund will be provided based on the following timeline: - 31-90 days - 90% - 15-30 days - 75% - 8-14 days - 50% - 6-7 days - 25% - 0-5 days - 0% "Senior" means any person of sixty (60) years or greater. "Set up Fee" means staffing wages per hour. "Staff Overtime Fee" means any hours worked beyond regular hours will be charged at double the staff wage. "Statutory Holiday rental fee" means facility rentals will be charged at two times the normal rate as per the fees and charges bylaw for rentals that fall on statutory holidays. "Student" means any person registered in a post-secondary institution. "Youth" means any person up to and including eighteen (18) years of age.
