Page 1 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw TOWN OF OSOYOOS BYLAW NO. 1357 A Bylaw to establish rates and regulations for the Osoyoos Water District WHEREAS Council deems it necessary and desirable to regulate the Osoyoos Water District distribution system, for the provision of services, good government and stewardship of public assets for the community; AND WHEREAS Council may by bylaw pursuant to the Community Charter impose a fee with different rates with respect of providing water services to the Osoyoos Water District; NOW THEREFORE the Council of the Town of Osoyoos in open Meeting assembled ENACTS AS FOLLOWS: 1 CITATION This bylaw may be cited for all purposes as the "Osoyoos Water District Rates and Regulations Bylaw 1357, 2019." 2 INTERPRETATION In this bylaw, unless the context otherwise requires: "Campground" means a facility approved pursuant to the "Camp-sites Regulations" of the Health Act, for the temporary accommodation of travellers. "Commercial unit" means an establishment including a cafe, coffee shop, restaurant, drive-in restaurant, pub, office, showroom, rest home, nursing home, hotels, motels, lodges, resorts, hospitals or other institutional business, or that portion of a multi-use building that is used for commercial purposes; "Commercial use" means the use of water for commercial requirements, sanitation and the irrigation of no more than quarter of an acre of garden or lawn with one service; "Commercial Greenhouse" means a structure for growing tender plants, being over 250 square feet in area; "Director of Operational Services" means the person appointed as such by the Town of Osoyoos; Page 2 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw "Domestic use" means the use of water for household requirements, sanitation and the irrigation of garden or lawn with no more than one service; "Dwelling unit" means one or more habitable rooms, constituting a self-contained unit with one or more separate entrances, containing eating, living, sleeping and sanitary facilities and used or capable of being used as a residence for one family; "Heavy commercial unit" means a packing house; "Heavy commercial use" means the use of water for commercial requirements, sanitation and the irrigation of no more than 15 acres of property; "Irrigation" means the distribution of water from the Osoyoos Water District to the surface or sub-surface of lawns, gardens, crops, orchards, or other areas situated outside buildings by pipes, hoses, sprinklers or any other method. "Metered" means a property connected to the Water District system, with a meter installed and billed using metered rates as set out in Schedule A; "Parcel irrigation charge" means the charge imposed upon those properties connected to the Osoyoos Water District system; "Osoyoos Water District" means the water utility system established pursuant to Town of Osoyoos Water Distribution System Establishment Bylaw No. 862, 1992; "Person" means any individual, firm, company, association society, corporation, group or municipality; "Personal Use Greenhouse" means a structure for growing tender plants of less that 250 square feet in area; "Readily accessible" means that access is available without the necessity of removing or moving away any panel, door or other similar obstruction; "Town" means the Town of Osoyoos; and "User" means the registered owner or tenant in occupation of real property. Page 3 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw 3 WATER RATES (1) A charge shall be and is hereby imposed upon the owners of real property situate both inside and outside the corporate limits of the Town of Osoyoos for the use of the Osoyoos Water District water system. (2) The flat rates to be paid by the users for the use of water supplied to their premises from the Osoyoos Water District water system shall be those stated in Schedule "A" which is attached to and forming part of this bylaw. (3) All flat rates are based on a calendar year of January to December, and shall be payable annually by June 15 of each year. (4) Any current flat rates remaining unpaid after the June 15 of each year shall be subject to a penalty of 10%. (5) Any unpaid flat rates remaining on December 31 of each year will be subject to a further penalty of 10% and shall be deemed to be in arrears in respect of property and shall be transferred to the real property roll maintained by the Collector for the Surveyor of Taxes as utilities in arrears effective March 1. (6) Any metered water charges as set forth in Schedule A shall be invoiced for water use for each calendar quarter. Any metered water charges remaining unpaid 30 days after date of invoice shall have a penalty of 10% of the unpaid balance added thereon. (7) Any unpaid metered water charges billed to December 31 and remaining on January 30 shall be deemed to be in arrears in respect of property and shall be transferred to the real property roll maintained by the Collector for the Surveyor of Taxes as utilities in arrears effective March 1. (8) The adjusted flat and metered rates shall form a charge or lien upon the land or real property upon or in respect of which the same is imposed. The amount of the adjusted flat rates shall be collected in the same manner and with like remedies as ordinary taxes upon land and improvements collected under the Community Charter. (9) Non-receipt of a utility billing will not exempt the user from paying for the service they receive. (10) Any user paying for the use of Osoyoos Water District shall be liable for same until they have given notice as outlined in Section 5 (1) of this bylaw, to the Town Page 4 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw of their desire to discontinue use thereof. Any service supplied for a portion of a month shall be charged as if it were a full month. (11) No person shall knowingly withhold information about the use of their premises that could affect utility rates or charges. It is the responsibility of the owner to notify the Town in writing when any changes or modifications are made to his premises that may affect their utility rates. Failure to provide the said notification will constitute a violation of this bylaw. In addition, it shall be reasonable and lawful for the Town to bill and collect from the owner the appropriate charges from the time the changes or modifications to his premises were found to have first existed. 4 WATER SERVICE CONNECTIONS (1) Application for water service shall be made to the Town in writing by the applicant on the form specified as Schedule "C" which is attached to and forming part of this bylaw. (2) Upon receipt of such application, and provided that the Osoyoos Water District water mains are laid to within 20 m of the applicant's property, the Town will tap the main and lay a service pipe to the nearest boundary of the applicant's property and for such connection the Town shall be entitled to demand and receive from the applicant, in advance, for 20 mm diameter domestic service, such fee as outlined in Schedule "B" attached to and forming part of this bylaw. (3) Where application for water service has been made in accordance with this bylaw and it is found that no Osoyoos Water District system mains are within 20 m, or extension of the Osoyoos Water District systems water mains is required to enable service, the applicant shall have the option to: (a) pay in advance for such extra water service which is required, the sum according to the Town's estimated cost; or (b) accept a full return of the monies paid at time of service application. (4) The Town shall in every case determine the location and size of service pipe to be used, having first given due consideration to any specific requests. (5) Where a specific size of water service has been requested, and where the Town cannot readily supply such service, the applicant shall have the option to: (a) accept the size of water service as determined by the Town; (b) pay in advance the appropriate cost of upgrading the Osoyoos Water Page 5 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw District system mains to meet the requested specifications, according to the Town's estimated cost; (c) accept a full return of monies paid at time of service application. (6) Charges for a water service connection shall be made according to the Town's estimated cost, when: (a) the size of domestic service is larger than 20 mm in diameter; (b) regardless of size, the service is to be used for commercial purposes; (c) regardless of size, the service is to be used for agricultural purposes. (7) All new water service connections to have a "water meter" installed to the Town's specifications and to be billed as per Schedule A "metered rates." (a) meters to be supplied with remote outside wall mounted Neptune touch pad reading device. Connect touch pad to meter complete with 4 strand 22 gauge wiring; (b) Meters to have "cubic meters" as unit of measure; (c) Meters shall be assessable (ie not boarded or covered over); (d) Meters shall be mounted horizontally only; (e) All meters to be supplied with Neptune R900V3 wall unit for future conversion to radio read. (8) No person except the duly authorized agents of the Town shall tap or make any connection with the Osoyoos Water District mains, unless written authorization is given in advance by the Director of Operational Services. (9) No person shall connect to, permit a connection to continue to exist, or allow a connection to be made to the service line extending from the Osoyoos Water District's main. (10) All users must keep all pipes, stopcocks and other fixtures on their premises in good repair and order and protected from frost at their own expense. (11) Where it is found that damage has been caused by misuse or abuse by any person to any part of the Osoyoos Water District system, or that service stops are not readily accessible, the user must repair such damage. Failure to make the necessary repairs within the time specified by the Director of Operational Services will constitute a breach of this bylaw and the user shall be subject to all penalties contained herein. (12) When any service line is abandoned, it shall be sealed off by an authorized agent Page 6 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw of the Town and for such service, the Town shall be entitled to demand and receive the fee as outlined in Schedule "B" of this bylaw. (13) All users shall install and maintain a readily accessible flow control device or devices on all water services. No person shall use in excess of 8.25 U.S. gal. per minute per acre. 5 WATER TURN-ON OR TURN-OFF (1) Requests for water from the Osoyoos Water District system for temporary construction, permanent turn-off, or temporary turn-on or turn-off shall be made as follows: (a) Application for water turn-on or turn-off shall be made to the Town in writing on the form specified as Schedule "D" which is attached to and forming part of this bylaw (b) The procedure set out in (a) above may be temporarily waived in emergencies or cases where it is impractical, or would create undue delay or hardship, provided that an application as outlined in (a) above is carried out as soon as possible and in no case later than five (5) days. (2) No person except the duly authorized agents of the Town shall turn on or off any service pipe stopcock. (3) Any unauthorized person who turns on or off a water service pipe stopcock shall be in violation of this bylaw and subject to the penalties in Section 7. (4) If a service line is found to be turned on and no record of the turn-on exists in the Town's files, it will be deemed appropriate to charge any rates, rents or tolls retroactive to the time when the Town determines that the property was occupied. 6. GENERAL (1) The irrigation season shall be from April 15 to October 15. If the 15th falls on a Friday, Saturday or Sunday, the turn on and/or Turn Off will be on the following Monday. Irrigation cannot take place prior to or after these dates unless application is made in writing on the form specified as Schedule "D" which is attached to and forming part of this bylaw and a fee is paid pursuant to Schedule "B." (2) For purposes of domestic use, Schedule "F" attached will regulate water use at Page 7 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw residential, commercial and other non-agricultural properties. (3) Notwithstanding subsection (1), the Town is authorized to suspend, regulate or stop the supply of water by Council resolution to any or all users for any use, whenever public interest may require it. (4) No person shall waste, lend, sell, give or otherwise dispose of water supplied by the Osoyoos Water District or permit the water to be taken or carried away for the use or benefit of others, except if it is required to extinguish or prevent the spread of fire. (5) The Town retains the right to adjust the water supply pressure or to interrupt supply due to emergent conditions or for the purpose of upgrading or carrying out general maintenance. Where it is practical and time permits, notice shall be given to all users affected where alterations of pressure or interruption of service are to take place. (6) Users depending on a continuous or uninterrupted supply of water or having processes or equipment that require particularly clear or pure water shall provide such emergency storage, oversize piping, pumps and tanks, filters, pressure regulators, check valves and additional service pipes, or other means for continuous and adequate supply of water suitable to their requirements at their own expense. (7) The Director of Operational Services or designate shall have free access to all parts of every building and/or property in which water is delivered and consumed after reasonable notice has been given and request made. He may make personal inspection of all pipes, taps, flow control devices and fixtures used for distributing water, and if found defective, or if any wastage of water is found to exist, notice will be given to have the defect remedied. (8) If any defect or defects of which notice is given shall not be remedied within the time limit specified by the Director of Operational Services, he shall have the authority to cut off the supply of water from the main until such time that the said defect or defects are repaired. No person shall have any claim against the Town by reason of the cutting off of the water. (9) No unauthorized person shall in any way interfere or tamper with any fire hydrant or part thereof. (10) Any water connection, pipe, apparatus, fitting or fixture which is not in accordance with the requirements of this bylaw or would cause noises, pressure Page 8 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw surges, disturbances which may result in annoyance to other users, damage to the rural water system or may in any way contribute to a potential contamination of the Osoyoos Water District system shall not be connected or allowed to remain connected to the Osoyoos Water District system. (11) The Town of Osoyoos does not guarantee pressure nor continuous supply of irrigation water, nor does it accept responsibility at any time for the maintenance of pressure on its lines, nor for increases or decreases in pressure. (12) Neither the Town, its officers, or agent shall incur any liability of any kind whatever by reason of the cessation in whole or part of irrigation water pressure or irrigation water supply, or changes in operating pressures, or by reason of the irrigation water containing sediments, deposits or other foreign matter. (13) All irrigation systems installed on private land must comply with the Town of Osoyoos Cross Connection Bylaw. (14) Every person to whose land irrigation water is delivered by the Town shall establish his/her irrigation system, permanent set or otherwise, in such a manner as to confine the water within the boundaries of the property. 7. PENALTIES AND ENFORCEMENT (1) Every person who violates any of the provisions of this bylaw or who suffers or permits any act or thing to be done in contravention or in violation of any of the provisions of this bylaw, who neglects to do or refrains from doing anything required to be done by any of the provisions of this bylaw or who does any act which violates any of the provisions of this bylaw, is guilty of an offence against this bylaw and liable to the penalties hereby imposed. Each day that a violation continues to exist shall constitute a separate offence. (2) Every person who commits an offence against this bylaw is liable to a fine and penalty of not more than Two Thousand Dollars ($2,000.00) and not less than Fifty Dollars ($50.00) for each offence, and in default of payment thereof, forthwith or within such time as the presiding Provincial Court Judge or Justice of the Peace shall direct, the fine imposed shall be recoverable under the provisions of the Offence Act, R.S.B.C. 1996 Chapter 338 and all amendments thereto. (3) If a person fails to discharge a matter or thing required or regulated by this bylaw, the matter or thing shall be done by the Town at the expense of the person in default. Page 9 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw (4) If action in default is taken under subsection (3), the council may recover the expense from the person, together with costs and interest at the rate prescribed under the Community Charter, in the same manner as municipal taxes. 8. SEVERABILITY (1) If any section, subsection, or paragraph of this Bylaw is found invalid by a decision of a Court of competent jurisdiction the invalid section, subsection, or paragraph shall be severed without effect on the remainder of the Bylaw. 9. REPEAL (1) Osoyoos Water District Rates and Regulations Bylaw No. 1241, 2008 and all amendments thereto, are hereby repealed. 10. EFFECTIVE DATE (1) This bylaw comes into effect on January 1, 2020. C. NEW CONNECTIONS Water charges commence on a newly constructed or installed building immediately upon the expiration of six months (one month in the case of a renovated building) from the date of validation of the building permit, provided however, that this amount will be prorated from the effective date to December 31 of the year in which the building is built or renovated. An extension to the 6 month period will be considered providing the builder applies in writing to the Building Official prior to the expiration of the 6 month period. Should a request come from a builder after the expiration of the six month period, an extension may still be granted upon payment of an administration fee of $17.85 for the first unit and $7.40 for each additional unit in the same complex. Extensions will be in multiples of one month periods, and are at the discretion of the Building Official based on projected construction completion date. Each block is a volume of water equal to ten percent of the allotment. For each ten percent block of water use in excess of the allotment (8.25 US gpm per min/acre) the rate per 1,000 US gallons of water increases. The rates are cumulative and only apply to water use within the range of the block/volume of water to which they are attributed. NORMAL - ALTERNATE DAYS WATERING: a) Days of Watering: Sprinkling is only permitted at residential, commercial and other non-agricultural properties as follows: Even numbered addresses: Watering is only permitted on Saturday, Tuesday and Thursday Odd numbered addresses: Watering is only permitted on Sunday, Wednesday and Friday b) Automatically Controlled Underground Sprinkling Systems (Residential and Commercial): Properties equipped with an automated time clock sprinkler system may only sprinkle between the hours of 12:00 midnight to 6:00 AM on the days permitted by the sprinkling regulations as described above. c) Manually Controlled Sprinklers (Residential and Commercial): Properties equipped with only manually controlled sprinkling systems, including those attached to outside taps, may only operate from 6:00 AM to 10:00 AM and from 7:00 PM to 12:00 midnight on the days permitted by the sprinkling regulations as described above. d) Sprinkling is not permitted between the hours of 10:00 AM and 7:00 PM during any day at any time of the year. Only one ½" (9mm) diameter outlet (outside tap) may be used at one time for sprinkling, and further, it is not permissible to use an open pipe or hose for irrigating purposes. e) Use of water hoses is permitted for the purpose of washing boats or motor vehicles only when equipped with an automatic shut off nozzle. f) No person shall use water to wash sidewalks, driveways or parking lots, except and only if necessary for applying a product such as paint or preservative, or when preparing a surface prior to paving or repointing bricks, or if required by law to comply with health or safety regulations g) Notwithstanding the above, the following are exempt from restrictions: Page 17 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw i) Watering of public sports playing fields, turf farms, and golf courses; ii) Watering of flower and vegetable gardens, decorative planters, shrubs and trees using micro-irrigation, drip-irrigation, or a hose with an automatic shut off nozzle; iii) Commercial car washes so long as each vehicle wash does not exceed 57 L of water. iv) Under authority of permit issued under this bylaw. h) As a further exemption restriction, owners or occupiers of property who, by reason of physical or mental incapacity are unable to water their property within the restricted days and times, may water their property on any two days of the week for a maximum of 8 hours per day. 2. Stage 1 - TWICE A WEEK WATERING: If the CAO gives notice that a reduction in water use is necessary requiring Stage 1 restrictions, the following shall apply: a) Days of Watering: Sprinkling is only permitted at residential, commercial and other non-agricultural properties as follows: Even Numbered Addresses: Watering is only permitted on Saturdays and Tuesdays Odd Numbered Addresses: Watering is only permitted on Sundays and Wednesdays b) Automatically Controlled Underground Sprinkling Systems (Residential and Commercial): Properties equipped with an automated time clock sprinkler system may only sprinkle between the hours of 12:00 midnight to 6:00 AM on the days permitted by the sprinkling regulations as described above. c) Manually Controlled Sprinklers (Residential and Commercial): Properties equipped with only manually controlled sprinkling systems, including those attached to outside taps, may only operate from 6:00 AM to 10:00 AM and from 7:00 PM to 12:00 midnight on the days permitted by the sprinkling regulations as described above. d) No use of water hoses is permitted for the purpose of washing boats or motor vehicles. e) No person shall use water to wash sidewalks, driveways or parking lots, or exterior building surfaces except and only if necessary for applying a product such as paint, preservative and stucco, preparing a surface prior to paving or repointing bricks, or if required by law to comply with health or safety regulations f) Notwithstanding the above, the following are exempt from Stage 1 restrictions: Page 18 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw i) Watering of public sports playing fields, turf farms if failure to do so will result in permanent loss of plant material; ii) Watering of flower and vegetable gardens, decorative planters, shrubs and trees using micro-irrigation, drip-irrigation, or a hose with an automatic shut off nozzle; iii) Commercial car washes so long as each vehicle wash does not exceed 57 L of water. iv) Under authority of permit issued under this bylaw. g) As a further exemption to the Stage 1 restriction, owners or occupiers of property who, by reason of physical or mental incapacity are unable to water their property within the restricted days and times, may water their property on any two days of the week for a maximum of 8 hours per day. 3. Stage 2 - ONCE A WEEK WATERING: If the CAO gives notice that a reduction in water use is necessary requiring Stage 2 restrictions, the following shall apply: a) Sprinkling is only permitted as residential, commercial and other non-agricultural properties as follows: Even numbered addresses: Watering is only permitted of Saturdays Odd numbered addresses: Watering is only permitted on Sundays b) Automatically Controlled Underground Sprinkling Systems (Residential and Commercial): Properties equipped with an automated time clock sprinkler system may only sprinkle between the hours of 12:00 midnight to 6:00 AM on the days permitted by the sprinkling regulations as described above. c) Manually Controlled Sprinklers (Residential and Commercial): Properties equipped with only manually controlled sprinkling systems, including those attached to outside taps, may only operate from 6:00 AM to 10:00 AM and from 7:00 PM to 12:00 midnight on the days permitted by the sprinkling regulations as described above. d) No Person Shall: i) Fill a swimming pool, hot tub, garden pond or decorative fountain at any time; or ii) Wash a vehicle or a boat with water; e) Notwithstanding the above, the following are exempt from Stage 2 restrictions: Page 19 of 20 Bylaw No. 1357, 2019 Water District Rates and Regulations Bylaw i) Watering of public sports playing fields, turf farms if failure to do so will result in permanent loss of plant material; ii) Commercial car washes so long as each vehicle wash does not exceed 57 L of water. iii) Watering of flower and vegetable gardens, decorative planters, shrubs and trees using micro-irrigation, drip-irrigation or a hose with an automatic shut off nozzle iv) Under authority of permit issued under this bylaw. 4. Stage 3 - NO LAWN WATERING: If the CAO gives notice that a reduction in water use is necessary requiring Stage 3 restrictions, the following shall apply: a) No person shall: i) sprinkle or irrigate any lawn or boulevard; i) fill a swimming pool, hot tub, garden pond or decorative fountain at any time; or ii) wash a vehicle or a boat with water; b) Notwithstanding the above, the following are exempt from Stage 3 restrictions: i) Commercial car washes so long as each vehicle wash does not exceed 57 L of water. ii) Watering of flower and vegetable gardens, decorative planters, shrubs and trees using micro-irrigation, drip irrigation, or a hose with an automatic shut off nozzle between the hours of 6:00 AM to 10:00 AM and 7:00 PM to 10:00 PM. 5. Stage 4 Emergency - NO OUTDOOR WATERING If the If the CAO gives notice that a reduction in water use is necessary requiring Stage 4 Emergency restrictions, the following shall apply: a) No person shall use water outdoors for any purpose. * Notwithstanding any restrictions in Stages Normal, and 1 - 4, all areas being irrigated with spray effluent are exempted from restrictions in this bylaw. A person who has installed a new lawn, either newly seeded or new sod, may apply to the Town for a permit, in the form set out in this Bylaw, which will allow the new lawn to be sprinkled outside of watering days, but within restricted hours. 2. A permit issued under Section 1 of this Schedule shall be conspicuously displayed at the premises for which it was issued. 3. New sod may be sprinkled for 21 days after installation, and newly seeded lawn may be sprinkled until growth is established or for 49 days after installation, whichever is less, provided a permit pursuant to Section 1 has been issued for the premises at which the new lawn has been installed. 4. After expiration of a permit issued under Section 1, a person may apply for and may obtain subsequent permits under Section 1. 5. Permits will not be issued or be valid during Stage 3, 4 restrictions.
