THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW Bylaw No. 1087, 1986 and amendments thereto CONSOLIDATED FOR CONVENIENCE ONLY This is a consolidation of the bylaws listed below. The amending bylaws have been consolidated with the original bylaws for convenience only. Certified copies of the original bylaws should be consulted for all interpretations and applications of the bylaws on this subject. BYLAW NO. THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 2 | P a g e A Bylaw to Regulate Kennels or Other Places for the Keeping, Training, Care, Breeding, or Boarding of Dogs. The Council of The Corporation of the District of Pitt Meadows, in open meeting assembled, ENACTS AS FOLLOWS: Citation 1. This By-law may be cited as "Pitt Meadows Kennel Regulation Bylaw, 1986 No. 1087". Interpretation 2. In this Bylaw, unless the context otherwise requires: "Kennel" means the use of lands, buildings or structures to keep, board or breed dogs; (Bylaw No. 2545, 2012) "Zoning Bylaw" means the Zoning Bylaw No. 2505, 2011 and amendments thereto. (Bylaw No. 2545, 2012) Kennel Licence - When Required 3. No person shall own, harbour or possess four (4) dogs or more unless a Kennel Licence under this Bylaw has first been obtained. Classes of Kennel Licence 4. For the purposes of this Bylaw, there shall be the following classes of Kennel Licenses: (a) Class "A" Kennel - Commercial Kennel; (b) Class "B" Kennel - Breeding Kennel; (c) Class "C" Kennel - Hobby Kennel. Class "A" Kennels: (a) Shall be permitted only in the General Agricultural (A-1) Large Lot Agricultural (A-2), and Agricultural and Farm Industrial (A-3) Zones; (Bylaw No. 2545, 2012) (b) where located within the Agricultural Land Reserve, shall require approval by the Agricultural Land Commission for a non-farm use within the Agricultural Land Reserve; (c) shall be permitted only on parcels not less than 2 hectares in area; (d) shall be limited to the keeping, training, breeding and boarding of the number of dogs over the age of four months specified in the license; (e) shall not exceed a density of fifty (50) dogs per site; (f) shall be constructed in accordance with Schedule "A", attached hereto and made a part of this Bylaw; (g) shall require that all dogs kept as personal pets separate from the Kennel Operation and kept on the premise not exceed three at any time and that all have valid licenses in accordance with the provisions of the "Animal Control Bylaw", as amended from time to time. (Bylaw No. 1800, 1996) Class "B" Kennels 6. Class "B" Kennels: (a) shall be permitted only in the following zones as defined in the Zoning Bylaw: (i) General Agricultural (A-1) Large Lot Agricultural (A-2), and Agricultural and Farm Industrial (A-3) Zones; (Bylaw No. 2545, 2012) (b) where located within the Agricultural Land Reserve, shall require approval by the Agricultural Land Commission for a non-farm use within the Agricultural Land Reserve; THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 4 | P a g e (c) shall be permitted only on parcels of not less than 1 hectare in area; (d) shall be limited to the keeping, training and breeding of not more than ten (10) dogs over the age of four months and shall specifically exclude the commercial boarding of any dogs; (e) shall be limited to a specific breed or breeds of dog as specified in the permit; (f) shall require that all dogs kept on the premises not exceed ten (10) at any time and that all have valid licenses in accordance with the provisions of the "Animal Control Bylaw", as amended from time to time. (Bylaw No. 1800, 1996) Class "C" Kennels 7. Class "C" Kennels: (a) shall be permitted in the following zones as defined in the Zoning Bylaw: (i) General Agricultural (A-1) Large Lot Agricultural (A-2), and Agricultural and Farm Industrial (A-3) Zones; (Bylaw No. 2545, 2012) (b) where located within the Agricultural Land Reserve and subject to its regulations, shall require approval by the Agricultural Land Commission for a non-farm use, within the Agricultural Land Reserve; (c) shall be permitted only on parcels of not less than 0.4 hectares in area; (d) shall be limited to the keeping, training and breeding of not more than five (5) dogs over the age of four months and shall specifically exclude the commercial boarding of any dogs; (e) shall require that all dogs kept on the premises not exceed (5) at any time and that all have valid licenses in accordance with the provisions of the "Animal Control Bylaw", as amended from time to time. (Bylaw No. 1800, 1996) THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 5 | P a g e Licence and Permit Fees 8. The possessor of a Kennel License shall pay an annual licence or permit fee as provided under Schedule "B", attached to and forming part of this Bylaw. Authority to Enter Property 9. The Poundkeeper and Building Inspector of the District of Pitt Meadows and any Peace Officer are hereby authorized and empowered to enter at all reasonable times upon any property to ascertain and ensure that the provisions of this Bylaw are being complied with. Reasonable effort shall be made by the Poundkeeper, Building Inspector or Peace Officer to contact the owner/operator of the Kennel prior to entering on the property. Penalty 10. Every person who violates any provisions of this Bylaw, or who suffers or permits any act or thing to be done in contravention or in violation of any of the provisions of this Bylaw, or who neglects to do or refrains from doing anything required to be done by any of the provisions of this Bylaw commits an offence and, upon conviction, shall be liable to a fine of not less than Fifty Dollars ($50.00) and not more than the maximum fine provided by the Offence Act and, where the offence is a continuing one, each day that the offence is continued shall constitute a separate offence. Bylaw Amendments 11. (Repealed by Bylaw No. 1497, 1992) READ a first and second time this 8th day of April, 1986. READ a third time this 22nd day of April, 1986. Mayor Clerk THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 6 | P a g e SCHEDULE "A" COMMERCIAL KENNEL REGULATIONS Class "A" Kennels shall be sited, constructed and maintained in accordance with the following minimum standards: 1. Siting: Siting of all buildings and structures for kennel use shall be in accordance with the provisions of the Zoning Bylaw. 2. Pen and Run Sizes: 2.1 Interior pens shall be not less than 1.85 square metres (19.91 sq. ft.) in area except that the size of not more than 50% of the total number of pens may be varied to accommodate larger or smaller dogs provided the average size of all pens is maintained at 1.85 square metres (19.91 sq. ft.). 2.2 Exterior runs shall be not less than 3.72 square metres (40 sq. ft.) in area except that where pen sizes are varied in accordance with 2.1 above, the run sizes may be varied in the same proportion. 2.3 Whelping areas at a ratio of one pen per twenty dogs but in no case fewer than one shall be provided in a location completely separated from the balance of the kennel. A whelping pen shall be not less than 1.85 square metres (19.91 sq. ft.) in area. 2.4 Isolation pens, the location and design of which are approved by the Building Inspector shall be provided at a ratio of one pen per ten dogs but in no case fewer than one such pen shall be provided. An isolation pen shall be not less than 1.85 square metres (19.91 sq. ft.) in area. 3. Building Requirements: 3.1 Minimum ceiling height shall be two metres (6.56 ft.) except than in any area to which the general public has access the minimum ceiling height shall be 2.13 metres (7 ft.). THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 7 | P a g e 3.2 Floors be constructed of a readily cleaned impervious material and designed and constructed to provide adequate slope to approved drains. 3.3 Walls shall be surfaced with an impervious material to a height of 0.91 metres (3 ft.) and shall separate all pens. Wire mesh shall be provided between the solid walls and the underside of the ceiling. 3.4 All pens shall be provided with natural light and ventilation equal to 10% of floor area for light and 5% of floor area for ventilation. 3.5 Exterior and ceilings shall provide reasonable soundproofing. 3.6 Kennels shall be provided and maintained at all times with adequate heat, light and water to provide a healthy environment for animals accommodated. Water shall be of sufficient quantity and quality for drinking, washing and cleaning purposes. 4. General Maintenance and Upkeep: 4.1 All exterior runs shall be enclosed on the perimeter by a landscape screen or fence to a height of 1.83 metres (6 ft.), such screen or fence to be maintained in good repair at all times. 4.2 All buildings and runs shall be kept in good repair at all times. 4.3 Kennels shall be kept clean and all waste and excrement shall be disposed of in a manner that does not create a nuisance and in a manner acceptable to the Medical Health Officer. 4.4 Kennels shall at all times be under the direct control of a responsible person. 4.5 Kennels shall not be operated in a manner which creates a nuisance to anyone occupying property in the vicinity. THE CORPORATION OF THE DISTRICT OF PITT MEADOWS KENNEL REGULATION BYLAW NO. 1087, 1986 26653v4 8 | P a g e SCHEDULE "B" ANNUAL LICENSE AND PERMIT FEES 1. All persons operating a Class "A" Kennel shall obtain an annual Business Licence and pay an annual business licence fee of One Hundred Dollars ($100.00). (Bylaw No. 1800, 1996) 2. All persons operating a Class "B" or "C" Kennel shall obtain an annual permit and pay an annual permit fee of ten dollars ($10.00), such fee being due and payable on or before the last day of February of any year. 3. All persons operating a Class "A" Kennel shall maintain a registry of all dogs boarded. Where a dog over the apparent age of four (4) months is accepted for boarding and the owner is a resident of Pitt Meadows, a notation shall be made in the Registry of the license number of the dog.
