City of Powell River Parking Lot Bylaw 2313, 2012 CONSOLIDATION

BYLAW 2313, 2012
A Bylaw to regulate motor vehicle parking in City Parking Lots.
The Council of the City of Powell River, in open meeting assembled, enacts as follows:
PART 1 - TITLE
1.
This Bylaw may be cited as "Parking Lot Bylaw 2313, 2012."
PART 2 - DEFINITIONS

For this Bylaw:
(a)
"Airport Terminal Building" means the Airport Terminal Building located at 7400
Duncan Street.
(b)
"Daily Parking" means any 24-hour period commencing on the date and time
stamped on the vending machine parking ticket.
(c)
"City" means the City of Powell River.
(d)
"City Parking Lot" means any of the designated parking areas as shown on
Schedules B, C, D and E all attached to and forming part of this Bylaw.
(e)
"Storage Shed" means the fire station building located on the City airport property
at Duncan Street.1
(f)
"Vehicle" means any motor vehicle.
(g)
"Vehicle/Trailer" means any motor vehicle with a boat trailer securely attached.
PART 3 - FEES

Subject to sections 11 to 28, every person who parks a vehicle or vehicle/trailer in a City
Parking Lot shall pay the parking fee or purchase an annual parking permit as
prescribed in Schedule A attached to and forming part of this bylaw.
PART 4 - VENDING MACHINE

The hourly and daily parking fees prescribed in Schedule A shall be paid to the vending
machine located within a City Parking Lot.
5.
Each person using a City Parking Lot shall ensure that the ticket issued by the vending
machine is prominently displayed on the dashboard of the motor vehicle and that the
date stamped thereon is fully legible.
6.
A ticket issued by the vending machine is valid only on the date stamped on it except
that, where a person parks a motor vehicle for two or more days, a series of tickets may

be bought on the first day and such tickets shall be valid for as many subsequent days
as there are tickets displayed.
7.
Tickets and permits are not transferable or assignable.
PART 5 - ANNUAL PERMIT
8.
Annual parking permits may be purchased from Financial Services at City Hall.
9.
Annual parking permits shall be for the calendar year January to December. Permits
purchased throughout the year shall not be prorated.
10.
Annual parking permits shall be prominently displayed on the dashboard of the motor
vehicle parked in a City Parking Lot.
PART 6 - DESIGNATED PARKING - AIRPORT
11.
Vehicles may park free of charge for up to but not exceeding one hour in the designated
one-hour parking spaces between the Airport Terminal Building and the Storage Shed in
the City Parking Lot as shown on Schedule B.2
12.
Vehicles may park free of charge for up to but not exceeding 5 minutes in the designated
5 minute loading zone in front of the Airport Terminal Building as shown on Schedule B.
13.
Taxicabs may park free of charge in the designated taxi parking area adjacent to Airport
Terminal Building as shown on Schedule B.
14.
Vehicles displaying Westview Flying Club identification may park free of charge in the
designated spaces adjacent to the security fence bordering the Westview Flying Club
leasehold as shown on Schedule B.
15.
The City shall provide designated parking spaces within the City Parking Lot at the
Airport for Airport terminal tenants.
PART 7 - DESIGNATED PARKING - NORTH HARBOUR MARINA
16.
Only boat trailers or vehicles attached to a boat trailer may park in the designated
vehicle/trailer pay parking area in the City Parking Lot as shown on Schedule C. Only
one ticket or one annual parking permit shall be required for a vehicle/boat trailer
combination.
17.
Only vehicles may park in the designated vehicle only pay parking area in the City
Parking Lot as shown on Schedule C.
18.
Vehicles may park free of charge for up to but not exceeding 15 minutes in the
designated loading zone in the City Parking Lot as shown on Schedule C.

19.
Only vehicles with an attached boat trailer may park free of charge for up to but not
exceeding 5 minutes in the designated tie-down area in the City Parking Lot as shown
on Schedule C.
PART 8 - DESIGNATED PARKING - SOUTH HARBOUR WHARF
20.
Vehicle Only pay parking is permitted in the City Parking Lot as shown in Schedule D.
21.
Only vehicles may park for up to but not exceeding two hours in the designated vehicle
only pay permit parking area in the City Parking Lot as shown on Schedule D.
22.
Vehicles may park free of charge for up to but not exceeding 30 minutes in the
designated loading zone in the City Parking Lot as shown on Schedule D.
PART 9 - DESIGNATED PARKING - MOWAT BAY
23.
Only boat trailers or vehicles attached to a boat trailer may park in the designated
vehicle/trailer pay parking area in the City Parking Lot as shown on Schedule E. Only
one ticket or one annual parking permit shall be required for a vehicle/boat trailer
combination.
24.
Only vehicles may park in the designated vehicle only day park use parking area in the
City Parking Lot as shown on Schedule E.
25.
Vehicles may park free of charge for up to but not exceeding 15 minutes in the
designated loading zone in the City Parking Lot as shown on Schedule E.
26.
Only vehicles with an attached boat trailer may park free of charge for up to but not
exceeding 5 minutes in the designated tie-down area in the City Parking Lot as shown
on Schedule E.
27.
Vehicles only are permitted to park on the side of Mowat Ave. as shown on Schedule E.
Except when purchased after August 31st as noted in Schedule A Day Parking Rates.3
PART 10 - EXEMPTION
28.
This Bylaw does not apply to:
(a)
Police, fire, or other emergency vehicles proceeding upon or engaged in an
emergency; City vehicles, or Canada Customs Inspector vehicles; or
(b)
Vehicles displaying official Coast Guard insignia when Coast Guard personnel are
engaged in Coast Guard business.
PART 11 - SIGNS
29.
The City shall ensure that signs are displayed in suitable locations within the City
Parking Lots to readily draw the provisions of this bylaw to the public's attention.

PART 12 - NOTICE OF VIOLATION
30.
The owner of any motor vehicle or boat trailer parked in contravention of this bylaw:
(a)
may be issued a notice of violation; and
(b)
may have his vehicle or boat trailer towed away and be liable for towing, storage
and penalty charges.
31.
Any person to whom a notice of violation is issued may pay to the City:
(a)
$30.00 if paid within 14 days; and4
(b)
$60.00 if paid after 14 days from the issuance of the notice of violation.5
32.
Any payment under Section 31 shall be made at City Hall, 6910 Duncan Street, Powell
River, BC.6
PART 13 - PENALTY
33.
Any person who violates any provision of this bylaw or who suffers or permits any act or
thing to be done in contravention of this bylaw, or who refuses, or omits or neglects to
fulfill, observe, carry out or perform any duty or obligation imposed by this bylaw may be
liable to prosecution pursuant to the Offence Act.
34.
Every day during which there is an infraction of this bylaw shall constitute a separate
offence.
PART 14 - SEVERABILITY
35.
If any section, subsection, clause or phrase of this bylaw is for any reason held to be
invalid by the decision of a Court of competent jurisdiction, the invalid portion shall be
severed and the decision that it is invalid shall not affect the validity of the remainder.
PART 15 - REPEAL
36.
Parking Lot Bylaw No. 2170, 2008 and all amendments are hereby repealed.

READ a third time the 15th day of March 2012.
