This bylaw may be cited as the "Traffic Bylaw, 1978". 2. In this bylaw, unless the context otherwise requires: "Bylaw Enforcement Officer" means a Bylaw Enforcement Officer appointed by Council to enforce the provisions of this Bylaw; "Clerk" means the Municipal Clerk of the Corporation of the District of Powell River; "Council" means The Council of the Corporation of the District of Powell River; "Crosswalk" means (a) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the road surface; or (b) the portion of a highway at an intersection that is included within the connection of the lateral lines of the sidewalks on the opposite side of a highway or within the extension of the lateral lines of the sidewalk on one side of a highway, measured from the edges of the roadway. "Driver" means any person who drives or is in actual physical control of a vehicle; "Emergency vehicle" means: (a) a motor-vehicle carrying rescue or first aid equipment where there is an urgent emergency justifying a rate of speed in excess of any maximum rate of speed provided for in this bylaw; (b) a motor-vehicle driven by a member of a fire department in the discharge of his duties; (c) a motor-vehicle driven by a peace officer or constable or by a member of the police branch of any of Her Majesty's Armed Forces or a member of the Provincial Gaol Service in the discharge of his duty; "Engineer" means the Municipal Engineer of the Corporation of the District of Powell River; "Engineering Department" means the Engineering Department of the Corporation of the District of Powell River; "Fire Chief" means The Fire Chief of the Corporation of the District of Powell River;3 "Fire Department" means the Fire Department of the Corporation of the District of Powell River; "Fire Lane"4 means any area as designated by the Fire Chief required for fire vehicle access; 3 Bylaw Amendment No. 1110 4 Bylaw Amendment No. 1110 CONSOLIDATED NOVEMBER 18, 2025 Traffic Bylaw 931 CONSOLIDATED NOVEMBER 18, 2025 5 "Highway"5 includes every highway within the meaning of the "Highway Act", and every road, street, lane or right-of-way designed or intended for use by the general public for the passage of vehicle, and every private place or passageway to which the public, for the purpose of the parking, including handicapped parking, or servicing of vehicles, has access or is invited; and includes the roadways, shoulder, boulevard, ditch, and sidewalk area and whatever land lie between the property lines of the highway; "Intersection" means the area embraced within the prolongation or connection of the lateral curb- lines, or if none, then the lateral boundary-lines of the roadways of the two highways which join one another at or approximately at right angles, or the area within which vehicles travelling upon different highways joining at any other angle may come in conflict; and, for the purpose of this definition, "highway" does not include a lane or way less than 5 m (16 feet) in width separating the rear property-lines of parcels of land fronting on highways running more or less parallel to and on each side of the lane or way; "Lane" means the roadway or way separating the rear property lines of parcels of land fronting on streets and running more or less parallel to the street; "Low-speed electric vehicle" means a neighbourhood zero emission vehicle as defined in Division 1 of the BC Motor Vehicle Act Regulationsi. "Motor-vehicle" means a vehicle, not run upon rails, that is designed to be self-propelled or propelled by electric power obtained from overhead trolley-wires; but does not include mechanically propelled invalids' chairs; "Municipality" means the Corporation of the District of Powell River or the area within its corporate boundaries; "Parade" means: (a) any procession or group of pedestrians numbering more than thirty persons who are standing, marching or walking on any street or sidewalk, or; (b) any group of vehicles numbering ten or more moving on any street; but does not include any funeral procession; "Park" when prohibited, means the standing of a vehicle whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading; "Peace Officer" means a constable or person having the powers of a constable; "Pedestrian" means a person afoot, or an invalid or child in a wheelchair or carriage; "Person" includes a firm or partnership, association, or corporation; "Private Road or Driveway" means any road or driveway the title to or possession of which is not vested in the Crown; "Roadway" means the portion of the highway that is improved, designed, or ordinarily used for vehicular traffic, but does not include the shoulder; "Senior R.C.M.P. Officer" means the Senior Officer of the Powell River Detachment of the Royal Canadian Mounted Police; "Sidewalk" means the area between the curb-lines or lateral lines of a roadway and the adjacent property-lines improved for use of pedestrians; Traffic Bylaw 931 CONSOLIDATED NOVEMBER 18, 2025 6 "Street or Highway" includes any road, land or right-of-way within the meaning of the Highway Act R.S.B.C. 1960 c. 172, designed or intended for or used by the public for the passage of vehicles, but does not include an arterial highway as defined in the Highway Act; "Stop" means: (a) when required, a complete cessation from movement; and (b) when prohibited, the stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or traffic-control device; "Through street" means a street or part of a street at the entrances to which stop signs are erected under this bylaw; "Traffic" includes pedestrians, ridden or herded animals, vehicles, cycles, and other conveyances, either singly or together, while using any street; "Traffic-control device" means a sign, signal, line, meter, marking, space, barrier, or device, not inconsistent with the provisions of the Motor Vehicle Act, R.S.B.C. 1960 c.253, placed or erected pursuant to any bylaws or resolutions of Council; "Traffic-control signal" means a traffic-control device, whether manually, electrically, or mechanically operated, by which traffic is directed to stop and to proceed; "Traffic sign" means any traffic-control device other than a signal by which traffic is directed, warned or regulated to stop and to proceed; "Vehicle" means a device in, upon, or by which a person or thing is or may be transported or drawn upon a highway, and includes a motor vehicle with a semi-trailer or trailer attached, a trailer, and a device propelled by muscular power. 6 Bylaw Amendment No. 1836 Traffic Bylaw 931 CONSOLIDATED NOVEMBER 18, 2025 7 TRAFFIC CONTROL 3. (1) Subject to the provisions of the Motor Vehicle Act, the Council may by resolution determine and designate the character, type and location of all traffic-control devices. (2) The Engineer shall place and maintain all traffic-control devices as directed by Council. (3) The traffic-control devices erected and placed shall be in accordance with the "Uniform Traffic control Devices for Canada" manual and any regulations made pursuant to the Motor Vehicle Act. TEMPORARY TRAFFIC SIGNS 4. (1) Where the interests of public safety require the Engineer, Engineering Department, Fire Chief, or any Peace Officer may erect or place a temporary traffic control device at any time or place. (2) Any person erecting or placing a traffic-control device under subsection (1) shall notify the Clerk, in writing, and the Clerk shall notify the Council at its next regular meeting. (3) No person shall leave any temporary traffic-control device in place upon a highway after the cause for traffic-control device no longer exists. 5. Except where otherwise directed by a Peace Officer or a person authorized by a Peace Officer to direct traffic, every driver and pedestrian shall obey the directions or instructions of any traffic-control device erected in accordance with this bylaw or a resolution of Council. TRAFFIC LANES 6. (1) The Council may, by resolution, designate the location of traffic lanes for traffic on any paved streets. (2) The traffic lane lines designated under subsection (a) shall be painted white and the center line shall be painted yellow, or otherwise marked on the road surface at the location and in the manner designated by Council. 7 (1) (a) The Council may by resolution designate the location of crosswalks for pedestrian traffic on any paved street. (b) The crosswalks shall be painted white or otherwise marked on the road surface, at the locations and in the manner designated by Council. FIRE LANES61 (2) The Fire Chief may designate certain areas as fire lanes and may cause to be posted in such lanes a sign or signs, as described in the Motor Vehicle Act and Regulations as amended, prohibiting the parking of vehicles at any or all times in or on that area so designated as a fire lane. 7Bylaw Amendment No. 1110 Traffic Bylaw 931 CONSOLIDATED NOVEMBER 18, 2025 8 STREET CLOSURE 8. (1) The Council may, by resolution, (a) authorize the Engineer or any other official of the Municipality to close to traffic any street or portion of any street, at any time and for any period and in respect of any class or classes of traffic; (b) authorize the Engineer to temporarily close to traffic any street or portion of any street as he may deem necessary. (2) Where any street is closed to traffic, the Engineer shall erect and maintain a good and sufficient barrier to indicate the closure. (3) No driver shall pass beyond any barrier indicating that a street is closed to traffic. THROUGH STREETS 9. (1) The Council may, by resolution designate certain streets or parts of streets as Through Streets and may alter or remove the designations. (2) The Engineer shall erect and maintain stop signs on any street intersecting a designated Through Street. BUS ROUTE 10. The Council may by resolution designate any streets or portion of any street on which buses for the conveyance of passengers may be operated. PARADES 11. (1) No person shall be a member of or take part in any parade unless (a) the parade is under the direction or control of one person as marshal or organizer; and, (b) a written permit for the parade has been issued to the marshal or organizer by the Senior R.C.M.P. Officer. (2) Any application to hold a parade shall be made in writing to the Senior R.C.M.P. Officer by the marshal or organizer at least twenty-four hours before the parade is to commence. (3) The application shall state (a) the nature of the parade; (b) the time at which the parade is to be held; (c) the place or places of formation and commencement; (d) the route intended to be taken; and (e) the place of disbandment. (4) The Senior R.C.M.P. Officer may issue written permission for a parade subject to any terms or conditions he may impose as to time, route or otherwise. (5) Where any deviation from the terms or conditions imposed under subsection (4) occurs, the permit shall be null and void. OBSTRUCTION OF TRAFFIC 12. (1) Except where authorized by the written permission of Council, no person shall form part of a Traffic Bylaw 931 CONSOLIDATED NOVEMBER 18, 2025 9 group of persons congregated on a street in such a manner as to obstruct the free passage of pedestrians or vehicles. (2) Except where authorized by the written permission of Council, no person shall do anything which directs the attention of persons or causes them to congregate in a group on any street in such a manner that (a) the free passage of pedestrians or vehicles is obstructed; or (b) the persons congregated might be in danger of injury from traffic. OBSTRUCTION OF STREETS 13.9 (1) The Municipal Engineer and any other officer, employee, agent or authorized contractor of the Municipality may remove, detain and impound any vehicle, chattel or obstruction which is unlawfully occupying any portion of a highway or public place. (2) The owner of any vehicle, chattel or obstruction which has been removed, detained or impounded under this by-law may, within 30 days from the date of removal, recover the vehicle, chattel or obstruction by first paying to the Municipality the following fees, costs and expenses: (a) Where removal or impoundment has been carried out by the Municipality, a basic fee of $25.00 and an impoundment fee of $5.65 for each day or part day of impoundment; or (b) Where the removal and impoundment has been carried out by an agent or contractor of the Municipality, a basic fee of $25.00 plus actual costs and expenses incurred by the Municipality for those services. (c) Where an amount is payable by an owner to the Municipality under Subsection (b) of this Section, the owner shall pay that amount tot he agent or contractor of the Municipality who effected the removal and impoundment. (3) Where an impounded vehicle, chattel or obstruction has not been reclaimed within 30 days after removal, the Municipal Engineer may; (a) order that the vehicle, chattel or obstruction shall be sold at public auction and in such cases the fees, costs and expenses imposed under this bylaw, and the auction expenses, shall be retained by the Municipality from the proceeds of the sale; or (b) take action on behalf of the Municipality in a court of competent jurisdiction for recovery of the fees, costs and expenses imposed under this bylaw. 14. No person shall place, deposit, or dump, or cause to be placed, deposited, or dumped, any rocks or dirt in or upon any street, including any portion of the shoulder or right of way without the consent of the Engineer. 15. Any person who removes any wrecked or damaged vehicle from any highway shall remove any glass or any other injurious materials which have dropped from the vehicle. 9 Bylaw Amendment 1725 Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 10 16. (1) Where in the opinion of the council, any trees, shrubs, hedges or bushes which are growing or standing on any lands adjacent to any highway (a) are dangerous; or (b) are unsafe or inconvenient to the public; the Council may direct to owner or occupier of the land, at his expense, to remove, cut down or trim any tree, shrub, hedge or bush. (2) The Council shall give to the owner or occupier of the land written notice requiring him within five days from the date of notice to remove, cut down, or trim the trees, shrubs, hedges, or bushes designated in the notice. (3) Where any owner or occupier does not within five days remove, cut down, or trim the trees, shrubs, hedges, or bushes as required, or make an application to a Judge of the County Court, the Municipality, by its workmen and others, may enter and effect the removal, cutting-down, or trimming at the expense of the person defaulting. (4) Where notice is given to the Council of an appeal to the Judge of the County court, the Judge shall hear and determine the matter, and his decision shall be final and without appeal. (5) The expenses incurred by the Municipality under this section shall, if unpaid on the thirty-first day of December in any year, be added to and form part of the taxes payable in respect of the lands designated in the notice. 17. Except where it is necessary to avoid conflict with traffic or to comply with the law or the directions of a peace officer or traffic-control device, no person shall stop, stand, or park a vehicle (1) on a sidewalk or boulevard; (2) in front of a public or private driveway; (3) within an intersection, except as permitted by a sign; (4) within 5 m (16 feet) of a fire-hydrant measured from a point in the curb or edge of the roadway which is closet to the fire-hydrant; (5) on a crosswalk; (6) within 6 m (20 feet) of the approach side of a crosswalk; (7) within 6 m (20 feet) upon the approach to any flashing beacon, stop-sign, or traffic-control signal located at the side of a roadway; (8) within 6 m (20 feet) either side of the entrance to or exit from any hotel, theatre, public meeting-place, dancehall, fire-hall, or playground10; 10 Bylaw Amendment No. 1034 Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 11 (9) Upon any highway for the principal purpose of (a) displaying vehicle for sale; (b) advertising, greasing, painting, wrecking, storing, or repairing any vehicle, except where repairs are necessitated by any emergency; (c) displaying signs; (d) selling flowers, fruits, vegetables, sea foods, or other commodities or articles (10) alongside or opposite a street excavation or obstruction when stopping, standing or parking obstructs traffic; (11) on the roadway side of a vehicle stopped or parked at the edge or curb of a roadway; (12) upon a bridge or other elevated structure upon a highway, or within a highway tunnel, except as permitted by a traffic-control device; (13) in a place in contravention of a traffic-control device that gives notice that stopping, standing, or parking is there prohibited or restricted; (14) in such a manner as to obstruct the visibility of any standard traffic sign erected by or with the authority of the Minister of Highways and Public Works or the Municipality; (15) in front of any lane; (16) in any lane or alleyway for any period of time longer than is necessary for the expeditious loading or unloading of passengers or materials; (17) on any lane or roadway in any position that obstructs the free passage of any traffic; (18) on any portion of a street that is indicated by any traffic sign as reserved for a class of vehicles unless the vehicle is of that class; (19) on the paved portion of any street without curbs where the pavement is 6 m (20 feet) or less in width; (20) on any portion of a street for a period of time longer than that indicated by any traffic sign applicable to that portion of the street; (21) on any portion of a street where parking is prohibited by any traffic control device; (22) on any street for longer than 36 hours; (23) On any school day between the hours of 8:00 a.m. and 5:00 p.m., no person shall park or stop any vehicle in front of any school grounds on the side of any street which forms part of the boundary of the school grounds; (24) No person shall park or stop any vehicle or combination of vehicles which exceeds a width of 2.15 m (7 feet) or a length of 6 m (20 feet), including any load, in any parking lot owned or operated by the Municipality, unless otherwise specified; 15(25) No person shall park or stop any vehicle on lands owned, leased, or controlled by the Municipality except as follows: (a) as permitted in a parking lot, owned or operated by the Municipality for no period of time longer than that indicated on any applicable traffic sign; (b) for street vending purposes in an area designated for street vending use by and following the requirements of City of Powell River Vending Bylaw 2536, 2018ii. Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 12 (26) Where the curb is painted yellow, no person shall park or stop any vehicle on any portion of the street adjacent to the yellow curb. (27) 16 Other than on the right side of the roadway and with the right hand wheels parallel to that side, and where there is a curb within 30 centimeters of the curb. (28) 17 Where the curb is painted red, no person shall park or stop any vehicle on any portion of the street adjacent to the red curb. 18. Except where (a) any vehicle is so mechanically disabled as to prevent its moving; or (b) an area is designated for angle parking; any driver shall park his vehicle parallel to and within 30 cm (12 inches) of the curb of the street. LENGTH RESTRICTIONS 19. Except for the purpose of loading or unloading freight, merchandise or passengers, no driver of any vehicle which has an overall length, including any load, of greater than 6 m (20 feet) shall park the vehicle on (a) Marine Avenue between Abbotsford Street and Fairmont Street; (b) Alberni Street between Marine Avenue and Harvie Avenue; (c) Cranberry Street between Crown Avenue and Mowat Avenue; (d) Manson Avenue between Cranberry Lake Road and Church Street; (e) Ash Avenue between Elm Street and Poplar Street; (f) Marine Avenue between Arbutus Avenue and Laurel Street. 20. No driver shall permit a motor vehicle to stand unattended or parked unless he has (a) locked the motor vehicle or made it secure in a manner that prevents any unauthorized use of the vehicle; and (b) where the motor vehicle is standing on a grade, turned the front wheels of the vehicle to the curb or side of the street. PASSENGER and LOADING ZONES 21. (1) Passenger zones and loading zones shall be located, established and maintained at any place and on any street approved and designated by resolution of the Council. (2) Any traffic signs which indicate or mark the zones shall be erected or placed under the direction of the Engineer. (3) The driver of any vehicle shall not stop or park any vehicle in any passenger loading zone for any period of time longer than is necessary for the expeditious loading or unloading of passengers, freight or merchandise. (4) Except where it is inconsistent with a resolution of the Council, a passenger or loading zone 16 Bylaw Amendment No. 1082 17 Bylaw Amendment No. 1361 Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 13 shall be in effect twenty-four hours per day. 22. (1) Where, in the opinion of the Engineer, traffic conditions warrant the installation of a designed zone, the Engineer is authorized to locate and establish (a) any loading zone adjacent to the main entrance of any hotel; (b) any passenger zone adjacent to the main entrance to any theatre. 23. (2) Any zone established by the Engineer shall be of the area and size he directs and shall be in effect twenty-four hours per day. 24. (1) The Engineer shall erect or cause to be erected any traffic signs necessary to indicate and mark any loading zone, passenger or commercial zone. (2) Where any resolution of Council which establishes any zone restricts the hours of operation of the zone, the Engineer shall ensure that any traffic signs which mark the zone shall indicate the hours of operation. 25. (1) Except (a) where the vehicle is a taxi or passenger bus; or (b) for the purpose of loading or unloading freight, merchandise or chattels of any kind; or (c) for the purpose of performing any service for which the vehicle is licensed under the Commercial Transport Act, R.S.B.C. 1960, c.101; no driver shall park any vehicle or combination of vehicles which exceed 2.15 m (7 feet) in width or 6 m (20 feet) in length, including any load, for any period longer than one hour on any street within the Municipality. EXEMPTION 26. (1) Any provisions of this bylaw which regulate the parking of any vehicle shall not apply to any emergency vehicle while attending to an official call. (2) Any provisions of this bylaw which prohibit the stopping or parking of any vehicle shall not apply (a) to any Municipal or Provincial utility vehicle; (b) to any vehicle of any public utility corporation; or (c) to any towing vehicle; while the vehicle is being used in work which requires the driver to stop or park the vehicle in contravention of this bylaw. 27. (1) The Council may by resolution exempt any class of vehicles from the provisions of this bylaw which regulate parking or stopping. (2) The Council may impose any conditions and may require any exempted vehicles to display an identification card or sticker issued by the Municipality. (3) No person shall display on any vehicle any unauthorized identification card or sticker which purports to exempt the vehicle from the provisions of this bylaw. 28. Except with a written permit issued by the Municipal License Inspector, no person shall operate in or on any vehicle any calliope, loud speaker, megaphone or any other noise-making device on any street within the Municipality. Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 14 BACKING RESTRICTIONS 29. (1) The driver of any vehicle shall not cause or allow any vehicle to move backwards into any intersection or over any crosswalk. (2) Unless it is safe to do so, the driver of any vehicle shall not cause or allow any vehicle to move backwards. 30. No driver shall turn a vehicle so as to proceed in the opposite direction; (a) on any street between intersecting streets; (b) at any lane intersection; (c) at any street intersection at which a "No U Turn" sign has been erected; (d) at any other street intersection unless the turn may be made (i) in safety; (ii) without backing the vehicle; and (iii) without interfering with any other traffic; (e) in a business district except at an intersection where no traffic-control signal has been erected. 31. (1) Except at any intersection at which an officer is directing traffic, no driver shall drive between the vehicles comprising a funeral or any authorized procession while it is in motion. 32. (2) The driver of any vehicles in a funeral procession shall drive with the headlights of the vehicle illuminated or display on the vehicle a pennant or other insignia to identify the vehicle. 33. Except where a Special Traffic Permit has been obtained from the Engineer, no person shall drive on any street within the Municipality any vehicle which (a) has a gross weight, axle-load or tire-load greater than the limits of weights and loads set out in the Commercial Transport Act, R.S.B.C. 1960, c. 101, and any regulations made pursuant to that Act; (b) has dimensions, including any load, greater than those set out in the Commercial Transport Act or its Regulations; or (c) has a combination of vehicles coupled together greater in number than is set out in the Commercial Transport Act or its Regulations. 34. (1) Any applicant for a Special Traffic Permit shall apply in writing, in the form shown in Schedule A, to the Engineer. (2) Any applicant shall furnish any information required by the Engineer. (3) Subject to section 30, the Engineer may, in his discretion, issue a Special Traffic Permit and may impose any conditions or restrictions on the operation of the vehicle to which the Permit applies. 35. Before any Special Traffic Permit is issued, the applicant shall deposit with the Engineer a bond of indemnity in the amount specified by the Engineer to secure payment to the Municipality for the cost of any repair or reconstruction to any street or other property of the Municipality which may be required as a result of the driving or operation of any vehicle for which a Permit is issued. 36. No person shall drive or operate on any street within the Municipality, any vehicle which has wheels, Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 15 tires or treads which are constructed or equipped with projecting spikes, cleats, ribs, clamps, flanges, lugs or any other attachment or projection which extends beyond the tread or transaction surface of the wheel, tire or tread. SPEED LIMITS 37. (1) Subject to subsections (2) and (3), no person shall drive or operate any motor vehicle on any street within the Municipality at a greater rate of speed than 50 km/h. 18 (2) No person shall drive or operate any motor vehicle at a greater rate of speed than 60 km/h on the following streets, as posted by traffic signs: (a) Marine Avenue between a point 150 m south of the intersection of Laurel Street and Marine Avenue to a point 1.1 km south of the intersection; (b) the Lund-Thunder Bay highway from a point 60 m north of the intersection of Sutherland Road and the Lund-Thunder Bay highway north to the Municipal boundary. (3) 19 No person shall drive or operate a motor vehicle in the Municipality on a lane not exceeding 8 meters in width at a speed in excess of 20 km/h. PEDESTRIANS 38. (1) Where crosswalks are located and marked at any street intersection, any pedestrian shall use the crosswalk to cross the street. (2) Where a pedestrian is crossing any street at a point other than within a crosswalk, he shall yield the right-of-way to any vehicle. (3) Upon the approach of any emergency vehicle, any pedestrian shall proceed or return to the nearest sidewalk or edge of the road and remain there until the vehicle has passed. (4) Except where a crossing is made in compliance with any traffic control signal or the direction of any officer, no person who has alighted from a bus which has stopped near an intersection shall start to cross to the opposite side of the street until the bus has passed. BICYCLES 39. (1) No person shall ride a bicycle on the sidewalk of any street or on a pedestrian path in any public park. (2) Any person who is riding a bicycle shall keep at least one hand on the handlebars. 40. (1) The Council may be resolution (a) designate a part of any street for the parking of bicycles; and (b) direct that racks or stands for the parking of bicycles be erected and placed in any designated area. (2) Any rack or stand for the parking of bicycles shall be placed adjoining the sidewalk or curb at a distance not less than 5 m from any corner, intersection or fire hydrant. 18 Bylaw Amendment No. 1289 19 Bylaw Amendment No. 1289 Traffic Bylaw 931 CONSOLIDATED NOVMEBER 18, 2025 16 (3) Where a bicycle rack or stand is available in the area, no person shall park a bicycle on the sidewalk or curb. 41. (1) Where a bicycle is operated on any street, it shall be equipped with brakes adequate to control its movement and to stop it. (2) The rider of any bicycle shall ensure that the brakes are in good working order. LOW - SPEED ELECTRIC VEHICLESiii 42. A person may drive a low-speed electric vehicle on any highway in the Municipality that has a speed limit of 50 kilometers per hour or lessiv. SIDEWALKS - Removal of Snow and Ice 1 43. The owner or occupier of any real property which is developed or used in whole, or in part in any way, other than as a one or two family dwelling, shall remove all snow and ice from any sidewalk adjacent to such parcel for a distance that coincides with the property line of his real property, not later than eleven o'clock in the morning on any day except Sunday. NOTICE OF VIOLATION 44. (1) The owner of any motor vehicle or trailer parked in contravention of this bylaw: v a) may be issued a notice of violation; and b) may have his vehicle or trailer towed away and be liable for towing, storage and penalty charges. (2) Any person to whom a notice of violation is issued must pay to the City as outlined below: vi a) $30.00 if paid within 14 days; and b) $$60.00 if paid after 14 days from the issuance of the notice of violation (3) Any payment under Section 41 shall be made at City Hall, 6910 Duncan Street, Powell River, BC. PENALTY 1 1 45. (1) Any person who violates any provision of this bylaw or who suffers or permits any act or thing to be done in contravention of this bylaw, or who refuses, or omits or neglects to fulfill, observe, carry out or perform any duty or obligation imposed by this bylaw may be liable to prosecution pursuant to the Offence Act.
