## CITY OF PRINCE GEORGE ## BY-LAW 1996 A By-law of the City of Prince George to authorize the undertaking of the provision of off-street parking facilities for the special benefit of a specified area of the City and the raising of the cost thereof from the special area. HEREAS pursuant to Section 616 of the Municipal Act, the ·ouncil of a District Municipality may by By-law undertake any work or service coming within the powers of the Municipality for the specia benefit of a specified area of the Municipality: AND WHEREAS pursuant to Section 866 of the Municipal Act for the purposes of providing off-street parking facilities, a City Municipality, having appopulation in excess of seven thousand Ilve hundred (7,500) is deemed to be a District Municipality, and the Council thereof may exercise the powers under Division (2), Part XVI, which includes Section 616: Prince George exceeds Reorget theed se the thousand, five tundred (9,500) ; AND\_ WHEREAS the City has acquired properties at the corner of Fifth Avenue and Brunswick Street for the purpose of providing off-street parking facilities and intends to, required, to purchase other properties for this purpose; to Oxford Leaseholds Limited for the purpose of constructing thereon a parking structure and has agreed to purchase back the parking . structure on or before September 1, 1972, and has agreed in the interim to lease back the structure operate it as a parkade to provide downtown off-street parking; AND WHEREAS the area that will specially benefit from the off-street parking facilities is more particularly described in Schedule "A" hereto: NOW THEREFORE, the Council of the City of Prince George, in open meeting assembled, enacts as follows: 1. The portion of the City of Prince George for the special benefit of which the off-street parking facilities hereby authorized are to be provided is defined in Schedule hereto and shall be known as the "downtown off-street parking area" 2. The Council is hereby empowered and authorized to acquire lease or otherwise and hold, use and improve tacilitles within the area defined in Schedule and personal property to provide off-street parking hereto. 3. The cost taxes, coration auding manageme induding ratt interesal, and debt repayment) of providing off-street parking facilities on those location set out in Schedule "B" hereto, within the area defined herein, shall be paid so far as possible by the revenue derived from the operation of the facilities and any cost not so paid shall be borne by the owners of real property within the area defined in Schedule "A" hereto and for that purpose, the Council may levy and impose within the area a rate upon the lands and improvements. 5. Ihe Council may, by By-law, merge this area with any other Specitled area created to provide off-street parking facilities whether contiguous or not, for the purpose of providing, consolidating or completing necessary works or services for such merged area; 6. This By-law shall take effect on the date of its final adoption by Council. 6.
