Definitions Definitions Definitions Definitions In this Bylaw: "Angle Parking" "Angle Parking" "Angle Parking" "Angle Parking" means the parking of a vehicle other than parallel to a curb or lateral lines of the roadway, and shall mean that the front end of the vehicle shall be closest to the curb or edge of the highway. "Authorized Person" "Authorized Person" "Authorized Person" "Authorized Person" means the person appointed by Council as head of the Development Services Department, or a person designated in writing by the head of the Development Services Department to carry out any act or function under this bylaw. BL7861 BL7861 BL7861 BL7861 "Boulevard" "Boulevard" "Boulevard" "Boulevard" means the area between the curb lines, the lateral lines or the shoulder of a roadway and the adjacent property line. "Bus" "Bus" "Bus" "Bus" means a vehicle for hire operated by British Columbia Transit and used for the transportation of passengers and operated in conjunction with a street transportation system in the City. "Bus Stop" "Bus Stop" "Bus Stop" "Bus Stop" means a part of a highway designated as a point at which buses will stop to take on or let off passengers. "Bylaw Enforcement "Bylaw Enforcement "Bylaw Enforcement "Bylaw Enforcement Officer" Officer" Officer" Officer" means the person(s) appointed to that position from time to time by Council resolution. "City" "City" "City" "City" means the City of Prince George. "Commercial Loading "Commercial Loading "Commercial Loading "Commercial Loading Zone" Zone" Zone" Zone" means an area or space established for the loading or unloading of materials, to be used exclusively by commercial vehicles. Consolidated Bylaw No. 6056, 1993 Page 2 Last Updated: December 10, 2019 Document Number: 529302 "Commercial Vehicle" "Commercial Vehicle" "Commercial Vehicle" "Commercial Vehicle" means the same meaning as commercial vehicle in the Commercial Transport Act and which is engaged in carrying merchandise or other commodities in the ordinary course of business. BL9081 L9081 L9081 L9081 "Corner" "Corner" "Corner" "Corner" with reference to a highway intersection means the point of intersection of the extension of the lateral curb lines or in the absence of curbs the extension of the edges of the roadway. "Council" "Council" "Council" "Council" means the Council of the City of Prince George. "Crosswalk" "Crosswalk" "Crosswalk" "Crosswalk" means: a) a portion of the roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface; or b) the portion of a highway at an intersection that is included within the connection of the lateral lines of the sidewalks on the opposite sides of the highway, or within the extension of the lateral lines of the sidewalk on one side of the highway, measured from the curbs, or in the absence of curbs, from the edges of the roadway. "Cycle" "Cycle" "Cycle" "Cycle" means a device having any number of wheels that is propelled by human power and on which a person may ride. "Driveway" "Driveway" "Driveway" "Driveway" means a part of a highway improved to provide vehicular access from the roadway to adjacent property. "Gross Weight" "Gross Weight" "Gross Weight" "Gross Weight" means the combined weight of vehicle and load. "Highway" "Highway" "Highway" "Highway" includes every highway within the meaning of the Highway Act, and every road, street, lane or right of way designed or intended for or used by the general public for the passage of vehicles, and every private place or passageway to which the public, for the purpose of the parking or servicing of vehicles, has access or is invited; and includes the roadway, shoulder, boulevard, ditch and sidewalk area and whatever lands lie between the property lines of the highway. "Highway, One "Highway, One "Highway, One "Highway, One=Way" Way" Way" Way" means a highway upon which the movement of vehicular traffic is limited to one direction. "Intersection" "Intersection" "Intersection" "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines, or if none, then the lateral boundary lines of the roadways of the two highways which join one another at or approximately at right angles, or the area within which vehicles traveling on different highways joining at any other angle may come in conflict. Consolidated Bylaw No. 6056, 1993 Page 3 Last Updated: December 10, 2019 Document Number: 529302 "Lane" "Lane" "Lane" "Lane" means any highway, not exceeding eight (8) metres in width, separating the rear property lines of parcels of land fronting on highways running more or less parallel to and usually on each side of the lane. "Loading Zone" "Loading Zone" "Loading Zone" "Loading Zone" means an area or space established for the loading or unloading of materials. "Manager, Regulatory "Manager, Regulatory "Manager, Regulatory "Manager, Regulatory Services" Services" Services" Services" means that individual who is the Manager of the Regulatory Services division of the City or his authorized representative. "Motorcycle" "Motorcycle" "Motorcycle" "Motorcycle" means a motor vehicle running on two or three wheels and having a saddle or seat for the driver to sit astride. "Motor Vehicle "Motor Vehicle "Motor Vehicle "Motor Vehicle" means a vehicle, not run on rails, that is designed to be self propelled. "Municipality" "Municipality" "Municipality" "Municipality" means the City of Prince George. "Parking Control "Parking Control "Parking Control "Parking Control Officer" Officer" Officer" Officer" means a person(s) employed by the City as a Parking Control Officer. "Parking Meter" "Parking Meter" "Parking Meter" "Parking Meter" means a mechanical device together with its support, erected to control and regulate the parking of a vehicle in a parking space. "Parking Meter Cover" "Parking Meter Cover" "Parking Meter Cover" "Parking Meter Cover" means a hood, bag or other covering for a parking meter that is placed over a parking meter by the City of Prince George to indicate that a parking meter space is not to be used. "Parking Meter Space" "Parking Meter Space" "Parking Meter Space" "Parking Meter Space" means a parking space, the use of which for parking a vehicle is controlled and regulated by a parking meter. "Parking "Parking "Parking "Parking Meter Zone" Meter Zone" Meter Zone" Meter Zone" means that part of a highway where parking is controlled and regulated by a parking meter(s). "Parking Space" "Parking Space" "Parking Space" "Parking Space" means that part of the surface of the roadway, the use of which is designated for the purpose of vehicle parking. "Passenger Passenger Passenger Passenger Transportation Service Transportation Service Transportation Service Transportation Service" The same meaning as in the Passenger Transportation Act. Consolidated Bylaw No. 6056, 1993 Page 4 Last Updated: December 10, 2019 Document Number: 529302 "Physically Disabled "Physically Disabled "Physically Disabled "Physically Disabled Placard" Placard" Placard" Placard" means a valid numbered placard, that: a) is issued by the Social Planning And Research Council Association of British Columbia (SPARC), b) bears the international wheelchair symbol for the physically disabled, and c) is displayed on the motor vehicle by hanging on the vehicle's rear=view mirror or by being placed face=up on the dash board on the passenger side of the vehicle. "Physically Disabled "Physically Disabled "Physically Disabled "Physically Disabled Person" Person" Person" Person" means a person who suffers from a permanent or temporary disability rendering it difficult or burdensome to walk. "Police Office "Police Office "Police Office "Police Officer"r"r"r" means a member of the Royal Canadian Mounted Police. "Police Vehicle" "Police Vehicle" "Police Vehicle" "Police Vehicle" means a vehicle owned or operated by the Royal Canadian Mounted Police. "Property Line" "Property Line" "Property Line" "Property Line" means the legal boundary between a highway and the parcels of land abutting thereon. "Pub "Pub "Pub "Public Parking Area" lic Parking Area" lic Parking Area" lic Parking Area" means an open area, structure, private place or passageway to which the public, for the purpose of the parking or servicing of vehicles, has access or is invited. "Residential Permit" "Residential Permit" "Residential Permit" "Residential Permit" A permit issued under the provisions of Schedule "I" attached to and forming part of this Bylaw. BL9081 L9081 L9081 L9081 "Roadway" "Roadway" "Roadway" "Roadway" means the portion of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder; and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of them collectively. "School Bus" "School Bus" "School Bus" "School Bus" means a motor vehicle used to convey children to or from school by or under a contract with the authority in charge of the school. "Shoulder" "Shoulder" "Shoulder" "Shoulder" means that part of the highway immediately adjacent to the travelled portion of the roadway and having a surface which has been improved for the use of vehicles with asphalt, concrete or gravel. "Sidewalk" "Sidewalk" "Sidewalk" "Sidewalk" means the area between the curb lines or lateral lines of a Consolidated Bylaw No. 6056, 1993 Page 5 Last Updated: December 10, 2019 Document Number: 529302 roadway and the adjacent property lines improved for use of pedestrians. "Sign" "Sign" "Sign" "Sign" means any sign or roadway, curb or sidewalk marking or other device placed or erected on a highway under the authority of this Bylaw for the purpose of regulating, warning or informing traffic. "Special Parking Special Parking Special Parking Special Parking Permit Permit Permit Permit" Means a permit issued under the provisions set out in Schedule "H" of this Bylaw. BL9081 BL9081 BL9081 BL9081 "Stop" or "Stand" "Stop" or "Stand" "Stop" or "Stand" "Stop" or "Stand" means: a) when required, a complete cessation from movement; and b) when prohibited, the stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or to comply with the directions of a peace officer or traffic control device. "Taxi" "Taxi" "Taxi" "Taxi" means a motor vehicle designed to carry not more than 10 persons that, with its driver, is operated for hire. "Tow Car" "Tow Car" "Tow Car" "Tow Car" means a motor vehicle used exclusively for towing or rendering assistance to other motor vehicles or to vehicles suffering from a defect or disability in their means of locomotion. "Traffic" Traffic" Traffic" Traffic" includes pedestrians, ridden or herded animals, vehicles, cycles and other conveyances, either singly or together, while using a highway to travel. "Traffic Control Device" "Traffic Control Device" "Traffic Control Device" "Traffic Control Device" means a sign, signal, line, meter, marking, space, barrier or any other device erected or placed under the authority of this Bylaw for the purpose of warning, regulating, guiding or directing traffic. "Traffic Control Signal" "Traffic Control Signal" "Traffic Control Signal" "Traffic Control Signal" means a traffic control device, whether manually, electrically or mechanically operated, by which traffic is directed to stop and to proceed. "Traffic, One "Traffic, One "Traffic, One "Traffic, One=way" way" way" way" means movement by vehicles upon a highway in one direction only. "Trailer" "Trailer" "Trailer" "Trailer" means a vehicle that is at any time drawn on a highway by a motor vehicle, except a) an implement of husbandry; b) a side car attached to a motorcycle; and Consolidated Bylaw No. 6056, 1993 Page 6 Last Updated: December 10, 2019 Document Number: 529302 c) a disabled motor vehicle that is towed by a tow car; and includes a semi=trailer as defined in the "Commercial Transport Act". "U "U "U "U=turn" turn" turn" turn" means the turning of a vehicle within the highway so as to proceed in the opposite direction to that in which the vehicle was travelling immediately prior to making the turn. "Vehicle" "Vehicle" "Vehicle" "Vehicle" means a device in, on or by which a person or thing is or may be transported or drawn on a highway, except a device designed to be moved by human power or used exclusively on stationary rails or tracks. "Vehicle for Hire Vehicle for Hire Vehicle for Hire Vehicle for Hire" means a Taxi service, Limousine service, Shuttle service, Transportation Network Service or other vehicle that is regulated by the Passenger Transportation Board. If the Director, Public Works or the Manager, Regulatory Services is of the opinion that for some temporary period to ensure the safety of the public, the proper movement of traffic, the parking of vehicles, or the proper and safe performance of some vital function of the Municipality, special regulations are required for the parking or stopping of vehicles on a highway under the jurisdiction of the Municipality, such person is authorized to make special regulations to prohibit or regulate the parking or stopping of vehicles on such highway during such times and days as such person deems proper and necessary and such person shall erect signs or otherwise give reasonable notice to indicate such special regulations. No person shall operate a vehicle on a highway at a greater speed than 30 km/h when approaching or passing, between dawn and dusk, a public playground for children where signs are erected. Subject to section 50, the driver of a vehicle shall yield the right of way to a pedestrian where traffic control signals are not in place or not in operation when the pedestrian is crossing the highway in a crosswalk and the pedestrian is on the half of the highway on which the vehicle is traveling, or is approaching so closely from the other half of the highway that he is in danger. 2. A pedestrian shall not leave a curb or other place of safety and walk or run into the path of a vehicle that is so close it is impracticable for the driver to yield the right of way. 3. Where a vehicle is slowing down or stopped at a crosswalk or at an intersection to permit a pedestrian to cross the highway, the driver of a vehicle approaching from the rear shall not overtake and pass the vehicle which is slowing down or stopped. 49. 49. 49. 49. Where there is a sidewalk that is reasonably passable on either or both sides of a highway, a pedestrian shall not walk on a roadway. In addition to the duties imposed by this section, a person operating a cycle on a highway has the same rights and duties as a driver of a vehicle. 2. A person operating a cycle: a) shall not ride on a sidewalk unless authorized by a bylaw or unless otherwise directed by a sign; b) shall not, for the purpose of crossing a highway, ride on a crosswalk unless authorized to do so by a bylaw or unless otherwise directed by a sign; c) shall, subject to paragraph a), ride as near as practicable to the right side of the roadway; d) shall not ride abreast of another person operating a cycle on the roadway; e) shall keep at least one hand on the handlebars; f) shall not ride other than on or astride a regular seat of the cycle; g) shall not use the cycle to carry more persons at one time than the number for which it is designed and equipped; and h) shall not ride a cycle on a highway where signs prohibit their use. 3. A person operating a cycle shall not ride it on a roadway if there is a usable path intended for the use of cycles adjacent to the roadway. 4. A person shall not ride a cycle, coaster, roller skates, sled or play vehicle when it is attached by the arm and hand of the rider or otherwise to a vehicle on a highway. 5. Eligibilit Eligibilit Eligibilit Eligibility a) A valid numbered physically disabled placard issued by the Social Planning and Research Council Association (S.P.A.R.C.) of British Columbia is recognized for the purposes of this bylaw as an authorized parking permit when used only by the physically disabled person to which it was issued. b) A permit or identification marker issued to a physically disabled person or to a person in respect of a motor vehicle by another jurisdiction shall be deemed to be a permit issued under this Bylaw provided that the permit or identification marker displays the following information: i) the international wheelchair symbol, ii) a serial number, iii) the name or unique identification number of the person to whom the permit was issued, iv) the issuing jurisdiction's name, and v) an authorizing signature, original or mechanically reproduced, or name of an official representing the issuing jurisdiction. c) A physically disabled license plate shall be deemed to be a physically disabled permit for the purposes of this bylaw. 2. 2. 2. 2. Regulation of Use Regulation of Use Regulation of Use Regulation of Use a) A Senior Citizen Parking Permit shall be affixed to the upper center on the inside of the front windshield below the rear view mirror. b) A vehicle bearing a currently valid Senior Citizen Parking Permit may park at a parking meter space free of charge up to the maximum time permitted by such meter subject to subsection c). c) A Senior Citizen Parking Permit is valid only when either the person to whom it was issued is operating the vehicle to which the permit is affixed or the person to whom it was issued is a passenger in the vehicle to which the permit is affixed. d) No person shall move a vehicle with a Senior Citizen Parking Permit affixed to it from one location to another in the same block to avoid the time limit regulations specified on the parking meters in that particular block. e) Damaged Senior Citizen Parking Permits may be replaced, upon payment of a replacement fee as set out in Schedule "C=2(b)" of the "City of Prince George Comprehensive Fees and Charges Bylaw No. 7557, 2004", providing the damaged portion of the permit is returned to the City. The public parking area owner is responsible for: BL6954 BL6954 BL6954 BL6954 a) The procurement, installation and maintenance of the authorized signs referred to in Section 62; b) Ensuring that the authorized signs are located so as to be seen by a person driving a vehicle; c) Ensuring that the authorized signs have a glare=free surface; and d) Ensuring that the authorized signs for parking spaces are 1.5 m above the ground measured to the bottom of the sign, and located as near to the front edge and centre of the designated parking stall as reasonably possible. 3. Subject to Section 60, no person shall park or leave a motor vehicle in a public parking area in a parking space reserved for physically disabled persons and identified by authorized signs as prescribed by Section 63(1) of this Bylaw, unless a valid physically disabled placard is displayed upon the rear view mirror or the dashboard of the motor vehicle. 2. The provisions respecting the placement of a valid physically disabled permit referred to in subsection (1) hereof shall be deemed to be satisfied if a valid physically disabled permit is placed on the dashboard of the motor vehicle at the request of a Police Officer, Bylaw Enforcement Officer, Parking Control Officer or a public parking area owner or operator. 3. Public parking area owners shall not authorize any person, other than a physically disabled person or a person conveying a physically disabled person, to park a motor vehicle in any space reserved for physically disabled persons and identified by authorized signs as prescribed by Section 63(1) of this Bylaw. With respect to enforcement by means of ticket under the Community Charter, the fines in Schedule "A" attached to and forming part of this Bylaw shall apply. a) Pursuant to section 264(1) of the Community Charter, the Bylaw section number appearing in Column 1 of Schedule "A" to this Bylaw designate the offence committed under the Bylaw and Column 2 opposite the section number indicates the respective words or expression. b) Pursuant to section 265(1)(a) of the Community Charter, the fine amount in Column 3 of Schedule "A" to this Bylaw is the fine amount that corresponds to the section number and words or expression set out in Columns 1 and 2 opposite the fine amount. c) Council delegates its duty to refer any disputed tickets to the Provincial Court for a hearing to a Bylaw Enforcement Officer and to the RCMP. (For example if there will only be 3 volunteers parking in the downtown at any given time, only 3 will be issued to the organization even if they may have 20 volunteers.) 5) The following are the conditions for their use: a) They are for volunteer use only and not for the use of paid employees. b) Permits are only required Monday to Friday 7 AM to 5 PM c) Permits are to be hung from the rear view mirror only while performing volunteer duties only d) Volunteer permits are for on=street parking only and are not valid in any off=street lot. e) Any misuse of the permits may result in the Organization having their permits cancelled. 6) Permits will expire 1 year from the date of issue and must be renewed by the Organization following the steps in 4). SCHEDULE "I SCHEDULE "I SCHEDULE "I SCHEDULE "I" Residential Residential Residential Residential & Visitor & Visitor & Visitor & Visitor Parking Permits Parking Permits Parking Permits Parking Permits Residents of property Zoned RS, RT, RM in areas identified as having a heavy and chronic demand for on=street parking by persons not residing in the area and have a posted time limit on parking on the street adjacent the property they reside may apply for a Residential Parking Permit. 1) There will be a limit of two (2) permits for each dwelling unit. 2) In order to obtain a Residential Parking Permit, the applicant will be required to provide a minimum of two (2) pieces of documentation that proves residency. 3) The primary piece of documentation is a vehicle registration document. This is sufficient to prove vehicle ownership; however, an additional piece of documentation is required to confirm the applicants address. 4) The following is a list of acceptable pieces of documentation to show proof of residency: a) driver's license showing the permit address; b) phone, utility, or cable TV bill; c) property tax receipt; d) bank, or credit card statement; e) tenancy agreement; f) vehicle insurance/registration document (showing the permit location as the current (address); or g) a change of address registered with the post office. 5) In instances where the applicant is not the registered owner of the vehicle or the vehicle is not registered to the permit address (i.e. company vehicle or student here temporarily), the applicant must provide proof of residency at the permit address. 6) Applicants residing in a Non=Permitted Secondary Suite, or a location not zoned RS, RT, RM will not be able to obtain a Residential Parking Permit. 7) All documentation is subject to verification by Bylaw Services. 8) To obtain a Residential Permit, the applicant must complete the Residential Parking Permit Application and return it along with the required documentation to Bylaw Services via one of the following options: Mail: Bylaw Services, 1100 Patricia Blvd, Prince George BC V2L 3V9 Fax#: 250=561=7745 Email: [email protected] BL9081 BL9081 BL9081 BL9081 Consolidated Bylaw No. 6056, 1993 Page 41 Last Updated: December 10, 2019 Document Number: 529302 Visitor Permits Visitor Permits Visitor Permits Visitor Permits: 1) Visitor (Temporary) Permits may be issued upon request by a resident of a residential property that is within an area where a parking restriction in a residential area has been implemented. 2) These permits are for the exclusive use of visitors to the residence. 3) These permits may not be utilized on a vehicle registered to the resident or permit holder or any vehicle registered to an address within the zone the permit is valid within. 4) In order to obtain a Visitor Permit a resident of the dwelling must call Bylaw Services at 250=561= 7622 to make application and supply the following information: a) Residents full name, address and email; b) Primary phone number; c) Secondary phone number; d) Vehicle license plate; e) Visitors Name; and f) Visitors Address. Renewal Renewal Renewal Renewal: 1) Residential Permits valid for a period of one year from the date of approval. 2) Residents are responsible for re=applying for their Residential Parking Permit before the Permit expires. 3) Residents can re=apply for a Residential Permit at Bylaw Services. 4) Re=application procedure is the same as the initial application for a permit, where the applicant has to provide proof of residency and vehicle ownership. 5) Visitor Permits are valid for only one week at a time. For stays longer than one week, application will have to be made again by contacting Bylaw Services.
