BYLAW NO. 8348, 2011
Amending
Bylaws
A Bylaw of the City of Prince George regulating parking and traffic on and in off-street
parking facilities operated by the City of Prince George.
WHEREAS the City owns or otherwise holds certain real property for the purpose of
providing off-street parking;
AND WHEREAS the Council of the City of Prince George deems it expedient to provide
for the regulation of parking and traffic on such real property, hereinafter described as
an Off-Street Parking Facility;
NOW THEREFORE, Council of the City of Prince George, in open meeting assembled,

Schedule "A" - Off-Street Parking Facilities
DEFINITIONS AND INTERPRETATION
1. Definitions
In this Bylaw:
(a) "Authorized Person" means the individual who is the Director of the Public
Safety and Civic Facilities of the City, or a person designated in writing by the
Director of the Public Safety and Civic Facilities to carry out any act or function
under this Bylaw;
(b) "Bylaw Enforcement Officer" means an officer or employee of the City who has
responsibility for inspection and enforcement related to bylaw compliance;
(c) "City" means the City of Prince George;
(d) "Council" means the Council of the City of Prince George;
(e) "Manager of Bylaw Services" means the individual who is the Manager of the
Bylaw Services of the City;
(f) "Motor Vehicle" means a Vehicle, not run on rails, that is designed to be self
propelled;
(g) "Off-Street Parking Facility" means any real property owned, leased, possessed
or otherwise held by the City from time to time, for the purpose of providing off-
street parking and designated as an Off-Street Parking Facility in Schedule "B"
attached to and forming part of this Bylaw;
(h) "Park" when prohibited, means the standing of a Vehicle, whether occupied or
not, except when standing temporarily for the purpose of and while actually
engaged in loading or unloading;
(i) "Parking Control Officer" means a person(s) employed by the City as a Parking
Control Officer;

(j) "Parking Offence Notice" means a parking offence notice issued under section
28 of this Bylaw;

(k) "Parking Space" means that part of the surface of the Off-Street Parking
Facility, the use of which is designated for the purpose of Vehicle parking;
(l) "Person" means any natural person, corporation, partnership, firm or
association and for the purpose of this Bylaw shall include the registered
owner of a Motor Vehicle;
(m) "Physically Disabled Parking Space" means a Physically Disabled Parking
Space established under section 16;
(n) "Physically Disabled Placard" means a valid numbered placard, that:
(a) is issued by the Social Planning And Research Council Association
of British Columbia (SPARC);
(b) bears the international wheelchair symbol for the physically
disabled; and
(c) is displayed on the Motor Vehicle by hanging on the Vehicle's rear-
view mirror or by being placed face-up on the dash board on the
passenger side of the Vehicle;
(o) "Physically Disabled Passenger Vehicle" means a Motor Vehicle that is
displaying a currently valid Physically Disabled Placard;
(p) "Physically Disabled Person" means a Person who suffers from a permanent or
temporary disability rendering it difficult or burdensome to walk;
(q) "Sign" means any sign or surface, curb or sidewalk marking or other device
placed or erected on or in an Off-Street Parking Facility under the authority of
this Bylaw for the purpose of regulating, warning or informing Traffic;
(r) "Stop" or "Stand" means:
(a) when required, a complete cessation from movement; and
(b) when prohibited, the stopping or standing of a Vehicle, whether
occupied or not, except when necessary to avoid conflict with other
Traffic or to comply with the directions of a peace officer or Traffic
Control Device;
(s) "Ticket Dispensing Machine" means a device which accepts payment via coin,
cash, credit card or debit card and disburses parking permits for use in an Off-
Street Parking Facility;
(t) "Traffic" includes pedestrians, ridden or herded animals, Vehicles, cycles and
other conveyances, either singly or together, while using a manoeuvring lane to
travel within an Off-Street Parking Facility;
(u) "Traffic Control Device" means a sign, signal, line, meter, marking, space,
barrier or any other device erected or placed under the authority of this Bylaw
for the purpose of warning, regulating, guiding or directing Traffic;
(v) "Traffic Control Signal" means a Traffic Control Device, whether manually,
electrically or mechanically operated, by which Traffic is directed to Stop and to
proceed;

(w) "Trailer" means a Vehicle that is at any time drawn on a highway by a Motor
Vehicle, except:
(a) an implement of husbandry;
(b) a side car attached to a motorcycle; and
(c) a disabled Motor Vehicle that is towed by a tow car; and includes a
semi-trailer as defined in the Commercial Transport Act; and
(x) "Vehicle" means a device in, on or by which a Person or thing is or may be
transported or drawn on a highway, except a device designed to be moved by
human power or used exclusively on stationary rails or tracks.
2. Interpretation
2.1
General
In this Bylaw:
(a) words importing the singular number or the masculine gender only, include
more Persons, parties or things of the same kind than one and females as
well as males and the converse;
(b) a word interpreted in the singular number has a corresponding meaning
when used in the plural;
(c) "may" shall be construed as permissive; and
(d) "shall" shall be construed as imperative.
2.2
Interpretation of Distances
Where a distance is used in this Bylaw as part of a prohibition of parking or
stopping within a specified distance of an object, structure, land or a part of an
Off-Street Parking Facility, such distance shall be measured:
(a) along the curb or edge of the surface from a point in such curb or edge of
surface opposite such object, structure, land or part of an Off-Street
Parking Facility, unless the context otherwise requires; and
(b) from such object, structure, land, or part of an Off-Street Parking Facility in
all directions.
2.3
Cumulative Effect
The various prohibitions of this Bylaw are cumulative and not mutually self-
exclusive.
2.4 Severability
If any section, subsection, sentence, clause or phrase of this Bylaw is for any
reason held to be invalid by the decision of any Court of competent jurisdiction,
the invalid portion shall be severed and the decision that it is invalid shall not
affect the validity of the remainder.

II - REGULATION OF PARKING AND TRAFFIC
REGULATIONS - SPECIAL CIRCUMSTANCES
3. Parking Prohibited - Special Circumstances
3.1
If the Authorized Person or the Manager of Bylaw Services is of the opinion that
for some temporary period to ensure the safety of the public, the proper
movement of Traffic, the parking of Vehicles, or the proper and safe
performance of some vital function of the City, special regulations are required
for the parking or stopping of Vehicles on or in an Off-Street Parking Facility,
such person is authorized to make special regulations to prohibit or regulate the
parking or stopping of Vehicles on or in such facility during such times and days
as such person deems proper and necessary and such person shall erect Signs
or otherwise give reasonable notice to indicate such special regulations.
3.2
Every Person shall obey the instructions or directions on any Sign erected
pursuant to subsection 3.1 and such Sign is deemed to have been erected
pursuant to the section of this Bylaw that normally regulates or prohibits the
matter, and those provisions apply to any act or failure to act contrary to the
special regulations made pursuant to subsection 3.1.
PARKING AND STOPPING
4. Pavement Markings/Parking Space
If a Parking Space is designated by lines or other markings on the surface, or
otherwise, no Person shall Stop, Stand or Park a Vehicle or permit a Vehicle to
remain parked or standing therein except entirely within the area so designated
as a Parking Space. No Person shall Park a Vehicle or permit a Vehicle to
remain parked in a landscaped area on or in an Off-Street Parking Facility.
5.
Parking Prohibited With Signs
No Person shall Park a Vehicle or permit a Vehicle to remain parked within an
area on or in an Off-Street Parking Facility that is indicated by a Sign to be a "no
parking" area.
6.
Stopping Prohibited With Signs
No Person shall Stop a Vehicle or permit a Vehicle to remain stopped on or in an
Off-Street Parking Facility contrary to a Sign, except the stopping of a Motor
Vehicle for the purpose of and while actually engaged in receiving or discharging
a Physically Disabled Person provided that such Motor Vehicle has a valid
Physically Disabled Placard displayed.
7.
Specified Parking Limit
No Person shall Park a Vehicle or permit a Vehicle to remain parked on or in an
Off-Street Parking Facility for a longer period of time than is displayed on a Sign.

8.
Fire Lanes
No Person shall Stop a Vehicle or permit a Vehicle to remain stopped in an area
designated by a Sign as a fire lane.
PARKING METERS & TICKET DISPENSING MACHINES
9.
Designation
For the purpose of regulating parking in an Off-Street Parking Facility, the
Authorized Person may erect and operate, or cause to be erected and operated,
parking meters, Ticket Dispensing Machines, Signs and any other Traffic Control
Devices which the Authorized Person may deem necessary in the Off-Street
Parking Facility.
10.
Rate of Charge
Notwithstanding any other provisions of this Bylaw, no Person shall Park a
Vehicle or permit a Vehicle to remain parked in a Parking Space on or in any Off-
Street Parking Facility unless the fee is paid in accordance with the rate per
hour or monthly fee as set out in the "City of Prince George Comprehensive Fees
and Charges Bylaw No. 7557, 2004", as amended from time to time.
11.
Valid Permit Required
No Person shall Park a Vehicle or permit a Vehicle to remain parked on or in any
Off-Street Parking Facility unless a valid parking permit is displayed on the
dashboard or rear view mirror of the Vehicle with the date, time and permit
number clearly visible. No Person shall Park a Vehicle or permit a Vehicle to
remain parked on or in any Off-Street Parking Facility for a period of time in
excess of the length of time indicated on the parking permit.
12.
Reserved Parking Space
No Person shall Park a Vehicle or permit a Vehicle to remain parked in a
reserved Parking Space other than the Person designated by the City to Park in
such reserved Parking Space.
13.
Vehicle to be Within One or More Spaces
No Person shall Park a Vehicle or permit a Vehicle to remain parked in such a
manner that it is not wholly within the area designated as a Parking Space
unless the Vehicle is of such length as to render it impossible to Park it in one
(1) Parking Space, in which case the adjoining Parking Space or spaces may, in
addition, be used if the required fee is paid for each Parking Space used in
whole or in part by the Vehicle.
14.
Acceptable Coins and Cash
No Person shall deposit or cause to be deposited in any Ticket Dispensing
Machine:

(a) any slug, device or other substitute for a Canadian coin;
(b) any coin, except a Canadian coin, or a token approved by the City, which the
Ticket Dispensing Machine is designed to accommodate; or
(c) any printed currency, except printed currency issued by the Government of
Canada for use as legal tender.
15.
Damage to Ticket Dispensing Machine - Offence
No Person shall damage, deface, injure, tamper with, break or destroy any
Ticket Dispensing Machine or part thereof or otherwise impair its full
usefulness.
DESIGNATED PARKING ZONES
16.
Physically Disabled Parking Spaces
16.1
Designation
The Authorized Person is hereby authorized to establish Physically Disabled
Parking Spaces on or in Off-Street Parking Facilities for the use of Physically
Disabled Persons.
16.2
Regulation of Use
If a Sign designates Physically Disabled Parking Spaces on or in an Off-Street
Parking Facility No Person shall Park or permit a Vehicle to remain parked,
other than a Handi-Dart Vehicle, in a Physically Disabled Parking Space unless
a valid Physically Disabled Placard is displayed upon the rear view mirror or the
dashboard of the Vehicle and that the Person to whom the Physically Disabled
Placard was issued to is either operating the Vehicle or being transported in
such Vehicle.
TRAFFIC MOVEMENTS
17.
Prohibited Movements
No Person shall cause a Vehicle to be driven or otherwise moved in any
manoeuvring aisle, or other part of an Off-Street Parking Facility, contrary to a
Sign.
18.
Obstruction
No Person shall Park a Vehicle or permit a Vehicle to remain parked in an Off-
Street Parking Facility if such Vehicle is obstructing the flow of Traffic or
obstructing another Vehicle from accessing or leaving a Parking Space or the
Off-Street Parking Facility.
SIGNS
19.
Erection of Signs, Traffic Signals, Etc.

The Authorized Person is hereby authorized and directed to erect and maintain
such Signs, Traffic Control Signals, markings, barricades, Traffic Control
Devices and other structures, and equipment as are required to give effect to
this Bylaw and as are required to regulate, direct, warn or inform Traffic for the
safety and convenience of the public.
20.
Defacing Signs and Traffic Signals
No Person shall move, remove, deface or in any manner interfere with any
Sign, Traffic Control Signal, marking or other Traffic Control Device placed,
erected or maintained under this Bylaw.
21.
Freshly Painted Lines on Parking Surface
No Person shall drive any Vehicle over any marking on a parking surface where
a Traffic Control Device is in place to indicate that the marking material has
been freshly applied, nor shall any Person drive into or over or otherwise move
or remove any Traffic Control Device so placed.
DERELICT VEHICLES
22.
Derelict or Unlicensed/Uninsured Vehicles
No Person shall Park a Vehicle or permit a Vehicle to remain parked in an Off-
Street Parking Facility if such Vehicle:
(a) is damaged, partially damaged or otherwise in such a condition that it
could be considered un-roadworthy; or
(b) is not displaying a current valid Vehicle licence plate and insurance.
23.
Vehicles Leaking Fluid
No Person shall Park a Vehicle or permit a Vehicle to remain parked on or in an
Off-Street Parking Facility if such Vehicle is leaking fluid from the Vehicle's
mechanical system.
24. Vehicle Repairs
(a) No Person shall Park a Vehicle or Trailer on or in an Off-Street Parking
Facility for the purposes of repairing a Vehicle or Trailer;
(b) No Person shall repair a Vehicle or Trailer on or in an Off-Street Parking
Facility;
(c) A Vehicle or Trailer in need of repair shall be immediately removed from the
Off-Street Parking Facility by the registered owner or their authorized agent.
25. Third Party Business Activity
Unless written permission is first obtained from the Authorized Person, no Person
shall Park a Vehicle or Trailer on or in an Off-Street Parking Facility:

(a) for the purposes of displaying such Vehicle or Trailer for sale;
(b) for the purposes of displaying signs; or
(c) for the purposes of selling commodities or food from the Vehicle or Trailer.
PERMIT PARKING
26. Parking Permits
The Authorized Person may issue Permits for hourly and monthly parking in each Off-
Street Parking Facility.
OFFENCES AND PENALTIES
27. Penalties
27.1 Subject to Summary Conviction
Every offence created under this Bylaw relating to unlawful parking, standing or
stopping of a Vehicle is punishable on summary conviction pursuant to the
provisions of the Offence Act, as amended from time to time.

27.2 Offences
a. This Bylaw may be enforced,
i. by an Information laid in accordance with the Offence Act;
ii. by means of a ticket under the Community Charter;
iii. by Bylaw Notice in accordance with the "Local Government Bylaw Notice
Enforcement Act"; or
iv. by a combination of the above noted methods in (i), (ii) and (iii).
b. With respect to enforcement further to a Bylaw Notice issued pursuant to the Local
Government Bylaw Notice of Enforcement Act, the fines outlined in Schedule "B" of
the "City of Prince George Bylaw Notice Enforcement Bylaw No. 8813, 2016", as
amended or replaced from time to time, shall apply.
c. Every person who contravenes a provision of the Bylaw for which a penalty to which
information laid in accordance with the Offence Act, shall be liable on summary
conviction to a fine not exceeding $10,000 and costs of prosecution.
d. The minimum fine for any other offence is the fine outlined in Column A1 of
Schedule "B" of the "City of Prince George Bylaw Notice Enforcement Bylaw No.
8813, 2016" shall apply.
27.3 Offences Punishable by the Motor Vehicle Act
Any Person who contravenes any section of this Bylaw for which a penalty is
provided by the Motor Vehicle Act is guilty of an offence and on conviction is
subject to the penalties provided therefor in the Motor Vehicle Act.

27.4 Successive Offences
If a person has Parked a Vehicle in a Parking Space in violation of the
provisions of this Bylaw, a separate offence shall be deemed to be committed
upon the expiry of each period of time during which the Vehicle could have
been lawfully parked as indicated by a Sign or other Traffic Control Device,
including a Ticket Dispensing Machine

28. Parking Offence Notice
A Bylaw Enforcement Officer, Parking Control Officer, or a member of the Royal
Canadian Mounted Police, upon observing a Motor Vehicle apparently parked,
standing, or stopped in contravention of this Bylaw, may issue or cause to be
issued a Parking Offence Notice levying penalties as set out in Schedule "B" of the
"City of Prince George Bylaw Notice Enforcement Bylaw No. 8813, 2016" as
amended or replaced from time to time. The Parking Offence Notice is to be left
on the Motor Vehicle which is parked, standing or stopped in contravention of this
Bylaw, and the leaving of the Parking Offence Notice shall be deemed to be
personal service of the Parking Offence Notice upon the owner or operator of
such Motor Vehicle.

29. Removal of Parking Offence Notice or Chalk Mark
29.1 No Person other than the owner or operator of a Vehicle shall remove any
notice, including without limitation any Parking Offence Notice, placed
thereon or affixed thereto by a Bylaw Enforcement Officer, Parking Control
Officer or member of the Royal Canadian Mounted Police in the course of
enforcing this Bylaw.
29.2 No Person shall remove, alter, deface, cover up or damage any mark
made by chalk on a tire or tires of a Vehicle by a Bylaw Enforcement
Officer, Parking Control Officer or member of the Royal Canadian Mounted
Police in the course of enforcing this Bylaw.

30. Voluntary Payment of Parking Penalties
30.1 Any Person, upon presentation of a Parking Offence Notice alleging a
violation of this Bylaw, at the office listed on the said Parking Offence
Notice, may pay out of court within thirty (30) days from the date of issue
of the said Parking Offence Notice, the specific penalty provided for such
an offence in Schedule "B" of the "City of Prince George Bylaw Notice
Enforcement Bylaw No. 8813, 2016", as amended or replaced from time
to time. of this Bylaw at the office listed on the Parking Offence Notice.
Upon such payment, no further proceedings shall be taken under this
Bylaw in respect of the said offence alleged on the Parking Offence Notice.

30.2 Any Person who is issued a Parking Offence Notice for an alleged violation
of this Bylaw because a valid Physically Disabled Placard was not
displayed, and who within twenty-one (21) days from the date of issue of
the said Parking Offence Notice obtains a Physically Disabled Placard,

upon presentation of the Parking Offence Notice and the Physically
Disabled Placard at the Bylaw Services division at City Hall shall not be
required to pay the penalty for the alleged violation of the provisions of the
said sections, and upon such presentation no further proceedings shall be
taken under this Bylaw in respect of the said offence alleged on the
Parking Offence Notice.

31. Failure to Pay the Parking Offence Notice
If under this Bylaw a specific fine or penalty is established and such fine or
penalty is not paid out of court, then upon the expiration of the voluntary payment
period, legal proceedings may be commenced against the registered owner of the
Vehicle. After the commencement of legal proceedings, the registered owner may
pay out of court up to twenty-four (24) hours prior to the scheduled court
appearance, the amount shown in Schedule "B" of the "City of Prince George
Bylaw Notice Enforcement Bylaw No. 8813, 2016", as amended or replaced from
time to time. Upon payment, no further proceedings shall be taken under this

32. Vehicles Subject to Removal When Illegally Parked

32.1 In addition to any other penalties provided by this Bylaw, upon discovery of any
vehicle parked, stopped or standing in any Off-Street Parking Facility in
contravention of the provisions of this Bylaw, a member of the Royal Canadian
Mounted Police, Parking Control Officer, Bylaw Enforcement Officer or the
Authorized Person may cause such vehicle to be moved or taken to and placed
or stored in a suitable place and all costs, including the Administrative Towing
Costs provided in Schedule "C-2(d)" of the "City of Prince George Comprehensive
Fees and Charges Bylaw No. 7557, 2004", and charges for the removing, care
and storage thereof, if any, are a lien upon the vehicle being released.
32.2 Upon discovery of any abandoned or unlicensed Vehicle on or in an Off-Street
Parking Facility with an apparent market value of less than $1,000.00, a
member of the Royal Canadian Mounted Police, Parking Control Officer, Bylaw
Enforcement Officer or the Authorized Person may cause such Vehicle to be
removed and disposed of by the City of Prince George at the expense of the
owner of the Vehicle.
APPLICATION AND ADMINISTRATION
33. Enforcement
This Bylaw may be enforced by a member of the Royal Canadian Mounted Police,
a Bylaw Enforcement Officer or a Parking Control Officer.
34. Application of Bylaw
This Bylaw applies to each and every Off-Street Parking Facility.
35. Bylaw Subject to the Motor Vehicle Act

This Bylaw is subject to the provisions of the Motor Vehicle Act.
36. Schedules Adopted
The Schedules referred to in this Bylaw shall form part of this Bylaw and each
entry in a column of such a Schedule shall be read in conjunction with the entry
or entries across therefrom, and not otherwise.
37. Repeal of Previous Bylaw
The "City of Prince George Off-Street Parking Rates Bylaw No. 5572, 1991", as
amended, is hereby repealed.
38. Citation
This Bylaw may be cited for all purposes as the "City of Prince George Off-Street
Parking Bylaw No. 8348, 2011".
