A bylaw to regulate traffic and the use of highways within the boundaries of the City of
Revelstoke

WHEREAS Council of the City of Revelstoke is authorized, pursuant to the provisions of the Motor
Vehicle Act and the Community Charter to regulate traffic, parking and the use of highways,
boulevards, sidewalks and public land within the City of Revelstoke.
NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open
meeting assembled ENACTS AS FOLLOWS:
1. THAT this Bylaw may be cited for all purposes as " Traffic and Highways Bylaw No. 2431".

2. DEFINITIONS
In this Bylaw:
Angle Parking means the Parking of a Vehicle other than parallel to a curb or the lateral
lines of the Roadway.
Arterial Highway means a Highway classified as an arterial highway pursuant to the
Transportation Act, SBC 2004, c 44.
Authorised Persons means the City Engineer, the Fire Chief, the Director, the RCIWP, a
Bylaw Enforcement Officer and other individuals designated by Council.
Boulevard means that portion of a Highway between the curb lines or the lateral lines of a
Roadway and the adjoining property or Roadway, and includes curbs, Sidewalks and
ditches.
Bus means a Hflotor Vehicle designed to carry more than 10 persons.
Bus Stop means a place where a Bus regularly stops, usually marked by a sign.
Business Licence means a licence to operate a business issued under the City's Business
Licensing & Regulation Bylaw No. 1503, as amended.
Bylaw Enforcement Officer means the person(s) appointed to the position of bylaw
compliance officer for the City.
Chattel means a moveable item of personal property and does not include wet or soiled
clothing/bedding, plastics, metals, perishable food, footwear, cardboard/paper, wooden items,
glass or personal hygiene items.
City means the municipality of the City of Revelstoke.
City Engineer means the person appointed to the position of a director responsible for the
function of engineering for the City, their deputy, or any person Council has designated to act
in their place.
Commercial Vehicle means a Vehicle which is a commercial vehicle defined as such and
licensed under the Commercial Transport Act, RSBC 1996, c 58, and any vehicle not so

licensed but which is used for the collection or delivery of merchandise, commodity, persons
or freight in the ordinary course of business or undertaking, with a Licenced GVW of five-
thousand, five hundred (5,500) kg or greater and includes a semi-truck or combination of
semi-truck and trailer but does not include an Emergency Vehicle, a Vehicle owned or
operated by the City or the School District while engaged in its lawful duties, or a Bus while
on a scheduled route.
Council means the municipal Council of the City.
Crosswalk means:
(a) any portion of the Roadway at an Intersection or elsewhere distinctly indicated for
Pedestrian crossing by signs or by lines or other markings on the surface; or
(b) the portion of a Highway at an Intersection that is included within the connection of
the lateral lines of the sidewalks on the opposite sides of the Highway, or within the
extension of the lateral lines of the Sidewalk on one side of the Highway, measured
from the curbs, or in the absence of curbs, from the edges of the Roadway.
Cycle means either of the following:
(a) a device on which a person may ride that meets all of the following criteria:
(i) the device has wheels and is only capable of being propelled by human power;
(ii) the device is not, and is not similar to, a wheelchair, a stroller, a skateboard, a
kick scooter, roller skates, in-line roller skates, skis or a sleigh;
(iii) the device is not a Designated Personal Mobility Device;
(b) a Motor Assisted Cycle;
Cycle Lane means a portion of a Highway that
(a) is designated for use of persons operating Cycles, either exclusively or alongside one
or more of the following:
(i) persons operating Designated Personal Mobility Device;
(ii) persons on skateboards, kick scooters, roller skates, in-line roller skates or other
devices that are only capable of being propelled by human power.
Designated Personal nflobility Device means an Electric Wheelchair or a Mobility
Scooter.
Director means a person appointed to the position of a Director responsible for the function
of public works for the City, their deputy, or any person Council has designated to act in their
place.
Driveway means that portion of land located on private property which has been improved to
provide Vehicular access to or from a property, starting from a point measured six (6) metres
from the property line onto the private property, and continuing to a building for which a
Permit has been issued.
Driveway Access means that portion of land which has been improved to provide Vehicular
access to or from a property, from a Highway between the curb or lateral lines of the

Roadway to the adjoining property line and inclusive of that portion of land on private
property measured from the property line up to and including 6 metres from the property line.
Electric Wheelchair means a wheelchair that:
(a) is designed and manufactured to transport persons who have limited mobility as a
result of a permanent or temporary disability that makes it impossible or difficult to
walk,
(b) has an electric motor that is not capable of propelling the device at a speed exceeding
twenty-five (25) kilometres per hour when the device is being operated on a clean,
paved and level surface, and
(c) meets the following criteria
(I) the device is designed to be solely self-propelled or self-propelled with the
capability to be propelled by human power;
(ii) the device is not a motor assisted cycle;
(iii) the device is designed to transport one person;
(iv) the device is not capable of exceeding the prescribed rate of speed;
(v) the device meets other prescribed criteria in the Motor Vehicle Act, RSBC 1996,
c 318, if any.
Emergency Vehicle means any of the following:
(a) a Motor Vehicle or Cycle carrying rescue or first aid equipment if there is an urgent
emergency justifying a rate of speed in excess of any maximum rate of speed
provided for in this Bylaw;
(b) a Motor Vehicle or Cycle driven by a member of a fire department in the discharge of
the member's duties;
(c) a Motor Vehicle or Cycle driven by a Peace Officer, constable or member of the
police branch of Her Majesty's Armed Forces in the discharge of the Peace Officer's,
constable's or member's duty;
(d) a motor vehicle driven by a sheriff, in the discharge of the sheriffs duties under the
Sheriff Act, RSBC 1996, c 425.
Encroachment means a building, structure, physical object, moveable item of personal
property, including without limitation, natural materials such as plants, soil and rocks
occupying a part of the surface or subsurface of a Highway or public place.
Extraordinary Traffic means the carriage of goods or persons over a Highway at one or
more times, in a Vehicle or by other means, that, in conjunction with the nature or existing
Highway condition in the opinion of the City Engineer or Operations Manager, substantially
alters or increases the burden imposed on the Highway to cause damage and expense in
respect of the Highway beyond what is reasonable or ordinary.
Fence means a structure used as an enclosure or for screening purposes.
Fire Chief means the person appointed to the position of Chief of the City's fire rescue
services, their deputy, or any person Council has designated to act in their place.

Highway means every:
(a) street, road, lane, bridge, viaduct and any other way open to public use, other than a
private right of way on private property, including a Pathway and Sidewalk; and
(b) Highway within the meaning of the Transportation Act.
Intersection means the area contained within the extension or connection of the lateral curb
lines, or if none, then the lateral boundary lines of the two Highways that join one another at,
or approximately at right angles, or the area within which Vehicles traveling on different
Highways joining at any other angle may come in conflict.
Lane means a Highway not exceeding eight (8) metres in width.
Licenced Gross Vehicle Weight or Licenced GVW means the Gross Vehicle Weight for
which a Commercial Vehicle is licensed under the Commercial Transport Act.
Government Vehicle means a vehicle operated by the City, the Province of British
Columbia, the Government of Canada or the RCMP.
Gross Vehicle Weight or GVW means the loaded weight of a single vehicle.
Idle or Idling means the operation of the engine of a nflotor Vehicle that is not in motion.
ICBC means the Insurance Corporation of British Columbia.
Median means the portion of a Highway constructed or painted to separate Traffic traveling
in one direction from Traffic traveling in the opposite direction and may include a physical
barrier or a raised or depressed paved or unpaved separation area that is not intended to
allow crossing Vehicular movement.
Mobile Equipment has the meaning prescribed to it in the Motor Vehicle Act.
Mobility Scooter means a scooter that
(a) is designed and manufactured to transport persons who have limited mobility as a
result of a permanent or temporary disability that makes it impossible or difficult to
walk,
(b) has an electric motor that is not capable of propelling the device at a speed exceeding
twenty-five (25) kilometres per hour when the device is being operated on a clean,
paved and level surface, and
(c) meets the following criteria
(i) the device is designed to be solely self-propelled or self-propelled with the
capability to be propelled by human power;
(ii) the device is not a motor assisted cycle;
(iii) the device is designed to transport one person;
(iv) the device is not capable of exceeding the prescribed rate of speed;
(v) the device meets other prescribed criteria in the Motor Vehicle Act, if any.
Hflotor Assisted Cycle, commonly referred to as e-bike or e-machine, has the meaning
prescribed to it in the Motor Assisted Cycle (E-Bike) Regulation, BC Reg 64/2024.

]| nflotor Vehicle means a Vehicle designed to be sel1Lpropelled but does not include Mobile
Equipment, a Motor Assisted Cycle or a Designated Personal Mobility Device.
Motorcycle means a motor vehicle that runs on 2 or 3 wheels and has a saddle or seat for
the driver to sit astride.
Multi-Use Pathway or MUP means a paved or unpaved portion of a Highway intended for
the mixed use of Pedestrians, cyclists and may be accessible for persons using a
Designated Personal Mobility Device.
Overload means the larger of the following:
(a) the number of kilograms resulting by subtracting from the GVW of a Commercial
Vehicle the Commercial Vehicle's Licensed GVW;
(b) the number of kilograms resulting by subtracting from the weight on any one axle or
combination of axles of a Commercial Vehicle the weight authorized by regulation
under the Commercial Transport Act to be carried on the axle or combination of axles.
Oversize means the amount resulting by subtracting from the outside width, height or overall
length of a Commercial Vehicle with its load, if any, the permissible outside width, height or
overall length prescribed under the Commercial Transport Act.
Owner includes Occupier and means:
(a) in respect of property, the registered Owner of an estate in fee simple, including the
tenant for life under a registered life estate, the registered holder of the last registered
agreement for sale or the holder or Occupier of property; and
(b) in respect to a Vehicle, a person who holds the legal title to the Vehicle, a person
who is a conditional purchaser and is entitled to be in possession of the Vehicle, or
the person in whose name the Vehicle is registered and includes a person in
possession of a Motor Vehicle under a contract by which they may become its
Owner on full compliance with the contract.
Panhandle means to beg for or, without consideration, ask for money, donations, goods or
other things of value whether by spoken, written or printed word or bodily gesture for oneself
or for any other person but does not include soliciting for charity.
Park includes Parking, and means the standing of a Vehicle, whether Occupied or not,
except when standing temporarily for the purpose of and while actually engaged in loading or
unloading.
Pathway means a portion of the Highway improved for sole use of Pedestrians or any other
improved area set aside for Pedestrian use.
Peace Officer means a member of the RCMP, a Bylaw Enforcement Officer, or another
person employed for the preservation and maintenance of public peace.

Pedestrian means the following persons:
(a) a person who is not
(i) in or on a Vehicle, Cycle or other device, unless the device is a device
described in paragraph (b) or (c), or
(ii) on an animal;
(b) a person who is in or on a device that
(i) is only capable of being propelled by human power, and
(ii) is, or is similar to, a wheelchair, a stroller, a skateboard, a kick scooter, roller
skates, in-line roller skates, skis or a sleigh;
(c) a person who is in or on a Designated Personal Mobility Device that is prescribed
for the purposes of this definition.
Permit means written or electronic approval granted by the City authorizing activities in
accordance with this Bylaw including the terms, conditions, plans and specifications set out in
such Permit.
Permit Holder means a person to whom a Permit has been issued.
RCMP means the Royal Canadian Mounted Police.
Recreational Vehicle includes a vehicle or combination of vehicles, motor home, or truck
and camper constructed or equipped for the principal purpose of habitation during travel or
recreation.
Right of Way means land or any interest in land acquired for the purpose of:
(a) public right of passage with or without vehicles;
(b) erecting and maintaining any pole-line;
(c) laying, placing, and maintaining drains, ditches, pipes, transmission lines, or wires for
the conveyance, transmission, or transportation of water, electric power,
communications, forest products, oil, or gas, or both oil and gas, or solids;
(d) the disposal of sanitary sewage, storm water or drainage;
(e) the operation and maintenance of the undertaking, and
(f) a Statutory Right of Way as defined in the Land Title Act, RSBC 1 996, c 250.
Roadway means the portion of the Highway that is improved, designed, or ordinarily used
for Vehicular Traffic, but does not include the shoulder; and where a Highway includes two
or more separate Roadways, the term Roadway refers to any one Roadway separately and
not to all the Roadways collectively.
Rubbish means waste or rejected matter including but not limited to litter, garbage, refuse
from places of human habitation, leaves, dirt, soil and debris from pruning or processing plant
material.

Sidewalk means the area between the curb-lines or lateral lines of a Roadway and the
adjacent property lines improved for use of Pedestrians or any other improved area set
aside for Pedestrian use.
Spare BC Parking Permit means a Parking Permit for persons with disabilities issued in
accordance with the Motor Vehicle Act Regulations, BC Reg 26/58, and the Social Planning
and Research Council of British Columbia (SPARC BC).
Stand or Standing means the halting of a vehicle, whether occupied or not and whether the
engine is running or not.
Stop Work Order means a notice signed by the City Engineer directing the immediate
suspension of all or a portion of work or construction.
Storage means a Vehicle that is left apparently unattended on a Highway, public space or
other public Right-of-Way for a period exceeding seventy-two (72) hours.
Structure means a construction of any kind whether fixed to, supported by or sunk into land
or water.
Taxi means a motor vehicle designed to carry not more than ten (10) persons that, with its
driver, is operated for hire.
Traffic includes Pedestrians, ridden or herded animals, Vehicles, Cycles and other
conveyances, either singly or together, while using a Highway for purposes of Standing or
travel.
Traffic Control Device means a sign, signal, line, meter, marking, space, barrier or device,
placed or erected by authority of
(a) the Province of British Columbia, or
(b) the City.
Traffic Control Signal means a Traffic Control Device, whether manually, electrically, or
mechanically operated by which Traffic is directed to stop and to proceed.
Trailer means a Vehicle that is at any time drawn on a Highway by a Motor Vehicle, except
(a) an implement of husbandry,
(b) a side car attached to a Motorcycle, and
(c) a disabled nflotor Vehicle that is towed by a tow car.
and includes a semi-trailer as defined in the Commercial Transport Act.
Traffic Control Person or TCP means any person who is a member of a class of persons
designated or assigned, in accordance with the Motor Vehicle Act or regulations, this Bylaw
or a resolution of Council, to direct Traffic and meets the qualifications and requirements set
out by WorkSafeBC.
Truck means any Vehicle or combination of Vehicles having a GVW in excess of eleven
thousand eight hundred (11,800) kilograms and designed or used primarily for the
transportation of property.

Truck Route means a route designated for Commercial Vehicle Traffic during specific
hours and days of the week.
Vehicle means a device in, upon, or by which a person or thing is or may be transported or
drawn upon a Highway, except a device designed to be moved by human power or used
exclusively upon stationary rails or tracks.
WorkSafeBC Clearance Letter means a letter from WorkSafe BC that confirms a business
is registered with WorkSafeBC and in good standing.
3.
AUTHORITY AND DELEGATION

The City Engineer is authorized to administer this Bylaw.
The City Engineer may:
(a) issue Permits and make orders to give effect to the provisions of this Bylaw and
rescind, revoke, amend or vary any Permit or order issued in accordance with
this Bylaw if such Permits or orders are not contrary or inconsistent with the
Motor Vehicle Act or other relevant legislation;
(b) order the permanent or temporary placement, replacement or alteration of
Traffic Control Devices for the regulation, prohibition or control of Traffic or
Parking to give effect to this Bylaw;
(c) order the alteration or removal of a Traffic Control Device, advertisement, or
guide-post that has been erected or maintained on or over any Highway by a
person other than the City or the Province of British Columbia;
(d) temporarily close a Highway, or restrict or divert Traffic as considered necessary
for safety or other situations deemed necessary;
(e) make orders for the designation and specification of accessible persons Parking
zones;
(f) impose conditions for the use of a Highway deemed necessary for the safety of
persons or property, including but not limited to:
(i) requiring qualified Traffic Control Persons or Traffic Control Devices be in
place;
requiring a pilot Vehicle escort;
(ii)
(iii) requiring a Vehicle operator to provide satisfactory confirmation of the
Vehicle's roadworthiness;
(iv) by public notice or Traffic Control Device, prohibit Vehicles not equipped
with chains, winter tires, sanding devices or any combination thereof as
determined adequate by the City Engineer in consideration of the current
road conditions, from being driven or operated on a Highway.
The Fire Chief may:
(a) direct and regulate Traffic in any manner deemed necessary during an
emergency and in doing so, may disregard any Traffic Control Device;

(b) place temporary Traffic Control Devices deemed necessary in the interest of
public safety or in an emergency;
(c) impound any Vehicle that interferes with this Bylaw or during an emergency
procedure;
(d) designate in any manner, a line, or lines near the location of a fire or other
emergency, beyond which the public must not pass.

EXEMPTIONS
4.1. Unless this Bylaw otherwise indicates, this Bylaw does not apply:
(a) to an Arterial Highway, unless approved by the minister responsible for the
administration of the Transportation Act;
(b) to the operation of a mechanically propelled Designated Personal Mobility
Device, if used for the purposes for which it was designed;
(c) if an Authorised Person determines the Bylaw does not apply in order to
comply with the law, or to address health and safety;
(d) persons operating a Government Vehicle or Emergency Vehicle while
engaged in their duties, or required for emergency call out or Standby call out
purposes;
(e) persons conducting works on behalf of a public utility corporation for the
purposes of an emergency.
GENERAL REGULATIONS
5.1. Except if an Authorised Person otherwise directs, every person must obey all
directions, regulations and prohibitions contained in or upon any Traffic Control
Device erected or placed under the provisions of this Bylaw.
5.2. Despite the provisions of this Bylaw, an Authorised Person may direct Traffic to
ensure the orderly movement of Traffic, to prevent injury or damage to persons or
property, or to allow proper action in an emergency, and all persons must obey such
directions.
5.3. A Traffic Control Person who is directing Traffic must do so in conformance with all
applicable City, WorkSafeBC and BC Ministry of Transportation and Transit policies
and procedures.
PERIWITS GENERAL
6.1. A person must not do any of the things in this Bylaw that require a Permit unless they
have first obtained a Permit from the City.
6.2. A person must, at all times, comply with the terms of Permits or orders issued in
accordance with this Bylaw. If a person does not comply with the terms of a Permit,
the City may revoke or terminate such Permit.

6.3. A person applying for a Permit in accordance with this Bylaw must:
(a) submit an application in the application form provided by the City; and
(b) accompany the application with Permit fees as set out in the City's Fees and
Charges Bylaw No. 2256, as amended.
6.4. Permits and orders issued in accordance with this Bylaw, including any amendments
or notices:
(a) must be issued in written or electronic form;
(b) may require the Permit holder to obtain and provide proof of liability insurance;
(c) must be dated and signed by the City Engineer or Director;
(d) may include any number of orders in accordance with this Bylaw;
(e) if for construction or works, may require a security deposit up to 125% of the
total estimated cost of the construction or works in form of a bank draft,
certificated cheque or an irrevocable letter of credit effective for the term of the
Permit;
(f) may require a WorksafeBC Clearance Letter;
(g) may require a Business Licence;
6.5. If a person holds a Permit for the use of a Highway, they must have the Permit
available at the site for any representative of the City to inspect.
6.6. If a person holds a Permit issued in accordance with this Bylaw, they must carry the
Permit in their Vehicle when operating it on a Highway within the City's boundaries
or have the Permit available upon request by the City.
6.7. If a Permit Holder was required to provide security under Section 5.4(e), following
completion of the construction or works, the Permit Holder must provide plans of the
construction or works installed to a scale satisfactory to the City Engineer and which
show the location, size and description of the works and the date of installation prior
to the return or refund of any security.
7. REHflOVAL OF SNOW AND RUBBISH
7.1. Owners or Occupiers of property must immediately remove any snow, ice or
Rubbish from the roof or other part of any Structure situated adjacent to or abutting
on any portion of a Highway if it constitutes a danger to persons or Vehicles using
the Highway.
7.2. Owners or Occupiers of real property must remove snow, ice or Rubbish from the
Sidewalks and Pathways bordering on real property Owned or Occupied by them
within twenty-four (24) hours of snow, ice or rubbish accumulating on the Sidewalk or
Pathway.
7.3. An Owner or Occupier of property must not place snow or ice from their property on
any portion of a Highway or Sidewalk.

9.
SPEED LIMITS
8.1. A person must not drive or operate a Motor Vehicle on a Highway in the City at a
speed greater than forty (40) kilometres per hour except if:
(a) in a Lane, then speed limits must not exceed twenty (20) kilometres per hour;
(b) Traffic Control Devices indicate road repair, clearing or cleaning, then speed
limits must not exceed thirty (30) kilometres per hour;
(c) approaching or passing a playground for children between dawn and dusk, then
speed limits must not exceed thirty (30) kilometres per hour;
(d) approaching or passing a school building or school grounds between 7:30 a.m.
and 5 p.m. on school days, then speed limits must not exceed thirty (30)
kilometres per hour;
(e) if designated rates of speed have been identified for a specified portion of a
Highway as shown on Schedule A, attached to and forming part of this Bylaw.
8.2. If this Bylaw has established alternate speed limits for the operation of Motor
Vehicles in the City, the City Engineer or the Director may erect Traffic Control
Devices indicating the designated speed limit.
GENERAL PROHIBITIONS
9.1. A person must not:
(a) remove any notice or ticket affixed or placed on a Vehicle by an authorized
person unless that person is the Owner or operator of such Vehicle;
(b) operate upon a Highway a Vehicle carrying any materials or goods which are
not secured in such a manner that the materials or goods are unable to fall from
the Vehicle while the Vehicle is proceeding along the Highway;
(c) disobey a Traffic Control Person controlling the movement of Traffic on a
Highway;
(d) alter, injure or remove, or attempt to alter, injure or remove a Traffic Control
Device or Traffic Control Signal or any part of it;
(e) place or maintain commercial advertising on a Traffic Control Device or Traffic
Control Signal;
(f) overtake or pass another vehicle in a designated school or playground zone, as
indicated by a Traffic Control Device;
(g) operate a Vehicle:
(i) other than a horse-drawn vehicle, the wheels of which are not equipped
with pneumatic tires in good order;
(ii) equipped with solid rubber tires, the thickness of which between the rim of
the wheel and the surface of the Highway is less than thirty-two (32)
millimetres;

(iii) with solid rubber tires at a greater rate of speed than twenty (20)
kilometres per hour;
(iv) having wheels, or tracks constructed or equipped with projecting spikes,
cleats, ribs, clamps, flanges, lugs, or other attachments or projections
which extend beyond the tread or traction surface of the wheel, tread or
track and except that this prohibition does not apply to a Vehicle equipped
with tire chains of reasonable proportions when required for safety or
winter studded tires when used between October 1st and April 30th of
each calendar year.
(h) distribute leaflets on a Highway by placing them on the windshield or any other
part of a nflotor Vehicle parked on a Highway, on any portion of a Traffic
Control Signal or Traffic Control Device;
(i) leave any glass or other debris from a wrecked or damaged Vehicle on a
Highway once the Vehicle has been removed from the scene of an accident;
(j) permit any materials or goods from a Hflotor Vehicle to fall and remain on a
Highway; or
(k) leave any excavation or other obstruction upon a Highway without sufficiently
Fencing, signing, barricading and marking the same with warning lights.
9.2. Except as otherwise permitted by a Traffic Control Device, a person must not drive a
Motor Vehicle, ride or herd any animals or ride a Cycle along any Sidewalks, parks,
Pathways or Boulevards.
10. HIGHWAY USES PROHIBITED WITHOUT PERNIIT
10.1. Except as authorized by a Permit, a person must not:
(a) operate tracked Vehicles on Sidewalks, Boulevards, Roadways or Lanes;
(b) place or permit to be placed, any fuel, lumber, merchandise, Chattel or
commodities of any nature on a Highway;
(c) drag or skid any object along or over a Highway in such a manner that the
object damages the surface of the Highway;
(d) using any manner of tool, dig up, break up, remove, excavate, move or alter any
land, located in, on or under on any part of a Highway;
(e) cause damage to, cut down or remove:
(i) any grass, shrubs, plants, bushes or hedges maintained by the City, on a
Highway;
(ii) any trees growing, planted, or maintained by the City, on a Highway;
(iii) any Fences, signs or other things, erected or maintained by the City, on a
Highway;

(f) place; allow to be placed; allow to cave in, fall or flow; accumulate; or allow to be
tracked on or carried on by a Vehicle, any soil, mud, rocks, stones, branches,
garden clippings, snow or other thing onto a Highway or to remain thereon;
(g) leave any excavation or other obstruction upon a Highway;
(h) place or allow to be placed, any Rubbish containers or other facilities related to
garbage on any portion of the Highway, except on the day of collection as
permitted in the City's Garbage Collection and Wildlife Attractant Bylaw No.
2178, as amended;
(i) construct, maintain or alter a ditch, sewer, culvert or drain that stops the flow of
water or causes the flow of water to damage the surface or subsurface of any
Highway;
(j) erect or maintain any sign, advertisement or guidepost on or over any Highway
or alter, repaint, tear down or remove any sign, advertisement or guidepost
erected or maintained on any Highway;
(k) mark, imprint or deface in any manner whatsoever a Highway or a Structure
situated upon a Highway;
(I) operate any Vehicle with any load unless the load is covered with a securely
fastened tarpaulin or other cover so as to prevent the load from becoming loose,
detached or in any manner hazardous to other users of the Highway.
11. TRUCK ROUTES
11.1. Subject to subsection 1 0.6, a Truck or a Commercial Vehicle with four or more axles
may only travel on designated Truck Routes, as set out in Schedule A of this Bylaw,
and on any street providing the shortest distance route between a designated Truck
Route and points of origin or destination, except for:
(a) an Emergency Vehicle;
(b) a Bus;
(c) a vehicle owned or operated on behalf of a public utility company;
(d) a Government Vehicle;
(e) in accordance with Sections 10.4, 10.5 or 10.7; or
(f) in accordance with a Permit.
11.2. The use of a Truck Route may be temporarily further restricted by written order of the
City Engineer if, in their opinion, it is necessary for safe passage or for the protection
of that road, or other roads or property, having regard to conditions such as road
capacity, visibility, damage, maintenance, repair or construction, obstructions,
flooding, snow, ice or other compromised Traffic or safety conditions, in relation to the
following:
(a) the gross weight of any vehicle or load;
(b) the weight on an axle, tire or wheel or the number of axles or wheels;

(c) the wheel base, width, length and height of vehicles;
(d) the width, length, height and distribution of loads;
(e) the speed at which vehicles may travel; and
(f) the hours when vehicles may use a Truck Route.
11.3. An order or orders under Section 1 0.2 will be effective when the City Engineer has
signed and dated the order and caused a notice or sign to be placed of a type and at
locations that the City Engineer considers relevant to persons subject to the
restrictions.
11.4. Despite any of the provisions of this Bylaw or of a Permit, if a Traffic Control Device
expressly limits the maximum weight, height, length, or width of a bridge or Highway,
a person must not operate a Truck or load which exceeds these maximum limits.
11.5. Despite Section 10.1, the City Engineer may issue a Permit for a person to drive or
Park a Truck on a Highway other than a Truck Route:
(a) to obtain fuel, repairs, accommodation or food at commercial premises;
(b) to collect or deliver cargo; or
(c) to supply a service;
provided that the person takes the shortest direct accessible connection between the
nearest Truck Route and the destination and then returns to the Truck Route using
the same connection as outlined on the approved route map attached to the Permit.
11.6. If a person driving a Truck has a subsequent delivery or service call to make in the
same area, the driver may proceed to this next destination, along Highways other
than a Truck Route and then, when finished, proceed by the most direct accessible
route to the nearest Truck Route.
11.7. If any Truck is permitted to be kept or Parked in accordance with the City of
Revelstoke Zoning Bylaw No. 2406, 2025, or any other City bylaw, at a location off a
Truck Route, and the Truck conforms with all other Highway use regulations but is
not engaged in the transport of materials or any other things to or from the premises,
a person may drive the Truck to and from the place where it is kept or Parked and, in
doing so, must drive it on the Highways forming the most direct accessible
connection between the location where the Truck is housed and the nearest Truck
Route.
11.8. Despite this section, a person in charge or control of a Truck must comply with all
other Parking and Traffic regulations.

12. IDLING
12.1. A person must not cause or permit a Motor Vehicle to Idle for more than three (3)
consecutive minutes.
12.2. The Idling provision in Section 11.1 does not apply to:
(a) a Motor Vehicle undergoing emergency repairs;

(b) a Motor Vehicle participating in an emergency or training activity;
(c) an armoured hflotor Vehicle;
(d) a Motor Vehicle in a parade or any other such event authorized by Council;
(e) a Motor Vehicle that must remain Idling to enable them to power any tools or
equipment necessary for, or incidental to, providing commercial or public utility
services;
(f) a Motor Vehicle that must remain Idling to power a heating or refrigeration
system for the preservation of perishable cargo; or
(g) a Motor Vehicle sitting with Occupants during temperature extremes.
13. PARKING PROHIBITIONS
13.1. Unless otherwise permitted by a Traffic Control Device a person must not stop,
Stand or Park a Vehicle or equipment:
(a) in violation of this Bylaw;
(b) contrary to any Traffic Control Device;
(c) on a Sidewalk or on a Boulevard;
(d) in front of or within three (3) metres of a public or private Driveway Access;
(e) in any Lane, unless the Vehicle is attended, actively loading or unloading and
placed to leave a minimum of three (3) metres of clear Roadway;
(f) in any designated fire lane;
(g) within six (6) metres of the entrance or exit of a Lane;
(h) within an Intersection or within ten (10) metres of an Intersection;
(i) within fifteen (15) metres of a controlled or uncontrolled railway crossing;
(j) within five (5) metres of a fire hydrant measured from a point on the curb or
edge of the Roadway which is closest to the fire hydrant;
(k) on a Crosswalk or within six (6) metres of the approach of a Crosswalk;
(1) within six (6) metres of the approach to a stop sign or Traffic Control Device
located at the side of a Roadway;
(m) adjacent to a curb painted yellow or red;
(n) more than thirty (30) centimetres from the curb or the edge of the Roadway;
(o) upon any Highway for the principal purpose of:
(i) displaying a Vehicle for sale;
(ii) advertising, servicing, painting or wrecking;
(iii) Storage or repairing, except where repairs are necessitated by an
emergency;
(iv) displaying signs;

(v) selling any commodities, including food trucks, unless a Permit has been
issued for the specific location;
(p) alongside or opposite a street excavation or obstruction when such action
obstructs Traffic;
(q) on either side of a Vehicle stopped or Parked parallel to the edge of the curb of
a Roadway, commonly referred to as "double parking";
(r) upon a bridge;
(s) in any manner that obstructs the visibility of any Traffic Control Device;
(t) in any manner that obstructs the free passage of Traffic on any Highway or
Roadway;
(u) contrary to the direction of Traffic flow on that side of the Highway;
(v) on a two-way Roadway, other than with the right-hand wheels parallel to that
side, except Motorcycles;
(w) being a Commercial Vehicle, on any Highway in a residential area, between
the hours of 7:00 p.m. and 6:00 a.m. of the following day;
(x) being a Recreational Vehicle, on any Highway for the purposes of living
accommodations between 7:00 p.m. and 6:00 a.m. of the following day and
moving the Recreational Vehicle from one location to another location does not
provide an exemption from this time restriction;
(y) in Angle Parking where the length of the Vehicle or Trailer exceeds six (6)
metres;
(z) on any Highway for a continuous period exceeding twenty-four (24) hours;
(aa) if there are designated Parking spaces identified by lines painted on the surface
of a Highway or City owned Parking lot, other than in a designated Parking
space;
(bb) upon a portion of a Highway that has been improved for and is identified by a
Traffic Control Devices for the travel of Cycles or Pedestrians;
(ec) on any Highway in contravention of the permitted length of time for Parking as
indicated by a Traffic Control Device;
(dd) in a loading zone identified by a Traffic Control Device unless actively loading
or unloading;
(ee) in a Bus Stop, or within thirty (30) metres of the approach side or within five (5)
metres of the leaving side of a Bus Stop;
(ff) in any City or City operated Parking lot for more than twenty-four (24)
consecutive hours;
(gg) in a zone reserved exclusively for Taxis, as indicated by a Traffic Control
Device;
(hh) on or adjacent to a portion of a Highway that has been improved as a IWedian;

(ii) on any Highway if the Vehicle is not displaying a valid licence plate or the
Vehicle is not insured;
(jj) within five (5) metres of a Canada Post mailbox for more than five (5) minutes;
(kk) if it interferes with Emergency Vehicles or their operations;
(II) if it interferes with the normal flow of Traffic on a Highway;
(mm) if it interferes with or restricts access to the construction, improvements,
maintenance, alteration, extension, widening, marking, or repair of a Highway,
watercourse or Right of Way;
(nn) being a Recreational Vehicle or Trailer that requires a Motor Vehicle for the
purposes of transportation, on a Highway without being attached or hitched to a
Motor Vehicle; or
(oo) on any Highway or public place in any manner that will obstruct snow removal.
13.2. A person must not occupy a Vehicle as living quarters while it is Parked upon any
Highway or in any other public place.
13.3. The City Engineer may issue temporary Parking Permits for Parking in areas
prohibited by this Bylaw or in excess of the length of time permitted by this Bylaw.
14. ACCESSIBLE PARKING
14.1. A person must not Park a Vehicle in a disabled zone unless the Vehicle displays a
Spare BC Parking Permit in a prominent position visible through the front
windshield.
15. SIGHT LINES
15.1. In accordance with the Transportation Association of Canada Geometric Design
Guide for Canadian Roads, nan Owner or Occupier of a corner lot at any
Intersection must not allow any Fence, retaining wall or vegetation to be erected or
grown if such Fence, retaining wall or vegetation is greater than 1.1 metres higher
than the finished grade of the abutting Highways for a distance of nine (9) metres
back along both abutting property lines of the lot, from the point of Intersection of the
two abutting property lines with the Highway.
15.2. Despite Section 14.2, if one or both of the abutting Highways may be defined as a
Lane under this Bylaw, then the Owner of the property abutting on the Highway and
the Lane must not permit a Fence, hedge or individual trees to remain so that the
Fence or hedge or individual trees are greater than 1.1 metre higher than the finished
grade of the abutting Lane and Highway for a distance of six (6) metres back along
both abutting property lines of the lot, from the point of Intersection of the two
abutting property lines with the Highway and the Lane or the two Lanes.
15.3. On properties used for normal farm practices as defined in the Farm Practices
Protection (Right To Farm Act), RSBC 1996,c 131:

(a) Fences intended to contain or exclude animals, which do not block visibility from
an intersecting Highway at the determination of the City Engineer or Director,
may exceed the height restrictions provided for in this Section;
(b) trees grown for agricultural crop purposes, which do not block visibility from an
intersecting Highway at the determination of the City Engineer or Director,
may exceed the height restrictions provided for in this Section.
16. TRAFFIC CONTROL DEVICES
16.1. The City Engineer and the Director may order the placing or erection of Traffic
Control Devices where and when deemed necessary or appropriate for regulation of
provisions within this Bylaw and the Motor Vehicle Act.
16.2. The Authorised Persons may order the alteration, repair, tearing down, removal or
impoundment of any sign, advertisement, or guide-post erected or maintained on or
over any Highway for which a valid Permit has not been issued, and the City must
not pay any compensation to any person for loss or damage resulting from such
action.
16.3. If for any reason, any Highway or any portion thereof is unsafe or unsuitable for
Traffic, or it is deemed advisable that Traffic should be temporarily restricted thereon
or diverted from, the Authorised Persons may close or cause to be closed, restrict
loads on, or divert Traffic from, such Highway or portion thereof and may erect or
place Traffic Control Devices upon such Highway.
16.4. If a Highway or portion thereof is temporarily closed in accordance with this Bylaw, a
person must not enter upon, or travel upon the Highway or portion thereof in
contravention of the applicable Traffic Control Device.
16.5. The Authorised Persons may place or cause to be placed temporary "No Parking"
signs or other "no Parking" Traffic Control Devices on a Highway or may require
Traffic be temporarily restricted or prohibited on a Highway:
(a) along the route of any parade;
in the vicinity of a large gathering or during special circumstances;
to facilitate the fighting of fires;
(b)
(c)
(d) to facilitate the clearing of snow, cleaning, repairing, excavating, decorating or
other work upon a Highway being carried out by the City or under its authority;
and
(e) in the interest of public safety.
17. COHflMERCIAL VEHICLE REGULATIONS
17.1. A person must not operate, Park, stop or Stand a Commercial Vehicle on any
Highway within the City, except:
(a) as required to deliver merchandise, commodities, persons or freight in the
ordinary course of business between the hours of 6:00 a.m. and 7:00 p.m.;

(b) if such Commercial Vehicle is transporting agricultural produce as a function of
an agricultural business within the City;
(c) if making a permissible delivery in accordance with this Bylaw, and it is done
using the most direct or appropriate route to or from the point of collection or
delivery and the Highway;
(d) if such Commercial Vehicle is being actively loaded or unloaded;
(e) if such Commercial Vehicle is a transit Bus or school Bus engaged in the pick-
up or drop-off of passengers; or
(f) if a Commercial Vehicle is a City Vehicle, or a Vehicle operating at the
direction of the City for the purposes of road maintenance, snow removal,
construction or work upon a Highway.
17.2. Unless authorized through a Permit and in compliance with the terms, conditions,
restrictions and requirements of the Permit, a person must not operate a
Commercial Vehicle on any Highway within the City:
(a) that is an Overload or Oversize Commercial Vehicle;
(b) exceeding the limits prescribed in the Commercial Transport Act; or
(c) contrary to posted GVW restrictions, height restrictions or any other posted size
restrictions.
17.3.
E
If in the opinion of the City Engineer or the Director, any Highway is liable to
damage through Extraordinary Traffic, they may regulate, limit or prohibit the use of
the Highway by any person operating or in charge of the Extraordinary Traffic, or
owning the goods carried thereby or the Vehicles used therein.
17.4. If a Commercial Vehicle is equipped with engine brakes, a person must not use such
brakes unless an emergency exists, or it is otherwise necessary for safety in the
circumstances.
I 18. PEDESTRIAN REGULATIONS

18.1. A Pedestrian must not:
(a) obstruct a Pathway by squatting, kneeling, sitting, or lying down on it between
the hours of 8:00 a.m. and 9:00 p.m. daily except for:
(i) a medical emergency;
(ii) a person using a Designated Personal nflobility Device;
(iii) sitting on a seat while waiting for a Bus;
(iv) sitting on a chair, bench or seat supplied by a public agency or at a
business permitted to occupy a portion of Sidewalk;
(v) during a parade, rally, demonstration, performance, or gathering;
(b) loiter in such a manner as to obstruct or impede or interfere with Traffic on a
Roadway;

(c) cross a Roadway in contravention of a Traffic Control Device;
(d) walk on a Roadway if a Pathway is reasonably passable and available;
(e) walk on a Roadway other than on the extreme left side or on the shoulder,
facing Traffic approaching from the opposite direction;
(f) cling to any Vehicle in motion or ride a bicycle, toy vehicle, sleigh or similar
device while clinging to any Vehicle in motion in or upon a Highway.
19. CYCLE, ROLLER SKATES, SKATEBOARDS, SLEIGHS, SKIS, INLINE SKATES
19.1. A person operating a Cycle on a Highway must comply with the provisions of this
Bylaw in the same manner as a person driving a Vehicle.
19.2. A person must not:
(a) operate a Cycle without properly wearing a safety helmet;
(b) being the parent or guardian of a person under the age of sixteen (16) years,
permit such person to operate a Cycle without properly wearing a safety helmet;
(c) being under the age of 16 years, or the parent or guardian of such, operate, or
knowingly permit such person to operate, a nflotor Assisted Cycle on a
Highway;
(d) operate a Cycle contrary to a Traffic Control Device;
(e) leave a Cycle on a Sidewalk to interfere with or obstruct the flow of Pedestrian
Traffic;
(f) operate a Cycle after sunset and before sunrise unless such Cycle is equipped
with visible lights on the front and rear, and the person is wearing reflective
clothing visible from the front and rear.
19.3. A person operating a Cycle, roller skates, sleighs, skates,skateboards, skis or other
similar means of conveyance, must:
(a) ride in a single file line as near as practical to the right side of a Highway or
within a designated Cycle Lane if available;
(b) ensure they ride safely and are visible at all times to other Highway users.
20. PANHANDLING
20.1. A person must not Panhandle on a Highway within ten (10) metres of:
(a) an entrance to a bank, credit union, or trust company,
(b) an automated teller machine;
(c) a Bus Stop;
(d) a Bus shelter;
(e) the entrance to any liquor or cannabis store, or
(f) the entrance to a movie theatre.

20.2. A person must not Panhandle from an Occupant of a Motor Vehicle which is:
(a) Parked;
(b) stopped at a Traffic Control Signal; or
(c) Standing temporarily for the purpose of loading or unloading.
20.3. A person must not Panhandle at any time during the period from sunset to sunrise.
20.4. A person must not sit or lie on a Highway, Sidewalk or Pathway for the purpose of
Panhandling.

COIWPLIANCE AND STOP WORK ORDER
21.1. If a person does any of the things otherwise prohibited under this bylaw without a
Permit, if there is any unsafe condition or if any Owner, Permit Holder or other
person is found to be in contravention of this Bylaw or the terms and conditions of a
Permit, the Director, or the City Engineer may:
(a) require a person to comply with this Bylaw and any Permit and bring works into
compliance within a time limit specified in writing;
(b) require a person to remedy a situation, including the preservation or restoration
of property, installation, repair, change or maintenance of an Encroachment or
works;
(c) direct the immediate suspension of all or a portion of work or construction by
attaching a Stop Work Order on the premises; and
(d) enter any property to affix or post a Stop Work Order.
21.2. The Owner or Permit Holder is responsible for all costs associated with the direction
to comply or any other requirement under this Bylaw.
21.3. If the required actions or repairs, or any part thereof, are not completed in accordance
with the provisions of this Bylaw and any applicable Permit, the City may draw funds
from the security, if one has been provided, and may complete the works at the
expense of the Owner. If no security is applicable, the Owner or Permit holder must
pay such expenses to the City immediately upon receipt of an invoice. The City may
deem any amounts remaining unpaid after the 31st day of December in any given
year property taxes in arrears for a parcel and recoverable as property taxes in
accordance with the Community Charter, SBC 2003, c 26.
21.4. If a Stop Work Order issued in accordance with this Bylaw is posted on a property or
delivered to a person responsible for the works, the person must not continue any
work other than remedial actions set out in writing by the City and must not
recommence works until the City has advised that the Stop Work Order has been
rescinded.
21.5. Despite the preceding, the City may immediately remove any item on public property
deemed to be a safety hazard, and the costs of removal must be the sole
responsibility of the Owner or Permit holder, and the City may recover such costs in
accordance with this Bylaw.

22. REMOVAL AND DETENTION
22.1. The Authorised Persons may remove, seize, tow, detain or impound any Vehicle,
fixture, Chattel, Encroachment, obstruction, earth, mud, rocks, stones, soil,
branches, clippings or other thing unlawfully occupying any portion of a Highway at
the Owner's sole expense if the Vehicle or other thing:
(a) has not been brought into compliance pursuant to an order issued in
accordance with this Bylaw;
(b) has been issued three (3) or more Bylaw Offence Notices under the Bylaw
Offence Notice Bylaw No. 2370, as amended or Municipal Information Tickets
under the Municipal Ticket Information System Bylaw No. 2082, as amended;
(c) is Standing or Parked in a position that causes it to interfere with or impede the
use of a Cycle Lane by cyclists, a Sidewalk by Pedestrians, a trail, or other
part of a Highway by Vehicles or interfere with emergency operations;
(d) is Standing or Parked in contravention of a Traffic Control Device, Traffic
Control Signal, Permit or order issued pursuant to this Bylaw;
(e) constitutes a hazard or danger to public safety, persons using the Highway or is
preventing normal flow of Traffic;
(f) has an apparent value as determined by the City Engineer or Director of less
than $500; interferes with construction, improvement, maintenance, snow
removal, alteration, extension, widening, marking or repair of a Highway;
(g) appears to have been abandoned for more than seventy-two (72) hours;
(h) has not been rectified or moved within twenty-four (24) hours of notification from
the City to remove such items; or
(i) is occupying City property without the necessary proof of insurance or licence
plate.
22.2. If in this Bylaw any matter or thing is required to be done by any person in default, the
City, it's agents, contractors or authorized persons may do such matter or thing, and
City may charge the actual costs of such actions taken to the person in default, with
interest.
22.3. In the exercise of the authority under this section, the City must not pay any
compensation to the Owner or any person for loss or damage resulting from the
removal, detention or impoundment, and the Owner must be liable for all expenses
incurred for the removal and storage of such Vehicle, fixture, Chattel or obstruction.
22.4. If a Vehicle is removed, detained or impounded, the City must send written notice to
the registered Owner as soon as possible at the address shown on the ICBC records
advising of the seizure or impoundment and where it can be claimed.
22.5. A Bylaw Enforcement Officer may detain and impound any play vehicle, Cycle or
skateboard being used by any person in contravention of this Bylaw, for a period of
twenty-four (24) hours for the first infraction, fourty-eight (48) hours for the second
infraction and seven (7) days for each succeeding infraction.

22.6. If a Bylaw Enforcement Officer detains and impounds a play Vehicle, Cycle or
skateboard, they must deliver the item to the RCMP building and advise the Owner of
the day and hour after which the item may be redeemed.
23. DISPOSAL OF UNCLAIMED PROPERTY
23.1. If a Vehicle is not claimed by its Owner within thirty (30) days of its impounding, the
City may provide for the recovery of the fees by sale, public auction or other means of
disposal as deemed necessary in accordance with the Community Charter and the
Motor Vehicle Act, after reasonable efforts have been made to contact the Owner.
23.2. If a Chattel is not claimed by its Owner within fourteen (14) days of its impounding,
the City may provide for the recovery of the fees by sale, public auction or other
means of disposal as deemed necessary in accordance with the Community Charter
and the Motor Vehicle Act, after the City has made reasonable efforts to contact the
Owner.
23.3. The City must apply the proceeds of such sale firstly to the cost of the sate, secondly
to the fees, costs and expenses of the City or its contractors for impoundment and
detention and thirdly the balance, if any, must be held by the City for one (1)year
from the date of sale for the Owner. If unclaimed at the end of the year, the City must
pay such sum into the general revenue of the City.
23.4. The City must not pay any compensation to the Owner or any person for loss or
damage resulting from the seizure, removal, detention or impoundment of a Vehicle
unlawfully occupying any portion of a Highway or public place; and the Owner must
be liable for a fee for the seizure.
23.5. The City must not pay any compensation to the Owner or any person for loss or
damage resulting from the seizure, removal, detention or impoundment of any thing
from any Highway under this section; and the Owner must be liable for a fee for the
seizure.
23.6. Should any Chattel or obstruction not be purchased at public auction held pursuant to
Section 22.2, then the City must dispose of the Chattel or obstruction by sale or in
the City dump, and the expenses incurred in the removal or disposal of the Chattel or
obstruction, less the proceeds (if any) of disposal, are recoverable as a debt due to
the City from the Owner.

24. PENALTIES AND ENFORCEMENT
24.1. Any Person who violates any provision of this Bylaw or who suffers or permits any act
or thing to be done in contravention or in violation of any of the provisions of this
Bylaw or who neglects to do or refrains from doing anything required to be done by
any of the provisions of this Bylaw, commits an offence and is liable on summary
conviction to a penalty not exceeding $50,000.00 but not less than $3,000.00 plus the
cost of prosecution or imprisonment for no more than six (6) months, in accordance
with the Offence Act, RSBC 1996, c 338, and the Community Charter.
24.2. Each day the violation continues to exist must constitute a separate offence.

24.3. Any person, Owner or Occupier who violates any provision of this Bylaw and thereby
causes damage to a Highway or any City owned property must be liable for costs
incurred in making repairs or taking remedial action and must pay to the City, within
30 days of receiving an invoice from the City, the cost and expenses to repair any
damage to a Highway.
24.4. No person, owner, or operator, may obstruct, hinder, delay, or knowingly make false
statements or mislead, either in writing or orally, the Authorised Persons.
24.5. Despite remedies, penalties and fines specified within this Bylaw, a person in violation
of the regulations contained in this Bylaw may be subject to penalties specified in the
City's Municipal Ticket Information System Bylaw No. 2082, as amended, and the
Bylaw Offence Notice Bylaw No. 2370, as amended.
25. RIGHT OF ENTRY
25.1. After taking reasonable steps to advise the Owner or Occupier before entering the
property, the Authorised Persons, acting reasonably, may at reasonable times enter
upon any property that is subject to the regulations of this Bylaw in order to determine
whether all regulations, prohibitions and requirements are being met.
26. Traffic and Highways Bylaw No. 1400 and all amendments thereto are hereby repealed.
