THE CORPORATION OF THE CITYOF ROSSLAND BYLAW# 2670 A BYLAWTO AMEND ROSSLANDZONING BYLAW No. 2518 WHEREAS Part 26 of the Local Government Act R.S.B.C. 1996, c.323 authorizes the Council of the City of Rossland to establish and amend a zoning bylaw; AND WHEREAS the Council of the City of Rossland deems it necessary and expedient to amend the City of Rossland's Zoning Bylaw No. 2518, 2011 NOW THEREFORE, the Council of the City of Rossland, in open meeting assembled, ENACTSAS FOLLOWS: SHORT TITLE 1. This Bylaw may be cited as the "Zoning Amendment Bylaw, No. 2670, 2018(9)". AMENDMENT 2. Section 3.1 -- DEFINITIONS -- of Schedule "A"of the City of Rossland Zoning Bylaw No. 2518 is hereby amended by adding the following new definitions: "Cannabis" means cannabis as defined in the Controlled Drugs and Substances Act and includes any products containing cannabis; "Cannabis Operation" means the cultivating, growing, producing, packaging, storing, distributing, dispensing, advertising, trading, consumption, or selling of cannabis or its derivatives but excludes City-approved Cannabis Retail Store. "Cannabis Retail Store" means a retail establishment licensed under provincial authority for the sale of cannabis for consumption off-premises. 3. Section 4.4 -- PROHIBITEDUSES of Schedule "A" of the City of Rossland Zoning Bylaw No. 2518 is hereby amended by adding the following new subsection. (d) Cannabis Operation 4. Section 4.1.2 PERMITTED USES Schedule "A" of the City of Rossland Zoning Bylaw No. 2518 is hereby amended by adding the following new subsection. (h) Cannabis Retail Store 1) a Cannabis Retail Store is not permitted within 150 m of the property line of a site containing a school or a youth centre. 2) A Cannabis Retail Store must install and maintain an air filtration system that effectively minimizes odour impacts on neighbouring properties. 5. Section 7.1 -- C-1 COMMERCIAL DOWNTOWN CORE Schedule "A" of the City of Rossland Zoning Bylaw No. 2518 is hereby amended by adding the following use 7.1.2 (k) Cannabis Retail Store ENACTMENT 3. (1) If any section, subsection, sentence, clause or phrase of this Bylaw is for any reason held to be invalid by a decision of any court of competent jurisdiction, the invalid portion shall be severed and the part that is invalid shall not affect the validity of the remainder. (2) This Bylaw shall come into full force and effect on the final adoption thereof.
