O. 999, 2021 DISTRICT OF SICAMOUS BYLAW N A Bylaw to allow the use of neighbourhood zero-emission vehicles on District highways. WHEREAS, pursuant to s. 36 of the Community Charter, Council has authority to regulate and prohibit in relation to all uses involving a highway; NOW THEREFORE the Council of the District of Sicamous, in open meeting assembled, ENACTS AS FOLLOWS: Definitions 1. In this Bylaw: "highway" includes a street, road, lane, bridge, viaduct and any other way open to public use, other than a private right of way on private property; "District" means the District of Sicamous; "neighbourhood zero emission vehic|e" means a vehicle that travels on four wheels and is powered by an electric motor and is designed to allow the vehicle to attain a speed of 32 kilometres per hour but not more than 40 kilometres per hour in a distance of 1.6 kilometres on paved level surface, and which: (a) meets or exceeds standards of the Motor Vehicle Safety Act (Canada) for a low-speed vehicle and bears a compliance label for a low-speed vehicle in accordance with that Act; or (b) if imported to Canada, has been imported as an admissible low-speed vehicle in accordance with the Motor Vehicle Safety Act (Canada) requirements and: i. bears a compliance label for a low-speed vehicle in compliance with that Act; or ii. meets applicable federal United States laws in accordance with the Motor Vehicle Safety Act (Canada). General 2. A person may drive or operate a neighbourhood zero emission vehicle on any highway in the District that has a speed limitof 50 kilometres per hour or less. 3. A person must drive or operate the neighbourhood zero emission vehicle in the lane of the highway that is closest to the right hand edge or curb of the highway, except in order to make a left hand turn or to pass another vehicle. o O?icer Neighbourhood Zero-Emission Vehicle Authorization Bylaw No. 999, 2021 I 2 of 2 Severability 4. If a portion of this bylaw is held invalid by a court of competent jurisdiction, then the invalid portion must be severed, and the remainder of this bylaw is deemed valid. Effective Date 5. This Bylaw comes into effect upon adoption Citation 6. This bylaw may be cited as the "Neighbourhood Zero-Emission Vehicle Authorization Bylaw No. 999, 2021".
