A BYLAW TO SET RATES AND CHARGES FOR THE OPERATION OF THE
TOWN'S WATER UTILITY
Council may, by bylaw pursuant to section 194 of the Community Charter, impose a fee for
all or part of a service of the municipality.
The Council of the Town of Sidney, in open meeting assembled, enacts as follows:
1.
This bylaw may be cited as "Water Utility Rates and Charges Bylaw No. 2210".
2.
In this Bylaw, unless the context otherwise requires:
(a)
Water means water supplied or made available by the Water Utility of the
Town;
(b)
Quarterly means a period of approximately three months, which
represents the Town's billing interval;
(c)
Fixed Charge means the quarterly charge per unit covering the fixed costs
of operating the Water Utility;
(d)
Variable Charge means the rate applicable to all water consumption
(metered water flow);
(e)
Billing Unit means the number of distinct sections, apartments or other
space divisions included within each water account; and
(f)
Scaling means a gradual reduction in the total number of Billing Units per
account, where the number of Units exceeds 50 (refer to Schedule A).

The following fees or charges are payable by the owner or occupier of property
which is connected to the Town's water distribution system.
(a)
A Fixed Charge per billing unit, per quarter, as specified in Schedule A of
this Bylaw; and
(b)
A Variable Charge, as specified in Schedule A of this Bylaw, for metered
water consumption.

4.
The following other charges are hereby set out in this Bylaw:
(a)
Where, by request of the owner, a connection is turned off, or back on,
there shall be payable a charge in accordance with the "Work for Others"
section of Town of Sidney Miscellaneous Fees and Charges Bylaw 1711.
(b)
When, at an owner's request, a meter is removed for testing and is found to
be within 1.5 per cent of the true flow, a testing charge of $120 shall be
applied to the account. There shall be no charge if the meter is found to be
reading the flow incorrectly (i.e. a variance of more than 1.5%).

Accounts will be billed quarterly, based on meter readings. If the charges remain
unpaid thirty one days after the due date indicated on the invoice, there shall be
payable a penalty of five percent (5%) of the current billing amount.
6.
This Bylaw covers all of the Town of Sidney, and any areas outside the Municipal
boundaries which are serviced by the Town.
7.
"Water Utility Rates and Charges Bylaw No. 2169" is hereby repealed.

Schedule A
1. Fixed Charge: $25.00 per Billing Unit, per Quarter.
2. Variable Charge: $6.86 per 1,000 gallons consumed.
3. Scaling of Billing Units: Any account with more than 50 Units shall be scaled as
follows for billing purposes:
