## BYLAW NO. 445 - 2007
## DOG LICENSING AND CONTROL
A Bylaw to provide for the licensing, control and impounding of dogs
Whereas Council of the Village of Silverton deems it necessary to regulate, by bylaw, the licensing, control and impounding of dogs in the Village of Silverton;
Now Therefore the Council of the Village of Silverton, in open meeting assembled, enacts as follows:
- This Bylaw may be cited as "The Village of Silverton Dog Licensing Bylaw No. 445 - 2007 and is effective on the date of adoption.
- Definitions: In this Bylaw unless the context otherwise requires:
## At Large means
- (a) in or upon the lands or premises of any person other than the owner of the dog without the consent, express or implied, of that person; and
- (b) in or upon a highway or public place not prohibited to dogs, unless on a leash or under the control of a competent person
Bylaw Enforcement Officer / Animal Control Officer means the person or persons appointed by Council from time-to-time and includes a peace officer for the purpose of enforcing and carrying out the provisions of this Bylaw.
Dog means an animal of the canine species, apparently over the age of four months.
Leash means a line, thong, or chain used for the purpose of restraining a dog and which does not exceed 183 centimetres (6 feet) in length and which is made of material of sufficient strength that the dog cannot break it.
License means a license issued pursuant to this bylaw.
Municipality means the area within the municipal boundaries of the Village of Silverton
Owner means a person over the age of sixteen years and includes a person who possesses or harbors a dog(s).
Pit bull Terrier includes an American Pit bull Terrier, a Pit bull Terrier, a Staffordshire Bull Terrier, an American Staffordshire Terrier, or any dog of mixed breeding of the foregoing breeds.
## DOG LICENCES
- No person shall own a dog without obtaining a dog license from the Village of Silverton.
- Upon payment of the appropriate license fee set out in Schedule 'A' to this bylaw, the Village office shall issue to the owner a dog license tag which shall be securely fastened to a collar or harness worn by the dog at all times except when the dog is penned up or enclosed on the owner's property.
- A dog license is not transferable to another dog or to an owner than the person to whom was issued the license.
- The Village office shall keep a book in which will be recorded the name and address of the owner of each dog for which a license is issued, the date of issuance of the license, the description of the dog and the license number.
## PROHIBITIONS
- An owner of a dog shall not permit or cause it to be at large in the Municipality.
- No owner of a Pit bull Terrier dog or mixed Pit bull breeding shall permit or cause it to be at large or on a highway or public place in the Municipality without the dog being effectively muzzled and leashed.
- No person shall keep four (4) or more dogs on any one parcel, unless that person has obtained a business license for the operation of a kennel, pursuant to the applicable bylaws.

- No owner shall permit any dog to bark persistently so as to disturb the quiet, peace, rest or enjoyment of the neighbourhood.
6. An owner whose dog defecates on another person's property, or on any private property, or on any street, lane, boulevard, pathway or any other Municipal or public property, or on any property used or reserved as a Park, recreational or cultural area, shall remove the defecated matter.
## ANIMAL CONTROL AND IMPOUNDING
1. The Animal Control Officer and/or Bylaw Enforcement Officer may be authorized to seize and impound unlicensed dogs and dogs which are at large.
2. The Animal Control Officer and/or Bylaw Enforcement Officer shall record in a book kept for that purpose the following information:
3. (b) the name of the person who brought or caused the dog to be impounded
4. (a) the number and description of each dog impounded
5. (c) the day and the hour in which the dog was received, redeemed or destroyed
6. (d) the location where the dog has been impounded
3. The Animal Control Officer or any person so authorized by him may capture any dog known to be vicious or savage.
8. Records shall be kept of all licenses issued and such records shall be considered public records.
9. Bylaw No. 275 - 1990 cited as "The Village of Silverton Dog Licensing and Control Bylaw and any amendments thereto are hereby repealed.
