THE CORPORATION OF THE VILLAGE OF SILVERTON BYLAW NO. 444 - 2007 BUSINESS LICENSE A Bylaw to regulate the carrying on of business in the Village of Silverton and to establish fees for Business Licenses Whereas Section 8 (6) and to Part 3, Division 9 of the Community Charter Council may regulate, by bylaw, the carrying on of business within its municipal jurisdiction; Now Therefore the Council of the Village of Silverton, in open meeting assembled, enacts as follows: 1. This Bylaw may be cited as "The Village of Silverton Business License Bylaw No. 444 - 2007 and is effective on the date of adoption. 2. Bylaw No. 305 - 1993 cited as "Business License Bylaw No. 305 - 1993 and any amendments thereto are hereby repealed. 3. Definitions: In this Bylaw unless the context otherwise requires: Act means Community Charter, Chapter 26 Revised Statutes of British Columbia, 2003, as amended and the Local Government Act, Chapter 323, Revised Statutes of B.C. 1996, as amended. Applicant means any person who makes application for a business license under the provisions of this bylaw. Business means the carrying on of a commercial or industrial undertaking of any kind or the provision of professional, personal or other services for the purpose of gain or profit. Carnival and Circus etc. means a person or business having any mechanical device or game of skill or chance or any side show. Coffee Shop, Catering means serving food or drink or the act of preparing and/or serving food or drink for public. Door to Door, Mobile Vendor and Direct Seller means a business or person located outside the School District No. 10 conducting or soliciting business within the Village. Home Occupation means a business carried out on a residential parcel located in a residential zone pursuant to the Village of Silverton Zoning Bylaw. Hotel Complex means a building normally occupied temporarily by tourists or transients and which shall include one or more of the following: banquet room, pub, cocktail lounge, dining lounge or restaurant. Laundromat means coin-operated or operator-operated laundry or dry-cleaning service. License Inspector means the person appointed as License Inspector by the Council of the Village of Silverton, to administer this Bylaw. Liquor Outlet means premises licensed under the Revised Statutes of British Columbia providing and/or serving primarily alcohol, including, but not limited to pub, lounge, beer and wine store. Miscellaneous means any business not specifically classified in Schedule 'A' of this Bylaw. Motel and Resort means any building comprising of not less than two sleeping or rental units normally occupied temporarily by tenants or transients. Person means, in addition to its usual connotation, a firm or partnership, association, company, society, or body corporate and in the singular shall mean and include the plural masculine and feminine and the converse. Professional means any one or a combination of the following but is not limited to: Accounts, Chartered or other Insurance Agent Appraiser Medical Practitioner Architect/Building Designer Notary Public Barrister/Solicitor Optometrist B.C. Land Surveyor Orthodontist Barber/Hairdresser Photographer Chiropractor Psychiatrist Consulting Engineer Real Estate Agent Dentist Veterinarian Restaurant means any food premises, whether permanent or temporary, fixed or movable, in which food is served to the public in exchange for money or service. Retail Merchants includes such businesses as: Bakery, Food and Drug Stores, Sand and Gravel Sales and Delivery, Tools and Equipment Sales and Rentals, Hardware and Building Supplies Store, Gift and Novelty Shop, Book and Magazine Stands and Electronic Sales and Repairs Store. Village means the Corporation of the Village of Silverton. 4. No person shall carry on business within the Village without first having obtained and paid for a Municipal Business License as set forth in Schedule "A" hereof. 5. Application for a municipal business license shall be made by completing an application in the form attached as Schedule "B' and by tendering the appropriate license fee as set out in Schedule "A". 6. In the event of a change of ownership of the business for which the license was issued, the new owner shall be required to pay a transfer fee of twenty per cent (20%) of the regular annual license fee. 7. The license holder or person in charge of the premises wherein the business is carried on or practiced shall at all times keep the license or licenses prominently displayed in the sales or reception are of the premises to which the public have access. 8. The Business License will be granted for a one year period to commence on the first day of January and terminate on the thirty first day of December in each year. 9. The annual fee for renewal of a valid and existing license shall be due and payable on February 28th of the licensed year. A penalty of ten dollars ($10.00) will be added to the Business License renewal fee not paid by February 28 of the same licensed year. 10. If one company or person operates more than one business under the same name, at one location, they will be charged one full license fee. This fee will be determined by the cost of the highest licensed fee as per Schedule "A". 11. A fifty percent (50%) reduction in fee will be made on account of any person commencing business after the 31st day of July of the licensed year. 12. Records shall be kept of all licenses issued and such records shall be considered public records. READ A FIRST TIME THIS 12th DAY OF DECEMBER 2006. READ A SECOND TIME THIS 12th DAY OF DECEMBER 2006. Hotel Complex means a building normally occupied temporarily by tourists or transients and which shall include one or more of the following: banquet room, pub/bar, cocktail lounge, dining lounge or restaurant. $275 / year 6. Laundromat means coin-operated or operator-operated laundry or dry- cleaning service. $50.00 /year 7. Liquor Outlet means premises licensed under the Revised Statutes of British Columbia providing and/or serving primarily alcohol, including, but not limited to pub, lounge, beer and wine store. $50.00 / year 8.
