w W PART 1]] - EFFECTIVE DATE PART IV - INTERPRETATION THE CORPORATION OF TIDE VILLAGE OF SILVERTON BYLAW NO. 355 A Bylaw to regulate traf?c and the use of all highways within the boundaries of the Village of Silverton ************************* WHEREAS the Council is authorized,pursuant to Section 120 of the Motor Vehicle Act and Sections 543 and 545 -- 548 inclusive of the Municipal Act, to regulate traf?c and the use of highways within the Municipality. THEREFOREBE IT RESOLVED that the Municipal COuncilof the Village of Silverton,in-open meeting assembled, enacts as follows: 101. This Bylaw may be cited for all purposes as "Traf?c and Highways Regulation Bylaw No. 355, 1998". 201. "Traf?c and HighwaysRegulation Bylaw No. 339, 1996" and all amendmentsthereto is hereby repealed in its entirety. 301 This Bylaw shall take effect upon adoption by Council. (1) the expressions and de?nitions contained within the Motor Vehicle Act, the Motor CarrierAct, the Highway Act, the Municipal Act, the Interpretation Act and the Commercial Transport Act and regulations thereto, shall be applicable and the followingadditional interpretationsshall prevail throughout: (2) wherever the male gender is used it shall mean the female and visa versa and wherever the singular is used it shall mean the plural and visa versa. "Access" means a driveway intendedfor ingress and/or egress to abutting property from a highway. "Boulevard" means the area other than a sidewalk betweenthe curb lines of a roadway or the lateral lines of a roadway or the shoulderthereof and the adjacent property line. "Clerk" meansthe person duly appointed as such from time to time by Council, and includesany person appointed or designated by the Clerk to,act on his/her behalf. "Commercial Vehicle" means a Commercial Vehicle de?ned as such under the Commercial Transport Act. "Council" means the Municipal Council of the Village of Silverton. Village of Silverton Page 2 Bylaw No. 355 "Emergency Vehicle" means; (a) A motor vehicle carrying rescue, ?re or ?rst aid equipment wherethere is an urgent emergency justifying a rate of speed in excess of any rate of speed provided for in this Bylaw or the Motor Vehicle Act; (b) A motor vehicle driven by a Peace Of?cer, Constable or member of the Police Branch of Her Majesty's Armed Forces in the discharge of his/her duties. "Extraordinary Traf?c" includescarriage of goods or persons over a highway whether in vehicles drawn by animal power or propelled by other means, that in conjunction with the nature or existing condition of the highway is so extraordinary or improperin the quality or quantity of the goods or the number of persons carried, or in the mode or time of use of the highway, or in the speed at which the vehiclesare driven or operated, as, in the opinion of the Council, substantiallyalters or increasesthe burden imposedon the highway through its proper use by ordinary traf?c, and causes damage and expense to the highwaybeyond what is reasonable or ordinary. "Hazardous Materials" means any explosive, ?ammable,toxic, noxious or other harmful or hazardousmaterials, includingdynamite, concentrated chemicalsin either solid,liquid or gaseous form, pressurized gases, gasoline and dieselfuel. "Highway"includes every highway, or boulevardwithin the meaning of the Highway Act, excluding highways classi?ed as Arterial under the Highway Act, and every road street, lane or right--of-waydesigned or intended for or used by the general public for the passage of persons and vehicles and every private place or passageway to which the public for the purpose of the parking or servicing of vehicles has access or is invited, and every place or passageway owned or operated by the Village of Silverton for the use of pedestrian "Lane" means a public highway within the ordinary meaning of lane not designed for general travel and primarily used as a means of temporary access to the rear of residences and businessestablishments. "Licensed Gross Vehicle Weight" means the gross vehicle weight for which a Commercial Vehicle is licensedunder the Commercial Transport Act. "Motor Vehicle" means a vehicle, not run upon rails, that is designed to be self propelled. "Offence Notice" means a Notice of Traf?c Violation "Operator" means any person who drives, operates, propels, or is in physical control of a vehicle,and shall be deemed to include the person in whose name the vehicle is registered. "Owner" means (i) the person who holds the legal title to the vehicle; (ii) the person who is entitled to be and is in possession of the vehicle; (iii) the person in whosename the vehicle is registered. "Park" means the stopping or standing of a vehicle whether occupied or not. "Peace Of?cer" means a police of?cer, police constable,constable or other person employed for the preservation and maintenanceof the public peace and includesany person appointed by Council to enforce the provisions of this bylaw. Village of Silverton Page 3 Bylaw No. 355 501. "Pedestrian" means a person afoot, or an invalid or child in a wheelchair or carriage. "Permit" means a document in writing issued pursuant to this bylaw. "Persons" means human beings, male or female, and includes a company or body corporate. "Public Works Foreman" means the person appointed as such by council,and any person delegated to assist him in carrying out his dutiesunder this bylaw. "Road Closure Permit" means a permit which authorizesthe closure of a highway or portion of a highway. "Shoulder" means the portion of the highway betweenthe travelled portion of an uncurbed highwayand the ditch; or if there is no ditch,the area betweenthe travelled portion of the highway and the boulevard. "Sidewalk" means the area between the curb-lines or lateral lines of a highway and the adjacent property lines improved for the use of pedestrians or any other improved area set aside for pedestrian use only. "Traf?c" includespedestrians, ridden or herded animals,vehicles, cycles and other conveyances, either singly or together, while using a highway for purposes of travel. "Traf?c Control Device" means a sign, signal, line,marking, space, barrier,or device, not inconsistentwith this bylaw, placed or erected by authorityof the Ministerof Transportation and Highways, or of the council or person duly authorized by the Minister of Transportation and Highways or the Council to exercise such authority. "Truck Route" means a highway, or portion thereof, that is designated for use by "Vehicle" means any device or means of conveyance in, upon, or by which a person or thing is or may be transported or drawn upon a highway, except a device designed to be moved by humanpower or used exclusivelyupon stationary rails or tracks. "Vehicle Government" means any truck or equipment in excess of 10,000kilograms owned and operated by a federal, provincial, or local government or its contractors. "Vehicle Utility" means any truck or equipment in excess of 10,000 kilograms owned and operated by a person or contractor in the business of providing utility services to the residentsof the Village and surrounding area. "Village" means The Corporation of the Village of Silverton or the territory under the jurisdiction of the Corporation of the Village of Silverton. THE CLERK: (1) may, issue, or cause to be issued,permits required pursuant to the provisions of this Bylaw. (2) may, issue or cause to be issued, offence notices for violations of this Bylaw (3) may, impound, or cause to be impounded,any vehicle, trailer or cycle in violation of this Bylaw. THE PUBLIC WORKS FOREMAN: (1) may, on any highway, place or erect or cause to be placed or erected,traf?c control devicesto regulate or prohibit traf?c wheredeemednecessary to ensure the orderly movement of traf?c, or to prevent injury or damage to persons or property or to prevent injury or damage to the highwayand where such traf?c control devicesareso placed or erected, they shall have the same force and effect as if placed by resolutionof Council. (2) may, regulate the use of vehicles not equipped with chains, snow tires, or sanding devices. (3) is hereby authorizedand empowered by order to place, replace or alter traf?c control devicesat any locationhe may determineto give effect to the provisions of the Motor Vehicle Act and this Bylaw. (4) is herebyauthorized and empowered to issue or cause to be issued,offence notices for violationsof this Bylaw. (5) may, impound,or causedto be impounded,any vehicle,trailer or cycle that is in violationof this Bylaw. PEACE OFFICERS, (1) may, issue offence notices for violationsof this Bylaw. (2) may, direct and regulate traf?c in any manner deemednecessary and in doing so, may disregard any traf?c control devices. (3) may, impound,or causedto be impounded, any vehicle,trailer or cycle that is in (4) may, require the driver of any vehicle to weigh such vehicle at any weigh scale forthwith. Unlessthe context otherwiserequires, (1) (2) The provisions of this Bylaw do not apply to persons, vehicles and to other equipment while actually engaged in highway construction or maintenancework upon, under or over the surface of a highway while at the site of the work, but do apply to them when travelling to or from the site of the work. A person riding an animal or driving an animal drawn vehicle upon a highwayhas all the rights and is subject to the provisions of this Bylaw. No person shall park, drive or operate a vehicle or cycle in contraventionof a traf?c control device. Every person shall at all times comply with any lawful order, direction,signal, or command made or given by a police of?cer, ?reman, ambulanceattendant, ?ag person or school patrol. 605. Unless otherwiseposted, and except in School and PlaygroundZones, which will be thirty (30) kilometresper hour, the maximum speed on any highway in the Village of Silverton shall be forty (40) kilometresper hour. 606. No person shall operate a vehicle on a lane at a greater rate of speed than twenty (20) kilometresper hour. 607. No person shall operate a vehicle within a constructionzone at a speed greater than twenty (20) kilometresper hour, unless otherwiseposted. 608. (1) No person operating a vehicle shall park, drive on, over or upon any sidewalk, curbor boulevardso as to encumber, obstruct,or damage same. (2) When a sidewalk crossing is not available,crossing by a vehicle will be permitted upon adequate provision being made to protect the sidewalk or boulevardfrom damage by the use of suitable planking or other material, having due 609. No person operating a vehicle shall block an intersectionor a crosswalk, notwithstanding any traf?c control device. 610. (1) No person shall drive any vehicle of any kind having wheel, tires or tracks constructed or equipped with projecting spikes, cleats, ribs, clamps, ?anges, lugs or other attachments or projections engaging the roadway along, on or across any bridge or hard surface highway within the Village, without ?rst obtaining the written permission from Public Works Foreman who shall determinewhich bridges and highwaysmay be used and the conditionsof such use. Nothing herein containedshall be construedas prohibiting the use of tire chains or studded winter tires. (2) The Public Works Foremanmay, by public notice or by the placing of signs on highways,regulate the operation of vehicleswhich are not equippedwith chains or winter tires or sanding devices or any combinationof these which may be considered adequate and necessary in Viewof the prevailing highwayconditions and no person shall drive any vehicle in contravention of such notice or signs. (1) (3) (4) (5) (7) (8) (9) Any truck or equipment exceeding 10,000kilograms shall not be permitted to travel on any residential street within the municipal boundariesof the Village except government or utility vehicles while engaged in work upon roadways, or trucks or equipment travelling through the Village to perform routine maintenanceor emergency servicesoutsidethe Village, or trucks delivering goods and materials to pro erties on a street or streets directly servicedby the roadway. Every person operating a truck or heavy equipment exceeding 10,000kilograms upon a highway as authorize under subsection611(1), shall travel by the closest and most direct route to the destinationof the trip upon entering or leaving the Village. Notwithstandinganything contained in this Bylaw, the Council shall have the discretionto determineand establish appropriate "truck routes" within the Village from time as deemed necessary and in the public interest,for vehiclesand equipment in excess of 10,000kgs. The followingroutes have been designated as "Truck Routes" withinthe Village of Silverton,as outlined in Appendix 1 attached hereto.and forming part of this Bylaw; and, are subject to the provisions of Sections 611(5) - 611(9): 4'11Street; Alpha Street; Silverton Creek Road; Leadville Street; 61hStreet; and, Standard Road. The Public Works Foreman may post signs or may cause signs to be posted on Highways in the Village to notify persons using the highways of regulations, limits or prohibitions with respect to Extraordinary Traf?c made under the authority of this bylaw. on designated truck routes, unless otherwise resolvedby Council: Days of Operation: Monday to Friday Hours of Operation: 7:00 am to 5:00 pm Speed Limit: 30 km/hr The Public Works Foreman may cause a highway to be close to traf?c or use at a time and for a period of time and for classesof traf?c or use as he believesmay be necessary for construction or protection of the Highway or other public work or for the protection of persons using the Highway or to enable traf?c permitted on the highway to be handledsafely and expeditiously. This Bylaw does not apply to a person who, with the approval of the Council, enters into an agreement with the Village for payment to the Village of compensation for the damage or expenses which may be caused by the Extraordinary Traf?c. No person shall drive on or use a Highway in the Village contrary to an agreement, order, regulation, limitation or prohibition made under this Bylaw. No person shall without a permit issued under authority of this Bylaw, and subject to the provisions of this Bylaw, operate on a highway a vehicle or combination of vehicles and trailers having a weight not conforming to the requirementsof the Commercial Transport Act and Regulations thereto. mam Traf?c and Load Restrictions: arson crating o barge in or vehicles there Highway Closure Permit: Removal of Offence Notice: Impoundment of Vehicles: Village of Silverton Page 7 Bylaw No. 355 613. 614. 615. 616. 617. No person shall, without a permit, and subject to the provisions of this Bylaw, operate on a highway, a vehicle or combinationof vehicles and trailers having a size not conforming to the requirements of the Motor Vehicle Act and Commercial Transport Act and Regulations thereto. Where in the opinion of the Public Works Foreman any highwayis liable to damage throughextraordinary traf?c thereon,the Public Works Foreman may regulate, limit or prohibit the use of the highway by any p op r in c of the extraordinary traf?c or owning the goods carried there the used in. (1) Temporary Highway Closure Permits may be issued by the Clerk to persons requiring partial or complete closureof a highway for the purposes of construction on or adjacent to a highway. (2) There shall be no charge for the permit except in the case of any direct costs incurreddue to traf?c control or like servicesprovided by the Village. No person, other than the owner or operator of a vehicle, shall remove from a vehicle any offence notice issued under authority of this Bylaw. (a) in violation of any of the provisions of this Bylaw; (b) in a position that causes it to interfere with the removal of snow, ice or sand from a highway, sidewalk or boulevard; (c) in a position that causes it to interfere with ?re?ghting; (d) in a position that causes it to interfere with the normal ?ow of traf?c on a highway; (e) in a position that causes it to interfere with the construction, improvement, alteration, extension, widening, marking repair or maintenance of a highway; (i) apparently abandoned on a highway; (g) without proper or valid licence plates displayed as required by the Motor Vehicle Act, The Public Works Foreman or a Peace Of?cer may, (a) move the vehicle, or require the driver or person in charge of such vehicle to move it to a position determined by the Public Works Foreman. PART VII - PARKING REGULATIONS m I nlawful Parking: Time Limits: Village of Silverton Page 8 Bylaw No. 355 (b) move the vehicle or take the vehicle into custody of the Village and cause it to be taken to and stored in a safe and otherwisesuitablelocation. All costs and charges for the removal, care and storage of a vehicleremoved and impoundedunder this Sectionshall be paid by the owner of the vehicle and shall be a lien thereon in favour of the keeper of any repair shop, garage or storage place in which such vehicle is stored and the same may be enforced in the manner provided by the Mechanic 'sLien Act, Warehousemen'sLien Act, Highways Scenic Improvement Act or Municipal Act. No person shall park a vehicle in any public place unless such person shall comply with all provisions of this Bylaw and other regulations posted by traf?c control devices. (a) Where a motor vehicle or trailer is left, withoutthe consent of the occupier of private property within the Village, the owner of a motor vehicle or trailer shall be deemedto have authorizedand empowered the occupierto be his agent for the purpose of towng the motor vehicle or trailer to a place of storage and storing it; (b) The agent has a lien against the motor vehicle or trailer for all reasonable advances made or charges incurred in connection with the towing and storing of the motor vehicle or trailer in the course of the agency; Notwithstandingany other provisions of this Bylaw, no person shall park a vehicle on any highway for longer than seventy-two (72 ) hours continuously. (2) 701 (1) (2) 702. 703. (1) Except when necessary to avoid con?ict with traf?c, or to comply with the law, or the directionsof a peace of?cer, or traf?c control device, no person shall stop, stand,or park a vehicle, (a) on a sidewalkor boulevard; (b) in front of, nor within one (1) meter of a public or private driveway in a residential,commercial or industrial zone; (0) within an intersection; (d) within ?ve (5) meters of a ?re hydrant; (e) on a crosswalk; (f) within six (6) meters of a crosswalk or an intersectionor any ?ashing beacon, stop sign, or traf?c control signal located at the side of a highway; Village of Silverton Bylaw No. 9 704. 705. 706. (2) (g) (h) (i) (j) (k) (1) (In) Page 9 within ?fteen (15) meters of the nearest rail of a railway crossing; Upon any highway for the purposes of, (i) displaying a vehicle for sale; (ii) advertising, greasing, painting, wrecking, storing, or repairing any vehicle, except where repairs are necessitated by an emergency; (iii) displayingsigns; (iv) selling any product; Except with the prior written approval of Council. alongside or opposite a highwayexcavation or obstructionwhen stopping, standing or parking obstructs traf?c; upon a bridge or other elevated structure on a highway, except as permitted by a traf?c control device; (i) on a highway in such a manner as to obstruct or impede the normal ?ow of traf?c; (ii) on a marked lane of a laned highway. in a place in contraventionof a tra?ic control device that gives notice that stopping, standing or parking is prohibited or restricted; in such a manner as to obstructthe visibilityof any standard traf?c sign; indicating the manner in which vehiclesshall be parked, except in accordance with such lines, markings or other signs; No person shall move a vehicle that is not lawfully under their control,into any of the places mentioned in Section 703(1). No person shall double park a vehicle on a highway. No person shall park any trailer upon any highway unlessin emergency situationsor the trailer is attached to a vehicle by which it may be propelled or drawn. No person shall park or leave unattended, a vehicle or trailer loaded or unloaded and used for the conveyance of hazardousmaterials,except, (1) (2) (3) at secured chemicalplants; at repair garages - for service only; at other approved secured areas PART V111- USE OF HIGHWAY REGULATIONS Snow Removal: Drainage: Littering: gonstruction: Village of Silverton Page 10 Bylaw No. 355 No person shall deposit,pile or spread snow or ice cleaned from roofs, parking lots, car lots, automobile service stations or garages, or any other surface or property, on any highway, sidewalk,boulevard,or other public place, except the place designated by the Public Works Foreman. Nothing herein contained shall be construed as prohibiting the Village from plowing snow to the property line of any highway or from removing such plowed snow. No person shall alter or stop the ?ow of water through any drain, sewer ditch or culvert on any highway. 801. (1) (2) 802. 803. (1) (2) (3) (1) (2) 805. (1) (2) (3) 806. No person shall operate on a highway, a vehicle or combinationof vehicle and trailer unless it is so constructed,loaded,or covered as to prevent any of its load from dropping,shifting, leaking, or otherwiseescaping therefrom. Should any material, due to any cause whatsoever,fall from the vehicle,the operator shall forthwithtake all reasonable precautions to safeguard traf?c from the consequences thereof and shall remove such material from the spillage area. No person shall place, throw, deposit or discard on any highway, any rubbish, litter or waste material of any description. No person shall excavate, construct any works, or occupy the highway for the purposes of construction adjacent to any highway unless otherwise authorizedby permit. Where authorized works are carried out on, over or under any highway, appropriate signs, ?ashers, barricades or other warning devices shall be provided around the construction zone to the satisfaction of the Village. No person shall cut, saw, break, split, place or pile ?rewood, lumber, blocks, stone, debris or other material or mix mortar on any highway. No person shall use any highway for any purpose other than that of lawful traf?c, except with the permission of the Clerk or the Public Works Foreman. No operator of a vehicle shall drive through any military or funeral procession, nor through the ranks of any other authorized parade or procession or in any way obstruct, impede or interfere with such procession or parade. No person shall operate upon a vehicle, any calliope,loudspeaker or other noise making deviceupon the streets of the Village for advertisingor other purposes unlessapproval has been grated by the Council. (1) (2) No person shall, except as provided herein or by any other bylaw, or unless otherwiseauthorized by Council, erect or maintain any structure which encroacheson orover any highway or public land. Approved structures overhanging the highway shall have a minimum clearanceof 2.5 meters above any sidewalk or walkway and 5 meters above any roadway. No person shall place, erect, remove or alter any sign, structure or other device on or over a street or land withoutthe express consent of Council. Every personwho in any way damagesany pavement, paved or unpavedsidewalk or curbing while leaving the travelledportion of the street, shall be liableto the Village and shall pay for the cost of repairing such damage to the satisfactionof Council. No person or gas, telephone, hydro electric, telegraph, pipeline company, radio or television broadcastingcompany or closed circuit television company shall use the streets in the Village for the construction and installationof the aforementionedutilities unless they have ?rst supplied the Village with complete plans and speci?cations of the proposed work to be constructed or installed and have in turn received written permission form the Village. All construction undertaken by any utility company under the provisions of this Section shall be in accordance with the applicable Bylaws of the Village and all applicable Provincial and Federal legislation. excavation,constructionor installationin such a manner as to prevent accidents, and shall place and keep upon such fence, railing or barricade,suitableand suf?cient lights during the night and shall take such further care and precaution as the Village may deem necessary for the safety of the public. Every person who violates any of the provisions of this Bylaw or who suffers or permits any act or thing to be done in contravention of this Bylaw, or who refuses, or omits or neglects to ful?l, observe,carry out or perform any duty or obligation imposedby this Bylaw shall be deemed to have committed an offence against this bylaw and shall be liable to a ?ne of not less than Fifty ($50.00) Dollars, nor more than Two Thousand($2,000.00) Dollars for each offence. Notwithstandinganything hereinbeforecontained,where any offence notice is issued pursuant to the provisions of this bylaw, any person may: (a) if paid within seven (7).daysof the issuance of the offence notice, pay to the Village, the sum of Twenty-Five ($25.00) Dollars as full satisfaction for each offence. (b) after seven (7) days of the issuanceof the offence notice, pay to the Village, the sum of Fifty ($50.00) as full satisfaction for each offence. (I) The owner of a vehicleshallincur thepenaltiesprovided for any offenceof this bylaw with respect to any vehicleownedby him, unless at thetime of such offence the vehicle was in the possessionof some person other than the owner withoutthe owner's consent; but nothing in this section shallrelievethe operator of a vehicle not being the owner, from incurring the penalties provided for such offence. (2) The onus of establishing that the vehicle was in the possession of some person other than the owner rests with the owner. 903. In additionto any other penalty which may be incurred,anyone failing to comply with the provisions of this Bylaw withinthetime limitedtherefor, or within a reasonabletime upon notice to that effect by the Village, shall be subject to the Village carrying out any such work, by its work crews or others, at the expenseof the o?'ender and any charges or costs incurredby the Village in this regard, shall be recoverable in any Court of competent jurisdiction. 1001. (a) (i) Removal of any vehicles - see fee schedulelisted in table below. If the rates in the ICBCTowing Rate Payment Schedule exceed those listed below, ICBC rates shall prevail (plus $20.00 administrationfee).
