THE CORPORATION OF THE TOWNSHIP OF SPALLUMCHEEN
BYLAW 2023
CONSOLIDATED WITH AMENDMENTS FOR CONVENIENCE ONLY
(Amendment Bylaw Nos. 2056, 2022 │ 2142, 2024)
A bylaw to authorize the use of the Municipal Ticketing Information System within the
Township of Spallumcheen
WHEREAS the Community Charter authorizes a Council, by bylaw to:
A. designate those bylaws which may be enforced by means of a form of ticket from
among those bylaws prescribed by regulation;
B. designate bylaw enforcement officers for the purpose of enforcing bylaws by
means of a prescribed form of ticket;
C. designate an offence against a bylaw by means of a word or expression on a
ticket; and
D. set fines, not exceeding $1,000 per occurrence, for contravention of designated
bylaws.
NOW THEREFORE the Municipal Council of the Corporation of the Township of
Spallumcheen, in open meeting assembled, enacts as follows:
1. CITATION
(a) This Bylaw may be cited as "the Township of Spallumcheen Municipal
Ticket Information Bylaw No. 2023, 2021".
2. BYLAW CONTRAVENTIONS
(a)
The bylaws listed in Column 1 of Schedule "A" of this Bylaw, as amended
from time to time, may be enforced by means of a ticket in the form
prescribed for the purpose pursuant to Chapter 26, Part 8, Division 3 of the
Community Charter.
3. COMPLIANCE OFFICERS
(a)
The persons whose job positions or titles are listed in Column 2 of Schedule
A to this bylaw are designated as compliance officers pursuant to Chapter 26,
Part 8, Division 3, section 264(1)(b) of the Community Charter for the
purpose of enforcing the bylaws listed in Column 1 of Schedule A opposite
the respective job positions.

4. OFFENCE AND PENALTY
(a)
The penalty for a bylaw contravention referred to in section 2 is as follows:
(i) Subject to subsection 4(b), is the penalty amount set out in Column A1 of
Schedule "B";
(ii) If received by the Township within 14 days of the person receiving or
being presumed to have received the notice, is the Early Payment
Penalty set out in Column A2 of Schedule "B";
5. SEVERABILITY
(a)
If any provision contained in the bylaw is found by a court of competent
jurisdiction to be invalid, illegal or unenforceable in any respect, the validity,
legality or enforceability of the remaining provisions contained herein shall not
be, in any way, affected or impaired thereby to the extent that the purpose of
the bylaw may be fulfilled in the absence of the impugned provision or
provisions of the bylaw.
6. REPEAL BYLAWS
(a)
The Corporation of the Township of Spallumcheen Bylaw No., cited as the
"Township of Spallumcheen Municipal Ticket Information Bylaw No. 1556,
2003" and all amendments thereto are hereby repealed.
7. EFFECTIVE DATE
(a) This bylaw shall take effect upon the date of its adoption.
