WHEREASThe Federal Governmenthas legalized the use and sale of recreational cannabis;
AND WHEREAS the Provincial'Government has given localgovernment the responsibilityfor
cannabisretail salelocations;
_AND WHEREAS
the Council of the District of Stewart"wishesto "allowcanna_bis-sales in the:
municipality;
NOWTHEREFORE,the Councilof the 'Districtof Stewart,
openmeeting assembled, enacts' as
follows:
THAT "DOWNTOWN
COMMERCIALZONEC1, Section 9.1of Bylaw.881,2Q14,beamended,by
adding permittedusesubsection
9.1.31--- CannabisRetailSales
ANDTHATGENERALCOMMERCIALZONEC2,Section10.1be amendedby adding permitted
use subsection10.1.45-- CannabisRetail Sales.
CITATION
1.. This bylaw may he cited as'~the.DISTRIC'I'or STEWARTZONING AMENDING'
(CANNABIS
RETAILSALES)BYLAWNo. 925,2018".
DEFINITIONS
2. In this bylaw:
a.
Cannabis means cannabisas defined in the Controlled Drugs and Substances»Act
and
includesany productscontaining cannabis.
b. Cannabis distribution
means 'a person who holds a cannabis distributor licence
issued by"theFederalGovernmentand anyfacilityoitoperationdesigned,'intendedor
used'for the -purposeof delivering, dispensing or transferringcannabis or cannabis
products to a personfor Medicalor Recreationalpurpose. A facilityi'n'clude'sall
premises,
cannabis -facilities, buildings, curtilage or
other
structures
used
to
accomplishthe storage, distribution
and disseminationofcannabis
.or~'marijuana.
c. Cannabisretail means' the businessof sellingcannabis and cannabisaccessory
products such as rolling papers, wraps, holders, pipes, water
pipes, bongs, and
vaporizers to retailcannabisconsumersand premises where.cannabisproducts are
sold or otherwise provided to a person who attendsthe premises.
