THE CORPORATION OF THE DISTRICT OF SUMMERLAND BYLAW NUMBER 2013-007 - LOW-SPEED ELECTRIC POWERED VEHICLE AUTHORIZATION BYLAW A BYLAW TO AUTHORIZE THE USE OF LOW-SPEED ELECTRIC- POWERED VEHICLES ON PUBLIC HIGHWAYS The Municipal Council of the Corporation of the District of Summerland, in open meeting assembled, enacts as follows: 1. In this Bylaw: "District" means the area contained within the geographical limits of the District Municipality of Summerland; "neighbourhood zero emission vehicle" means a vehicle that travels on 4 wheels and is powered by an electric motor that is designed to allow the vehicle to attain a speed of 32 kilometres per hour but not more than 40 kilometres per hour in a distance of 1.6 kilometres on a paved level surface, and which: (a) meets or exceed standards of the Motor Vehicle Safety Act (Canada) for a low- speed vehicle and bears a compliance label for a low-speed vehicle in accordance with that Act; or (b) if imported to Canada, has been imported as an admissible low-speed vehicle in accordance with the Motor Vehicle Safety Act (Canada) requirements, and (i) bears a compliance label for a low-speed vehicle in accordance with that Act; or (ii) meets applicable federal United States laws in accordance with the Motor Vehicle Safety Act (Canada). 2. A person may drive or operate a neighbourhood zero emission vehicle on any highway within the District that has a speed limit of over 40 kilometres per hour but not more than 50 kilometres per hour. 3. As permitted by Section 24.06(2)(a) of the Motor Vehicle Act Regulation, a person may drive low-speed electric-powered vehicle on a street where the posted speed is 40 km/h or less. 4. The authority conferred by Section 2 and 3 is in addition to the authority under: (a) Section 24.06(2)(a) of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, as amended, for a person to drive or operate a neighbourhood zero emission vehicle on a highway that has a speed limit of 40 kilometres per hour or less; and (b) Section 24.06(2)(c) of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, as amended, for a person to drive or operate a neighbourhood zero emission vehicle in accordance with the provisions applicable to a "utility vehicle" as defined in the said Regulations, as set out in Section 24.03 of the Regulations. 5. A person who drives or operates a Neighbourhood Zero Emission Vehicle as authorized by this bylaw may cross a highway that has a speed limit that is not greater than 80 kilometres per hour at an intersection to enable the person to continue on a highway on which the person is authorized to drive or operate a Neighbourhood Zero Emission Vehicle. 6. This bylaw may be cited as "Bylaw No. 2013-007, Low-Speed Electric Powered Vehicle Authorization Bylaw. Read a first, second and third time this 27th day of May, 2013.
