SUN PEAKS MOUNTAIN RESORT MUNICIPALITY
BYLAW NO. 0193, 2022
A bylaw to regulate the storage of solid waste and to
control wildlife attractants

WHEREAS Council wishes to minimize human - wildlife conflicts by reducing, to the greatest extent
possible, the likelihood of Solid Waste being stored or disposed of in a manner that might reasonably be
expected to attract Dangerous Wildlife;
NOW THEREFORE the Council of the Sun Peaks Mountain Resort Municipality, in open meeting
assembled, enacts as follow:
TITLE
1. This Bylaw may be cited for all purposes as "Solid Waste and Control of Wildlife Attractants Bylaw No.
0193, 2022".
DEFINITIONS
"Attractant" means any substance which could reasonably be expected to attract wildlife including
but not limited to food products, garbage, kitchen waste, unclean barbeques, pet food, bird feed,
grain, restaurant grease, used food packaging, game meat, fruit, seeds, nuts, honey, salt, oil,
antifreeze or other petroleum products, and unmanaged compost other than grass clippings,
leaves or branches/
"Dangerous Wildlife" wildlife that is prescribed as dangerous under the BC Wildlife Act.
"Parcel" means:
i)
a single area of land with defined boundaries and registered under the provisions of the
Land Titles Act; or
ii)
a single area of land with defined boundaries held by way of lease granted by the Federal
or Provincial Crown or their agencies.
and includes a bare land strata lot and a strata lot.
"Wildlife Proof Container" means a fully enclosed container, of sufficient design and strength to
prevent access by Dangerous Wildlife, that is securely affixed to the ground or to an immovable object
or fixture.
ADMINISTRATION AND ENFORCEMENT
2. Any Bylaw Officer or other Municipal Employee designated by the Chief Administrative Officer is
authorized to enter on any Parcel, at all reasonable times to ascertain whether the regulations
and directions of this Bylaw are being observed.
3. Every person who violates or fails to comply with a provision of this Bylaw, or an order, direction
or notice given under this Bylaw, commits an offence may be subject to a fine as outlined in the
Bylaw Enforcement Notification Bylaw No. 0011 as amended from time to time.

4. Each day a violation, contravention or breach of this Bylaw continues constitutes a separate and
distinct offence.
5. Notwithstanding anything in this Bylaw, every person who violates any of the provisions of this
Bylaw may be served with a violation notice in accordance with Bylaw Enforcement Notification
Bylaw No. 0011 as amended from time to time.
SOLID WASTE STORAGE
6. Every owner or occupant of a Parcel shall ensure that any Wildlife Proof Container located on the
Parcel is kept and maintained:
a) in a clean and sanitary condition;
b) in a closed and secure manner when solid waste is not being deposited or removed; and
c) in good working order.
WILDLIFE ATTRACTANTS
7. No person shall cause, permit or allow any wildlife Attractant that may attract Dangerous Wildlife to
be stored, kept or otherwise to remain on land except in a Wildlife Proof Container
8. No person shall provide, leave, dispose of, or place an attractant in, on or about any land or
premises in a manner that may attract or be accessible to Dangerous Wildlife.
9. No person shall install or keep a bird feeder on a Parcel unless the bird feeder is inaccessible to
any wildlife other than birds.
10. No person shall feed Dangerous Wildlife.
