BY-LAW NO. 4349
A By-law to regulate the keeping of
Pigeons and Doves.

THIS IS A CONSOLIDATED BY-LAW PREPARED BY THE CITY OF
SURREY FOR CONVENIENCE ONLY. THE CITY DOES NOT WARRANT
THAT THE INFORMATION CONTAINED IN THIS CONSOLIDATION IS
CURRENT. IT IS THE RESPONSIBILITY OF THE PERSON USING THIS
CONSOLIDATION TO ENSURE THAT IT ACCURATELY REFLECTS
CURRENT BY-LAW PROVISIONS.
WHEREAS pursuant to Section 871(e) of the Municipal Act, Chapter 255, R.S.B.C.,
1960 and amendments thereto Council may regulate the keeping of pigeons and doves.
THEREFORE the City Council of the City of Surrey, in open meeting assembled, enacts
as follows:
1.
No person, being the owner or keeper of pigeons or doves, or upon whose land
pigeons or doves are kept, shall allow, suffer or permit such pigeons or doves to
perch, roost or rest upon the land or buildings of any person in the City of Surrey
or to stray, feed or roost on any highway or public place in the City of Surrey, save
and except:
(a)
on real property of which the owner of such pigeons or doves is the owner
or lessee, and
(b)
for the purpose of exercising or racing when such pigeons or doves shall
be under the control of the owner.
2.
No person shall keep or harbour pigeons or doves on a record lot having an area
of less than six thousand (6000) square feet.
3.
No person shall keep pigeons or doves in, upon, or under any building used for
human habitation.

4.
Every building, structure or enclosure used to accommodate pigeons or doves
shall be located not less than thirty (30) feet from any residence located on the
same record lot and shall comply with the provisions of the Zoning By-law.
5.
The number of racing pigeons maintained on any record lot shall not exceed 15
birds per 1000 square feet of area of said record lot.
6.
The size of any loft to accommodate pigeons shall be at least:
2 1/2 square feet per bird for racing pigeons
3 square feet per bird, excluding flight pen, for fancy pigeons

Every building, structure, or enclosure used to accommodate pigeons or doves
shall be so constructed as to be airy, dry and light, and shall have the inside of all
walls and ceilings lime-washed or painted at least once a year. The outside of
such buildings shall be maintained in a clean and respectable manner.
8.
All lands and premises where pigeons or doves are kept shall at all times be
maintained in a clean, sanitary and inoffensive condition, and all cleanings and
other refuse resulting from the keeping of such pigeons or doves shall be disposed
of in a manner which will not create a nuisance or health hazard.
9.
No person shall keep any pigeon or dove afflicted with an infectious or contagious
disease, except in a licensed animal hospital or under condition of isolation and
quarantine approved by the Medical Health Officer.
10.
In the event that a pigeon or dove becomes infected with an infectious or
communicable disease the owner shall forthwith consult a licensed Veterinarian to
diagnose the condition. If the diagnosis of said Veterinarian confirms that said
pigeon or dove is infected with an infectious or communicable disease said owner
shall forthwith notify the Medical Health Officer in writing stating the fact and
furnishing particulars of the condition. The owner shall then immediately
undertake to carry out any instruction of the Medical Health Officer.

11.
The Medical Health Officer, or his duly authorized representative is hereby
authorized and empowered to enter at all reasonable times into or upon any lands
or premises to ascertain whether the provisions of this By-law are being or have
been complied with, and may take such action as he deems necessary to ensure
that the provisions of this By-law are complied with.
12.
It shall be unlawful for any person to prevent, or obstruct the entry of the Medical
Health Officer or his duly authorized representative, into or upon any lands or
premises, for the purpose of carrying out any inspections under this By-law.
13.
It shall be unlawful for any person to cause, suffer or permit any lands and
premises to be used in contravention of this By-law or to otherwise contravene or
fail to comply with any provisions of this By-law.
14.
Any person who violates any of the provisions of this By-law or who suffers or
permits any act or thing to be done in contravention of this By-law or who
neglects to do or refrains from doing any act or thing required by this By-law shall
be guilty of an offence under this By-law and shall be liable on summary
conviction to a penalty of not less than Twenty-Five Dollars ($25.00) and not
exceeding Two Hundred and Fifty ($250.00) Dollars together with the costs of
conviction.
15.
This By-law may be cited for all purposes as "Control of Pigeons and Doves
By-law, 1974, No. 4349."
16.
"Control of Pigeons By-law, 1960, No. 1805" is hereby repealed.

RECONSIDERED AND FINALLY ADOPTED, signed by the Mayor and Clerk on the
