THE DISTRICT OF TOFINO
BYLAW NO. 1130, 2010
NEIGHBOURHOOD ZERO EMISSION VEHICLE BYLAW 1130, 2010
WHEREAS the Council deem it necessary and expedient to authorize the use of
neighbourhood zero emission vehicles within the District of Tofino;
WHEREAS municipalities have the authority under Section 24.06 (2) of the Motor
Vehicle Act Regulations, Motor Vehicle Act to permit the operation of neighbourhood
zero emission vehicles;
NOW THEREFORE the Council of the District of Tofino, in the Province of British
Columbia, in an open meeting assembled Hereby Enacts as Follows:
1. This bylaw may be known and cited for all purposes as the "District of Tofino
Neighbourhood Zero Emission Vehicle Bylaw 1130, 2010".
2. In this Bylaw,
"Neighbourhood Zero Emission Vehicle (NZEV)": means a vehicle that
travels on four wheels and is powered by an alternative fuel engine (such
as an electric motor) that is designed to allow the vehicle to attain a speed
of 32 kilometres per hour but not more than 50 kilometres per hour in a
distance of 1.6 kilometres on a paved level surface.
"Defined Area": means the area within the District of Tofino municipal
boundary to where the vehicle is authorized to operate in (as shown in
Schedule "A").
3. A person may drive or operate a neighbourhood zero emission vehicle (NZEV)
on any highway within the defined area (as described in Schedule "A") of the
Municipality that has a speed limit of over 40 kilometres per hour but no more
than 50 kilometres per hour.
4. A person who drives or operates a NZEV may cross a highway that has a speed
limit that is not greater than 80km/hr at an intersection to enable the person to
continue on a highway on which the person is authorized to drive or operate a
NZEV.
