PARKING IN LIEU
BYLAW NO. 1176, 2012
A Bylaw to regulate parking.
The Council of the District of Tofino, in open meeting assembled, enacts as follows:
1. CITATION
This bylaw may be known and cited for all purposes as the "District of Tofino Parking
In Lieu Bylaw No. 1176, 2012".
2. DEFINITIONS
The words used in this bylaw shall have the same meaning as those defined in the
Zoning Bylaw, with the following exceptions:
"Parking Space" means a space for the parking of one motor vehicle either outside
or inside a building or structure, but does not include manoeuvring aisles and
other areas providing access to the space;
"Parking-In-Lieu" means a procedure by which Council waives the requirement to
provide off-street parking spaces in return for payment of an amount of money
specified in the Zoning Bylaw which the District of Tofino uses for the provision
of off-street parking spaces or transportation infrastructure that supports walking
and cycling.
3. GENERAL
a) Parking-in-Lieu Regulations
Where an applicant is permitted by the zoning bylaw and has agreed to
purchase a parking-in-lieu space, Schedule A attached hereto shall be amended
to list the following information:
i.
the property affected by the waiver;
ii. the extent to which the parking requirements are waived; and
iii. the amount of money accepted by Council as payment-in-lieu.
b) Schedules
"Schedule A" is attached hereto and forms an integral part of this bylaw.
4. SEVERABILITY
If a portion of this bylaw is held invalid by a Court of competent jurisdiction, then the
invalid portion must be severed and the remainder of this bylaw is deemed to have
been adopted without the severed section, subsection, paragraph, subparagraph,
clause or phrase.
5. EFFECTIVE DATE
This Bylaw comes into force and takes effect on the date of adoption.
