THE CITY OF TRAIL
BYLAW NO. 2782
A BYLAW TO IMPOSE FEES IN RESPECT OF THE RECREATION AND PARK SERVICES AND PROPERTY OF THE
CITY OF TRAIL
WHEREAS the Council of the City of Trail considers it necessary and desirable to impose fees for the
provision of its recreation and park services and the use of its recreation and parks property;
NOW THEREFORE the Council of the City of Trail, in open meeting assembled, enacts as follows:
Citation
1. This bylaw may be cited as the "Trail Recreation Fee Bylaw No. 2782, 2014".
Definitions
2. In this Bylaw:
(a)
Adult - means an individual age 19 or older.
(b)
City Facilities - means all City of Trail recreational facilities and parks.
(c)
City Recreation and Park Services - means all recreational and park services offered by
the City of Trail.
(d)
Commercial - means any activity carried on for the purpose of gain or profit.
(e)
Family - means 1 Adult, or 2 Adults related by marriage or co-habitating in a marriage-
like relationship for a period not less than one year, and his, her or their children by
marriage, blood relationship, adoption, guardianship, or foster parent relationship all
together residing in a single residence.
(f)
Non-Profit - means any legally constituted organization whose objective is to support or
engage in activities of public or private interest without any commercial or monetary
profit.
(g)
Non-Resident - means an individual who does not meet the criteria for residency in the
City of Trail, Village of Fruitvale, Village of Montrose, Village of Warfield or Regional
District of Kootenay Boundary Electoral Area 'A' pursuant to s. 52 of the Local
Government Act.
(h)
Organized Sport Activity - means a sport that is played by an individual by joining a sports
league, association, club, organization or team that uses City Facilities. For the purpose
of this Bylaw, curling or playing for the Trail Smoke Eaters Junior A Hockey Team is not an
Organized Sport Activity.
(i)
Resident - means an individual:

(i)
who meets the criteria for residency in the City of Trail, City of Rossland, Village of
Fruitvale, Village of Montrose, Village of Warfield or Regional District of Kootenay
Boundary Electoral Area 'A' pursuant to s. 64 of the Local Government Act.
(ii) who is the registered owner in fee simple of a Class 4, 5 or 6 property, pursuant to
the Assessment Act and regulations thereto, within the boundaries of the City of
Trail, Village of Fruitvale, Village of Montrose, Village of Warfield or Regional District
of Kootenay Boundary Electoral Area 'A' and is a non-resident property elector in the
City of Trail, Village of Fruitvale, Village of Montrose, Village of Warfield or Regional
District of Kootenay Boundary Electoral Area 'A'; or
(iii) who is a director or an officer of a corporation which is the registered owner in fee
simple of a Class 4, 5 or 6 property, pursuant to the Assessment Act and regulations
thereto, within the boundaries of the City of Trail, Village of Fruitvale, Village of
Montrose, Village of Warfield or Regional District of Kootenay Boundary Electoral
Area 'A'. For the purposes of this Bylaw, only one director or one officer of a
corporation is a Resident.
(j)
Residency Card - means a card that entitles a holder to discounted fees for recreational
and park services offered by the City of Trail.
(k)
Sport Pass - means a pass that is required in order for an individual who does not have
a Residency Card to use a City Facility during an Organized Sport Activity.
(l)
Tourist - means an individual:
(i)
who is not a Resident; and
(ii)
whose primary place of residence is not within the boundaries of the City of
Rossland or Regional District of Kootenay Boundary Electoral Area 'B';
and who wishes to access City Recreation and Park Services or use City Facilities on a
drop-in basis or for an Organized Sport Activity.
Fees
3. The City of Trail imposes fees for the provision of City Recreation and Park Services and the use
of City Facilities as specified in Schedules 1 to 11 (the "Schedules") inclusive.
4. The fees in the Schedules include applicable taxes, unless stated otherwise.
5. The applicable fees in the Schedules must be paid in advance of using any City Recreation and
Park Services or using any City Facilities.
Organized Sport Activity
6. To participate in an Organized Sport Activity, each player must either have a Residency Card or a
Sport Pass for the City Facility where the Organized Sport Activity is held.

7. Residency Cards are free for Residents.
8. For an individual who is a Resident pursuant to section 2(i)(ii) or section 2(i)(iii), Residency Cards
are free for his or her Family.
9. Non-Residents can purchase a Residential Card for $1,312.00 per individual or per group of
individuals who are a Family.
10. The fee to replace a lost or stolen Residency Card is $11.00.
11. Residency Cards expire on August 31st of each year regardless of date of purchase.
Sport Pass
12. Non-Residents can purchase a Sport Pass for a specific City Facility where an Organized Sport
Activity is held for the fees noted in Schedule 1.
13. Sport passes are free for Tourists.
14. A Sport Pass is valid for a season of the Organized Sport Activity for which the Sport Pass is
purchased.
Severability
15. If any portion of this bylaw is declared invalid and set aside by a court of competent jurisdiction,
then the invalid portion must be severed and the remainder of the bylaw shall be valid.
Repeal
16. That the Trail Recreation Fee Bylaw No. 2690, 2009 and amendments thereto is hereby
repealed.

ADOPTED the 18th day of August 2014.
