## DISTRICT OF TUMBLER RIDGE BYLAW NO. 667, 2018
## A Bylaw to regulate Recreational Cannabis Consumption for the District of Tumbler Ridge.
WHEREAS, Council may, by bylaw, regulate, prohibit and impose requirements in relation to public health and public places;
NOW THEREFORE the Council of the District of Tumbler Ridge, in open meeting assembled, enacts as follows:
## PART 1 - CITATION
- 1.1 This Bylaw may be cited as District of Tumbler Ridge Recreational Cannabis Consumption Bylaw No. 667, 2018'.
## PART 2 - DEFINITIONS
- 2.1 The following words and phrases shall have the following meanings:
- a) Cannabis has the same meaning as in the Cannabis Act (Canada), subject to any prescribed modifications;
- b) Cannabis Smoke means any smoke that is the by product from cannabis use, including but not limited to vaping and smoking;
- c) District means the District of Tumbler Ridge;
- d) District Walking Path means any District owned and maintained walking path, including but not limited to Bear Walks;
- e) Enforcement Officer means a member of the Royal Canadian Mounted Police, the District Fire Chief, District Bylaw Enforcement Officers and any other person employed for the preservation and maintenance of the public peace.;
- f) Owner means the registered owner of a parcel of land.
## PART 3 - GENERAL REGULATIONS
- 3.1 Recreational Cannabis Consumption is prohibited in the following public owned spaces and areas, as outlined in Schedule 'A':
- a) Downtown Core including but not limited to the Community Centre, skate park, city center parking lots and tennis courts and bordered by Northgate, Southgate, Pioneer Loop and Monkman Way;
- b) All Residential Zones including R1, R2, R3, R4, RM1, RM2 and MHP;
- 3.2 No person shall consume Recreational Cannabis in a prohibited area.
- 3.3 Recreational Cannabis Consumption is permitted by bylaw on all privately owned property with permission from the property owner, within the District unless otherwise regulated by another Government agency.
## PART 4 - NUSIANCE
- No person shall make or cause, or permit to be made or caused, any nuisance recreational cannabis smoke that disturbs the quiet, peace, rest, enjoyment, comfort or convenience of two or more persons within 100 metres of any privately owned parcel in R1, R2, R3, R4, RM1, RM2 and MHP Zones.
## PART 5 - INSPECTIONS
- 5.1 Council may designate Enforcement Officers that may enter on any property at any reasonable time for the purpose of ascertaining whether the regulations and requirements of this Bylaw are being observed.
- 5.2 No person shall obstruct an Enforcement Officer from entering property.
## PART 6 - SEVERABILITY
- 6.1 If any portion of this Bylaw is held to be invalid by a Court of competent jurisdiction, such invalidity shall not affect the remaining portions of the Bylaw.
