## CITY OF WILLIAMS LAKE BYLAW NO. 934 A BYLAW OF THE CITY OF WILLIAMS LAKE TO REGULATE PERSONS DEALING IN SECOND HAND GOODS WHEREAS Section 526 of the Municipal Act, empowers the Council by Bylaw, to regulate the carrying on of business in the Municipality, to the extent not inconsistent with the intent of this or any other Act, for the purpose of protecting the public or preventing or minimizing nuisances and misleading business practices, and the regulations may be different for different classes of business; AND WHEREAS Section 527, subject to Section 526 of the Municipal Act, further empowers Council to regulate by Bylaw, all licensed persons purchasing, taking in barter or receiving used or second hand goods; AND WHEREAS the Council has adopted Bylaw Number 884, 1982, cited as the "City of Williams Lake Second Hand Business Bylaw No. 884, 1982"; AND WHEREAS the Council now deems it expedient to repeal the said Bylaw and replace it with new and more comprehensive regulations; NOW THEREFORE the Council of the City of Williams Lake in open meeting assembled hereby enacts as follows: 1. This Bylaw may be cited for all purposes as the 'Williams Lake Bylaw to Regulate Persons Dealing in Second Hand Goods Number 934, 1984". 2. Bylaw Number 884, 1982 is hereby repealed. ## 3. DEFINITIONS In this Bylaw the expressions and definitions contained within the "Municipal, Act", the ''Offence Act", and the "Interpretation Act" regulations thereto, shall be applicable. The following additional interpretations shall also prevail: ## Bylaw No. 934 BYLAW ENFORCEMENT OFFICER means the person appointed from time to time by Council of the City of Williams Lake, and any person delegated to assist him in the enforcement of Municipal laws and regulations; CHIEF CONSTABLE means the senior officer of the R.C.M.P. Detachment having jurisdiction in the City, or for the purpose of this Bylaw, any peace officer designated by him; CITY means the City of Williams Lake; COUNCIL means the Council of the City of Williams Lake; LICENCED BUSINESS means a person licenced under the City of Williams Lake Licence Bylaw who, in the course of carrying on his licenced business, purchases, takes in barter, or receives used or second hand goods of any description. PURCHASE means buy, barter or receive. ## 4. AUTHORITIES The Bylaw Enforcement Officer and any peace officer are authorized and empowered to enforce this Bylaw. ## 5. REGULATIONS - 5.1. Every Licenced Business shall keep a record in which he shall write clearly the following particulars, at the time of purchase of any article or thing in the way of his business, namely: - (1) A correct description of any article or thing purchased, including make, colour, model, serial number and any descriptive mark or name on the article or thing. ## Bylaw No. 934 - (2) The date and hour of making the purchase. - (3) The name, place, of residence and street address of the person from whom the purchase was made. 3. 5.2 Each article purchased shall be held by the licensed business for a period of 72 hours during which time it shall not be altered in form, sold, exchanged or otherwise disposed of. 4. 5.3 Pursuant to the Municipal Act, every licensed business shall deliver to the Chief Constable, each day, a list of articles purchased in the preceeding twenty-four (24) hour period. The list shall include all information as required by Section 5.1. 5. 5.4 No licensed business shall permit any entry in the record to be erased, obliterated or defaced nor shall he permit any part of them to be cut or removed. 6. 5.5 A licensed business shall, at all reasonable times, allow a peace officer to inspect the record and any article or thing held at the time of the inspection. ## 6. PENALTIES - 6.1 A person who violates any of the provisions of this Bylaw is guilty an offence punishable on conviction. ## Bylaw No. 934 - 6.2 A person who is convicted of an offence under this Bylaw is liable a fine of not more than Two Thousand Dollars ($2,000.00). 7. This Bylaw shall come into force and take effect upon the date of final adoption by the Council.
