CITY OF WILLIAMS LAKE BYLAW NO. 2365 BEING A BYLAW OF THE CITY OF WILLIAMS LAKE TO PROVIDE FOR THE LICENSING, REGULATING AND SETTING OF FEES OF ALL BUSINESSES WITHIN THE CITY OF WILLIAMS LAKE. WHEREAS Council may, pursuant to section 8(6) of the Community Charter, regulate in relation to business; AND WHEREAS when regulating business, Council may, pursuant to section 15 (1) of the Community Charter, impose terms and conditions for obtaining, continuing to hold or renewing a licence permit, or approval, and specify the nature of the terms and conditions and who may impose them; AND WHEREAS Council has given notice of its intention to adopt this Bylaw and provided an opportunity for persons who consider they are affected by this Bylaw to make representations to Council pursuant to section 59 of the Community Charter; NOW THEREFORE the Council of the City of Williams Lake, in open meeting assembled, hereby enacts as follows: CITATION 1. This Bylaw may be cited as the "Williams Lake Business License Bylaw No. 2365, 2022". REPEALS 2. Bylaw No. 1523 of the City of Williams Lake, being the "Williams Lake Business License Bylaw No. 1523, 1995", and all amendments thereto are repealed. 3. Bylaw No. 1494 of the City of Williams Lake, being the "Williams Lake Regulate and Control Sidewalk Vendors Bylaw 1494, 1995, and all amendments thereto are repealed. PART I - ADMINISTRATION AND INTERPRETATION APPLICATION 4. This Bylaw applies to the whole of the area within the boundaries of the City of Williams Lake as may be amended from time to time. "CONSOLIDATED VERSION" Bylaw No. 2365 P a g e | 2 5. Every person applying for a license, or a transfer of license shall complete the application form as outlined in Schedule "B" attached to and forming part of this Bylaw. Applications must be signed by the owner or their duly authorized representative. 6. Any person making an application for a license shall give true and correct details for the business that the license is being applied for, on the application form supplied by the License Inspector. Any false declarations or concealment of material facts shall be deemed an infraction of this Bylaw and shall be liable to the penalties outlined in Part 4. DEFINITIONS 7. In this bylaw, unless the context otherwise requires, the definitions in the Community Charter and Interpretations Act govern, and the following definitions apply: "Applicant" means any person who makes an application for a license pursuant to this Bylaw; "Beer and Wine Store" means a retail trade store that primarily sells beer and wine products for consumption off the premises; "Building Official" means the person designated in or appointed to that position by the City, and includes a building inspector, plan checker, and plumbing inspector; For certainty, the Building Official is the "Building Inspector" referred to in the Community Charter and Local Government Act; "Business" means the carrying on of a commercial or industrial undertaking of any kind or the providing of professional, personal, or other services to receive income or revenue but does not include an activity carried on by a Municipal, Provincial, or Federal Government, or Crown Corporation; "Bylaw Enforcement Officer" means an officer or employee of the City who has responsibility for inspection and enforcement relating to bylaw compliance; "Cannabis" means cannabis as defined in the Controlled Drugs and Substances Act and includes any products containing cannabis; "Casino" means every place approved by the British Columbia Gaming Commission for the conduct of casino gaming activities; "City" means the City of Williams Lake; "City Clerk" means the Corporate Officer of the City of Williams Lake or person appointed by City Council from time to time; "Circus and Carnival" means a secondary use providing a variety of shows, games and amusement rides including Ferris wheels, food and game booths, or other similar rides in which the patrons take part, for a temporary period; Bylaw No. 2365 P a g e | 3 "Contractor" means any person, resident or non-resident, who performs any type of construction or building work or service for a fee or provides materials, except where a license fee for a different type of business is imposed elsewhere in this Bylaw; "Council" means the Municipal Council of the City of Williams Lake; "Day Care" means a facility providing care programs for more than two (2) children unrelated to the caregiver, licensed by the Province, and as defined in the Child Care Licensing Regulation, as amended from time to time; "Farmers' market" means a temporary or seasonal market for the display and sale of farm produce, craft products, food, and entertainment in an open-air or indoor venue; "Home-based business" means any business authorized by the City's Zoning Bylaw No. 1825, 2002 as amended from time to time, where: the business is operated by the person or persons living in the residence, which is incidental and accessory to the use of the property for residential purposes; "Large" means a mercantile business occupying a space with 600 square metres or greater of building area; "License Inspector" means the officer(s) appointed as such from time to time by the City of Williams Lake and any person delegated to assist in carrying out his/her duties under this bylaw, including Bylaw Enforcement Officers, Building Officials, and Peace Officers; "Licensed Food Service" means a business that holds a Liquor Primary License issued by the Province of British Columbia Liquor Control and Licensing Branch where the primary purpose is the service of liquor, as opposed to food, such as pubs and bars; "Medium" means a mercantile business occupying a space between 200 and 600 square metres of building area; "Mobile Vendor" means a person who owns or operates a motorized, mobile, self-contained vehicle that is equipped to cook/serve food, beverages to sell or offer for sale any commodity; "Nightclub" means an establishment where a full range of liquor products are sold for consumption on the premises and where a dance floor and entertainment are provided; "Non-resident business" means a business other than a resident business, carried on within the Municipality or to which any work or service is performed within the Municipality; Bylaw No. 2365 P a g e | 4 "Not-for-profit" means a society or organization which is not registered as a charitable society or organization under the Income Tax Act (Canada) and is not qualified to issue tax receipts to its donors; "Person" means and includes an association, corporation, firm, individual, organization, partnership, party, or society; "Principal Residence" means the residence in which an individual resides for a longer period of time in a calendar year than any other place; "Resident Business" means a business carried on, in, or from premises within the Municipality; "Short-Term Rental" means the service of accommodation for less than 90 consecutive days; "Sidewalk Vendor" means a person who owners or operates a non-motorized mobile cart to sell or offer for sale any commodity; "Small" means a mercantile business occupying a space smaller than 200 square metres of building area. SCHEDULES 8. Schedule A through B are attached to and form part of this Bylaw. SEVERABILITY 9. If a section, subsection, paragraph, subparagraph, or phrase of this bylaw is for any reason declared invalid by a court of competent jurisdiction, the decision will not affect the validity of the remaining portions of this Bylaw. GENERAL PROVISIONS License Required 10. No person shall carry on a business within the City without having obtained a valid business license. Form of License 11. Every license granted under this Bylaw shall state that the holder is licensed to carry on the business stipulated therein in a lawful manner for the period specified at the place therein stated. Display of License 12. Licenses shall be permanently displayed at all times in the business area of the premises to which the public has access. Except as otherwise provided, every license issued under this Bylaw shall terminate on the 31st day of December of the year in which it was issued. 14. Every person who ceases to carry on a business licensed under this Bylaw shall, upon the termination of the business, notify the License Inspector in writing that the business license is no longer required. Pro-rating of License fee 15. The license fee for a new business starting after the first quarter (March 1st), second quarter (June 1st) and third quarter (September 1st) periods of the licensing year may be prorated accordingly within a minimum fee of Fifty dollars. a) Prorating shall not apply to existing businesses which obtain Temporary Licenses. 16. Subject to part 2, no proportionate reduction shall be made on account of any person commencing or ceasing to do a business at a particular time, in any one year. License Fees 17. No license shall be issued until the fee, as set out in Schedule A and forming a part of this Bylaw, has been paid to the City of Williams Lake. Separate License 18. Where a business is carried on from more than one premise within the City Limits, the business shall require a separate license for each location or premise, except as provided in Temporary Licenses. 19. Where there is more than one separate and distinct business category located within the same premises, each business category shall have a separate license. Temporary Licenses 20. A business that wishes to operate for a temporary period of time, up to 15 consecutive days, from a separate fixed commercial premises, shall apply for a temporary licence. Change of Location, Name or Ownership 21. Business licenses are non-transferable, and no change of location, name or ownership shall be allowed without the licensee completing a new application for a business license, submitting an administrative fee of Thirty-five dollars ($35.00), and being issued a new business license. 22. Every holder of a license shall notify the License Inspector of any change in the mailing and/or the business address, the business practice, the number of people employed, the number of rental units or the number of vehicles used in the Bylaw No. 2365 P a g e | 6 operation of the business, or any other alteration to the premises in which the business is carried out. 23. Upon the termination of the business by the license holder, the licensee shall notify the License Inspector that the license is no longer required and shall surrender the license to the License Inspector. Conditions of Business 24. All premises upon or in which the applicant for license proposes to carry out or conduct any business shall, before any such license is granted, be approved by the License Inspector, Medical-Health Inspector, Fire Prevention Officer, Building Inspector and any other official of a Provincial or Municipal Department involved. Where any federal/Provincial Act or Regulation or any other City Bylaw applies to any matter covered by this Bylaw, the issuance of a business license under the provisions of this Bylaw shall not relieve the licensee from complying with the provisions of such other enactments. PART II - SPECIFIC REGULATIONS 25. In addition to the general provisions of this bylaw, including the requirement of a business license, the businesses dealt with in this part are also subject to the following regulations. Automobile Dealer (New and Used) 26. Every automobile dealer (new and used) applicant must provide the Licensing Department with a copy of the Motor Dealer's certificate of registration issued to such applicant under the Motor Dealer Act. Each existing automobile dealer (new and used) licensee shall provide the Licensing Department with a copy of said certificate upon request. Carnival and Circus 27. It is a term and condition of every license issued in respect of a carnival or other show having any mechanical ride or riding device that the licensee obtains, maintains, and provides to the City, proof satisfactory to the Licenses Inspector of a commercial general liability insurance policy that: a) has limits of not less than $5,000,000 per occurrence; b) includes the City named as additional insured; c) the licensee shall hold the City harmless against claims, actions for injury, property damage, loss or death arising out of or resulting from the operation of a business. d) contains a cross-liability clause; e) provides that the insurer will give the City at least 30 days prior written notice of cancellation of, or material alteration to, the policy. Bylaw No. 2365 P a g e | 7 Contractors 28. Every person licensed as a Contractor shall provide proof of trade qualification certificate for all employed tradesmen and substrates including but not limited to, plumbing, refrigeration, and electrical. Direct Sales and Solicitation 29. Every person carrying the licenses for door-to-door sales must provide the City of Williams Lake with a valid copy of a Personal Identification. 30. All applications shall be forwarded by the License Inspector for approval by the Williams Lake RCMP before issuance of the business license. Criminal Record Checks will be copied on file. Escort Service 31. Every person carrying on or operating the business of escort service as defined in Schedule A shall: a) Upon request supply to the License Inspector the name and age and proof of identification of any person engaged or proposed to be engaged in the said business; and b) Notify the License Inspector within 48 hours of any change in the personnel engaged in the said business. Home-Based Business 32. Every person operating a Home-based business shall be licensed under the classification which reflects the nature of the business. 33. Home-Based Businesses shall comply with the provisions and standards contained in the City of Williams Lake Zoning Bylaw No. 1825, 2002. Horse Drawn Wagons 34. Every application or business license to operate a horse-drawn wagon within the City of Williams Lake must be approved by the local detachment of the RCMP concerning the operation of the business and structure of the wagon. 35. Except when required by traffic devices or persons authorized to direct traffic, no horse-drawn wagon shall stop or park anywhere on City streets. 36. Prior to issuance of the Business License, the applicant shall obtain and maintain comprehensive general liability insurance of an amount not less than three Million Dollars, indemnifying the City of Williams Lake from Claims, actions for injury, damage, loss, or death arising out of or resulting from the operations of the business. Bylaw No. 2365 P a g e | 8 Mobile and Sidewalk Vendors 37. Every business carrying a license for sidewalk or mobile vendor shall only operate on private property with permission of the owner/tenant a copy of which is to be kept on file at the City, and any City-owned "free" public parking lot as identified by the Director of Municipal Services. 38. Every person who sells from a vehicle shall provide registration for the vehicle and provide valid Personal Identification. 39. Every business shall obtain five million liability insurance inclusive of limits covering bodily injury, death and property damage including the loss of use of such property, showing the City of Williams Lake as a coinsured party and a copy of which is to be kept on file at the City. 40. Health Permit approval from the local Environmental Health Officer (if preparing and serving food or beverages) is required and a copy of which is to be kept on file at the City. 41. Must always display business license within the motorized or non-motorized vehicle/chart. Secondhand Sales 42. Persons carrying on the business of retail sales of secondhand goods shall comply with provisions of the City of Williams Lake Bylaw No 934, 1984 to regulate persons dealing in Secondhand Goods. This provision excludes auto wreckers or the sale of scrap metal. Security and Patrol Service 43. Every person carrying on the business of watching, guarding, or patrolling for the protection of persons or property, or as a private detective shall be required to hold a license, as outlined in the Private Investigators Act of the Province of British Columbia. 44. All applications for security and patrol service shall be forwarded by the License inspector for approval by the Williams Lake RCMP before issuance of the business license. Transportation Service 45. Every business carrying the license for a pedicab/taxi must provide the City of Williams Lake with a valid copy of a British Columbia Driver's License. 46. No business shall operate or permit to operate, in the City, a commercial passenger vehicle unless licensed under the provisions of the British Columbia Passenger Transportation Act. Bylaw No. 2365 P a g e | 9 Temporary License 47. Every business carrying a license must obtain the permission of the owner or tenant and a copy of which is to be kept on file at the City. PART III - ENFORCEMENT AND OFFENCES SUSPENSION Authority to Suspend License 48. The License Inspector may suspend any license as determined if the holder of the license: a) is convicted of an offence indictable in Canada; b) is convicted of an offence under an Act or municipal bylaw in respect of the business for which the holder is licensed or with respect to the premises named in the licence; c) in the opinion of the official, has been guilty of such gross misconduct in respect of the business, or respect to the premises named in the licence, that it warrants the suspension of the licence; d) has ceased to meet the lawful requirements to carry on the business for which the holder is licensed or with respect to the premises named in the licence; e) has conducted the holder's business or performed service in a manner that may be harmful or dangerous to the health or safety of a person actually or apparently under the age of 16 years, or f) has sold, offered for sale, displayed for sale or distributed to a person actually or apparently under the age of 16 years anything that may be harmful or dangerous to the health or safety of a person actually or apparently under the age of 16 years; g) is not compliant with the terms of the license by the Provincial Liquor and Cannabis Regulations Branch or is convicted of any offence under any Municipal bylaw or Statute of the Province of British Columbia in respect of the business for which the holder is licensed or to the premises named in the license; Notice to Suspend 49. Where a license has been suspended under the Municipal Act, a "Notice of Suspension" shall be issued to the licensee by the License Inspector, in writing, outlining the reasons for suspension and shall be served on the licensee or delivered to the licensee by registered mail to the address of the business shown on the business license application. A "Notice of Suspension" of a license may be posted by the License Inspector or Bylaw Enforcement Officer upon the premises for which the license was issued and such notice shall not be removed until the license is reinstated, the former licensee ceases to occupy the premises or a new business other than the one carried on by the licensee is started in the premises. Right to Appeal Suspension 51. Any person whose license has been suspended, who has been refused a license, or who wishes to appeal the classification, shall file an appeal, in writing, addressed to the Corporate Services Department, and such appeal shall be made within thirty (30) days after the date of the refusal, revocation, suspension or date upon which the license was issued subject to conditions. Revocation 52. Council may revoke a license under the Municipal Act for "reasonable cause" after giving notice to the licensee and after allowing the licensee to be heard. 53. The notice and opportunity to be heard, referred to in subsection a) of this section is not required with respect to the licensee who by reasonable efforts cannot be found. 54. A "Notice of Revocation" may be posted by the License Inspector upon the premises for which the license was issued, and such notice shall not be removed until the license is reinstated, the former licensee ceases to occupy the premises, or new business other than the one carried by the licensee is started in the premises. Notice of Hearing 55. A notice of hearing to revoke a license after the refusal by the License Inspector to issue a license or to consider the granting of a license shall be made in writing, outlining the time, date, and place of the hearing, and the reasons for Council's consideration of a request to revoke or refuse the license, and served on the licensee(s) or delivered to the licensee(s) by registered mail to the address shown on the application for the license. ENFORCEMENT 56. Any person designated as a Bylaw Enforcement Officer under the City of Williams Lake's Bylaw Notice Enforcement Bylaw or is named as the Enforcement Officer under the City of Williams Lake's Municipal Ticket Utilization Bylaw is hereby authorized and empowered to enforce the provisions of this Bylaw by Notice or Municipal Ticket Information or as otherwise provided by this Bylaw. Bylaw No. 2365 P a g e | 11 57. It shall be the duty of the License Inspector, and he/she is hereby authorized and empowered to inspect, compel, and require that all regulations and provisions prescribed in this Bylaw and other Licensing Bylaws as may be enacted from time to time, shall be carried out. 58. The License Inspector shall make rules and regulations for the internal management of his/her department. 59. The License Inspector shall maintain and keep records of all licenses issued. 60. All such records shall be considered public records and shall be open for inspection at reasonable times to any person having business with the License Inspector. No person shall be entitled to inspect more than one License Application at any time without paying an admin fee of $35.00. OFFENCES 61. Any person, firm, or corporation that: a) Fails to comply with the provisions of this Bylaw, or b) Tenders a cheque or other negotiable instrument, in full or partial payment of any fee payable hereunder, which is not honoured by the financial institution or bank against which is issued, or c) Provides false information about size, location, ownership, or legal conformity of the business, or d) Carries on the business after receiving notice of suspension or after the business license has been revoked, or e) Carries on business without a Business License, commits an offence, and each day's continuance of an offence constitutes a new and distinct offence. PENALTIES 62. Any person, firm or corporation who contravenes any provision of this Bylaw is guilty of an offence and is subject to the following enforcement provisions: a) To the penalties imposed by the Offence Act, or b) To a fine as imposed by means of the Municipal Ticket Information system under the Community Charter, or a bylaw notice under the Local Government Bylaw Notice Enforcement Act. c) All penalties relevant to contraventions of this Bylaw being addressed within the provisions of Section 63 are contained in Schedule A-4 of the City of Williams Lake Bylaw Notice Enforcement Bylaw#2196, 2013. d) Where a Business Licence Violation Notice has been issued under this Bylaw and that person has not paid the voluntary fine, the cost for service of the summons shall be added to the amount of the voluntary fine. RECONSIDERED AND ADOPTED THIS 21st DAY OF June , 2022. *original signed by _______________________________ MAYOR *original signed by _______________________________ CORPORATE OFFICER BUSINESS LICENSE BYLAW NO. 2365 - SCHEDULE A "CATEGORIES AND FEES" CODE TYPE OF BUSINESS FEE 0100 ACCOMMODATIONS The fee is payable from every person carrying on the business of operating or renting more than two (2) rental units, suites, or rooms in a hotel, motel, rooming house, bed and breakfast house, apartment, mobile park, campground, including nursing home, home for specialty care or seniors. $150.00 0101 SHORT-TERM RENTAL The fee is payable from every person carrying on the business of operating or renting one (1) or more short-term rentals located at their principal residence, including secondary suites and accessory dwelling units. This includes short-term rentals advertised on platforms such as Airbnb, VRBO, Facebook Marketplace, Newspaper Classifieds and Community Bulletin Boards. $150.00 0200 AUTOMOBILE/EQUIPMENT/RECREATION SALES, RENTAL AND SERVICE/REPAIR The fee payable from every person carrying on the business of sales, rental, service, and repair of new or used automobiles/equipment/ recreational vehicles including but not limited to snowmobiles, ATVs, boats, farm equipment, logging machinery, and lifts. $200.00 0201 AUTO WRECKER/SALVAGE YARDS The fee is payable from every person carrying on the business of retail sales of secondhand goods, scrap metal and automobile wreckers. $250.00 0300 BUILDING/PARKING RENTAL - OFFICE, COMMERCIAL, INDUSTRIAL The fee is payable from every person carrying on the business of letting or renting a building or portion of a building for commercial, office or industrial purposes. $120.00 0400 BUSINESS SERVICES The fee is payable from every person carrying on a business offering a service, excluding businesses that sell products as their primary business and professional services, including but not limited to electronic repair, collection agency, pawnbroker, janitorial service, stationery shop, travel agency, upholsterer, promotion and design service, photography studio, funeral service, seamstress/tailor, tutor, jewelry maker, handicrafts, laundromat/dry cleaner, newspaper, broadcasting station, direct sales, administrative office and daycare. $100.00 0500 CASINO/NIGHTCLUB The fee is payable from every person carrying the business of a casino, nightclub, or entertainment establishment with a gaming license or liquor dance floor. $250.00 0501 CARNIVALS/FAIRS/ CIRCUS The fee is payable from every person carrying on the business of a carnival/fair/circus with rides, exhibit, food booth, game booth or where animals are used to perform. *See Part 2 - Business Regulation for additional regulations that apply. $1000.00 0600 CONTRACTORS The fee is payable from every person carrying on business who performs any type of construction, building work or service including but not limited to carpentry, electrical, plumbing, roofing, equipment operation, civil work, landscaping, HVAC technician, painting, welding, drywalling, fencing, and snow removal. *See Part 2 - Business Regulation for additional regulations that apply. $150.00 0700 FINANCIAL INSTITUTIONS The fee is payable from every person carrying on the business of a bank, trust company, finance and loan company or brokerage. $500.00 0800 FOOD SERVICES The fee is payable from every person carrying a business for the preparation and sales of foods including but not limited to a restaurant, butcher, deli, bakery, caterer, pizza delivery, and coffee shop. $120.00 0801 FOOD SERVICES - LICENSED The fee is payable from every person carrying a business for the preparation and sales of foods with a liquor primary license. $150.00 0900 FUEL SALES AND SERVICES - Retail The fee is payable from every person carrying on the business of a fuel bar, service station or bulk fuel as follows: $250.00 0901 FUEL SALES AND SERVICES - Bulk The fee is payable from every person carrying on the business of a fuel bar, service station or bulk fuel as follows: $450.00 1000 HAIRSTYLIST/ AESTHETICIAN The fee is payable from every person carrying on the business of professional service to a hairstylist, eyelash technician, nail technician, cosmetologist, aesthetician, barber, tattooing and piercing. $80/person 1100 MANUFACTURING/WHOLESALE The fee is payable from every person carrying on a business of manufacturing, fabricating, wholesale or warehousing materials including but not limited to wood products, food, and all commercial/ industrial uses. $500.00 1101 MANUFACTURING/DISTRIBUTION - CANNABIS $5,000.00 1200 NON - FOR - PROFIT ORGANIZATIONS $50.00 1300 PROFESSIONAL SERVICES The fee is payable from every person carrying on the business of professional service to the public including but not limited to engineering, veterinarians, accounting, barristers, medical professionals, dental professionals, surveyors, land appraisers, physiotherapists, midwives, chiropractors, naturopathic physicians, insurance agents, real estate agents. $100/agent Bylaw No. 2365 - Schedule A - City of Williams Lake Business License Categories & Fees Page 3 1400 RECREATION FACILITIES/CLUBS The fee is payable from every person carrying on the business of a recreation facility (indoor/outdoor) or health spa including but not limited to an aerobic fitness studio, gyms, sports complex, bowling alley, dance studio, performing arts, theatre, bingo hall, and private clubs. $100.00 1500 RETAIL SALES - SMALL The fee is payable from every person carrying on a business of retail sales of goods or products from permanent commercial premises less than 200 square metres of building area. $120.00 1501 RETAIL SALES - MEDIUM The fee is payable from every person carrying on a business of retail sales of goods or products from permanent commercial premises between 200 and 600 square metres of building area. $250.00 1502 RETAIL SALES - LARGE The fee is payable from every person carrying on a business of retail sales of goods or products from permanent commercial premises greater than 600 square metres of building area. $750.00 1600 RETAIL SALES -
