CITY OF WILLIAMS LAKE BYLAW NO. 2430 BEING A BYLAW OF THE CITY OF WILLIAMS LAKE TO REGULATE THE ZONING AND DEVELOPMENT OF REAL PROPERTY WITHIN THE MUNICIPALITY. WHEREAS The Local Government Act empowers the Council of the City of Williams Lake to enact bylaws respecting zoning and certain other developmental matters; AND WHEREAS the Council of the City of Williams Lake has passed Bylaw No. 1825, cited as "City of Williams Lake Zoning Bylaw No. 1825, 2002"; AND WHEREAS the Council of the City of Williams Lake now deems it expedient to repeal Bylaw No. 1825, 2002 and all amendments thereto and replace it with a new and more comprehensive bylaw; NOW THEREFORE the Council of the City of Williams Lake, in open meeting assembled, hereby enacts as follows: Title: 1. That this Bylaw shall be cited as "City of Williams Lake Zoning Bylaw No. 2430, 2025". Repeals: 2. That Williams Lake Zoning Bylaw No. 1825, 2002 and all amending Bylaws thereto are hereby repealed. Schedules: 3. That the following Schedules, attached hereto and forming an integral part of this Bylaw, shall be to provide direction for the orderly development, preservation and enhancement of the City of Williams Lake, and shall apply within the boundaries of the City of Williams Lake as presently constituted. - Schedule 'A' - Explanatory Text - Schedule 'B' - Land Use Map Adoption: 4. Schedule 'A' Explanatory Text Page 2 PART 1 - SCOPE AND ADMINISTRATION 1.1 BASIC PROVISIONS PURPOSE 1.1.1 The purpose of this Bylaw is to provide a clear and efficient system of land use regulation for orderly development, and re-development, of the City having regard for the provisions of the City's Official Community Plan. APPLICATION 1.1.2 This Bylaw applies to all land, buildings and structures including the surface of water within the boundaries of the City. CONFORMITY 1.1.3 No land, water surface, building or structure shall be used or occupied, and no building or structure or part thereof shall be erected, moved, altered or enlarged, unless in conformity with this Bylaw. SEVERABILITY 1.1.4 If any section, subsection, sentence, clause or phrase of this bylaw is for any reason held to be invalid by decision of a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Bylaw. COMPLIANCE WITH OTHER BYLAWS 1.1.5 In addition to this Bylaw, a person is responsible for determining and complying with the requirements of all other applicable City bylaws as well as provincial and federal enactments. UNITS OF MEASURE 1.1.6 Metric units are used for all measurements in this Bylaw. Approximate imperial equivalents are shown in parentheses following each metric measurements for convenience only and do not form part of this Bylaw. 1.2 ADMINISTRATION ENFORCEMENT 1.2.1 The Director of Planning and Development Services, Building Officials, and Bylaw Enforcement Officers are authorized to enforce the provisions of this Bylaw. 1.2.2 The Director of Planning and Development Services, Building Officials, and Bylaw Enforcement Officers shall have the right of entry and may, in compliance with Section 16 of the Community Charter, enter onto any land or into any building to inspect the same and to ascertain whether the provisions of this Bylaw have been carried out. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 3 1.2.3 No person shall interfere with or obstruct the entry of a Bylaw Enforcement Officer or any authorized City representative onto any land or into any building to which entry is made or attempted pursuant to the provisions of this Bylaw. VIOLATIONS 1.2.4 Each person who contravenes or who causes or allows a contravention of any requirement or prohibition imposed by this bylaw shall be guilty of an offence against the Bylaw; and each day such contravention is caused or allowed to continue shall constitute a separate offence. PENALTY 1.2.5 Every person who contravenes or violates any provision of this Bylaw, or who suffers or permits any act or thing to be done in contravention or in violation of any provision of this Bylaw, or who neglects or refrains from doing anything required to be done by any provision of this Bylaw, is guilty of an offence and is subject to the following enforcement provisions: (a) to the penalties imposed by the Offence Act; or, (b) to a fine as imposed by the means of a Municipal Ticket Information under the Community Charter or a Bylaw Notice under the Local Government Bylaw Notice Enforcement Act. 1.2.6 All penalties relevant to contraventions of this Bylaw being addressed within the provisions of Section 1.2.5 (b) are contained in Schedules of the City of Williams Lake Bylaw Notice Enforcement Bylaw No. 2196, as amended or replaced from time to time. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 4 PART 2 - INTERPRETATION 2.1 RULES OF INTERPRETATION 2.1.1 Words, phrases and terms used in this Bylaw that are neither defined in this Bylaw, nor in the Local Government Act, nor the Community Charter, nor the Interpretation Act, shall be given their usual and customary meaning. 2.1.2 Notwithstanding the requirements and limits contained in this Bylaw, those lands which have been designated as development permit areas pursuant to the Local Government Act are additionally subject to the guidelines and conditions specified in the current Official Community Plan Bylaw and all amendments thereto. 2.2 NON-CONFORMING CONDITIONS 2.2.1 A use or structure that does not conform to the provisions of this Bylaw, but was lawful at the time this bylaw was adopted, may benefit from lawful non- conforming status as provided under the Local Government Act. 2.3 UNDEFINED USES 2.3.1 The following guidelines shall be applied in interpreting the use definitions: (c) Typical uses listed in the definitions as examples are not intended to be exclusive or restrictive; and (d) Where a specific use generally conforms to two or more definitions, the specific use is deemed to conform to and be included in that defined use which is most similar in functional purpose or physical characteristics (i.e. a secondary suite is an accessory residential use and not an accessory use). 2.4 DEFINITIONS 2.4.1 The following words, terms, and phrases in this Bylaw, shall have the following meanings: ACCESSORY BUILDING OR STRUCTURE means a building or structure located on a parcel, the use of which building or structure is incidental and ancillary to the principal permitted use of the land, buildings or structures located on the same parcel. Examples include covered decks, sunrooms, gazebos, sheds, detached garages, lean-tos, greenhouses, etc. ACCESSORY RESIDENTIAL means the use of a building or portion of a building as a dwelling unit, being a use accessory to the principal use of the property. Examples include a caretaker suite, security guard suite. ACCESSORY USE means a use combined with or closely related to a principal permitted use of the land, buildings or structures located on the same parcel as listed under the applicable zone. AGRICULTURAL LAND RESERVE means those lands designated pursuant to the Agricultural Land Commission Act. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 5 AGRICULTURE means a use providing for production of farm products. Examples include the production of dairy products, meat products such as cattle, hogs, sheep, poultry and other animals, wheat or other grains, forage crops such as hay, vegetables or other field crops, including hops farms. For Land in the Agricultural Land Reserve is use may be supplemented with uses permitted under the Agricultural Land Commission Act and its regulations. AIRPORT INDUSTRIAL means industrial uses related to the operation of an airport, including terminal buildings; hangars; runways and ground maintenance equipment buildings; aircraft and avionics associated services; vehicle and aircraft parking facilities; water bomber or chemical staging areas for forest protection; flying schools and related facilities; fuel dispensing and storage facilities, office and accessory residential. ANIMAL CLINIC means the use of land, buildings or structures for the care, examinations, treatment, boarding, short term accommodation of animals and pets and may include uses such as pet grooming, and the sale of medicine and supplies. Also known as kennels, vet hospitals, animal shelters, doggy daycare. APPROVING OFFICER means the City's Approving Officer as appointed pursuant to the Land Title Act. ARTS AND CULTURE means the use of a premises to produce dance, live music, creative writing, painting, pottery, crafts, photography, wood carving, and other works of art ae exhibited, produced, performed or sold. ASSEMBLY USE means the occupancy or the use of a building or part thereof by a gathering of persons for religious, charitable, philanthropic, cultural, recreational, or educational purposes, including auditoriums, libraries, conference centers, social halls, group camps, museums, place of worship and similar uses. BACKYARD BEEKEEPING means the keeping of bees accessory to primary residential use, as permitted in this bylaw, and as regulated by City of Williams Lake Animal Control Bylaw No. 2102, as amended or replaced from time to time. BACKYARD HEN KEEPING means the keeping of hens accessory to primary residential use, as they are defined in the Animal Control Bylaw and as permitted in this bylaw, and as regulated by City of Williams Lake Animal Control Bylaw No. 2102, as amended or replaced from time to time. BASEMENT means that portion of a building below the first or ground -oriented level having less than 1.2m of clearance from its ceiling to the average finished grade of the building perimeter. BELOW GRADE FLOOR SPACE means that portion of the gross floor area of the basement that is situated below the average finished grade, the amount to be determined by the application of the following formula: Distance from basement to average finished grade X Gross Floor Area Distance from basement floor to floor level of storey above. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 6 BREWERY means a small-scale brewery that produces beer, ciders, ales, etc. annually and may include accessory uses of wholesaling, tours, tastings, sampling rooms, special events, a lounge, retail sales and related activities as regulated by the BC Liquor and Cannabis Regulation Branch. BUILDING means any structure or portion thereof used or intended to be used for the purpose of supporting or sheltering any use or occupancy, said structure to have at least four walls and a roof supporting structure constructed with wood, concrete, steel or similar material. BUILDING OFFICIAL means the City's building inspector or a duly authorized representative. BYLAW ENFORCEMENT OFFICER means an officer or employee of the City who has responsibility for inspection and enforcement related to bylaw compliance. CAMPGROUND means a site intended for or used for the temporary accommodation of travelers in recreational vehicles (RV) or tents which are not occupied as principal residences and excludes a mobile home or recreational vehicle park, and which site may include one or more of the following as accessory uses limited to the occupants of the campground: laundry facility, washroom, and shower facilities, convenience store, office and recreational facilities. CANNABIS means cannabis as defined in the Cannabis Control and Licensing Act and includes any products containing cannabis. CANNABIS, DISTRIBUTION means the sale and distribution in accordance with a license to distribute cannabis under the Cannabis Control and Licencing Act, the Cannabis Distribution Act, or the federal Cannabis Act. CANNABIS, MANUFACTURING AND PRODUCTION means the production of cannabis in accordance with authorization under the federal Cannabis Act and does not include cultivation for personal use. CELLAR means a space not being occupied for dwelling purposes having the lower floor of which is 1.5m below the average finished grade at the perimeter of the building. CEMETERY means the use of land, buildings, or structures for the internment of human or animal remains and includes burial grounds, columbaria, crematoriums, mausoleums, ash gardens and memorial parks. CHILDCARE, COMMERCIAL means a building, part of a building or premises licensed for a group childcare program, preschool, child minding, out of school care, or special needs day care use pursuant to the Community Care and Assisted Living Act. CHILDCARE, FAMILY means a building, part of a building or premises licensed for family childcare program use pursuant to the Community Care and Assisted Living Act which provides for a maximum of eight children. CITY means the City of Williams Lake. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 7 CIVIC means a use providing for public functions and includes federal, provincial and municipal offices and yards, public schools, medical services, community centres, libraries, museums, emergency and protective services and similar activities. COMMERCIAL means an occupation, employment or enterprise that is carried on for gain or monetary profit by any person. COMMUNITY CARE FACILITY means any facility or premise licensed pursuant to the Community Care and Assisted Living Act provided for persons, that require full time or partial care for meeting basic needs, that may include meal services, medical and personal services, recreation and social programing. Examples include Nursing Homes, Long-term Care, and/or Retirement Homes. COMMUNITY SEWER SYSTEM means a system of sewerage works or a sewage disposal system that is owned, operated and maintained by the City, or by an improvement district or a regional district. COMMUNITY WATER SYSTEM means a system of waterworks which is owned, operated and maintained by the City, or by an improvement district or a regional district, or a water utility as defined in the Water Utility Act. CONTRACTOR SERVICES means premises used for the provision of contractor services, including road construction, landscaping, concrete, electrical, heating and cooling, plumbing or similar services of a construction nature which require on-site storage of equipment and vehicles, warehouse space and accessory sales and office space. COOKING FACILITY means facilities intended or used for the preparation of cooking of food; and includes any room containing cooking appliances, including hot plates or microwave ovens, counters, cabinets, plumbing, or where wiring exists for installation of such facilities. COUNCIL means the Municipal Council of the City. DECK means an unenclosed, outdoor, raised platform or floor structure, more than 0.6m above finished grade, that is accessory to a building. DERELICT means with reference to a vehicle, a vehicle, or part of a vehicle, which is incapable of movement under its own power or unfit for its intended purpose. DEVELOPMENT means a change in the use or an improvement of any land, building or structure and shall include the carrying out of any building, engineering, construction or other operation in, on, over or under land or water, or the construction, addition or alteration of any building or structure. DIRECTOR OF PLANNING AND DEVELOPMENT means the Director of Planning and Development of the City or a duly authorized representative. DRIVE AISLE means the area that provides on-site circulation for vehicles within parkades or surface parking lots, and does not include a street, laneway, alley, pathway, or driveway. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 8 DRIVE-THROUGH means a facility for the provision of food, drink, and other commercial services to persons within a motor vehicle, without the need for such persons to exit the motor vehicle which facility is only permitted on parcels specified by legal description in this bylaw. DWELLING UNIT, ACCESSORY means a self-contained dwelling unit that detached or combined within a building on the same parcel containing cooking, eating, living, sleeping and sanitary facilities. Examples include secondary or accessory suites, in-law suites, laneway homes, and carriage homes. DWELLING UNIT, APARTMENTS means a building which contains four or more dwelling units, with each dwelling unit having its principal access from a common interior or exterior corridor. Examples include market rentals, seniors housing, affordable housing, independent living apartments. DWELLING UNIT, MULTI-PLEX means a building which contain two or more dwelling units, with each dwelling unit having its principal access from a separate ground-oriented entrance, and which may have its dwelling unit separated by a common wall running along an interior lot line. Examples include duplexes, triplexes, townhouses, row housing/semi-detached. DWELLING UNIT, SINGLE DETACHED means a self-contained, detached dwelling unit used or intended to be used by one or more persons and usually containing cooking, eating, living, sleeping, and sanitary facilities that meets the BC Building Code. EAVE means the projecting lower edges of a roof overhanging the wall of a building. EDUCATIONAL means a place of learning which offers post-secondary education courses, including business schools, colleges, technical, trade and vocational schools, universities or special education programs, that may include administrative, social, research and recreational facilities and associated housing to the institution. EMERGENCY SHELTER means a facility or residential facility staffed and supervised by a public authority or non-profit agency for the purpose of providing temporary sleeping accommodation for people in need of emergency shelter and may include meal services, support services as well as administrative and office space for use by program staff. Examples include homeless shelters. ENTERTAINMENT means a commercial use that is contained within a building providing recreational or leisure opportunities to the public and may be a licensed establishment that includes amusement arcades, bowling alleys, pool halls, cinemas, social clubs, theatres, casinos and similar uses, but specifically excludes adult-oriented entertainment. ENTERTAINMENT, ADULT-ORIENTED means businesses that derive a substantial portion of their income from sexually explicit materials or performances and may be a licensed liquor establishment, have live entertainment and / or exotic dancing. Examples include adult bookstores and video stores, adult arcades, theaters, and cabarets. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 9 FAÇADE or FACE means the portion of any exterior elevation of a building or structure exposed to public view extending from the finished grade to the eaves or to the top of a parapet wall and the entire length of the building elevations, including all areas divided by firewalls. FENCE means a structure that is used to form a boundary to enclose or screen an area but does not include a retaining wall. FLOOR AREA means the space on any storey of a building between exterior walls and required firewalls including the space occupied by interior walls and partitions, but not including exits, vertical service spaces and their enclosing assemblies; For the purpose of a multi-family dwelling or commercial building, floor area or gross floor area excludes: (a) any portion of a floor used for parking purposes, unless such parking is a principal use; (b) any portion of a floor used for common laundry purposes, unless such laundry is a principal use; (c) any portion of a basement or cellar containing heating, laundry, storage facilities or recreational area; and, (d) uncovered swimming pools and open sun decks; For the purpose of a single detached dwelling and duplexes, floor area or gross floor area: (a) includes garages, carports, basements (exclusive of the below finished grade floor space) and covered decks; and, (b) excludes cellars. FLOOR AREA RATIO (FAR) means the figure obtained when the floor area of all buildings on a lot is divided by the area of the lot (FAR = Total Building Floor Area/Total Lot Area). FOOD ESTABLISHMENT means a building or part of a building used primarily to serve or sell food the public for immediate consumption. Examples include a restaurant, cafe, cafeteria, delicatessen, take-out counter, ice-cream parlour, tea or lunchroom, coffee shop, snack bar. FOOD ESTABLISHMENT, LICENSED means a building or part of a building where beverages with or without food are sold and served to the public pursuant to the Liquor Control & Licensing Act such uses as a neighbourhood pub, sports bar, restaurant. FRONTAGE means that length of a lot boundary which abuts a highway. GARAGE means an accessory building, portion of a principal building, designed and used primarily for the storage of vehicles and includes a carport. GOLF COURSE means an area used for playing golf, and typically includes a club house, driving range, accessory retail sales and a restaurant. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 10 GRADE in relation to a driveway or parking space means the steepness of the slope measured using the full rise and run of the driveway. GRADE, FINISHED means the lowest of the average levels of finished ground adjoining each exterior wall of a building, or a retaining wall determined by average levels of finished ground (see figure below). GREENHOUSE AND NURSERY means an enclosed, partially enclosed building or structure or unenclosed area for the cultivation, harvesting, storing and selling of vegetables, fruits, grains, flowers, trees, bushes, bedding plants, sod and similar products, and may include retail or wholesale of landscaping and gardening products and materials. HABITABLE AREA means any room or space utilized for designed for eating, sleeping or human occupancy, excludes bathroom, kitchen, utility room, workroom, furnace room and storage room. HEALTH SERVICES, MAJOR means a facility providing room, board, and surgical or other medical treatments for the sick, injured or infirm including outpatient services and may include accessory staff residences, food and beverages services, medical and diagnostic laboratories and pharmaceutical dispensary. Examples include hospitals, morgues, treatment centers, long term care facilities. HEALTH SERVICES, MINOR means a premise use for the provision of physical or mental health services on an out-patient basis. Services may be preventative, diagnostic, treatment, therapeutic, rehabilitative or counseling nature. Examples include medical and dental offices, chiropractors, acupuncture clinics, vocational rehabilitation, blood banks, health clinics, maternity care, and may include accessory medical diagnostic laboratories, the retail sale or rental of medical supplies and pharmaceutical dispensaries. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 11 HEIGHT means, in reference to a building or structure, the vertical distance from the average finished grade at the perimeter of the building or structure, or, in the case of a detached carport or garage, from the finished floor level, to the highest point of the roof surface of a flat roof, to the deck line of a mansard roof, and to the mean level between the eaves and the ridge of a gable, hip, gambrel or other sloping roof, and in the case of a structure without a roof, to the highest point of the structure (see figure below). HELIPORT means a permanent facility that is used for the landing and takeoff of helicopters, said facility being ancillary to the principal use of the land or building. HIGHWAY means a public street, road, path, lane, walkway, trail, bridge, viaduct, thorough-fare and any other public way and may include arterial, collector and local but specifically excludes private rights of way on private property. HIGHWAY, PROVINCIAL means Cariboo Highway No. 97, or Chilcotin Highway No. 20, which are Arterial highways under the jurisdiction of the Ministry of Transportation and Transit, as defined in the Transportation Act. HOBBY FARM means agricultural activity that is not the principal use of the parcel and does not include the use of land, buildings and structures for the commercial production of poultry, livestock, fur bearing animals or the growing of mushrooms. In the case of horses, cattle, sheep, goats, or other camelids, raised by personal use, no more than two (in total) shall be permitted on an individual property. HOME-BASED BUSINESS means a commercial occupation or profession carried on by a resident of the dwelling unit which is clearly incidental and accessory to the use of the parcel for residential purposes. HOTEL means a building providing temporary overnight accommodation of the traveling public in guest rooms or suites. Hotels may provide concierge service, cleaning service, meeting rooms, dining services, and other guest services or amenities. Examples include apartment hotels, hostels, inns, and motels. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 12 INDUSTRIAL, HEAVY means a use providing resource processing, manufacturing, waste management, recycling, transportation and delivery, energy utilities, heavy construction and machinery, resource use, extraction support that may have administrative or sales offices, storage buildings, structures and yards for associated uses and accessory residential. Examples include all light industrial uses and solid waste facilities, sawmills, concrete and asphalt plants, power plants, storage and salvaging yards and rail use. INDUSTRIAL, LIGHT means the processing or storage of goods, light manufacturing, assembly, warehousing, distribution, service industrial such as storage, cleaning, repairing, or renting, trade and technology operations, may include administrative and sales offices, storage buildings, structures and yards for associated uses as well as accessory residential. Examples include bulk loading and storages, transportation and delivery, service construction, metal fabricating, storage and salvaging yards, equipment sales and repair yards, bulk landscaping supplies, research facilities, occupational support, mini storage and rail use. INSTITUTIONAL refers to land or buildings used for public or non-profit purposes that serve the community's needs, often involving public services, including educational, health services, religious assembly, public service or community facilities and activities. LANE means a highway intended to provide secondary access to lots at the side or rear. LOADING SPACE means a space for the loading or unloading of a vehicle, either outside or inside a building or structure, but specifically excludes manoeuvring aisles and other areas providing access to the space. LOT means a parcel of land which is legally defined either by registered plan or legal description. LOT, CORNER means a lot which abuts two or more roads where the interior angle of the intersection is less than 135 degrees. LOT COVERAGE means the total horizontal area of all buildings or parts thereof, as measured from the outermost perimeter of all buildings on the lot and expressed as a percentage of the total area of the lot, and includes the area covered by carports and elevated parking areas, but excludes steps, eaves, cantilevered balconies, open air sundecks and uncovered pools. LOT LINE, EXTERIOR means the lot line or lines common to the parcel and an abutting highway (except a lane), other than the front lot line. LOT LINE, FRONT means the lot line common to the lot and the street or, where there is more than one street, the lot line common to a street and the portion of the lot designated as front yard. LOT LINE, INTERIOR means the lot line or lines other than a front or rear lot line common to the parcel and another parcel or common to the parcel and a lane. LOT LINE, SIDE means an interior or exterior lot line. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 13 LOT LINE, REAR means the lot line or lines opposite to and most distant from the front lot line or, where the rear portion of the lot is bound by intersecting lot lines, the point of such intersection. LOT SIZE means the same as site area. LOT SIZE, MINIMUM means the smallest area into which a parcel may be subdivided. LOT WIDTH means the distance between the side lot lines as measured at the front lot line and at the rear lot line; for panhandle lots, the distance excludes the narrow strip of land that forms the panhandle portion of the lot. MANUFACTURED HOME means a single or multiple section dwelling unit that is manufactured and assembled in a factory to Canadian Standards Association Z240MH standards and designed to be transportable by wheels. MANUFACTURED HOME PARK means a lot used or occupied by any person for the purposes of providing spaces for the placement of four or more manufactured home dwellings and for imposing a charge or rental fee for the use of such space. METAL SHIPPING CONTAINERS means a purpose-designed metal cargo containers constructed for the transportation of goods and materials for storage purposes. Also known as cargo containers, roll off containers, sea cans, and freight containers, but does not include dumpsters and recycling receptacles intended for neighbourhood collection. MINI STORAGE FACILITY means a building or part of a building, divided into individual lockers, each providing storage space for the storage of non- hazardous items. MODULAR HOME means a dwelling unit that is factory built to the CAN/CSA A277 standards installed on a permanent foundation compliant with the BC building code. MOTOR VEHICLE includes automobiles, trucks, motorcycles, all-terrain vehicles and snowmobiles, recreational vehicles, and buses. NATURAL BOUNDARY means the visible high water mark on any watercourse where the presence and action of the water are so common and usual, and so long continued in all ordinary years, as to mark up on the soil of the bed of the watercourse a character distinct from that of the banks thereof, in respect to vegetation as well as in respect to the nature of the soil itself, and in cases where there is no visible high water mark shall mean the average high water mark. OFFICE USE means the occupancy or use of a building for the purpose of carrying out business or professional activities but not retail sales. Examples include accounting firms, financial institutes, insurance agencies, engineering, lawyers, real estate offices, etc. OFF-STREET PARKING means the use of land for the parking of vehicles other than on a highway including the parking spaces and the manoeuvring aisle. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 14 OUTDOOR STORAGE means the use of land outside of an enclosed building where construction materials and equipment, new building materials, stone products, utility equipment or other materials, goods, products, vehicles, equipment or machinery are stored, baled, piled, handled, sold or distributed. PANHANDLE LOT means any parcel that has its frontage at the end of a narrow access strip that is an integral part of the parcel. The access strip is not included when calculating the area of such parcel or the front yard setback requirement. PANHANDLE LOT, FRONT LOT LINE means a lot line adjoining and approximately perpendicular to the access strip; excludes any lot line in the access strip. The front property line of the panhandle lot must extend to the side lot line opposite the access strip, forming the rear lot line of the parcel in front. PARCEL means any lot, block, or other area in which land is held or into which it is subdivided but does not include a highway. PARCEL DEPTH means the distance between the front lot line and the most distant part of the rear lot line of a parcel. PARK means public land used or intended for both active or passive recreational uses; and includes all greenspace, gardens, facilities and apparatus, playing fields, playground equipment, utilities, archaeological, historical, cultural and natural sites, buildings and other structures that are consistent with the general purposes of public parkland. PARKING AREA means a portion of a lot that is used to accommodate off-street parking. PARKING SPACE means the space for the parking of one vehicle either outside or inside a building or structure but excludes maneuvering aisles and other areas providing access to the space. PERMITTED USES means the uses of the land, buildings or structures that are permitted in the applicable zone. PERSONAL SERVICES means a use whereby professional or personal services are provided together with the sale of goods, wares, merchandise, articles or things accessory to the provision of such services. Examples include hairdressers, gyms, shoe repair, dry cleaning, massage therapy, personal/home care and spas. PREMISES means the buildings and structures located on a parcel of land. PROPERTY LINE means lot line. PUBLIC SERVICE means a use providing for the essential servicing of the City with water, sewer, electricity, telephone and similar services where such use is established by the City, by another government body or by a company operating under the Utilities Commission Act and includes broadcast transmission facilities, sewer, watermain and power line easements, pump houses, substations, telephone exchanges and traffic controls. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 15 RECREATION FACILITY means a facility that may have indoor or outdoor components used and equipped for the conduct of sports and leisure activities and includes bowling alley, games court, curling and roller rink, fitness centre, swimming pool, fairground and similar activities and may combined with concessions, retail sales, programs, services and office use. RELIGIOUS ASSEMBLY means the use of premises for the assembly of persons for worship and related religious activities and may include accessory community services, programs or activities. Examples include chapels, churches, convents, gurdwaras, monasteries, mosques, parish halls, synagogues, and temples. RESOURCE means a use providing for the conservation, management or extraction of primary forest, mineral and other resource materials and includes the preliminary grading, cutting or crushing of such materials for shipment, but excludes all manufacturing of products and any processing not specifically included. RETAIL SALES means premises where goods, merchandise and other materials are offered for sale to the general public and includes limited onsite storage or limited seasonal outdoor sales to support that store's operations, such as appliance, automotive parts, clothing, gift, grocery, hardware, pharmaceutical, and sporting goods stores. RETAIL SALES, BEER AND WINE means a retail premises as licensed pursuant to the Liquor Control and Licensing Act. RETAIL SALES, CANNABIS means the business of selling cannabis and cannabis accessory products for off-premises consumption as licensee pursuant to the Cannabis Control and Licensing Act. RETAIL SALES, CONVENIENCE means the retail sales of a limited selection of everyday items such as beverages, confectionery, groceries, automotive accessories, personal care items, pharmaceutical items, printed materials, tobacco, and tourism or seasonal related products. RETAINING WALL means a structure supporting or intended to support or retain soil, loose rock, or gravel which is on a slope greater than the angle of repose. SCREENING means a continuous fencing, wall, compact hedge or combination thereof, supplemented with landscape plantings that effectively provides a visual separation or enclosure for the site, and is broken only by limited access. SERVICE COMMERCIAL means premises used for business of sales, services and repairs that excludes daily household needs, such use as automotive, recreational and equipment sales, service repair and rental, car washes, mobile home sales, building supplies outlets, recycling depots, contractor services, greenhouses and nurseries and similar activities including associated office and storage areas. SERVICE STATION, MAJOR means premises used for the bulk storage and distribution of petroleum products, gasoline pumping stations, sales of propane and other automotive products including key lock or card lock services. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 16 SERVICE STATION, MINOR means the use of land and structures for gasoline pumping stations and may have a convenience store, the retail sales of propane and motor vehicle accessories. SETBACK means, depending on the context: (a) The minimum permitted distance between a building or structure and the designated lot lines; or (b) The required minimum distance from a watercourse, or other body of water to the building or structures; or (c) The minimum separation between buildings or structures on a lot. SHORT-TERM RENTAL ACCOMMODATION means an accommodation provided to members of the public in a short-term rental operator's primary residence, in exchange for money or other consideration, for a period of less than 30 consecutive days. The accommodation may include the rental of an entire dwelling unit or bedrooms, with or without the provision of breakfast served on the property. Examples include but not limited to bed and breakfast, boarding, lodging. SIGN means a letter, numeral, picture or attention drawing device displayed out of doors in such manner as to be visible from a highway. SITE AREA means an area of land considered as a unit devoted to a certain use or occupied by a building or structure or group of buildings or structures united by a common interest or use but excludes the access strip portion of a Panhandle Lot. SOLID WASTE FACILITY means a facility designed, constructed and operated for the collection, processing, transferring or disposal of the solid waste stream or components thereof, but not inclusive of household or neighbourhood composting. Examples include transfer stations, material recycling facilities, composting facilities and disposal facilities. STORAGE AND SALVAGING YARDS means a premise that is used for wrecking, salvaging, dismantling or storing of used vehicles, equipment, materials such as woods, fiber, metal and scrap yards. STOREY means the habitable portion of a building that is situated between the top of any floor and the top of the floor or ceiling immediately above it. STRATA LOT means a strata lot as defined by the Strata Property Act. STRUCTURE means any construction or development fixed to, supported by or sunk into land or water. SUBDIVISION means the division of land into two or more parcels, whether by plan, apt descriptive words, or otherwise. SUPPORTIVE HOUSING COMPLEX means a residential facility that provides affordable housing opportunities for vulnerable persons that is linked to voluntary and flexible support services and operated by a non-profit Society incorporated in accordance with the Societies Act. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 17 TELECOMMUNICATIONS ANTENNA TOWER means a device that requires a licence from the Federal Government and is used to receive and/or to transmit radio- frequency signals, microwave signals, or other communications energy transmitted from other antennas. TOURISM means a premise used for a range of activities and industries that cater to travelers for leisure, business or personal purposes for a short period of time, including accommodation, transportation, attractions, public amenities, souvenir or cultural shops and activities or businesses related to the tourism industry. TRAILS AND AMENITIES means a use undertaken in an outdoor setting including nature trails, walking and recreation trails, green space, open space, botanical gardens, and amenities such as benches, picnic tables, rest stops, public facilities, parking areas. TRANSPORTATION AND DELIVERY FACILITY means premises used for the sorting and shipping of packages, transportation vehicles, courier services, fleet and trucking services and may include office use or storage compounds such as mail courier, moving companies, shipping companies. UTILITY USE, PUBLIC means the use of land whereby water, sewer, electrical, telephone, cable and other similar public services are provided and maintained. WAREHOUSE means a building used for the receiving and storage of goods or personal property for compensation and includes the storage of goods by a distributor or supplier who markets goods for retail sale at other locations and includes limited retail sales from the site. WATERCOURSE means any natural or man-made depression includes the sea or any lake, river, stream, creek, spring, ravine, swamp, gulch, surface source of water supply or source of groundwater supply, whether enclosed or in a conduit. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 18 YARD means that portion of a parcel that may not be built upon as defined by the minimum setback requirements (see figure below). ZONE means the areas into which the City is divided in accordance with the map or maps shown and attached to this Bylaw and for which specific regulations are hereinafter outlined for each area. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 19 PART 3 - GENERAL DEVELOPMENT PROVISIONS 3.1 GENERAL LAND USE REGULATIONS PROHIBITED USES 3.1.1 The following Uses are prohibited in all zones: (a) all uses except those specifically permitted by the Bylaw; (b) any use shall be carried on wholly or partly in a tent, recreation vehicle, travel trailer, or passenger vehicle, except as expressly permitted in this Bylaw; (c) the use of a tent, recreation vehicle, travel trailer, or passenger vehicle used for habitation. 3.1.2 The outdoor storage of vehicles (including parts thereof) which are in a state of disrepair, derelict, wrecked, or being dismantled for salvage or which are not insured for the current year, except as specifically permitted by this Bylaw. USES ALLOWED IN ALL ZONES 3.1.3 The following uses are permitted throughout all zones: (a) accessory uses; (b) greenspace, plazas and playground equipment; (c) public utility use (but not including sewage treatment plants or electrical substations or facilities); (d) off-street parking area; (g) short-term rental accommodations subject to Section 3.11; (h) place of worship. 3.2 AGRICULTURAL LAND RESERVE 3.2.1 Notwithstanding anything contained in this Bylaw, land within the City designated as "Agricultural Land Reserve", pursuant to the Agricultural Land Commission Act, shall be subject to: (a) the Agricultural Land Commission Act; and (b) regulations made pursuant to the Agricultural Land Commission Act; and (c) relevant orders of the Provincial Agricultural Land Commission made pursuant to the Agricultural Land Commission Act. 3.3 ACCESSORY BUILDINGS AND STRUCTURES 3.3.1 Accessory buildings and structures are permitted in all zones and shall comply with the building siting (setback) requirements of the principal building except where alternate standards are specified in the Regulations section of any Part of this bylaw. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 20 3.3.2 Accessory buildings attached to the principal Building shall be considered part of the principal building. 3.3.3 An accessory building or structure shall not be used as a dwelling unit, except in the case where an accessory residential use is permitted by the Bylaw. 3.4 ACCESSORY DWELLING UNITS 3.4.1 Accessory dwelling units must have separate entrances from the exterior of the building, a single cooking facility, one or more bedrooms and one or more bathrooms that meets the BC Building Code regulations. 3.4.2 Accessory dwelling units shall provide a well-lit 1.2m (3.9ft) wide access path route from the Street to the entrance of the unit. 3.4.3 Each dwelling unit shall have a clearly identifiable civic addressing signage visible from the street or lane. 3.4.4 Off-street parking shall be required in accordance with Part 5 of this bylaw. 3.4.5 Additional water and sewer utility fees will be charged for each dwelling unit in accordance with City of Williams Lake Waterworks Bylaw No. 1972, as amended or replaced from time to time, and City of Williams Lake Sewerage Works Management Bylaw No. 871, as amended or replaced from time to time. 3.5 CANNABIS RELATED REGULATIONS 3.5.1 Cannabis retailer must be 300m (984ft) (in a straight line from the closest lot line to the closest lot line) from public or private schools, group childcare (excluding family day cares), and Cariboo Memorial Recreation Centre. 3.5.2 Cannabis retailer must be 500m (1,640ft) (in a straight line from the closest lot line to the closest lot line) from another lot where a cannabis retailer is licensed and permitted, whether or not a cannabis retailer is active or not. 3.5.3 Only one cannabis retailer is allowed per lot. 3.5.4 No drive-through and mobile cannabis retail is permitted. 3.5.5 No building or structure or portion thereof used for cannabis production or distribution shall be located closer than 100m to any zone that allows residential use. 3.5.6 The interior setback for a principal building for cannabis manufacturing and production or cannabis distribution may be reduced to 15m (49ft) in cases where the abutting property is zoned Industrial (M-2). 3.5.7 An accessory building or structure used for security purposes for a cannabis production facility does not have to comply with the required 100m separation setback from any zone that allows residential. The general setback provisions for accessory residential use of the Industrial (M-2) zone will apply to a building or structure used for security purposes. 3.5.8 No outdoor storage of cannabis products or processing equipment is permitted in any zone. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 21 3.5.9 Outdoor sales of cannabis are not permitted. 3.6 EXCEPTIONS TO HEIGHT REQUIREMENTS 3.6.1 A chimney, church spire, flagpole, elevator, mechanical and ventilation devices, or similar objects not used for human occupancy are not subject to the height limitations of this Bylaw, provided that such structures shall not occupy more than 20% of the roof area of a building. 3.7 SIZE, SHAPE AND SITTING OF BUILDINGS AND STRUCTURES 3.7.1 No building or structure shall be constructed, reconstructed, altered or extended so as to cause any existing building or structure on the same lot to violate the provisions of this Bylaw. 3.7.2 The following items shall be sited to the rear of the parcel in a residential zone: satellite dishes, solar panels, residential light poles, heat pumps. 3.8 PROJECTIONS INTO REQUIRED YARDS 3.8.1 The following features may project into a required front, side or rear yard: Steps, eaves and gutters, cornices, sills, chimneys, or other similar features, provided that such projections do not project more than 1m (3.2ft) into the required yard or 0.65m (2ft) in the case of a side yard of less than 3m (10ft) in width. 3.8.2 Balconies and sunshades, provided that such projections do not project more than 1m into the required yard (see figure below). Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 22 3.9 SPECIAL SITING AND SETBACKS CIRCUMSTANCES SETBACKS - SITE TRIANGLE 3.9.1 No hedge, planting, tree, fence, signs, or other structures shall be erected, placed, or maintained within the corner visibility triangle to a height greater than 1.2m (4ft). 3.9.2 On a corner parcel in any zone there shall be no obstruction to the line of vision within the sight triangle, being a triangular area formed by extending a minimum of 6m boundary along the parcel lines from the point of the exterior corner intersection of the parcel lines and a line connecting these two points as illustrated in the figure below. SETBACKS - ARTERIAL HIGHWAYS 3.9.3 Notwithstanding the setback requirements specified in each of the zones, no building shall be located within 4.5m (15ft) of the property line fronting on a Provincial Highway, except where a lane provides secondary access in which case the setback may be reduced to 3m (10ft). 3.9.4 Furthermore, proposed developments adjacent to a Provincial Highway will be reviewed for compliance with Section 4.01 of the BC Highway Act regulations. SETBACKS - WATERCOURSE 3.9.5 Notwithstanding the setback requirements specified in each zones, no building shall be located within 30m (98ft) of the natural boundary of any other natural watercourse or source of water supply. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 23 SETBACKS - HEAT PUMPS AND HVAC 3.9.6 Heat pumps and mechanical units shall be subject to the setbacks for accessory buildings or structures. 3.10 STORAGE AND METAL SHIPPING CONTAINERS GENERAL STORAGE REGULATIONS 3.10.1 No lot in a residential zone shall be used for the storage of materials, vehicles, or as a wrecking or junk yard, as provided in City of Williams Lake Good Neighbour Bylaw No. 2194, as amended or replaced from time to time. 3.10.2 Any storage that is not contained within a building, on a lot within a commercial or industrial zone, which abuts a residential zone or is directly across a road or lane from a residential zone, shall be enclosed by a landscape screen that is no less than 2m (6ft) high. This enclosure shall comply with the visual clearance provisions as specified in Section 3.9. METAL SHIPPING CONTAINERS 3.10.3 Metal Shipping Containers shall conform to the following regulations: (a) Metal shipping containers, are permitted as either a Temporary Use or a Permanent Use, as specified and regulated in each applicable zone. (b) All metal shipping containers must: i) Be painted; ii) Be kept clean at all times; and iii) Not be rusty or in a state of disrepair. (c) Metal shipping containers must meet the minimum lot line setbacks for Accessory Buildings and Structures as detailed within the specific zone regulations. (d) Metal shipping containers are not permitted to be used for: i) The installation of signage; ii) Advertising; iii) Graffiti or murals. (e) Placement Restrictions - Metal Shipping Containers are not permitted to be placed between the principal building and the front property line (street). USE AS PART OF A BUILDING OR BUILDING COMPONENT 3.10.4 Metal Shipping Containers must meet the following requirements to be used as part of a building or building component: (a) Where a metal shipping container is used as part of a building constructed in accordance with the current edition of the BC Building Code, the design must be reviewed and prepared by a registered professional, as defined in the BC Building Code. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 24 (b) Upon the issuance of a valid building permit, the metal shipping container shall no longer be considered as such and shall be classified as a building or portion of a building. (c) Metal shipping containers must not be used for human habitation, unless: i) Permitted under a valid building permit in compliance with City of Williams Lake Building Bylaw No. 2274, as amended or replaced from time to time, and the current edition of the BC Building Code. (d) Where a Metal shipping container is modified and certified in accordance with CSA A277 'Procedure for Certification of Prefabricated Buildings', for the purpose of this Bylaw it shall be deemed to be a manufactured home or portion of a manufactured home, and not a Metal Shipping Container. TEMPORARY USE OF METAL SHIPPING CONTAINERS 3.10.5 Metal Shipping Containers may be temporarily placed on construction sites for storage incidental to an active construction project, provided the following conditions are met: (a) A valid building permit for construction has been issued and remains active; and (b) The metal shipping container be removed within 30 days of: i) acceptance of a final inspection; ii) the suspension or cessation of construction, as determined by the Building Official; iii) expiration of the building permit. 3.10.6 One Metal Shipping Container may be placed temporarily on a property, for non- construction purposes, for up to 30 days with prior written approval from the Director of Planning and Development, provided the following conditions are met: (a) No structures may be attached to or placed on top of the container during this period. (b) A one-time extension of 30 days may be requested. (c) The temporary placement of a Metal Shipping Container for the following purposes shall not require a building permit: i) Moving; ii) Special events, with written approval from the Manager of Planning and Development; iii) Storage of non-flammable and non-combustible materials only; iv) Notification to the City, including intended use and storage on the prescribed form. STACKING OF METAL SHIPPING CONTAINERS 3.10.7 Metal shipping containers may be stacked vertically, up to a maximum of two (2) containers, within Industrial Zones. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 25 3.11 SHORT-TERM ACCOMMODATIONS 3.11.1 Short-term rental accommodation is permitted in residential and mixed-use zones, subject to compliance with all requirements and provisions of the Short- Term Rental Accommodations Act. 3.11.2 Short-term rental accommodation must have a valid license issued under City of Williams Lake Business License Bylaw No. 2365, as amended or replaced from time to time. 3.11.3 Short- term rental accommodations must occupy a building or a portion of a building that complies with the BC Building Code requirements for life and safety. 3.12 HOME-BASED BUSINESS 3.12.1 A home-based business may only be conducted in a zone in which it is permitted, and all of the following conditions must be satisfied: (a) All activities shall be conducted entirely within the principal building or accessory buildings and rear yards. (b) Home-based business use, including storage, shall occupy no more than 25% of the floor area of the principal building and accessory buildings. (c) No automobile, boat, or heavy machinery servicing or repair is permitted as a home-based business use. (d) The use or occupation shall be operated by a person resident in the dwelling unit and shall not involve the employment of more than one full-time or two part-time employees on the premises. (e) Home-based business use may require additional approval requirements from agencies such as Interior Health Authority for the approval of a business license. (f) All outdoor advertising sign shall comply with the requirements of City of Williams Lake Sign Bylaw No. 2360, as amended or replaced from time to time. (g) Home -Based Business operations shall be in accordance with City of Williams Lake Good Neighbour Bylaw No. 2194, as amended or replaced from time to time, and enforcement shall be in accordance with any applicable Council policy or Bylaw. (h) A home-based business, its employees and its suppliers shall not use on-street parking. (i) Home-based businesses where customers or clients are permitted to enter the business: one additional parking space must be provided, over and above the minimum parking requirements of the zone, which may be provided in a stacked configuration. (j) Motor vehicles using off-street parking shall include no more than one vehicle related to the home-based business and comply with City of Williams Lake Traffic Control Bylaw No. 2093, as amended or replaced from time to time. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 47 PART 5 - LOADING AND PARKING PROVISIONS 5.1 GENERAL PROVISIONS METHODS OF CALCULATION 5.1.1 When the calculation of the total parking and loading requirements results in a fractional figure, it shall be rounded upward to the nearest whole number. 5.1.2 If more than one use is located on a parcel or parking collectively serves more than one building or use, the parking requirement would thus be calculated based on the site use with the greatest amount of parking. 5.1.3 A loading space shall not be considered as an off-street parking space for the purpose of calculating the parking spaces provided. 5.1.4 If a use is not listed, the number of spaces shall be calculated on the basis of the most similar use that is listed. 5.1.5 For existing buildings, structures or uses, all parking spaces required shall be the lessor of: parking spaces existing at the date of adoption of this Bylaw; or the parking spaces required by applying the regulations set out in this Part to the existing buildings, structures or uses. SITE ACCESS AND DRIVEWAYS 5.1.6 No access to an off-street parking area from a highway shall be closer than 8m (26ft) from the intersection of two highways measured at the property lines. 5.1.7 The access to all off-street parking spaces from a highway shall not be less than 6m (20ft) in width and not more than 9m (30ft) in width. 5.1.8 Access to and egress from a lane may be permitted along the entire length of a lot line that adjoins that lane. 5.1.9 Where points of access and egress abut a landscape screen such screening shall not be more than 0.6m (2ft) in height for a distance of not less than 6m (20ft) from all points of access and egress. 5.1.10 Turn around facilities are to be provided for any dead-end access driveway and driveways fronting an arterial highway in accordance with the BC Building Code. 5.1.11 Maximum driveway grade across the boulevard shall be 5%, and the maximum grade within the lot shall not exceed 12%. 5.1.12 Driveways for four or fewer dwelling units shall meet the following requirements: (a) Minimum driveway width shall be 6m (20ft); (b) Driveway access roads must have a minimum of 9m (30ft) centre line radius on all curves and corners along the road; (c) (e)A maximum of one access driveway will be permitted, except if abuts a lane; and Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 48 (d) Curb and gutter shall be installed as required; i) When required on access roads, curbs must tie to City curb via a curb return. 5.1.13 Driveways for five or more dwelling units, commercial or industrial uses: (a) Minimum driveway width shall be 6m (20ft). (b) Curb and gutter shall be installed as required; When required on access roads, it must tie to City curb via a curb return. (c) Driveway surface water must be contained on-site. (d) Driveway access roads must have a minimum of 11.0 m (36ft) inside edge radius on all curves and corners along the road; (e)A maximum of two access driveway will be permitted, except if abuts a lane. DRIVE-THROUGHS 5.1.14 The minimum vehicle stacking length from the order point to the street (or conflicting aisle with access to the street) shall be 60m (10 vehicles) for basic restaurants and cafes. For high volume restaurants and cafes, the minimum stacking length shall be 120m (20 vehicles). 5.1.15 For all other developments (banks, pharmacies, etc), the minimum stacking length should be 30m (five vehicles). 5.1.16 The minimum stacking length between the order point and the pickup window at restaurants and cafes should be 24m (four vehicles). 5.1.17 The minimum drive-through lane width should be 3.65m (12ft), with widening in corners as required. 5.1.18 The drive-through shall be set back at least 1m from any street line, and at least 3m (10ft) from any property line abutting a residential property (with appropriate landscape screening). 5.1.19 Drive-in businesses, such as fuel Bars, Oil Change Services, and/or Car Washes, shall provide a magazine storage (stacking) area that is a minimum of 2.75m (9ft) wide. 5.1.20 The magazine storage area shall be a minimum of 18m (three vehicle lengths) long, measured from the entrances of the building or service to the street Line or to any internal Access Road or Circulation Aisle that provides direct access from the street. GARBAGE COLLECTION 5.1.21 The vehicle approach to the garbage bin(s) shall have a maximum grade of 3% for a minimum of 15m (50ft). 5.1.22 The approach shall have a 3.6m (12ft) long hard-surfaced apron cable of withstanding a front axle weight of 16,300 kg. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 49 5.1.23 Access to the bins must provide an 11m (36ft) turning radius for garbage collection vehicles. 5.2 ACCESSIBLE PARKING REGULATIONS ACCESSIBLE PARKING REQUIREMENTS 5.2.1 Accessible Parking Spaces shall be provided in accordance with the following Table: Land Use Min. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 50 ACCESSIBLE PARKING DESIGN CONSIDERATIONS 5.2.4 All parking spaces shall: (a) have a firm, slip resistant and level surface with grade not exceeding 2%. be located close, and be accessible, to an entrance conforming to the current edition of the British Columbia Building Code; (b) Use high-contrast diagonal lines on pedestrian aisles; and, (c) require signage at the front of stalls 1.2m (4ft) high and pavement markings showing the universal wheelchair symbol to denote accessible parking stalls. 5.2.5 In larger parking lots, signage is required directing drivers to accessible parking areas. 5.3 LOADING REGULATIONS LOADING REQUIREMENTS 5.3.1 Loading Space shall be provided in accordance with the following table: Land Use Min. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 51 LOADING SPACE DESIGN CRITERIA 5.3.5 An off-street loading area shall: (a) not be located within a required front or side yard if there is a rear lane; and be constructed so as to permit unobstructed access to and egress from each loading space at all times and not obstruct access or egress to any required off-street parking space; and, (b) shall be clearly marked with the words "LOADING SPACE ONLY" or delineated with diagonal lines on a sign adjacent to the space or on the wall facing. 5.3.6 A provision shall be made for access by vehicles to all off-street loading spaces by means of a 6m (20ft) wide maneuvering aisle and shall be located so that each separate use within a development has access to a space. 5.4 OFF-STREET PARKING REGULATIONS OFF-STREET PARKING REQUIREMENTS 5.4.1 Off-street Parking Spaces shall be provided in accordance with the following Table: Land Use Min. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 54 5.4.7 Space for Maneuvering should be provided at any dead-end aisle in a parking lot, equivalent to one standard vehicle parking space. 5.4.8 For commercial and institutional uses with at least 10 required parking spaces, the parking lot shall have an accessible pedestrian connection (comprised, 1.5m (5ft) sidewalk and crosswalks where appropriate) to provide direct connection between the building entrance(s) and the city pedestrian network. 5.4.9 Required off street parking areas may not be used for the display, storage, sale, or rental of vehicles, trailers, boats, or other products and materials. OFF-STREET PARKING DESIGN CRITERIA 5.4.10 All required off-street parking areas shall be designed to permit safe and unobstructed passage of expected vehicle types, including delivery vehicles, waste collection vehicles, and emergency vehicles. This shall be demonstrated by appropriate vehicle path analysis as required. 5.4.11 All required off-street parking areas shall: (a) be surfaced with a permanent surface of asphalt, concrete or similar pavement so as to provide a surface that is durable and dust-free for the purpose intended; (b) have fences or curbs to prevent the crossing of sidewalks and boulevards except at authorized exits and entrances; (c) have the individual parking spaces, manoeuvring aisles, entrances and exits clearly marked by curbs, fences or lines and signs; (d) have a maximum gradient and cross slope of 5%; (e) have surface drainage directed to the public storm sewer system or other approved location; Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 55 (f) have the lighting of the parking lot, if lighted, placed in such a manner so as to minimize light falling on abutting properties; (g) provided with parking aisles limited to a maximum 50m (164ft) in length unless broken up by landscaping islands, pedestrian facilities, and/or circulation access and pathways; and, (h) provided with raised concrete curbing where Parking Aisles intersect with Access Roads, Circulation Aisles, or other Parking Aisles, where the island created by raised concrete curbing shall be a minimum of 1.5m (5 ft) in width and shall be landscaped. 5.5 BICYCLE PARKING REGULATIONS BICYCLE PARKING REQUIREMENTS 5.5.1 Bicycle Parking Spaces shall be provided in accordance with the following Table: Land Use Min. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 56 PART 6 - LANDSCAPING, SCREENING AND FENCING 6.1 LANDSCAPING GENERAL LANDSCAPING REGULATIONS 6.1.1 Within all commercial zones, the entire portion of a lot, excluding the area(s) occupied by buildings, parking, loading areas, and/or sidewalks, must be landscaped. BOULEVARDS 6.1.2 Shall be maintained in accordance with City of Williams Lake Good Neighbour Bylaw No. 2194, as amended or replaced from time to time. 6.1.3 No retaining walls, structures or buildings shall be constructed within boulevards. 6.1.4 Boulevard parking may be permitted through boulevard parking permit approved by the Director of Municipal Services, or duly authorized representative. SWIMMING POOLS 6.1.5 Swimming pools shall not be located in a front yard. 6.1.6 Swimming pools shall meet the siting requirements for accessory buildings and structures. 6.1.7 Fencing around swimming pools shall be in accordance with City of Williams Lake Building Bylaw No. 2274, as amended or replaced from time to time. RETAINING WALLS 6.1.8 Retaining walls exceeding 1.2m (4ft) in Height must be designed and reviewed by a registered professional engineer and require the issuance of building permit. 6.1.9 Retaining walls on all residential Parcels, may not exceed a height of 1.2m (4ft) measured from grade on the lower side, except where the Grade of the parcel on which it is located is lower than the abutting parcel, in which case the height is subject to approval from the Approving Officer or Building Inspector. 6.1.10 Retaining walls are not subject to required setbacks and may be built to front, side and rear lot lines. 6.1.11 The combined height of a fence and retaining wall shall not exceed maximum fence height per Section 6.3.1, measured from grade shown in the figure below. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 57 6.2 SCREENING GENERAL SCREENING REGULATIONS 6.2.1 Automobile wrecking, salvage yards, commercial and industrial storage yards shall be screened by opaque fencing, landscape hedging or combination of. SCREENING FROM RESIDENTIAL USE 6.2.2 Industrial or commercial use lots that abuts, is adjacent to, or is directly across the street of residential use lots, the owner of the industrial or commercial use, shall provide opaque screening along the boundary of the shared property line. SCREENING FROM HIGHWAY 6.2.3 Any Industrial or commercial use lots that abuts a Provincial Highway or Mackenzie Avenue, the owner of the industrial or commercial use, shall provide opaque screening along the boundary of the shared property line. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 58 RECYCLING AND GARBAGE 6.2.4 All commercial, institutional, mixed use or multi-unit residential use buildings must provide a recycling and garbage collection facility that is either completely contained within the principal building or fully screened and accessible from a driveway or lane at an outdoor location on the parcel. 6.2.5 All screening of the refuse or recycling bin must use opaque materials and will be a minimum of 2.0m (6ft) in height. 6.2.6 An unobstructed access lane with a minimum width of 3.0m (10ft) and a minimum vertical clearance of 4.6m (15ft) shall be provided to provide access to a required garbage and recycling room or enclosure. 6.3 FENCING 6.3.1 The maximum fence height is as follows: Zones Front or Exterior Side Yard Rear or Int. Side Yard Residential 1.2m (4ft) 2.5m (8ft) Commercial 1.2m (6ft) 2m (6ft) Industrial 2.5m (8ft) 2.5m (8ft) Mixed-use, Institutional, Park, Community Use 1.2m (4ft) 2m (6ft) 6.3.2 Despite Subsection 6.2.3.1, fences are permitted where required for screening in accordance with Section 6.2. 6.3.3 In all zones, fences constructed on corner parcels must conform to the sight triangle, as per Section 3.9. Fences are not subject to required setbacks and may be built to front, side and rear lot lines. 6.3.4 A fence on a parcel zoned residential, commercial, institutional, community services or park must not include barbed wire, razor wire, electric wire, ultra- barrier, or any other material intended to deter trespass by threat or cause of personal injury to any animal or person who may come into contact with the fence. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 59 6.3.5 Where deemed necessary for the construction of a building or site, as determined by the Building Inspector, a guardrail, screening or hoarding up to 2m (6ft) in height may be required. Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 60 PART 7 - SUBDIVISION PROVISIONS 7.1 REGULATION OF SUBDIVISION 7.1.1 The purpose of this Part is to regulate the minimum dimensions and area of parcels of land which may be created by subdivision. 7.2 MINIMUM LOT SIZE AND WIDTH 7.2.1 The size and width of a parcel to be created by subdivision and which may lawfully be used as the site for a building shall not be less than the minimum dimensions and area for the construction of buildings or dwellings, as set out in the minimum lot size and width statement in the applicable zoning district schedule, where such minimum area and width have been specified. 7.2.2 The access strip of a panhandle lot shall not be considered part of a lot for the purpose of calculating lot size. 7.3 MINIMUM FRONTAGE 7.3.1 For all zoning districts, no parcel of land in any proposed subdivision shall have less than 10% of its perimeter fronting on a public street. 7.3.2 Notwithstanding Section 7.3.1, the minimum frontage for parcels of land in a proposed cul de sac subdivision may be less than 10% of the perimeter of the parcel, provided that the minimum frontage is not less than 10m (32ft) and the width of the lot is not less than 20m (65ft) measured 10m (32ft) back in a perpendicular manner from the front lot line. 7.4 PARCELS EXEMPT FROM MINIMUM LOT DIMENSION REQUIREMENTS 7.4.1 The consolidation of two or more parcels into a single parcel may be permitted, notwithstanding that the consolidated parcel may not comply with the minimum parcel size requirement as specified in the zoning district in which the new parcel is situated. 7.5 PARCEL SHAPES 7.5.1 The depth of each parcel of land in a subdivision shall not exceed 40% of the perimeter of the parcel, excluding the access strip of a panhandle lot. 7.5.2 Unless the pattern of existing subdivision precludes it, and unless it is impracticable, side lot lines shall be perpendicular or radial to the adjoining highway. 7.5.3 No panhandle lot shall be created: (a) where the access strip is narrower than 20.0m (65ft) if further subdivision of the parcel is possible under the provisions of this Bylaw; or (b) where the access strip is narrower than 7.5m (24ft); or Zoning Bylaw No. 2430 - Schedule 'A' Explanatory Text Page 61 (c) where the length of the panhandle is excessive with respect to the provision of the services or ability to access the building site with emergency vehicles. 7.5.4 That panhandle lots may be considered: (a) Where topographical or other severe physical constraints prevent conventional subdivision and the panhandle lot appears the best solution to possible further subdivision of lands in order to provide physical access; or (b) Where there is no possibility of a road being created to eliminate the need for a panhandle subdivision; or (c) Where there is no other subdivision possibility in an established area. 7.6 BARE LAND STRATA SUBDIVISION 7.6.1 Any parcel created under a Bare Land Strata Plan pursuant to the Strata Property Act shall be subject to the requirements of this Bylaw, except for the interior setback exemption for common walls as specified in Section 4D.2 of this Bylaw. 7.7 LEGAL SURVEY PLANS 7.7.1 Remainder lots will be accepted only if a parcel can be further subdivided under current zoning.
