07/28/2020 Brandon Fire and Emergency Services Fireworks / Flame Effects Device and Pyrotechnics Regulation - "P31" 1. No person shall set off fireworks/ flame effects device or pyrotechnics within the boundaries of the city of Brandon. 2. The only exception, is for special events such as Canada Day celebrations. All applications for special events must make application to the Fire Chief or designate for a fireworks/ flame effects device or pyrotechnics permit. The Fire Chief, at his absolute discretion, may authorize permits. 3. Any Individual or Company who has received a permit to set off or use fireworks/ flame effects device or pyrotechnics in the City of Brandon must do so safely and in compliance of The Canada Explosives Act. 4. A business selling fireworks/ flame effects device or pyrotechnics within the city may have possession of fireworks/ flame effects device or pyrotechnics for the purpose of sale if such business has previously obtained a Fireworks/ Flame Effects Device and Pyrotechnics Sales Permit from the Fire Chief or designate. The Fireworks/ Flame Effects Device and Pyrotechnics permit is good for as long as the business is in operation. 5. A Business selling Fireworks/ Flame Effects Device and Pyrotechnics in Brandon and has obtained a Fireworks/ Flame Effects Device and Pyrotechnics permit must adhere to the following: o Must only use static displays of fireworks, fireworks posters, or other advertising advising of the availability of fireworks/ flame effects device and pyrotechnics being sold on the premises. o Must ensure that the individual(s) purchasing the fireworks/ flame effects device and pyrotechnics is aware that they cannot use or set off the fireworks/ flame effects device and pyrotechnics in the City of Brandon. o Must have the individual(s) purchasing the fireworks/ flame effects device and pyrotechnics sign a waiver form agreeing to not using or setting off fireworks/ flame effects device and pyrotechnics in the City of Brandon. o Must maintain a copy of each fireworks/ flame effects device and pyrotechnics waiver form for a twelve month period, commencing on the date of sale and present all such fireworks/ flame effects device and pyrotechnics waiver form for inspection by the Fire Chief or his designate. 6. The storage of fireworks and the disposal of unused fireworks shall be in compliance with The Canada Explosives Act. ACS-05-2025 07/28/2020 7. The use or sale of flying lanterns or more commonly known as Chinese lanterns are strictly prohibited in The City of Brandon. 8. Permits and waiver forms can be obtained from the Brandon Fire and Emergency Services website or by attending the #1 Fire Hall in person located at 120 - 19th Street North. 9. The decision of the Fire Chief with respect to an application for a permit is final and absolute. ENFORCEMENT 1. Any person who contravenes, neglects, omits or fails to obey or observe any provision of this Regulation is guilty of an offense and is liable on summary conviction to a fine not exceeding One Thousand Dollars ($1,000.00) and costs on conviction or to imprisonment for a term not exceeding thirty (30) days or to both such a fine and such an imprisonment.
