BY-LAW NO. 7378
BEING A BY-LAW of The City of Brandon to further amend Solid Waste Collection and
Disposal By-law No. 6965.
WHEREAS the City of Brandon has deemed it necessary and expedient to amend said by-
law as it pertains to compliance with the solid waste disposal and recycling program;
NOW THEREFORE the Council of The City of Brandon, duly assembled, enacts as follows:
1.
By-law No. 6965 shall be amended as follows:
Section 6 - REFUSE/RECYCLING CARTS:
(i)
by adding to subsection (t), immediately after the words: "as per bulk item
policy", the following: "Bulky items in contravention of the Bulk Items Policy
Schedule "D" shall be subject to the enforcement provisions set out in the
City's Compliance By-Law."
Section 7 - SETTING OUT REFUSE/RECYCLING CARTS, BULKY ITEM COLLECTION
SERVICES ITEMS:
(i)
by replacing in subsection (d), (a) with (b);
Section 16 - PENALTIES:
(i)
by adding to subsection (a), immediately after the words: "such fine and such
imprisonment", the following: "under the Provincial Offenses Act"
(ii)
by adding the following as subsection (b): Any person who contravenes,
neglects, omits or fails to obey or observe any provision of this Bylaw is guilty
of an offense and is liable to penalties assessed in accordance with the
terms and provisions of the City of Brandon's Compliance Bylaw No 7198C
as it exists, or as may be passed from time to time.
2.
This by-law shall come into full force and take effect on the day following its
passage.
