TOWN OF CARBERRY
BYLAW NO. 11/2022
BEING a by-law to set the Carberry Transfer Station fees and Charges.
WHEREAS Section 252(1) of The Municipal Act provides, in part, as follows:
"may set terms and conditions in respect of users, including:
(a) Setting the rates or amounts of deposits fees and other charges,
and charging and collecting them;
(c) discontinuing or disconnecting a service and refusing to provide the
service to users who fail to comply with the terms and conditions."
AND WHEREAS Section 252(2) of The Municipal Act provides as follows:
"a charge referred to in clause (1)(a) may be collected by the municipality in
the same manner as a tax may be collected or enforced under this Act."
AND WHEREAS it is deemed advisable to set certain fees and charges for the
disposal of waste at the Carberry Transfer Station;
NOW THEREFORE the Council of the Town of Carberry, in council duly assembled,
enacts as follows:
Abbreviations:
"EAL": Environment Act License
Definitions:
Non-burnable construction waste: Any waste other than recyclable
materials and household garbage, that is not clean, untreated, unpainted wood
as outlined in the EAL.
White Goods: Items such as refrigerators, freezers, air conditioning units,
and the like, that are not certified as having the refrigerant removed.
Other non-burnable items: Items such as furniture, mattresses, non-
recyclable and non-household garbage.
1. THAT the following rates be set for disposal of items at the Carberry Transfer
Station:
a. All items required to be placed in the roll-off bins and transferred to
Evergreen Environmental:
$300.00/MT
b. White Goods, non-certified refrigerant removed:
$25.00/unit
2. THAT the following items be free of charge for disposal:
a. Household garbage
b. Recyclable materials (cardboard, paper, etc.)
c. Recyclable Glass
d. Recyclable metals
e. Tires
f. Empty gas cylinders
g. Recyclable electronics
h. Compost
i. Clean burnable materials
j. Concrete/masonry
k. Paint and aerosols
l. Clean fill
3. THAT the fee for using the scale only be $10.00 per use.
4. THAT the Joint Waste Committee has the authority to negotiate special rates
on a per case basis.
5. THAT By-law NO. 6/2021 and all other by-laws contrary or inconsistent
herewith hereby be repealed.
6. THAT this by-law shall come into force and effect on the day after passing
thereof.
DONE AND PASSED as a by-law of the Town of Carberry, in Council duly assembled
at the Town of Carberry, in the Province of Manitoba, this 21st day of February, 2023.
