TOWN OF CARBERRY
BYLAW NO. 17/2025
WHEREAS the Town of Carberry ("Town") has Traffic Bylaws to control the traffic
and parking in the Town;
AND WHEREAS it is deemed necessary to amend said Bylaws from time to time;
NOW THEREFORE the Council of the Town of Carberry in regular session
assembled ENACTS as follows:
1. This bylaw may be referred to as the Town of Carberry Traffic Bylaw.
2. The schedules attached to this bylaw shall be amended from time to time, as
necessary to remain current with the applicable signage or requirements, by
resolution of the Council of the Town of Carberry.
3. INTERPRETATION
Where used in this bylaw, unless the context otherwise requires, the interpretations
shall be as in Section 2 of the Highway Traffic Act being Chapter 29 of the SM
1966 with all amendments thereto and as follows:
(a)
"Approach, driveway, or sidewalk crossing" means that portion of a
sidewalk or boulevard improved or designed for the passage of
vehicle traffic.
(b)
"Highway Traffic Act" means the Highway Traffic Act, SM 1966,
Chapter 29 as amended from time to time or any replacement
thereof.
(c)
"Street" means a roadway designated as a street, avenue, or
driveway in a plan of subdivision duly approved and it includes and
extends to the pavements and shoulders improved and unimproved,
both.
(d)
"Town" means the Town of Carberry.
(e)
"Vehicle" includes a motor vehicle, trailer, traction engine, farm
machinery, and any conveyance drawn, propelled, or driven, by any
kind of power, including muscle power.
(f)
"Restricted Area" means any curb or area marked by yellow paint,
blue paint, signs or other means of designating an area.
4. PARKING
(a)
Subject to the provisions of the Highway Traffic Act and excepting
emergency vehicles and other provisions of this bylaw, parking of
any vehicle shall be prohibited at any time at those places or in the
manner hereinafter set forth:
I.
Within five (5) meters of the intersection of any street, lane, or
level railway in the said Town.
II.
Within three (3) meters of either side of any hydrant in the said
Town.
III.
On or protruding on to any sidewalk.
IV.
On any street or avenue facing against the flow of traffic.

V.
Double parking of any vehicle.
VI.
In front of any driveway or lane so as to block the flow of traffic.
VII.
In any lane or alley within the said Town.
VIII.
Between the signs on the south side of Fourth Avenue
between Dufferin Street and Simcoe Street.
IX.
Between the signs on the south side of Fourth Avenue, at the
intersection with Main Street.
X.
On First Avenue between Main Street and the east side of the
property owned by the School Division.
XI.
Between the signs on Toronto Street between First Avenue
and Stickle Avenue.
XII.
On the North side of First Avenue, from Ottawa Street to a
point fifty-seven (57) feet West.
XIII.
On the East side of Market Street from First Avenue to Fourth
Avenue.
(b)
Parking on Main Street between Second Avenue and Fourth Avenue
shall be prohibited for the following classes of vehicles;
I.
Tractors.
II.
Any truck over one (1) Ton including trucks or farm trucks.
III.
Any vehicle drawing or towing a trailer. Vehicles towing
campers and stopping short-term for the purposes of making
purchases at local retailers are permitted.
(c)
That trucks over one (1) Ton capacity shall not be permitted to unload
from Main Street between Second Avenue and Fourth Avenue, and
trucks when unloading from Third Avenue or Fourth Avenue shall
park parallel to the sidewalk and shall not obstruct the passage of
traffic on the Avenue.
(d)
That any person operating a vehicle and desirous of parking any
such vehicle on any street in the said Town shall park such vehicle
parallel to the curb not more than thirty (30) centimeters from the said
curb.
(e)
That no person shall park any vehicle in a space designated or
assigned specifically for persons with disabilities, except for the use
and benefit of such persons with disabilities.
(f)
No person shall park any vehicle between the hours of 02:00 and
08:00 on Main Street between Second Avenue and Fourth Avenue
between November 1 and April 15. Vehicles so parked may be towed
away at the owner's expense.
(g)
A "Loading Zone - 15 Minute Parking" shall be in place immediately
adjacent to the Bus Loop in front of Carberry Collegiate at 230 Main
Street. The Loading Zone shall extend from the Northmost point of
the curb to one hundred (100) feet south. This shall be in effect

Monday to Friday, 07:00 to 18:00. It shall be marked with signs
indicating the same.
(h)
A "No Standing - Drop Off & Pick-up Only" zone will be in place
immediately adjacent to the Bus Loop in front of Carberry Collegiate
at 230 Main Street. The No Standing Zone shall extend from a point
one hundred (100) feet south of the Northmost Point of the bus loop
to a point two hundred (200) feet south of the Northmost point of the
bus loop. This shall be in effect Monday to Friday, 07:00 to 18:00. It
shall be marked with signs indicating the same.
(i)
A "2 Hour Maximum" zone will be in place immediately adjacent to
the Bus Loop in front of the Carberry Collegiate at 230 Main Street.
The 2 Hour Maximum zone shall extend from a point two hundred
(200) feet from the northmost point of the curb to three hundred (300)
feet from the northmost point of the curb. This shall be in effect
Monday to Friday, 07:00 to 18:00. It shall be marked with signs
indicating the same.
(j)
A "Loading Zone - 15 Minute Parking" shall be in place immediately
adjacent to the Bus Loop in front of Carberry Collegiate at 230 Main
Street. The Loading Zone shall extend from a point three hundred
(300) feet from the Northmost point of the curb to the southmost point
of the curb. This shall be in effect Monday to Friday, 07:00 to 18:00.
It shall be marked with signs indicating the same.
(k)
A "No Parking - Loading and Unloading Only" zone shall be in place
from the west edge of the back lane to a point twenty (20) feet west
in front of 422 Third Avenue for the purposes of deliveries at the
business immediately east of the lane.
(l)
No disabled vehicle or vehicle in non-operating condition, or
unserviceable vehicle shall be parked on any street in the said Town
for more than seventy-two (72) hours. Vehicles so parked may be
towed away at the owner's expense. This includes unlicensed,
unregistered vehicles that do not have valid and current registration
plates affixed.
(m)
Campers, Travel Trailers, RVs, and other towable vehicles are not to
be stored on the street, avenue, lane or boulevard for a period longer
than 48 hours.
(n)
No person shall, within the limits of the said Town, erect or permit to
be displayed any sign purporting to prohibit parking along the streets
in any area without having first obtained from Council of the said
Town a permit authorizing the same. The Council of the said Town,
upon receipt of such application for a permit, may grant a permit
authorizing the erection of such signs as may be approved in such a
place or places as may be approved, and in such a manner as may
be approved, the defining of the area in which parking shall not be
permitted, the applicant shall in all cases furnish the Council of the
Town with full particulars as to the area wherein it is desired that
parking shall be prohibited and shall pay all costs in connection
therewith.
(o)
Nothing in this bylaw shall be deemed to prohibit funerals from
posting "No Parking - Funeral" signs within the Town for the
purposes of conducting a funeral.

(p)
This section does not apply to ambulance, police, or fire department
vehicles clearly giving audible signals by bell, siren, or exhaust
whistle, or any other suitable visible warning device or to any
commercial vehicle having obtained special permission from Council
as provided in Section 5.
5.
CARBERRY PLAINS COMMUNITY CENTER
(a)
The area in front of the Carberry Plains Community Center BE and
IS hereby DESIGNATED as a restricted parking zone;
(b)
That no person shall park a vehicle in front of the Carberry Plains
Community Center in the designated restricted zone between the
"No Parking" signs except when a bona fide delivery is being made;
(c)
That the officers and employees of the Town of Carberry and the law-
enforcing officers, after giving ten (10) minutes warning, shall have
the power to tow away any vehicle found parking in the restricted
zone and to recover from the owner of the vehicle all of the costs of
such towing.
6. "U" TURNS AND GENERAL TRAFFIC
(a)
That no person operating a vehicle shall turn such vehicle around
and proceed in the opposite direction:
I.
At any point on Main Street between First Avenue and Fourth
Avenue and not in the intersections
II.
At the intersection of First Avenue and Main Street
At the intersection of Main Street and First Avenue
III.
At the intersection of Second Avenue and Main Street
At the intersection of Main Street and Second Avenue
IV.
At the intersection of Third Avenue and Main Street
At the intersection of Main Street and Third Avenue
In said Town and said intersections are hereby declared to be "No U-Turn"
signs shall be placed by the said town at the intersections.
(b)
No vehicle shall back around the corner of the intersection of any two
streets, or avenues or street or avenue.
(c)
No vehicle shall within the limits of the said Town make a U-Turn on
any street or lane between street or avenue intersections except in
any cul-de-sac, and at the intersection of Main Street and Fourth
Avenue (Main Street traffic only).
(d)
No vehicle shall within Town limits of the said Town turn and cross
the lane of traffic flowing in the opposite direction to which he is
travelling between any two (2) intersections of any two (2) streets or
avenues for the purposes of parking on a street or avenue.
7. The Town of Carberry shall establish a Loading Zone, with a time limit of 20
minutes, always, directly in front of the Royal Canadian Legion, at 25 Main
Street.

8. That the Town of Carberry shall establish pedestrian crosswalks by erecting
signs and painting the street at the following points:
(a)
On Main Street at the south side of the intersection of First Avenue
and Main Street.
(b)
On Main Street at the north side of the intersection of Second Avenue
and Main Street.
(c)
On Main Street at the south side of the intersection of Third Avenue
and Main Street.
(d)
On First Avenue at the west side of the intersection of Toronto Street
and First Avenue.
(e)
On Selkirk Street at the north side of the intersection of Selkirk Street
and Third Avenue.
(f)
On First Avenue at the east side of the intersection of Main Street
and First Avenue.
(g)
On First Avenue at the west side of the intersection of Jardine Street
and First Avenue
(h)
On Ottawa Street at the east side of the intersection of Second
avenue.
(i)
On Second Avenue at the north side of the intersection at Ottawa
Street.
9. The Council of the Town of Carberry shall have the AUTHORITY TO GRANT
EXCEPTION from any one of the provisions of Section 4 to 7 of this Bylaw by
way of special resolution of Council to any owner or operator of a vehicle who
can show cause.
10. The said Town shall ERECT YIELD SIGNS at the intersections referred to in
Schedule "A" and every person who fails to yield the Right-of-Way at the
locations referred to in Schedule "A" of this Bylaw shall be guilty of an offence.
11. The said Town shall ERECT STOP SIGNS at the intersections referred to in
Schedule "B" and every person who fails to stop at the Stop Sign as referred to
in Schedule "B" of this Bylaw shall be guilty of an offence.
12. Every person who PARKS in or upon the prohibited areas or in any manner
contrary to the provision of Section 4 or 5 of this Bylaw shall be guilty of an
offence.
13. Any person failing to observe the provisions of Section 6 re "U-TURNS" and
general traffic shall be guilty of an offence.
14. A Peace Officer, Bylaw Enforcement Officer, or Designated Officer for the
purpose of enforcing the provisions of this or any other Bylaw or regulation of
the Town of Carberry, respecting the parking of vehicles, may mark on or place
by mark, ticket, citation or notice upon a vehicle which is parked in
contravention of this Bylaw.
15. A Peace Officer, Bylaw Enforcement Officer, or Designated Officer may place
a chalk mark on tires to justify overtime parking violations, issue a ticket, or tow,
and as far as issue a ticket and tow of the vehicle.

16. Whenever any motor vehicle is found parked or left in violation of any provisions
of this Bylaw and such vehicle is not removed and impounded as provided for
in this Bylaw, the officer finding such vehicle, shall conspicuously affix to such
vehicle, a traffic citation, such citation shall contain the license plate and such
information describing the vehicle, as the officer determines, to assist in
identifying the owner or operator of the vehicle.
17. Any person who violates, contravenes, disobeys or refuses, omits, neglects,
fails to observe, obey or comply with any or all provisions of this Bylaw, is guilty
of an offence.
18. Where such contravention, refusal, neglect, omission or failure to obey or
observe continues for more than one day, the person is guilty of separate
offence for each day it continues.
19. Where an offence is alleged, under Section 10(1) of the Municipal By-Law
Enforcement Act, A person to whom a penalty notice is delivered may, within
the period set by bylaw and in accordance with the instructions on the notice,
i. Pay the administrative penalty; or
ii. Request a review by the screening officer.
20. That Bylaw NO. 06/2025 and all other bylaws contrary or inconsistent herewith
are hereby repealed.
21. That this bylaw shall come into force and effect on the day after passing thereof.
DONE AND PASSED as a bylaw of the Town of Carberry, in Council duly
assembled at the Town of Carberry, in the Province of Manitoba, this 28th day of
