TOWN OF CARBERRY
BY-LAW NO. 4/2020
BEING A BY-LAW OF THE TOWN OF CARBERRY TO REGULATE AND
ESTABLISH
A
REDUCED-SPEED
SCHOOL
ZONE
AREA
ON
DESIGNATED HIGHWAYS.
WHEREAS Section 98.1 of The Highway Traffic Act and the Reduced Speed
School Zones (RSSZ) Regulation No. 136/2013 authorize a municipality to
pass a by-law establishing reduced maximum permitted speed for vehicles
being driven on a highway within a school zone with the geographic
boundaries of a municipality;
AND WHEREAS the Town of Carberry deems it advisable and in the best
interests of the municipality to establish a reduced-speed school zone with
a reduced speed for vehicles;
AND WHEREAS it is deemed necessary to amend said By-law from time to
time;
NOW THEREFORE the Council of the Town of Carberry enacts as a by-law
the following:
1.
That this by-law be called the "Reduced-Speed School Zone By-law".
2.
That for the purposes of this by-law, "highway", "reduced-speed
school zone", "school", "school property", "traffic control device", and
"vehicle" have the same meanings as set out in The Highway Traffic
Act and the Reduced-Speed School Zones Regulation No. 136/2013
and as may be amended from time to time.
3.
The schools in connection with the Reduced-Speed School Zone are:
(a) R.J. Waugh School
(b) Carberry Collegiate Institute
4.
The following Streets and Highways are designated as the RRSZ, the
applicable sections of each are listed in section 5:
(a) Provincial Road 351, also known as First Avenue
(b) Main Street
(c) Second Avenue
(d) Ottawa Street
5.
That for the purpose of this By-law, the speed zone is designated as:
(a) Main Street: from First Avenue to thirty-seven (37) meters
South of Second Avenue
(b) First Avenue (PR 351): from seventy-one (71) meters West of
Main Street to ten (10) meters East of Ottawa Street
(c) Ottawa Street from First Avenue to fifty (50) meters South of
Second Avenue.
(d) Second Avenue from fifty (50) meters West of Main Street to
fifty (50) meters East of Ottawa Street.
6.
That the maximum permitted speed for vehicles being driven in a
reduced-speed school zone on a highway is thirty (30) kilometers per
hour.
7.
That the reduced maximum permitted speed established under
Section 4 apply within the reduced-speed school zone from 6 a.m. to
6 p.m., Monday to Friday.
8.
That the municipality shall identify a reduced-speed school zone with
traffic control devices that comply with Reduced-Speed School Zones
Regulation No. 136/2013.
9.
That By-Law No. 2/2014 and all other by-laws contrary or inconsistent
herewith are hereby repealed.
10.
That this by-law shall come into force and effect on the day after
passing thereof.
DONE AND PASSED by the Council of the Town of Carberry assembled in
Carberry in the Province of Manitoba this 12th day of May, 2020.
