TOWN OF CARMAN BY-LAW NO. 2091 Town of Carman By-Law 2091 BEING a by-law of the Town of Carman providing for the regulation of traffic within the Town of Carman. WHEREAS a municipality has the direction, control and management of municipal streets within its boundaries; AND WHEREAS Section 90(1) of The Highway Traffic Act provides for a traffic authority to make rules or by-laws to regulate and control vehicular and other traffic and the parking thereof within its jurisdiction; AND WHEREAS Section 90(2) of The Highway Traffic Act provides for the Council of a municipality to impose penalties for a violation of any such rule or by-law; AND WHEREAS Section 90(3) of The Highway Traffic Act provides for the Council of a municipality to make rules or by-laws applicable to any part of a provincial street within the municipality; AND WHEREAS Section 236(1)(b)(ii) of The Municipal Act, L.M. 1996, c.58, Chap. M225, states, 236(1) Without limiting the generality of clause 232(1)(o) (Enforcement of by-laws), a by-law passed under that clause may include provisions (b) remedying contraventions of by-laws, including, (ii) subject to the regulations, providing for fines and penalties, including the imposition of a penalty for an offence that is in addition to a fine or imprisonment, so long as the penalty relates to a fee, rate, toll, charge or cost that is associated with the conduct that gives rise to the offence, or related to enforcing the by-law. AND WHEREAS Section 3(2)(a) of the Municipal By-law Enforcement Act C.C.SM.0 M245 states a Town may require administration penalties to be paid if the Town designates the By- law contraventions that may be dealt with by a penalty notice. AND WHEREAS the Council of the Town of Carman deems it necessary and expedient to pass a by- law regulating and controlling traffic and parking within the said Town, pursuant to the provisions of The Municipal Act and The Highway Traffic Act, and amendments thereto; NOW THEREFORE the Council of the Town of Carman, in Council assembled enacts as follows: 1. SHORT TITLE This by-law may be referred to as the "Town of Carman Traffic By-Law." 2. INTERPRETATIONS Unless otherwise expressly provided or unless the context otherwise requires, words and expressions in the By-law have the same meaning as the same words and expressions in The Highway Traffic Act of the Province of Manitoba. 3. DEFINITIONS In this by-law, the following definitions shall apply: (a) "Boulevard" means that portion of street between the curb line or the lateral line of the roadway and the adjoining property line exclusive of the sidewalk; and that portion of a street between the curb line or lateral lines of the roadways of a divided street; (b) "By-Law Enforcement Officer" shall mean a person appointed or designated under The Municipal Act to enforce the By-laws of the Town of Carman and includes a designated employee or officer under the Municipal or Planning Act. (c) "Council" means the Council of the Town of Carman or such Committee as Council may delegate as Traffic Authority for the Town of Carman; (d) "Curb" means the lateral boundaries of a roadway whether marked with curbs or not; (e) "Designated parking space" means a space designated by signs or pavement markings as being for the sole use of motor vehicles displaying a permit that is located: a) on a highway, b) in a public parking lot or facility, or c) in a private parking lot or facility to which the public has access (f) "Driver" means a person who drives or is in actual physical control of a vehicle, and the expressions "Drive" and "Driving" have a corresponding meaning. (g) "Lane" means a street six (6.0) metres or less in width; (h) "Motor vehicle" means a motor vehicle as defined in The Highway Traffic Act. TOWN OF CARMAN BY-LAW NO. 2091 (i) "Parade" means any procession or body of pedestrians numbering more than fifteen (15) standing, marching, or walking anywhere on a street, or any group of vehicles except a funeral procession, numbering ten (10) or more stopped or moving anywhere on a street; (j) "Parking" and its derivatives means the standing of a vehicle, trailer or bus, whether occupied or not, upon a street or street, otherwise than temporarily for the purpose of and actually engaged in loading or unloading, or in obedience to traffic regulations, signs or signals; (k) "Permit" means a valid physically disabled person's parking permit issued under section 124.3 of the Highway Traffic Act (l) "Persons" shall mean any individual, firm, company, association, society, corporation or group (m) "Police" shall mean the Police or R.C.M.P. (n) "Public Works Department" shall mean all works and operating department staff of the Town of Carman which perform work upon a public street or lane within the Town. (o) Sidewalk" means a footpath, whether or not paved or improved, that is intended primarily for the use of pedestrians and that either; (a) forms part of that portion of a highway that lies between the curb line or, if there is none, the lateral boundary line, of the roadway and (b) the adjacent property lines, or (c) the straight production of the adjacent property lines to the curb line or if there is none, to the lateral boundary line, of an intersecting highway, or (d) although not part of a highway, is a publicly maintained right-of-way, set aside for pedestrian traffic only and for the purpose of giving access to property adjacent thereto; (p) "Special event" shall mean a parade, procession, block party or such other event held on a public street, lane or throughfare which will require closure to public traffic. (q) "Street" means a street over which the Town of Carman has jurisdiction; (r) "Public Works Director" means the waterworks and/or public works Public Works Director of the Town of Carman or such person as may be authorized by the said Public Works Director to exercise some or all of the powers vested in him by this By-law; (s) "Traffic Control Devices" means a sign, signal, light, marking, or device, not inconsistent with The Highway Traffic Act, placed or erected by authority of the Council of the Town of Carman for the purpose of regulating, warning or guiding traffic; (t) "Vehicle" means a device, in, upon, or by which a person or thing is or may be transported or drawn upon a highway but does not include; (a) a device designed to be moved by human power or used exclusively upon stationary rails or tracks, and (b) a motorized mobility aid. 4. APPLICATION OF THE BY-LAW 4.1 Unless otherwise specified or unless the context otherwise requires, the provisions of this By- law shall apply to pedestrians, bicycles, motorcycles, motor vehicles and vehicles and any other conveyances within the limits of the Town of Carman. 4.2 Where there is any conflict between the provisions of this by-law, the provisions of The Highway Traffic Act and/or The Municipal Act, as the case may be, shall apply. 4.3 The Schedules to this By-law are part of this By-law and shall be identified as such. 5. CAUSING OR PERMITTING OFFENCE 5.1 Any person who causes or permits an offence against this By-law is guilty of an offence under the Manitoba Highway Traffic Act. 6. PARADES 6.1 No person shall hold, take part in, or be a member of a parade, unless (a) the parade is under the direction or control of a Marshall or organizer and (b) The local Canadian RCMP Detachment has duly permitted the parade. 6.2 A person desiring to hold a parade shall apply in writing to the local Royal Canadian Mounted Police for a permit not less than three (3) business days before the time set for the commencement of the parade, and shall when making the request, specify the nature of the parade, the day and hour at which it is to be held, the places of formation and dispersal the exact route to be followed and estimated length of time for the parade. TOWN OF CARMAN BY-LAW NO. 2091 6.3 The local Royal Canadian Mounted Police may issue a permit for a parade subject to any directions that may be imposed as to time, marshaling and route to be followed and every such permit shall be issued subject to compliance with all By-laws of the Town of Carman. If there is any deviation from the terms under which the permit is issued, the permit shall be void and of no effect. 6.4 Unless so directed by a Police Officer, no person other than the driver of an ambulance, police vehicle, or Fire Department vehicle in an emergency shall drive through a parade. 6.5 While a parade is in motion, pedestrians shall not walk through or into a parade. 7. TEMPORARY TRAFFIC CONTROL DEVICES 7.1 The Public Works Director shall place and maintain or cause to be placed and maintained approved temporary traffic control devices to prohibit or regulate traffic in an emergency or for the purposes of carrying out any authorized work on the street including street cleaning and snow removal operations. 7.2 Any person undertaking work upon or adjacent to a street which may in any way interfere with or obstruct the normal use of the street shall place and maintain such temporary traffic control devices as may be required by the Town while such work is being completed. 7.3 Every person shall obey the instructions of a traffic control device placed under this by-law, unless directed to do otherwise by a peace officer. 7.4 No person shall drive a vehicle on any street or any portion of a street that has been barricaded or otherwise indicated as being closed to traffic. 7.5 No person shall drive any vehicle over or upon any fire hose laid on, along or across any street. 7.6 Persons wishing to have a special event on any street or streets in the Town of Carman, shall make application to the Town of Carman Office. The CAO will review the application and may approve or reject the application (with conditions) and so advise the applicant. The CAO may refer the decision to Council. The application shall include the nature of the parade, procession, or special event; the route intended to be taken, the date and length and the person or person responsible for the event. The CAO, or the Public Works Director is hereby empowered to barricade or cause to be barricaded or erect a sign or remove a sign on any street or portion thereof deemed necessary for this event. If the event requires public awareness through the press or other means this shall be done at the expense of the applicant. 7.7 8. SPEED LIMITS 8.1 No person shall drive a vehicle at a rate of speed greater than 50 kilometers per hour within the Town of Carman unless otherwise directed by a Traffic Control Device, except for the exceptions noted in 8.2. 8.2 No person shall drive a vehicle at a rate of speed greater than 30 kilometers per hour (i) on any back lane within the Town of Carman (ii) on Kings Park Road between Centre Avenue West on the north to PR 245 on the south, and (iii) First Avenue NW between Fourth Street NW and Eighth Street NW. (iv) in School Zones as outlined in Town of Carman By-law No. 19/2041. (v) all streets surrounding Carman Elementary School. (vi) All gravel roads within the limits of the Town of Carman 9. ONE WAY STREETS AND LANES 9.1 The streets or portions of streets and lanes or portions of lanes referred to in Schedule "A" to this by-law are hereby designated as one-way. 9.2 No person shall drive or operate a vehicle, motorcycle or bicycle upon a one-way lane or street except in the direction specified in Schedule "A" hereto for that one-way street or lane. 9.3 No person shall drive or operate a vehicle, or motorcycle upon a sidewalk, trail, pathway unless otherwise permitted by the Town of Carman Public Works Director or CAO. 10. U-TURNS 10.1 No person shall turn a vehicle so as to proceed in the opposite direction at a place on a street where a traffic control device prohibits the making of a U-turn. 11. ROUTE OF TRUCK TRAFFIC 11.1 All trucks and truck tractors within the Town of Carman shall be operated only over and along streets set forth as Truck Routes on Schedule "A" hereto, but any truck may operate upon any street where necessary to the conduct of business at a destination point, provided that Truck TOWN OF CARMAN BY-LAW NO. 2091 Routes are used until reading the intersection nearest the destination point. Upon leaving the destination point, a truck or truck tractor shall return by the shortest routing to a Truck Route. 11.2 All streets and sections of streets set forth as Truck Routes in Schedule "A". 11.3 When Route signs, of the type approved by The Street Traffic and Motor Transport Board of the Province of Manitoba for use in and adjacent to the Town of Carman are installed and maintained on a street or section of street, the street or section of street shall be deemed to be a Truck Route within the terms of this by-law. 11.4 Where Provincial Trunk Street signs or Provincial Road signs of the Province of Manitoba are installed and maintained on a street or section of street, the street or section of street shall be deemed to be a Truck Route within the terms of this by-law. 11.5 The operator of a truck or semi- trailer truck may go off the Truck Route to their place of residence or business if the truck is unladen except for non-commercial goods or belongings or for the purpose of emergency repairs. 11.6 The Public Works Director shall keep and maintain a current map setting out the streets and sections set, copies of the map at no charge. WEIGHT RESTRICTIONS 11.7 No person shall drive or operate a vehicle or combination of vehicles where the gross weight of the vehicle exceeds the maximum gross vehicle weight specified for that truck route. 11.8 No person shall drive or operate a vehicle or combination of vehicles on a truck route if the gross weight of any axle assembly or group of axle assemblies on that vehicle or combinations of vehicles exceeds one or more of the maximum weight prescriptions for axle assemblies specified. 11.9 The Public Works Director is authorized to place and maintain temporary traffic control devices to limit the weight of vehicles operating upon any street during periods of the year when damage to such street would otherwise reasonably be expected to occur. 11.10No person shall operate a vehicle upon a street in contravention of a traffic control device placed pursuant to section23(3) thereof. 11.11The Public Works Director or CAO at their discretion may issue a permit to allow a vehicle to be operated without compliance with the weight restrictions imposed pursuant to this By- law provided the applicant for such permit: a) Furnishes satisfactory evidence of the vehicle and axle assembly weights; b) Provides particulars of the trip including its purpose, date and time and proposed route; c) Pays the sum of a permit as per the fees and charges policy. d) Which permit shall only be valid for the time and route specified in the permit. 12. DANGEROUS GOODS 12.1 No person shall operate a vehicle containing dangerous goods any place within the Town of Carman. 12.2 No person shall park a vehicle containing dangerous goods any place within the Town of Carman. 12.3 Section 13.1 and 13.2 of this By-Law shall not apply to prohibit a person from; a) Transporting a dangerous good from any place where it may be lawfully stored to any place where it may be lawfully stored to any place where it may be lawfully delivered provided that the most direct route is used to transport the dangerous good from the storage location to the point of delivery; b) Parking a vehicle for the purpose of delivering a dangerous good at a location where the dangerous good at a location where the dangerous good may be lawfully delivered for the period of time necessary to off-load that dangerous good. c) Notwithstanding any other provision in this By-law to the contrary, no person shall park a vehicle containing a dangerous good any place without the prior approval of the Fire Chief or CAO. 13. ENGINE RETARDANT BRAKES PROHIBITED 13.1 The operation of engine retardant brakes shall be prohibited within the Town of Carman. TOWN OF CARMAN BY-LAW NO. 2091 14. PARKING RESTRICTIONS 14.1 No person shall stop, stand or park a vehicle in areas so designated by appropriate signs erected by the Town of Carman prohibiting standing, stopping and/or parking. 14.2 No vehicle shall be parked in a lane, but this provision shall not apply to any vehicle standing temporarily for the purpose of and while engaged in loading or unloading. 14.3 No person shall stand or park a vehicle: (i) in a loading zone whether the vehicle is occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading that vehicle; (ii) on a boulevard, a sidewalk, or on a curb; (iii) to obstruct the entrance to a lane, a driveway or approach leading into a private premises. (iv) with its left side to the curb, except on a one-way street in which parking is permitted on both sides of the street; (v) displayed for sale on a street; (vi) where a sign or painted curb, placed and/or authorized by the Town of Carman prohibits parking, and where a sign has been erected prohibiting the parking of vehicles; (vii) Within three (3) meters of an intersection; (viii) Within three (3) meters of from the point of the curb or edge of the roadway immediately opposite a fire hydrant; (ix) No person shall park a vehicle within 100 meters of the scene of a fire or emergency except firefighting equipment or other emergency vehicles required in the firefighting operations. (x) No truck with a gross vehicle weight rating of 6,804 kg (15,000 lbs) or more, nor semi- trailers of any type, shall park on any c o m m e r c i a l street Carman, notwithstanding that a truck or trailer may park on a street while loading and unloading. Such loading and unloading shall be done as quickly as possible and shall not block the street for other vehicular traffic. (xi) No truck with a gross vehicle weight rating of 6,804 kg (15,000 lbs) or more, nor semi- trailers of any type, shall park on any residential street Carman, notwithstanding that a truck or trailer may park on a street while loading and unloading. Such loading and unloading shall be done as quickly as possible and shall not block the street for other vehicular traffic. (xii) The parking of un-laden semi-trucks with a GVW of 15,000 lbs or greater shall be permitted on residential driveways. (xiii) All trucks with a GVW of 15,000 lbs or greater on property within the Town of Carman shall only be operated over and along the streets or sections of streets set forth as truck Routes on Schedule "B" attached hereto, but any truck may operate upon any street where necessary to conduct business at a destination point. Upon leaving the destination point, the truck shall return by the shortest route to a Truck Route. (a) All streets and sections of streets set forth as Truck routes in schedule "B" attached hereto shall be further identified as Truck routes by appropriate Truck Route signs. (xiv) No person shall park a vehicle in a single location on a street for forty-eight (48) consecutive hours or more. 14.4 No person being the operator or owner of any garage, machine shop, repair shop or paint shop shall park or permit to be parked on a street within the Town of Carman, any vehicle which has been delivered into or left in the custody or care for the purpose of storage, for sale or for the purpose of having same examined, repaired, adjusted, or painted. 14.5 No vehicle, other than motorcycles, shall stand backed up to the curb except when actually loading or unloading, and no vehicle shall stand so backed up that it interferes with or interrupts the passage of other vehicles. 14.6 There shall be no parking in the business section from 06:00 pm to 08:00 am on: (i) First Street SW between Centre Avenue West and First Avenue SW; (ii) First Avenue SW between First Street SW and Main Street South; (iii) Main Street South between Centre Avenue N. and Second Avenue SW. TOWN OF CARMAN BY-LAW NO. 2091 14.7 That there be designated parking for 20 metres immediately in front of the Memorial Hall, located at 12-2nd Avenue SW, allowing a maximum of 15-minute parking, Monday through Friday, 8:30 a.m. to 5:00 p.m. 14.8 No person shall park a truck, truck tractor and/or semi-trailer, motorhome, recreational trailer, bus, or any other recreational vehicle or truck with a rated capacity of more than one ton on any street for a period of time longer than eight (8) hours except for the purpose of and while actually engaged in loading or unloading, and except for the purpose of transporting a tradesman to and from premises in the immediate area being worked on by said tradesman. No person shall leave unattended or unattached a trailer of any type upon a street. 14.9 No person shall park a trailer of any type with an operating refrigeration unit upon a street within 100 metres of a residence. 14.10 No person shall park construction equipment or place a dumpster on any street without permission from the Public Works Director. 15. PARKING FOR DISABLED PERSONS 15.1 No person shall stop, stand or park a motor vehicle in a designated parking space within the Town of Carman or in a manner that makes such a designated parking space inaccessible unless a permit is displayed in the vehicle and is used in accordance with The Highway Traffic Act and regulations under that Act. 15.2 For the purpose of this section, designated parking space and permit have the same meaning attributed to those terms under Section 124.1 of The Highway Traffic Act. 16. PARKING DURING SNOW REMOVAL 16.1 Persons shall remove parked vehicles and refrain from parking on public streets and lanes during and after snowfall events which require the removal of accumulated snow. Persons may resume parking on the street once snow removal operations are completely finished on that street. 16.2 No person shall park a vehicle on a street at any time between the hours of nine (9:00) P.M. and six (6:00) A.M. of any day commencing from 1st October to the 30th of April during snow removal or street cleaning or maintenance operations. 16.3 The By-law Enforcement Officer, RCMP, Police, Public Works Director, CAO, or Designated Officer may remove or cause to be removed from a street, a vehicle that is stopped or parked in a position that causes it to interfere with removal of snow from the street or maintenance of the street. 16.4No person shall deposit snow from private properties onto public roads, streets, lanes and ditches. 17. PARKING EXCEPTIONS 17.1 The provisions of this by-law prohibiting or regulating parking, stopping, and standing do not apply to: (a) vehicles of the Royal Canadian Mounted Police Department; (b) vehicles owned or employed by the Town of Carman while in use in connection with work of necessity being done while in or near a street requiring the vehicles to be stopped or parked in contravention of such provisions; (c) vehicles of the Government of Canada, the Government of Manitoba or a public utility while such vehicles are actually engaged in work of necessity on or near a street requiring the vehicles to be stopped or parked in contravention of such provisions. (d) vehicles of emergencies services such as fire department and ambulance services. 18. MARKING PARKED VEHICLES 18.1 The By-law Enforcement Officer, RCMP, Police, Public Works Director, CAO or Designated Officer so empowered by Council, for the purpose of enforcing the provisions of this By-law, or of any other by-law or regulation of the Town of Carman respecting parking of vehicles, may place a mark upon a vehicle, which is parked upon a street. 18.2 No person shall remove, alter, obliterate or deface a mark made or placed upon a vehicle by an authorized person as provided above, until the vehicle has been moved through the nearest intersection. TOWN OF CARMAN BY-LAW NO. 2091 18.3 No person, other than the owner or person having charge of a vehicle, shall remove a ticket or notice placed on the vehicle be a By-Law Officer, Police Officer, RCMP Officer or Designated Officer to notify the owner or person in charge of the vehicle of an alleged contravention of this By-law relating to the stopping or parking of the vehicles. 18.4 No person shall attach an electrical cord or other device between a vehicle parked on a street and a building, outlet or device located upon private or public property. 19. REMOVAL OF VEHICLES UNDER CERTAIN CONDITIONS 19.1 Any vehicle may be towed from a street or from an off-street parking area when it is: (a)in contravention of the provisions of this by-law; (b)in a position that causes it to interfere with the movements of persons or machinery engaged in any of the operations of the Town of Carman works, such as street sweeping, snow removal and other works hereof; (c) in a position that causes it to interfere with the movements or operating of emergency equipment, The By-law Enforcement Officer, Police, CAO, Designated Officer or the Public Works Director or any person appointed by him, any member of the Royal Canadian Mounted Police, the Fire Chief of the Town of Carman, or any Town Constable under contract to the Town of Carman, may move the said vehicle or cause it to be moved, or may require the driver or person in charge of the vehicle to move it to a position determined by the aforesaid party or parties, or may authorize the removal and detention of the violating vehicle and store it in a suitable place. 19.2 The costs and charges incurred in moving and/or storing any vehicle that is impounded pursuant to the provisions of this by-law shall be considered a lien on the vehicle and shall be payable by the owner of the vehicle. 19.3 The By-law Enforcement Officer, RCMP, Police or Designated Officer may order a vehicle be towed away when such a vehicle is parked in a No Parking Zone or is in violation of the time limit in any restricted parking zone, or in violation of this by-law, and the costs and or fees of which are the responsibility of the registered owner. 20. ENFORCEMENT 20.1 The By-law Enforcement Officer, RCMP, Police, or Designated Officer are hereby authorized to enforce the following traffic regulations on private and public parking lots upon request by the Owner and all Municipal Parking Lots where the required signage is in place, namely: - Physically Handi-capped Parking Only - No Parking, Fire Lane - Emergency Vehicles Only - No Parking, Loading Area - No Parking, Entrance Only or Exit Only - No Parking 20.2 The By-law Enforcement Officer, RCMP, Police, or Designated Officer may issue a penalty notice to any person who has allegedly contravened any of the provisions of this By-law. 20.3 A penalty notice must be in a form set out in Schedule "C" to the Municipal Enforcement By-Law No. 2091 and shall be delivered to the affected person in accordance with that by-law. The penalty notice must be issued to a named person unless it is issued for a by-law contravention respecting the parking of a vehicle, in which case the notice must set out the vehicle's license plate or, if none, the vehicle identification number. 20.4 If a violation under this By-law is also a violation under the Highway Traffic Act, the Police or RCMP, may issue a penalty notice under the provisions of this By-law or a "Summons" under the Highway Traffic Act, at their discretion. 21. PENALTIES 21.1 Any person guilty of a breach of this By-law shall pay the administrative penalty outlined in Schedule "A" of the Municipal By-law Enforcement By-law No. 2091 or request a review by a screening officer in accordance with Part II of said By-Law. 21.2 That the amount of the administrative penalties set out in Schedule "A" to the Municipal By-law Enforcement By-law No. 2091 or its amendments. TOWN OF CARMAN BY-LAW NO. 2091 22. LIABILITY OF OWNERS TO CONVICTION 22.1 Where an offence, consisting of a violation of any provision of this by-law (a) Is committed by means of, or with respect to, a motor vehicle; or (b) occurs by reason of, or with respect to, the ownership, use or operation of a motor vehicle, the owner of the motor vehicle may be charged with commission of the offence and, if the Screening Officer, Adjudicator, Judge or Magistrate before whom the charge is tried, is satisfied that the offence was committed, the owner is guilty of the offence and is liable on summary conviction, to the penalty herein provided for that offence unless the owner satisfies the Screening Officer, Adjudicator, Judge or Magistrate that, at the time of the violation the motor vehicle was in the possession of a person other than the owner, without the consent of the owner. 22.2 Any person receiving a parking ticket may pay the penalty outlined on said ticket, voluntarily, at the Town of Carman office, 12-2nd Avenue SW, Carman Manitoba between the hours of 08:30 to 16:30, Monday through Friday, excepting holidays. 22.3 On voluntary payment for such contravention, the employee of the Town of Carman authorized to receive the sum mentioned shall issue a receipt. 23. REPEAL AND ENACTMENT 23.1 By-law No. 1993/2014 and all other existing by-laws of the Town of Carman relating to traffic control and regulations are hereby repealed. 23.2 The repeal of the by-law(s) in the last preceding section mentioned shall not revive any by-law or any provision of any by-law repealed by it, nor shall the said repeal prevent the effect of any saving clause in the said by-law or the application of the said by-law or any other by-law or provision of law formerly in force to any transaction, matter or thing anterior to the said repeal to which they would otherwise apply. 23.3 This by-law shall come into full force and take effect upon the passage thereof. 24. VALIDITY OF BY-LAW 24.1 Should any provision of this by-law be declared to be invalid by a court of competent jurisdiction, it is the intent of Council that it would have passed all other provisions of the by- law independent of the elimination of any such portion as may be declared invalid.
