## BY-LAW NUMBER 02/2009
## BEING A BY-LAW OF THE CITY OF DAUPHIN TO REGULATE AND CONTROL TRAFFIC & PARKING IN THE CITY OF DAUPHIN SECTION 1 - TRAFFIC
WHEREAS a municipality has the direction, control and management of municipal roads within its boundaries;
AND WHEREAS Section 90(1) of The Highway Traffic Act provides for a traffic authority to make rules or by-laws to regulate and control vehicular and other traffic and the parking thereof within its jurisdiction;
AND WHEREAS Section 90(2) OF The Highway Traffic Act provides for the council of the municipality to impose penalties for a violation of any such rule or bylaw;
AND WHEREAS Section 90(3) of The Highway Traffic Act provides for the council of a city to make rules or by-laws applicable to any part of a provincial highway within the city'
AND WHEREAS Section 236(1) (b) (i) of the Municipal Act L.M. 19967, c.58 Chap. M225 states:
- 236(1) Without limiting the generality of clause 232(1) (o) (enforcement of bylaws), a by-law passed under that clause may include provisions
(ii) subject to the regulations, providing for fines and penalties, including the imposition of a penalty for an offence that is in addition to a fine or imprisonment, so long as the penalty relates to a fee, rate, toll, charge or cost that is associated with the conduct that gives rise to the offence, or related to enforcing the by-law.
- (b) remedying contraventions of by-laws, including
AND WHEREAS it is deemed necessary and expedient to pass a By-law to regulate and control vehicular and other traffic and the parking thereof within the City of Dauphin;
NOW THEREFORE, the Council of the City of Dauphin, duly assembled, enacts as follows:
SHORT TITLE: This by-law may be referred to as "The Traffic & Parking By-Law"
## INTERPRETATION
## WHERE USED IN THIS BY-LAW.
- (a) "Approved Parking Area" means a space designated by signs or pavement markings as being for the sole use of motor vehicles. The approved parking area excludes those areas designated as prohibited parking areas or loading zones pursuant to the Highway Traffic Act or the City of Dauphin Traffic By-law and amendments.
- "Boulevard" means that portion of a street not meant for vehicular traffic between the curb lines or the lateral lines of the roadway and the adjoining property line, including the sidewalk; and that portion of a street between the curb lines or lateral lines of the roadway of a divided street and includes medians.
- (c) "By-Law Enforcement Officer" means the City of Dauphin By-law Enforcement Officer and is partially or wholly responsible for the enforcement of this by-law.
- (d) "Chief of Police" means the Chief of Police for the City and anyone acting or authorized to act on his or her behalf.
- (e) "Complimentary Tickets" means any complimentary pass, courtesy card, sticker, certificate, or other thing purporting to provide for any exemption from the provisions of this By-law.
- (f) "Council" means the Council of the City.
- (g) "Crosswalk" means that portion of a roadway clearly indicated for pedestrian crossing by lines or other markings on the surface, or, where no such markings exist, that portion of a roadway within the prolongation irectly (not diagonally) across such roadway, of the lateral boundary lines o sidewalk on an intersecting stree
- (h) "Curb" means the lateral boundaries of a roadway whether marked with curb stones or not.
- "Designated Officer" means By-Law Enforcement Officer, Special Constable or any other person or agency by or acting for the City of Dauphin and partially or wholly responsible for the enforcement of this bylaw.
- (i) "Director of Operations" means the City of Dauphin Municipal Engineer or any person designated to act in his stead.
- (k) "Driver" includes the rider and driver of a horse, the rider of a bicycle and the operator of a motor vehicle.
- (1) "Holiday" means New Year's Day, Louis Riel Day, Good Friday, Victoria Day, Canada Day, August Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day.
- (m) "Highway" means a public thoroughfare within the City of Dauphin. Every highway shall be deemed to include all space between the property lines on either side, and whenever the expression "highway", or lane within the City of Dauphin. Whenever in this by-law any highway is referred to by name or number as a street or avenue such street or avenue so named or numbered shall mean the street or avenue within the City of Dauphin commonly bearing such name or number.
- (n) "Horse" includes mule, ox or other beast of burden.
- (0) "Intersection" or Street Intersection" means that area within the side lines, real or projected, of two or more streets, or of a street and a lane, which meet at an angle or across each other. In the case of the intersection of two through streets, each street shall be regarded as intersecting the other. Street in this case meaning the travelled portion between curb lines or ditch lines.
- (p) "Lane" means a highway six meters or less in width.
- (9) "Loading Zone" means a designated portion of a Street adjacent to the Curb or Road edge, reserved for the exclusive use of Vehicles, including taxicabs, during the loading or unloading of passengers or goods.
- (r) "Motor Vehicle" means a vehicle not run upon rails that is designed to be self-propelled or propelled by electric power, but does not include a farm tractor, a self-propelled implement of husbandry, a special mobile machine, or a snowmobile other than one mentioned in the exception set out in clause (a) and (b) of subsection (10) of The Highway Traffic Act.
- (s) "Operator" means the owner of and every person who drives or operates a motor vehicle.
- (t) "Parking" means causing or allowing a vehicle to stand on a highway. For the purposes of any provisions of this by-law restricting parking to any period of time unless a vehicle is moved at least through the nearest intersection it shall be deemed to have remained stationary. The provisions of this by-law with respect to parking shall not apply to vehicles in charge of civic employees while in use in connection with work being done on or in any highway.
"Parked" means stationary or permitted to remain stationary as the context may require.
- (4) "Peace Officer" means any member of the Royal Canadian Mounted Police, By-law Enforcement Officer, Special Constable, or any person lawfully authorized to direct or regulate traffic, or to enforce this by-law.
2. (v) "Pedestrian" means any person afoot.
3. (w) "Roadway" means that portion of a highway intended to be used for vehicular traffic.
4. (x) "Street" means a highway more than six metres in width.
5. (y) "Traffic" includes pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together, while using any highway.
6. (z) "Traffic Signs" means a sign, marking or device (other than a traffic light signal) placed or erected by police authority or by a municipal department having jurisdiction, for the purposes of guiding, directing, warning or regulating traffic.
7. (aa) "Traffic Light Signal" means any device whether manually, electrically or mechanically operated by which traffic is regulated.
8. (bb) "Trailer" means a Vehicle designed for carrying chattels, and for being towed by a motor vehicle or other vehicle.
9. (cc) "Truck" means a Motor Vehicle or semi-trailer Truck that is not a delivery car and that is constructed or adapted to carry goods, wares, and merchandise, freight or commodities, but not passengers or their personal luggage and that has more than four tires in contact with the road.
10. (dd) "Vehicle" means a device in, upon or which by a person or property may be conveyed on a highway, including a bicycle or pushcart.
2. Every horse and every person driving, loading or riding the same shall be subject to all of the provisions of this by law insofar as the same can be made applicable
12. Unless otherwise specified or unless the context otherwise requires, he provisions of this by-law shall apply to persons, horses an‹ ehicles only while upon a highway

## GENERAL REGULATIONS
4. No vehicle shall cross from one side of a highway to the other or turn around in a highway, except at an intersection.
5. (a) No person shall deliver any tuel or ice trom a vehicle in such manner as to interfere with pedestrian traffic or cause annoyance to the general public.
2. (b) Wherever access can be had to a lane, all deliveries or collection of commodities or garbage shall be made therein.
3. No animal or vehicle shall be driven or backed or allowed to stand on any sidewalk but may be driven over a crossing.
7. No person shall drive, operate, or have on a highway a vehicle in such condition, o constructed or so loaded as to be likely to cause unnecessary delay to traffic o accident or injury to man, beast or property. Without restricting the generality o the foregoing, no wood sawing machine shall be allowed on any highway unless the saw is sufficiently covered or guarded.
5. No bicycle shall be equipped with nor shall any person use upon a bicycle any siren horn or any device producing a sound which resembles that produced by a siren horn.
9. Persons wishing to hold a special event on any streets) in the City of Dauphin, including parades, marches, rallies, block parties, street closures and any other event shall make application in writing to the City of Dauphin requesting approval for such event. The applicant shall comply with the current City of Dauphin policy establishing guidelines for the approval of such events, and which may be amended from time to time by resolution of Council.
## TURNING AT INTERSECTIONS
10. Where two intersecting highways form an angle greater or less than a right angle, a vehicle shall bear sharply across to the proper side of the highway along which it is to proceed
## "U" TURNS PROHIBITED
11. No driver of any vehicle shall with such vehicle make what is commonly known as a "U" turn at the intersection of any Avenue with Main Street or at the entrance to properties South of Whitmore Avenue and East of PTH #5A.
## RIGHT-OF-WAY:
12. The driver of a vehicle shall not drive between the vehicles comprising an uthorized parade or procession while they are in motion provided that the sai ehicles are conspicuously so designated. This provision shall not apply t ambulances travelling in emergencies or vehicles of the police or fire department.
13. (a) The driver of a vehicle entering Main Street North directly from Part Lots 1, 2 and 3, in Block 20, as shown on the Plan of Survey registered in the Dauphin Land Titles Office as No. 243, shall upon entering said Main Street North turn and drive his vehicle to his right only. He shall also proceed cautiously in so entering said
Main Street North and when so doing he shall yield the right-of-way to passing vehicles and pedestrians.
- (b) No driver of a vehicle travelling northerly on Main Street North shall, with such vehicle make a left hand turn onto River Avenue West, at its intersection with Main Street North.
- (c) The driver of a vehicle entering Main Street North directly from Part Lot 1, 2, 3, 18,19 and 20, Block 21, as shown on the Plan of Survey registered in the Dauphin Land Titles Office as No. 243, shall upon entering said Main Street North turn and drive his vehicle to his right only.
- (d) The driver of a vehicle entering Main Street South directly from Part Lots 11 and 12, Block 9, as shown on the Plan of Survey registered in the Dauphin Land Titles Office as No. 243, shall upon entering said Main Street South turn and drive his vehicle to his right only.
- (e) The driver of a vehicle (school buses exempted) entering Mountain Road from the Dauphin Regional Comprehensive Secondary School access/frontage road turn and drive his vehicle to his right only.
- (f) No driver of a vehicle travelling Easterly on Fifth Avenue North West shall, with such vehicle make a left hand turn onto Main Street North, between the hours of 7:00 A.M. and 6:00 P.M., Monday to Friday.
## GENERAL PARKING REGULATIONS:
14. No Vehicle shall be parked in a lane, but this provision shall not apply to any uniade standing temporarily for the purpose of and while engaged in loading of
15. No Vehicle shall be parked in a street in front of or within one meter of a driveway or approach leading into private premises.
16. As authorized by Section 113(1) (c) of The Highway Traffic Act, no person shall stop, stand or park a vehicle within an intersection or within six (6.0) metres thereof.
17. No person shall park a vehicle displayed for sale.
18. No person being the operator or owner of any garage or machine shop or repair shop or paint shop shall park or permit to be parked on a highway with The City of Dauphin any vehicle which has been delivered into or left in his custody or care for the purpose of storage or for sale or for the purpose or purposes of having same examined, repaired, adjusted or painted.
19. No vehicle shall stand backed up to the curb except when actually loading or unloading and must stand parallel with the curb and face in the direction of the
going traffic, but no vehicle shall stand so backed up if it interferes with or interrupts the passage of other vehicles.
20. No person shall park any vehicle on any street in the City of Dauphin, other than parallel with the curb and headed in the direction of traffic with the right hand wheels of the vehicle within three hundred (300) millimetres of the curb or boulevard or grass strip, whichever may border the roadway on the side of the street whereon the vehicle be parked and with a clear space of one (1.0) metre both in front and behind the vehicles so parked.
21. No person shall park any detached vehicle known as a trailer or semi-trailer on any highway.
22. No person shall stop, stand or park: i) Vehicles of the type know as a truck, tractor, truck and trailer, semi trailer, van or other vehicles including all commercial vehicles exceeding the length of 22 feet on any residential street in any one location for a period of time longer than two hours except for the purpose of and while actually engaged in unloading and loading, or in the case of a vehicle used by a tradesperson working on premises in the immediate area.
4. ii) Fifth wheel recreation trailers, or other recreational trailers, including a trailer designed specifically for the transport of a boat, motor homes and buses which have been converted into motor homes, are exempted form this subsection so long as they are parked for less than 48 hours and are unoccupied and in the case of trailers are connected to a motor vehicle.
5. ili) Commercial vehicles are not ancillary to residential use; such vehicles are only permitted to park on private property in residential areas once per seven days for no more than 48 hours and shall in no circumstances be permitted to idle for more than 15 minutes.
23. No person shall park any vehicle having a trailer or semi-trailer attached thereto on any highway with the exception of those highways on which parallel parking of vehicles is directed by this by-law except where prohibited by Section 26.
24. No persons shall park a vehicle on any street or enter that street in the block of a fire scene, except on direction or order of a member of the Police or Fire Department.
25. No person shall leave a vehicle parked at one place on any street in the City of Dauphin for a period longer than forty-eight (48) hours.
## PARKING BUSES AND TRUCKS:
26. No person shall park any vehicle having an over-all length exceeding nine (9.0) metres, other than a private passenger vehicle on:
2. (a) Main Street.
3. (b) First Avenue North West between Main Street and First Street North West.
4. (c) First Avenue North East between Main Street and First Street North East.
5. (d) Second Avenue North West between Main Street and First Street North West.
6. (e) Second Avenue North East between Main Street and First Street North East.
7. (f) On that part of Third Avenue North East lying between Main Street and First Lane East of Main Street.
8. 26.(1) (a) The City of Dauphin will designate certain locations within the City of Dauphin as bus stops and allow the operation of bus services within the City in certain instances.
9. (b) The designated bus stops within the City of Dauphin shall be as follows:
- (1) MacNeill School - Davidson Avenue West
- (2) On the West Side of Main Street, near or by:
12. (i) 403 Main Street North
13. (iii) 505 Main Street South
14. (i) 7 - Eleven (109 Main Street South)
15. (iv) Corner of Main Street and Eleventh Avenue South West.
- (3) On the East Side of Main Street, near or by:
17. (i) One Block South of Intersection of 6th Avenue South East and Main Street South.
18. (iii) New Life Centre (404 Main Street North)
19. (ii) City Hall (100 Main Street South)
- (4) On the East Side of Sandy Street, near or by:
21. (i) The intersection of Sandy Street with River Avenue
- (5) (i) On the South side of Second Avenue North East near or by Parkview Lodge.
- (6) (i) On the North side of Whitmore Avenue near or by Happy Haven.
3. (c) The use of the aforesaid bus stops, or any of them, and the operation of any bus service, shall be allowed only after the approval by the Council of the City of Dauphin pursuant to an application being filed by an e spent it the cir ide i seator indied The posed us to ca Dauphin shall have the sole discretion to determine whether any such application shall be approved or rejected and the terms and conditions of any approval.
## 26. (2) PARKING FOR HANDICAPPED PERSONS:
## (1) In this part:
- (1) "Decal" means the International Symbol of Access identification Sticker issued by the Province of Manitoba, Department of Highways and Transportation to identity vehicles owned and operated by physically handicapped persons.
- (2) "Decal Vehicle" means a vehicle displaying a Decal affixed to the rear license plate of the vehicle or to a Placard which is visible through the windshield of the vehicle.
- (3) "Placard" means a sign displaying the International Symbol of Access for placaraly daisied bed perses, nades nate in ed person's parking
4. (a) The Canadian Paraplegic Association; or
5. (c) The Community Therapy of the Physically Handicapped - to identify vehicles used regularly for the conveyance of physically handicapped persons.
6. (b) The Society for Manitobans with Disabilities; or
- (4) "Placard Vehicle" means a vehicle displaying -
8. (a) A Placard which is visible through he windshields of the vehicle; or
9. (b) Out of Province license plates and any card, permit, sticker or license plate issued by any Province or Territory of Canada or State of the United States of America for the purpose of

identifying that vehicle as being operated by or for the use of physically handicapped persons.
- (5) "Reserved Parking Space" means a parking space reserved for decal Vehicles and Placard Vehicles and identified by the posting of a sign bearing the International Symbol of Access and located on the following streets or portions thereof:
- a) From a point sixteen (16.0) metres West of the intersection of Main Street North and Third Avenue North West along the North side of Third Avenue North West to a point twenty- three (23.0) metres West of the aforesaid intersection.
- b) From a point fifteen (15.0) metres East of the intersection of Main Street North and Second Avenue North East along the South side of Second Avenue North East to a point twenty-two (22.0) metres East of the aforesaid intersection.
- c) From a point fifteen (15.0) metres East of the intersection of Main Street North and Fifth Avenue North East, along the North side of Fifth Avenue North East to a point twenty-two (22.0) metres East of the aforesaid intersection.
- d) On the Southerly side of Fourth Avenue North West Westerly from it's intersection with Main Street North from a point thirteen point five (13.5) metres to a point twenty-one (21.0) metres West of the aforesaid intersection.
- e) From a point sixty-seven point four (67.4) metres Easterly of the intersection of Second Street North East and First Avenue North East along the Northerly side of First Avenue North East to a point seventyfour point four (74.4) metres Easterly of the aforesaid intersection.
- (1) No person shall park a vehicle other than a Decal Vehicle or a Placard Vehicle in a Reserved Parking Space.
- (2) No person shall park a Decal Vehicle and a Placard Vehicle, in any Reserved Parking Space for more than the stated times in Schedules F, G, and H.
## 26. (3) MOTOR VEHICLE LICENSING - PARKING TEST ZONE
That a Motor Vehicle Licensing Parking Test Area is hereby established in the following location, namely:
On the Northerly side of First Avenue South West, lying between points in the street curb, distant one hundred and twenty-two point sixty-five (122.650) metres and one hundred and twenty-nine point sixty-five (12g.650) metres, South Easterly from the North East corner of the intersection of Second Street South West and First Avenue South West.

## 26. (4) DRIVER EDUCATION - PARALLEL PARKING ZONE
That a Motor Vehicle Licensing Parking Test Area is hereby established in the following location, namely:
On the Northerly side of First Avenue South West, lying between points in the street curb, distant ninety-two point three (92.3) metres and ninety-nine point three (99-3) metres, South Easterly from the North East corner of the intersection of Second Street South West and First Avenue South West.
## TEMPORARY TRAFFIC SIGNS:
27. (a) The City Director of Operations is authorized to place and maintain or caused to be placed, and maintained, temporary traffic control devices for the purpose of prohibition or regulating traffic where highway construction, repair, painting, snow removal, street cleaning or any emergency occurs.
2. (b) Unless otherwise directed by a Peace Officer, no person shall drive a vehicle or bus on any portion of a street or lane roped, barricaded or otherwise indicated as prohibited by the proper authority, as being closed to traffic for the time being.
## TRAFFIC SIGNS:
28. The Director of Operations is authorized to place and maintain or cause to be placed and maintained, all traffic control devices for the purpose of prohibiting or regulating traffic in accordance with the provisions of The City By-laws and/or The Highway Traffic Act, R.S.M. 1970, Cap H6o and amendments thereto.
## SPECIAL PARKING PROVISIONS:
29. The Director of Operations or any person so designated by him or under his supervision and direction are hereby given authority notwithstanding any traffic rules under this by-law to conduct and carry our snow removal and/or cleaning of streets and when such measures are being carried out no person shall rely on or be governed by the ordinary rules in the are of such measure.
## AUTHORITY TO MOVE VEHICLES UNDER CERTAIN CONDITIONS:
30. Where any vehicle is standing or parked:
2. (a) Contrary to any section of this by-law;
3. (b) In a position that causes it to interfere with the movements of persons or machinery engaged in any of the operations described and set out in Section 28 hereof;
4. (c) In a position that causes it to interfere with the movements or operating of
any fire fighting, ambulance or other emergency equipment by the Director of Operations or any person appointed by him, any member of the Royal Canadian Mounted Police, the Fire Chief of the City, or any City Constable under contract to The City of Dauphin, may move the said vehicle or cause it to be moved, or may require the driver or person in charge of the vehicle to move it to a position determined by the aforesaid party or parties, or may authorize the removal and detention of the violating vehicle by a garage keeper and any such vehicle and the owner thereof shall be subject to the provisions of "The Garage Keeper Act" Chapter Gio, Statutes of Manitoba, 1970, and all amendments thereto.
## 31. (1) SNOW, ICE OR DIRT - BUSINESS PREMISES - ZONE 1
Every occupant. or in the event there is no occupant, the owner or person having charge or care of every business premise, shop, building, lot or parcel of land fronting or abutting on any Street highlighted in pink and marked as Zone 1 on Figure " " hereto shall:
- (a) before 10:00 hours on each day (1o o'clock in the forenoon), following every fall of snow, hail or rain, which shall freeze on the sidewalk, or after falling of snow or ice from off any building, in those areas included within Zone 1 of Figure ", " hereto. cause the same to be removed entirely off the sidewalk fronting or abutting on such premise, shop. building, lot or parcel of land, provided always that in the event the ice or snow shall lie so frozen upon the surface, preventing it from being removed without damage to the sidewalks, every such person as aforesaid shall strew the same with ashes, sand, or some other suitable substance which will not damage the said sidewalk surface; further provided no person shall remove from any street, boulevard or sidewalk in such a manner that could create a hazardous condition for either vehicular or pedestrian traffic: or,
- (b) before 10:00 hours on each day, (10 o'clock in the forenoon) remove from the sidewalk fronting or abutting the aforesaid properties all dirt or other obstructions: and,
- (c) when the day for a clean up under paragraphs (a) and/or (b) hereof falls on a holiday, then the clean tip may be delayed until the day following the holiday, except when a business affected by this provision is open on any such holiday, then said provisions are to be met on the holiday: and,
- (d) where the provisions of paragraphs (a) and/or (b) hereof have not been met within twenty-four hours of the time specified in the said clauses, then the By-law Enforcement Officer shall notify the City Foreman who shall cause the snow, ice, dirt or other obstructions to be removea forthwith by his staff, the expense of such clean up to be recorded anc charged to the owner or owners of the land in default; and,
- (e) the City Foreman shall monthly report all such expenditures to the City Administrator and the expenditures shall be charged against the
adjacent lot or parcel of land on the tax roll for the calendar year of such clean up and collected in the same manner as ordinary municipal taxes.
## 2) SNOW OR ICE - ALL PROPERTIES - ZONE 2
- (a) It shall be an offense for any person to remove from any private property, public property, street, boulevard or sidewalk excluding those areas included within Zone 1 on Figure " " hereto, any snow or ice ano deposit same on any street, boulevard or sidewalk in such a manne that could create a hazardous condition for either vehicular o pedestrian traffic.
- (b) Subsection (a) shall not apply to the City, the Department of Highways, their agents or employees who are actively engaged in snow removal from streets, boulevards or sidewalks in the course of their employment or fulfillment of contract.
- (c) Any person occupying a property where a building abuts the property line adjacent to a street in such a manner that snow cannot be cleared ile the snow at the curb line of the street ir such the property may pile the shoe at the curb line of the street in e if a hazardous condition is not cleared when snow is piled in this manner.

## THROUGH STREETS:
32. The following named streets are hereby declared to be through streets:
2. (a) Main Street North;
3. (b) Main Street South;
4. (c) First Street North East from First Avenue North East to River Avenue.
5. (d) First Street North West from Second Avenue North West to River Avenue.
6. (e) Mountain Road from First Avenue North East to River Avenue.
7. (f) Second Street South West from Railway tracks to Fourth Avenue South West and from Fourth Avenue South West to Jackson Street;
8. (g) Jackson Street from Second Street South West to PTH #5A.
9. (h) First Street South West from First Avenue South West to Fourth Avenue South West.
10. (i) First Avenue North East from Main Street to Mountain Road.
33. Excepting as provided in the next succeeding section hereof all traffic proceeding along any through street other than across any street intersection thereon durin he time when traffic light signals are in operation thereat shall have the right-of way over traffic entering or crossing it with the exception of vehicles specifically given right-of-way by subsection 1 of Section 99 of "The Highway Traffic Act".
12. Except where traffic light signals are in operation thereat every vehicle excepting an ambulance, police or fire department vehicle giving clearly audible signal by bell, iren or exhaust whistle and excepting the vehicles in a funeral processio indicated as such by lighted head lamps, shall come to a full stop immediatel before crossing or entering:
13. (a) Any through highway, or
14. (b) Any protected intersection;
and for the purpose of this section the expression "protected intersection" shall mean any intersection where a "stop sign" is erected at or adjacent to the entrance thereof.
35. (a) The vehicles in a funeral procession if indicated as such by lighted head lamps upon approaching a stop sign or stop signal or red traffic light signal shall slow down as may be necessary for safety but may proceed cautiously past such sign.
- (b) After passing such stop sign vehicles shall have the right-of-way over all other vehicles upon the highway at such intersection.
## AUTHORIZATION OF TRAFFIC LIGHT SIGNALS:
- The installation, operation and maintenance of traffic light signals is hereby authorized at the intersections formed by the following streets, avenues and boulevards:
- (a) Main Street South, Memorial Boulevard and Second Avenue South West;
- (b) Main Street North, Third Avenue North East and Third Avenue North West;
- (C) Main Street North, Second Avenue North East and Second Avenue North West;
- (d) Main Street North, First Avenue North East and First Avenue North West;
- (e) Second Avenue North West, First Street North West;
- (f) Main Street South and Whitmore Avenue.
## AREAS CLOSED TO TRAFFIC:
- No person shall drive any vehicle through, over or upon any street or portion of street which has been closed off for the purpose of making repairs thereon, or during the course of a fire and which has been roped off or barricaded or whereon any sign has been erected indicating by words or writing thereon that the said
- That Schedule "A", Schedule "B" ", Schedule "C" ', Schedule "D" and Schedule "E" attached hereto respecting "Loading Zones", "Prohibited Parking Zones", "Stop Signs", "Yield Signs" and "No Stopping Zones" respectfully, shall form part of this By-law.
## SECTION 2 - PARKING
## DIRECTOR OF OPERATIONS TO ENSURE CONSISTENCY OF SIGNAGE:
The Director of Operations shall ensure consistency of any sign, mark, or device erected by the City of Dauphin for the purpose of regulatory warning or guiding traffic.
Any curb painted "yellow" is considered a courtesy on behalf of the City and lack of a painted curb does not form a basis for challenging a parking prohibition.
Any signage posted indicating regulatory requirements shall have precedence over yellow painted or non-painted curb areas.
## 2. OFFICER MARKING PARKED VEHICLES:
- (1) The By-law Enforcement Officer for the purpose of enforcing the provisions of this or any other by-law or regulation of the City, respecting the parking of vehicles, may make or place a mark upon any tire of a vehicle which is parked upon a street.
2. It shall be an offence for any person to remove, alter, obliterate or leface a mark made or placed upon a vehicle by a By-lav Enforcement Officer as provided in Subsection (1) until the vehicl has been moved through the nearest intersection.
## PROHIBITIONS AND OFFENSES:
- (1) No operator shall park a vehicle in the approved parking areas set forth in Schedule "F" hereto in the City of Dauphin for longer thar wo (2) hours duration at any time between the hours of 7:00 A.M and 6:00 P.M. on any day except Saturday, Sunday and holidays.
For the purposes of this section, if a vehicle does not move through a street intersection during the aforesaid two (2) hour period, the operator shall be deemed to be in violation of this section, irrespective of the location at which the vehicle is parked.
- (2) No operator shall park a vehicle in the approved parking areas set forth in Schedule "G" hereto in the City of Dauphin, for longer than thirty (30) minutes duration at any time between the hours of 7:00 A.M. and 6:00 P.M. on any day except Sundays and holidays.
- (3) No operator shall park a vehicle in the approved parking areas set forth in Schedule "H" hereto in the City of Dauphin for longer thai ifteen (15) minutes duration at any time between the hours of 7:00 A.M. and 6:00 P.M. on any day except Sundays and holidays.
- (4) Where Handicapped Parking zones are located in a timed parking zone they shall be subject to the permitted parking time specified.
- (5) No operator shall park a vehicle at any portion of an approved Section hereen parking there has been prohibited pursuant to

## 4. COMPLIMENTARY PARKING PASSES
- (1) No operator shall display or use any complimentary pass, courtesy card, sticker, certificate, or other thing purporting to provide for any exemption from the provisions of this By-law unless such Ericement anie the per dand Detacherent, Cly By Law
- (2) Where an organization, club, or business is holding a convention, seminar or other such event and requires Complimentary Parking Passes as per Schedule "'" attached, the said organization, club or business shall make application to the By-law Enforcement Officer, stating which days the event is being held and the quantity of Complimentary Parking Passes that are required for the vehicles.
- (3) The By-law Enforcement Officer shall enter the date authorized and sign Each Complimentary Parking Pass before forwarding said passes to the organization, club or business. There shall be no tee charged for the Complimentary Parking Passes.
- (4) The By-law Enforcement Officer shall be authorized to give out "Courtesy Notice - Do Not Pay" as per Schedule "'" attached to:
- i) Vehicles in violation of this said by-law but have out of province license plates;
3. ii) Vehicles in violation of this said by-law where new signage has been erected and as a courtesy, a time frame of two weeks is given to the community prior to enforcing.
## EXEMPTIONS AND EXCEPTIONS:
- (1) Any approved parking area may be used without time limit:
2. (a) By all vehicles on Saturday, Sunday and holidays as defined in Section 2 hereof and on every other day of the week before the hour of 7:00 A.M. and after the hour of 6:00 P.M. in the afternoon;
3. (b) By vehicles of the Royal Canadian Mounted Police while on lawful police business;
4. (c) By vehicles of, or employed by, or involved in work, being performed on behalf of the City of Dauphin while in use in connection with work being done on or near an approved parking area;
5. By vehicles of the Government of Canada or the Government of Manitoba, and of any public utility if such vehicles have the owner's name painted thereon and are actually engaged in works of necessity on or near an approved parking area and requiring them to stand or be parked in contravention of any such provisions; and
6. (e) By duly licensed commercial vehicles while unloading or loading.
- (2) The City of Dauphin, the Royal Canadian Mounted Police Detachment Commander, or the Fire Chief may override the Provision of this by-law and impose more restrictive provisions on stopping, standing or parking pursuant to their discretionary powers as set out herein or elsewhere where required in the interest of public safety or convenience.
## TEMPORARY CLOSING OF PARKING SPACES:
Whenever due to any special circumstances, the Royal Canadian Mounted Police Commander or the Director of Operations considers that any approved parking areas should be temporarily discontinued as a parking area, he may cause to b placed or erected, a sign or signs directing "no parking" at such approved parking area.
## OFFENCES & PENALTIES:
- (1) Whenever a vehicle is found parked or left in violation of any provision of this By-law, any Peace Officer, on finding such vehicle shall conspicuously affix an Offence Notice to such vehicle, ano hereafter referred to as a "Summons" or by handing the Summons to the owner or operator thereof, and such notice shall state the vehicle license plate number, the date and time and place of violation, and briefly describe the alleged violation.
- (2) Withstanding Sections 3(1), (2), (3), if the vehicle with a Summons affixed has not been moved after a period of Two (2) hours, Thirty for each two hours; thirty minutes or fifteen minutes as the case
- (3) Any person liable to pay a parking fine shall pay the fees of which are due as Outlined Schedule "K" attached and include Option "A" which provides for voluntary payment within 7 days of the date of service of summons and Option "B" which provides for voluntary payment if paid after 7 days from date of service of Summons. A person who has received a Summons and wishes to enter a "Not Guilty" plea may do so by appearing before a Judge, Magistrate or Justice at the Provincial Court Office, Dauphin, Manitoba.
Voluntary payment under the said Options "A" or "B" may be made at the Dauphin City Hall, 100 Main Street South, Dauphin, Manitoba, Monday through Friday, 9:00 A.M. - 4:30 P.M. or at the City Hall Drop Off Box available twenty-four hours (24 hrs) a day.
- (4) Every person found guilty of any breach of any of the provisions of this by-law shall be liable upon conviction therefore to a fine not exceeding the sum of One Thousand Dollars ($1,000.00) and costs for each offence and in default of payment of the fine and costs forthwith the City shall have and is hereby empowered to register a lien against any vehicle registered in the name of the offender for the amount of the fine together with costs including costs for each offence including costs of registration and discharge and an administration fee of $60.00.
- That by-laws No. 3912, 3913, 3944, 3956, 3993, 4023, 4047, 4072, 4098, 4160, 4161, 4174, 4195, 4196, 4213, 4225, 4248, 4251, 4270, 4298, 26/93, 38/93, 24/94, 25/94, 43/94, 04/95, 05/95, 32/95, 33/95, 25/97, 26/97, 04/98, 19/98, 02/99, 14/2000, 16/2000, 27/2000, 01/2001, 09/2001, 21/2001, 09/2002, 16/2003, 18/2003, 22/2003, 24/2003, 31/2003, 32/2003, 08/2004, 15/2004, 06/2005, 15/2005, 21/2005, 01/2006, 15/2006, 16/2006, 18/2006 and all other amendments or by-laws of the City of Dauphin prior to the date of passing this bylaw of the City of Dauphin be and are hereby repealed.
9. This by-law shall come into force and effect immediately upon the passing thereof.

- 4) Parkview Lodge Senior Citizens Home, 29-2nd Avenue North East - Loading Zone That a loading zone be established in front of the entrance to Senior Citizens Home located on Lots 11, 12, 13 and 14, Block 23, Plan 243, being No. 29-2nd Avenue North East, in The City of Dauphin which loading zone shall be twelve (12.0) metres in length along the curb where parallel parking is in effect. Such zone shall be designated by appropriate signs and no person shall park any vehicle therein at any time except where engaged in taking on or discharging a passenger.
## 5) Medical Loading Zones-
A portion of every highway four (4.0) metres in length where diagonal parking is the rule and seven (7.0) metres in length where parallel parking is the rule, directly in front of the office premises within the City of every doctor of medicine and dental medicine and being on that side of the highway on which such premises shall front, is hereby reserved for the use of patients visiting such office premises and no person shall park any vehicle therein, except temporarily while discharging or taking on a passenger therein.
- School Loading Zones - No person shall park any vehicle other than a school bus between the hours of 8 o'clock A.M. and 5 o'clock P.M., during the days Monday to Friday, both days inclusive, except that there shall be no parking at intersections at any time as set out in Section 113(1) of The Highway Traffic Act.
