TOWN OF GILLAM
BY-LAW 664.2003
BEING A BY-LAW OF THE TOWN OF GILLAM TO ESTABLISH WATER AND SEWER RATES WITHIN THE
TOWN OF GILLAM.
WHEREAS the Town of Gillam owns and operates a sewer and water facility within the limits of the said Town of
Gillam;
AND WHEREAS Subsection 232 of The Municipal Act provides, in part, as follows:
(1)
A Council may pass by-laws for municipal purposes respecting the following matters:
(l)
public utilities;
(2)
Without limiting the generality of subsection (1), a council may in a by-law passed under this division
(d)
establish fees of other charges for services, activities or things provided or done by the
municipality or for the use of property under the ownership, direction, management or control of
the municipality;
AND WHEREAS Subsection 84 of The Public Utilities Board Act provides, in part as follows:
(1)
No change in any existing individual rates, joint rates, tolls, charges, or schedules thereof or any
commutation, mileage, or other special rates shall be made by any owner of a public utility, nor shall any
new schedule of any such rates, tolls, or charges be established until the changed rates or new rates are
approved by the board, when they shall come into force on a date to be fixed by the board; and the board
may, either upon written complaint or upon its own initiative, hear and determine whether the proposed
increases, changes, or alterations are just and reasonable.
NOW THEREFORE the Council of the Town of Gillam duly assembled hereby enacts as follows:
1.
THAT By-Law 450 enacted by the Town of Gillam the 22nd day of May, 1991, is hereby repealed.
2.
THAT all accounts for minimum monthly charges for metered services as set forth in the Schedule of
Monthly Rates shall be billed monthly, together with any excess charges for metered water and sewer
services for the month. Consumers shall pay for water and sewer service supplied to them by the Town of
Gillam at the rates and terms set out in "Schedule A" attached hereto and forming part of this by-law.
3.
THAT this by-law shall come into force and become effective on, from and after both the approval by The
Public Utilities Board and receipt of third and final reading thereof.
DONE AND PASSED as a By-Law of the Town of Gillam, at Gillam, in the Province of Manitoba, this 17th day of
December, 2003.

Minimum charges set out above, shall be paid monthly together with the commodity charges for any
consumption in excess of the minimum.

4.
Billings and Penalties
Accounts shall be billed monthly, and shall be due and payable 30 days after date of billing. A penalty of
1.25% (one and one-quarter percent) of the amount of the bill shall be added monthly if not paid by the
due date.
5.
Disconnection
Service may be disconnected and discontinued immediately and without further notice in the event of non-
payment of the account within 30 days after due date.
6.
Reconnection
Any service disconnected due to non-payment of account shall not be reconnected until all ARREARS,
PENALTIES and a RECONNECTION FEE of $50.00 have been paid.
7.
Outstanding Bills
Pursuant to The Municipal Act, the amount of all outstanding charges for water and sewer services are a
lien and charge upon the land, and shall be collected in the same manner in which ordinary taxes upon the
land are collectible, and with like remedies.
8.
Hydrant Rentals
The Town of Gillam will pay the utility an annual rental of $70.00 for each hydrant connected to the system.
