1 GRANDVIEW MUNICIPALITY BY-LAW NO. 10-2015 Being a By-Law of the Grandview Municipality to establish the rules, regulations and fees for the Grandview Waste Disposal Ground. WHEREAS Section 232(2) (d) of The Municipal Act provides in part the following: 232(2)(a) A council may in a by-law regulate or prohibit, and 232(2)(d) A council may in a by-law establish fees or other charges for services, activities or things provided or done by the municipality or for the use of property under the ownership, direction, management or control of the municipality. AND WHEREAS Council deems it efficient to set rules and regulations for the use of the Grandview Disposal Ground; AND WHEREAS Council deems it necessary to set such fees for commercial waste; NOW THEREFORE the Council of the Town of Grandview in session duly assembled enacts as follows: 1. THAT the Grandview Waste Disposal Ground will be operated in accordance with the Waste Disposal Ground Operating Permit to operate a Class 3 Waste Disposal Facility situated at SE 31-25-23, issued in accordance with the Waste Disposal Ground Regulation 150/91, Permit No. 3011-35. 2. THAT the Waste Disposal Ground shall be open to the public at hours authorized by the Council. 3. THAT the Waste Disposal Ground shall be supervised by a Grandview Municipal employee at all times when open to the public. 4. THAT the Grandview Waste Disposal Ground shall be used only by residents of the Grandview Municipality. 5. THAT all materials delivered to the grounds must be sorted into clean burn material and regular garbage. Clean burn material includes trees, branches, and unpainted wood. 6. THAT paint cans, agricultural chemical jugs, and tires will be accepted at the grounds for recycling, and must be sorted into the proper designated area. 7. THAT there shall be no removal of any waste, debris, chemical jugs, recyclable material or any items that have been deposited as waste from the Waste Disposal Ground by members of the public. 8. THAT there shall be no removal of scrap metal from the Waste Disposal Ground, with the exception of an authorized scrap metal dealer approved by Council. 9. THAT Commercial waste haulers will be accepted at the disposal site provided the material originates within the Municipality and provided the material is sorted. The name and location or origin will be requested. 2 10. THAT large scale demolition waste will require pre- approval from the Municipal Office. 11. THAT waste disposal fees shall be charged to Commercial waste haulers based on the following: (a) Single Axle Truck or $25.00 per load Equivalent Single Axle Trailer (b) Three Ton Truck or $50.00 per load Equivalent Tandem Axle Trailer (c) Tandem Axle Truck $100.00 per load (d) Semi Truck $200.00 per load End Dump Trailer 12. THAT prepaid 'Tipping Fee' punch cards will be required to access the site by Commercial Waste Haulers. The cards can be purchased at the Municipal Office @ 531 Main Street in Grandview. Any person who contravenes, or refuses, neglects, omits, or fails to observe or obey any provision of this by-law is guilty of an offense and is liable to: (a) A fine of not less than $500.00 and not more than $1,000.00 DONE AND PASSED by the Council of the Town of Grandview, duly assembled at Grandview, in the Province of Manitoba, this ___________ day of ___________ A.D. 2015.
