Being a by-law of the Village of Lac du Bonnet to provide for the licensing of businesses not subject to business tax under the provisions of the Municipal Act.
WHEREAS Sectlon 113 (2) of The Municipal Act provides as follors:
- " The Council of a municipality may by by-law, license and regulate any business carried on within the muricipalitu."
AND WHEREAS Section 713 (3) (d) (é) of the Municipal Act provides in part as bollons:
- " The power to license and regulate a business includes the power to set a fee not exceeding Two Hundred ($200.00) Dollars on a business." AND WHEREAS the nearly

AND WHEREAS, it is deemed to be expedient and in the best interest of the Village of Lac du Bonnet to license those businesses or enterprises not subject to tax assessment.
NOW THEREFORE BE IT AND IT IS HEREBY ENACTED as a By-Lau of the Village of Lac du Bonnet as bollows:
- | BY-LAW TITLE: This By-Law may be referred to as the Lac du Bonnet Business License By-Law.
## 2) DEFINITIONS:
for the purpose of this By-Law;
## Transient Trader means
- 1) any person who does not reside within the Village of Lac du Bonnet and who goes from place to place, to house, on foot or with any vehicle, bearing or trawing goods, wares or merchandise for sale, or
- 2) any person no does not reside within the Village o6 Lac du Bonnet and who goes from place to place, house to house, providing any kind of service lor which there is charged a see, or

4. any firm or business, corporation or company, or the like, not based in the Village of Lac du Bonnet, whose representatives or agents go from place to place or from house to house, bearing or drawing goods, uares or merchandise for sale, or for providing a service for which there is charged a bee.

## 4) GENERAL:

- b) Licenses issued under the provisions of this by-law are not transferable.
- el License fees may be pro-rated to the nearest six months in any year.
## 5) EXEMPTIONS:
- A. The following are exempt from paying business license fees within the Village of Lac du Bonnet:
- i) any student enrolled in any Lac du Bonnet schools, where that student is principally responsible for the business being conducted by that student
3. ii) Persons who pay business tax or fee in lieu of to the Rural Municipality of Lac du Bonnet.
4. iii) any commercial traveller selling or obbering for sale, by wholesale, any goods by sample cards, specimens or otherwise, for future delivery from someplace outside the Village of Lac du Bonnet.
5. iv) any duly recognized charitable organization.
## 6) PENALTIES:
Any person, firm or Corporation who vialates, contravenes or fails to observe and carry out any of the provisions of this By-Law shall, upon conviction thereos, to a fine of not more than One Thousand ($1,000.00) Dollars and costs or to an imprisonment for a period not exceeding Thirty (30) days or to both such fine and imprisonment as provided in the Municipal Act, Section 746.
- 7) CERTAIN BY-LAWS RESCINDED: By-Law No. 134, 263,292 and 543 of the Village of Lac du Bonnet are hereby rescinded, and also By-Law 564/92.
- 8) EFFECTIVE DATE:
Shall be January 1st. 1993.
