## Town of Lac du Bonnet
## By-Law No. 52/06
Being a By-Law to provide for parking for physically disabled persons.
WHEREAS Section 282 of the Municipal Act provides:
designated parking space" means a parking space designated by signs o avement markings as being for the sole use of motor vehicles displaying permit and that is located
- a) од a highway or municipal road,
- c) in a private parking lot of facility to which the public has access; (designated parking space)
- b) in a public parking lot or facility; or
"motor vehiclo" means a motor vehicle as defined in the Highway Traffic Act; (motor vehicle)
"permit" means a permit as defined in the Highway Traffic Act; (permit)
## AND WHEREAS Section 283 of the Municipal Act provides:
- (1) An urban municipality with at least 1000 residents must, and any other municipality may, by by-law, make it an offence for a person o stop, stand o pe unless a permit is displayed in the vehicle and is used in accordance with the Highway Traffic Act, and
- (2) A by-law made under subsection (1) must impose a fine for its contravention which must be an amount equal to or greater than the maximum fine for any other parking violation imposed in the Municipality; and
- (3) A by-law made under subsection (1) may provide that instead of or in addition to a fine, a vehicle parked in contravention of the by-law may be towed, at the owner's expense;
## AND WHEREAS Section 284 provides that;
- (1) A Municipality may, by by-law, require owners or operators ol parking lots or other parking facilities of which the public has access to provide designated parking spaces for the use of motor vehicles displaying a permit in accordance with the Highway Traffic Act and for prohibiting the use of such spaces by other vebicles and
- (2) A by-law made under subsection (1) may
3. (a) Specify the dimensions of designated parking spaces and to be provided by each owner or operator, and the number of spaces may be based on a proportion of the total number of parking spaces in the parking lot or parking facility; and
AND WHEREAS The Town of Lac du Bonnet proposes by By-Law t nake it an offence for a person to stop, stand or park a motor vehicle in lesignated parking space for physically disabled persons or in a manner tha nakes such a designated parking space inaccessible
- (b) Specify the requirements for the design, dimensions and location of sigus or pavement markings for designated parking spaces.

AND WHEREAS the Town of Lac du Bonnet deems it expedient to pass such a By-Law,
NOW THEREFORE the Council of the Town of Lac du Bonnet, in open meeting, duly assembled, enacts as follows:
- THAT no person shall stop, stand or park a motor vehicle in designated parking space for physically disabled persons, or in a nanner that makes such a designated parking space inaccessible unless a permit is displayed in the vehicle and is used in accordanc with The Highway Traffic Act of Manitoba and the regulationg under the Act.
