## TOWN OF LAC DU BONNET By-Law 62/25 BEING a By-Law of the Town of Lac du Bonnet to establish fair and reasonable procedures for water & wastewater repairs. WHEREAS Section 232(1) of The Municipal Act provides that a council may pass By-Laws for municipal purposes respecting the following matters; - (a) the safety, health, protection and well-being of people, and the safety and protection of property; - (e) private works on, over, along or under municipal roads; - (f) property adjacent to highways or municipal roads, whether the property is publicly or privately owned; - (h) drains and drainage on private or public property. - (I) public utilities. AND WHEREAS Section 232(2) of The Municipal Act permits council to establish fees or other charges for services, activities or things provided or done by the municipality or for the use of property under the ownership, direction, management, or control of the municipality; AND WHEREAS the Council of the Town of Lac du Bonnet deems it necessary to establish procedures for water & wastewater repairs; NOW THEREFORE the Council of the Town of Lac du Bonnet, in meeting duly assembled, enacts as follows: ## TOWN OF LAC DU BONNET RESPONSIBILITIES 1. The Town shall operate: - a. A water supply and distribution system for the purpose of supplying residences and consumers within the Town with potable water and adequate fire protection. - b. A wastewater collection and disposal system for the purpose of collecting, treating and disposing of sewage produced by the residents and other consumers of water within the Town. 2. The operation, construction and maintenance of all works relating to the Water and/or Wastewater System main lines shall be under the responsibility of the Town. ## PROPERTY OWNER RESPONSIBILITIES 3. The entire length of the water and or wastewater line from the building to the main as per schedule A, shall be the responsibility of property owners, the owners shall be responsible for: - a. The maintenance and repair of the Water Service Line including but not limited to the thawing of frozen lines; and - b. For the clearing of any blockages in the Wastewater Service Line, Including but not limited to tree roots. ## WATER REPAIRS 4. The property owner must notify public works prior to calling any contractor so that a site inspection can take place to verify the cause. 5. The property owner is liable for all repairs, costs of materials including labour, and any other expenses necessarily incurred to repair or replace any water connections/lines from the water main line to owner's residence. 6. The property owner must contact public works to arrange a second site inspection after all cleanup and repairs have been completed. ## WASTEWATER REPAIRS 7. The property owner must notify public works prior to calling any contractor so that a site inspection can take place to verify the cause. 8. The property owner is liable for all repairs, costs of materials including labour and any other expenses necessarily incurred to repair or replace any wastewater connection/line from the wastewater main to the owner's residence. 9. The property owner must contact public works to arrange a second site inspection after all cleanup and repairs have been completed. 10. Property owners should be aware that in the case of wastewater line repairs it can take a number of days and therefore they may be without wastewater service during this time.  ## OFFENCES AND PENALTIES 11. In the event of non-compliance of this By-Law, Council of the Town of Lac du Bonnet shall order the public works manager to remedy the situation at the expense of the property owner. Any unpaid fees owed by the property owner or cost incurred by any remedial actions or measures required to be taken by the Town may be added to the taxes of the said property and may be collected or enforced in the same manner as a tax may be collected or enforced under The Municipal Act. ## REPEAL 12. THAT By-Law 47/22 Water & Wastewater Repairs be hereby repealed. DONE AND PASSED AND ENACTED as a By-Law of the Town of Lac du Bonnet in the Province of Manitoba this 26th day of June, 2025.
