; ## BY-LAW NO. 1407 Being &amp; By-law of The Town of Minne desa, in Manitoba to regulate the use of firevorks. WHEREAS Section 907(b) of The Municipal Act, being Chapter 173 of the Revised Statutes of Manitoba, 1954, provides that a municipal corporation may pass by-laws for preventing or regulating the firing or setting off of ftrevorks within the limits of the municipal corporation; AND WHEREAS the Council of The Town of Minnedesa in Manitoba deems It advisable and in the interests of the peace and security of the inhabitants of The Town of Minnedosa to regulate the use of fireworks therein; NOW THEREFORE the Council of The Town of Minnedosa in open meeting duly assembled, hereby enacts as follows: 1. In this By-law, - (a) "Fireworts" means any chemical compound or mechanically mixed preparation of an explosive or conbustible or inflannable nature or any composition thereof, which is enclosed in any case or contrivance or is otherwise manufactured so as to form any device or article specially designed or adapted for the production of pyrotechnic effects and shall without restriding the generality of the foregoing include such devices commonly known as squibbs, sparklèrs, rockets, wheels, Roman candles, and firecrackers. - (b) "Private property" means any land or lands, Including any premises thereon, registered in the appropriate Land Titles Office, in the name of any person, persons or corporation other than a municipal corporation or the Crown in Right of Canada or in Right of the Province of Manitoba, or any department or agency thereof, but Includes land purchased under agreement for sale under the Veterans' Land Act, of Canada. - (c) "Public property" means any land or lands, and any premises thereon, which is not private property. - (d) "Adult" means any person, male or female, over the age of sixteen years. 2. No person shall within the 1imits of The Town of Minnedosa, in Manitoba, light, set off, fire or Instruct, or cause or permit any person to light, set off or fire any fireworks in or upon public property. 3. No person shall within the limits of The Town of Minnedosa In Manitoba, 11ght, set off, fire, or instruct, or cause or permit any person to light, set off or fire any firevorks in or upên private property, unless the person lighting, setting off or firing such fireworks is an adult or the person instructing or causing or permitting the lighting, setting off, or firing of such ffreworks is an adult and is exercising actual and continued supervision of such lighting, setting off or firing. 4. Any person guilty of a breach of any provision of this By-law shall upon conviction thereof before a Police Magistrate or any Justice or Justices of the Peace having Jurisdiction, forfeit and pay a fine not exceeding the sum of Fifty ($50,00) Dollars and costs for each offence, and in case of non-payment of any fine and costs authorized under this By-law, It shall be lawful for the Police Magistrate, Justice Or Justices so convicting as aforesaid, to issue a warzant under his hand and seal (or their hands and seals as the case may be) to levy the fine and costs by distress and sale of the goods and chattels of such person, and in case of non-payment of fine and coste inflicted for any such breach, and there being no distress found out of which said fine and costs can be levied, it shall and may be lawful for the Police Magistrate, Justice or Justices so convicting as aforesaid, to connit such person to the common gaol of the Western Judicial District in Manitoba for any period not exceeding thirty (30) days.
