MUNICIPALITY OF KILLARNEY - TURTLE MOUNTAIN BY-LAW NO. 4 -2024 ************************************************************************************* Being a By-Law of The Municipality of Killarney - Turtle Mountain to revise and update the fees payable to the Municipality for municipal services rendered under the authority of the Municipal Act. ************************************************************************************* WHEREAS in accordance with Section 232 (2)(d) of The Municipal Act, a municipality may in a by-law establish fees or other charges for services, activities or things provided or done by the municipality; AND WHEREAS The Municipality of Killarney - Turtle Mountain deems it advisable to include in one by- law the fees and charges payable to the municipality for certain services rendered by officers and employees of the municipality; AND WHEREAS the Municipality of Killarney - Turtle Mountain deems it necessary and expedient to keep current the schedule of fees for services provided; NOW THEREFORE, the Council of the Municipality of Killarney - Turtle Mountain, duly assembled, enacts as follows: 1. THAT this By-Law shall be known as the Fees and Charges By-Law; 2. That the fees and charges payable to the Municipality be as set out in the following schedules attached hereto; Schedule "A" Finance and Administration Schedule "B" Animal Control Fees Schedule "C" Cemetery Fees Schedule "D" Waste Disposal Grounds Tipping Fees Schedule "E" Machine Rentals Schedule "F" Aggregate Fees Schedule "G" Planning District Fees 3. THAT Council may review this by-law annually. 4. THAT Council may from time to time amend each schedule attached to this by-law as necessary. 5. THAT the fees, fines and charges set out in the schedules attached to this by-law shall take precedence over any other previous related by-law. 6. THAT any unpaid fees for charges owed to the Municipality by any taxpayer, including any penalties related thereto, may be added to taxes of the said taxpayer and may be collected or enforced in the same manner as a tax as defined by The Municipal Act. 7. THAT By-law 4-2023, of the Municipality of Killarney - Turtle Mountain is hereby repealed. Effective August 16, 2023 $300.00 quarter/triplex trailer Business License $200.00 / year *** Schedule "B" - Animal Control Fees Application Fees For a kennel permit $100.00 For a permit to keep restricted animals $100.00 License Fees (Annual) Related Changes For each spayed female or neutered male dog $10.00 For each male dog $50.00 For each female dog $50.00 For each dog declared to be a dangerous animal $100.00 Replacement tag $5.00 Transfer of license $5.00 Kennel permit - annual fee $100.00 Restricted Animal permit - annual fee $100.00 Penalties and Impoundment Fees For any dog, cat or any other domestic pet that was apprehended running at large or that was for any other reason, impounded by the animal control officer - For first impoundment of a dog, flat fee: $75.00 For first impoundment of a cat, flat fee: $35.00 Plus actual pound costs as charge by Vet Clinic - For second impoundment of a dog, flat fee:* $100.00 For second impoundment of a cat, flat fee: $50.00 Plus actual pound costs as charge by Vet Clinic (If occurs within 12 months of first offense) For voluntary impoundment: For each day of impoundment: $25.00 Impoundment fees for Livestock: $100.00 Impoundment fees for dangerous, quarantined and or restricted animals: $100.00 Schedule "C" Cemetery Fees Price of Plots: 4' x 8' cemetery plot $350.00 3rd & 4th urn interment per plot $750.00 /each Cremation Plots: Plot in designated cremation area $250.00 Columbarium: Single Niche in columbarium (up to 2 urns maximum per niche) ** $1500.00 Free standing family niche (up to 4 urns maximum per niche)** $4000.00 ** All engraving of doors, and opening and closing of niches, shall be done, and invoiced through Wheatland Funeral Services. Failure to Notify: Failure to notify as per Section 2 (d) of By-Law 6-2023 $500.00/offense Location & Marking: Killarney/ Holmfield/ Ninga Cemetery: i) Summer rate (April 15 - October 31) $75.00 ii) Winter rate (November 1- April 16) $150.00 ** For instances where the 48-hour notification has not been given, fees for marking graves will be doubled. Disinterment: Flat fee plus expenses $500.00 Perpetual Care (applicable to each individual interred): Perpetual Care to be paid at time of interment $500.00 All fees will be subject to applicable taxes. Schedule "D" Waste Disposal Grounds Tipping Fees Single Axle Truck - One Ton $30.00 Three Ton Truck or Equivalent Tandem Axle Trailer $30.00 Tandem Axle Truck $60.00 Semi Truck/End Dump Trailer $150.00 Construction rubble from all commercial businesses will be charged a minimum of $30.00/load for pick-up trucks and single axle trailers. All oversized loads in one category will be charged the next highest rate. The fee for tree stumps will be the same as other materials. Building Permit Residential, new dwelling and additions: Main Floor $100.00 base fee &.35 /sq. ft. Each additional floor .35/ sq. ft. Basement $75.00 base fee Grade beam, piles & crawl space $75.00 base fee Garages, carports & Accessory Building (s) $120.00 Decks $75.00 Covered deck (s) same as new additions. New Commercial (non-residential) $100.00 base fee 1% of the first $500,000 of project value and 0.6% of the valuation of the work over $500,000 Agricultural Buildings $75.00 base fee & .06/sq. ft. (Barns, Large Sheds, Open housing) 2. Demolition/ Removal Permit $75.00 House removal, site clean up deposit of $2,500.00, refundable after inspection by the authority having jurisdiction. 3. Moving Permits New RTM's from outside the planning district shall be inspected by the authority having jurisdiction of that area and a copy of the building inspection report and permit application shall be provided. Where there is no such authority the inspection shall be carried out by the planning district development officer. The inspection fees shall be equal to fees prescribed in Inspections section of Fee by-law. Moving Permits $250.00 RTM/Older home shall be inspected before being moved into municipality, this inspection shall be $20.00 per hour, plus expenses, if located outside our municipality. 4. Plumbing Permit 75.00 (Renovations only, it is included in the building permit fee) 5. Development Permit (ITS Authorization) (a) All Buildings and structures, unless indicated separately in this section will be charged a Development Permit Fee on the following: - Construction Value up to $25,000.00 --------------------------------------$75.00 - Construction Value between $25,001.00 and $100,000.00---------$125.00 - Construction Value between $100,001.00 and $250,000.00-------$200.00 - Construction Value between $250,001.00 and $750,000.00-------$300.00 - Construction Value between $750,001.00------------------------------$500.00 6. Occupancy Permit $80.00 7. Failure to obtain Permit Where a permit is required and where a permit has not been obtained prior to the commencement of the actual work, the fee shall be double the normal rate. AND: (a) Where a development permit/building permit has not been obtained, for whatever reason, before the activity requiring it has started. ( Surcharge of $80.00 shall be added to permit fees) (b) Non-compliance with a Notice or Order ($250.00 Penalty fee due immediately) (c) Non-compliance with a second Notice or Order ($350 penalty fee due immediately) (d) Non-compliance with third Notice or Order ( $550.00 penalty fee due immediately PLUS requires that this matter be reviewed by Council and further legal actions at the council discretion will be taken to gain compliance. 7. Permit Refund Whenever a permit is surrendered for cancellation within six (6) months of obtaining the permit, a refund of the fees paid shall be made after deducting $60.00 plus any inspection fees. 8. Inspections 1- Inspections related to a Development Permit/Building Permit/Plumbing Permit and conducted during regular hours;----------------------------(Fee included in permit fee) $0.00 2- Whenever an inspection is requested of a building, RTM, mobile or modular home, building to be moved into the district, structure, plumbing system, along with the writing of a report or Order, other than an inspection following the issuance of a permit, and conducted withing business hours within the RM, the fee shall be:$60.00 per hour or fraction thereof, plus travel expenses, for the inspection and the writing of the report and any subsequent time spent on the administration of the file until completion or closing of the file. 3- Inspections outside regular business hours, including requested inspections, which are not restricted to a Development Permit $75.00 per hour or fraction therof, plus travel expenses. 4- Travel expenses for items listed above; as per current mileage rates and meal charges prescribed by the current councillor remuneration by-law. 5- When an inspection is called for and the site work is not complete to the satisfaction of the Building Official and when an additional inspection is required, additional charges for the inspection as follows; $60.00 per hour or fraction thereof, plus travel expenses at the current rate prescribed by the current councillor remuneration By-law.
