## MUNICIPALITY OF KILLARNEY - TURTLE MOUNTAIN ## BY-LAW NO. 6-2021 *xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx************************ ## BEING A BY-LAW OF THE MUNICIPALITY OF KILLARNEY - TURTLE MOUNTAIN FOR THE REGULATION OF TRAFFIC AND PARKING. *x*xxx*·*×*********×xxxxxxxxxxxx*********xx*xx*xxxx***********xxx*x************************* WHEREAS by Section 287 of The Municipal Act S.M. 1996 Cap. M225, a Municipality has the direction, control and management of municipal roads within its boundaries. AND WHEREAS by Section 90 (1) of The Highway Traffic Act R.S.M. 1970 Cap. H60 and Amendments thereto, a Municipality may make rules regulating traffic and parking generally on highways within its juridiction; NOW THEREFORE BE IT AND IT IS HEREBY PASSED AS A BY-LAW OF THE MUNICIPALITY OF KILLARNEY - TURTLE MOUNTAIN, IN COUNCIL duly assembled as follows: 1. SHORT TITLE: This By-Law may be referred to as the Municipality of Killarney - Turtle Mountain Traffic by-law. 2. INTERPRETATION: Where used in this by-law, unless the context otherwise requires: - (1) "ACT" means The Highway Traffic Act R.S.M. 1970 Cap. H60 and Amendments thereto. - (2) "'APPROACH" "DRIVEWAY", or "SIDEWALK CROSSING" means the portion of a sidewalk improved or designed for the passage of vehicular traffic. - (3) "BICYCLE" shall have the same meaning as defined in the "Act". - (5) "BUS" means any vehicle designed and used to carry more than ten (10) passengers for hire and operated by a public transit utility authorized to pick up and deposit passengers in the Municipality of Killarney - Turtle Mountain. - (4) "BOULEVARD" means that portion of street between the curb line or the lateral line of the roadway and the adjoining property line exclusive of the sidewalk; and that portion of a street between the curb lines or lateral lines of the roadways of a divided highway. - (6) "BUS STOP" means a designated portion adjacent to the curb of a street reserved for the loading and unloading of passengers or buses. - (7) "CURB" means the lateral boundaries of a roadway whether marked with curb stones or not. - (8) "DIAGONAL PARKING" shall mean parking a vehicle facing the side of a highway or road at an angle of approximately 45°, more or less, to the side of the highway or road and to the direction of traffic flow on said highway or road, and where there is a curb, with the front of the vehicle within thirty (30) centimetres of said curb. - (9) "EMERGENCY VEHICLES" means vehicles of the Police and Fire Departments, ambulances and vehicles in a funeral procession and vehicles carrying rescue or first aid equipment in the case of an urgent emergency. - (10) "FOREMAN" means the person appointed by the Council of the Municipality of Killarney - Turtle Mountain together with any other person or persons designated from time to time to perform the duties and exercise the powers hereinafter conferred. - (12) "HOLIDAY" or "PUBLIC HOLIDAY" includes New Year's Day, Louis Riel Day, Good Friday, Victoria Day, Remembrance Day, Dominion Day, Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day - (11) "HIGHWAY" shall have the same meaning as defined in the "Act" or any other day proclaimed as a holiday by the Federal, Provincial or Municipal Governments. - (13) "INTERSECTION" shall have the same meaning as defined in the "Act". - (15) "LOADING ZONE" means a designated portion of a highway adjacent to the curb reserved for the exclusive use of vehicles during the loading and unloading of passengers or goods, or both. - (14) "LANE" means a highway as defined in the "Act" and being nine (9) meters or less in width. - (16) "ONE WAY STREET" and "ONE WAY LANE" means a street or a lane, as the case may be, so designated by Council, as one upon which vehicles, buses and bicycles, shall move only in the direction indicated. - (18) "OWNER" shall have the same meaning as defined in the "Act". - (17) "OPERATOR" includes the registered owner of, and every person who drives or operates a vehicle. - (19) "PARADE" means any procession or body of pedestrians, (excepting members of Her Majesty's Forces) authorized under Section 12 herein numbering more than thirty individuals standing, marching or walking anywhere on a highway, or any group of vehicles numbering ten or more (except a funeral procession or vehicles of Her Majesty's Armed Forces), standing or moving anywhere on a highway. - (20) "PARALLEL PARKING" shall mean parking on a road or highway with the length of the vehicle parallel to the side of the road or highway, and where there is a curb, with the right hand wheels within thirty (30) centimetres of the curb on the right side of the vehicle. - (21) "PARK &amp; PARKING" where used in this By-Law shall have the same meaning and effect as defined in the "Act". - (23) "ROADWAY" means that portion of a highway intended to be used for vehicular traffic. - (22) "PERSON" includes a Firm or Corporation. - (24) "SIDEWALK" shall have the same meaning as defined in the "Act". - (25) "STAND" shall have the same meaning as defined in the "Act". - (26) "STOP" shall have the same meaning as defined in the "Act". - (28) "TAXICAB STAND" means a designated portion adjacent to the curb of a street exclusively for the use of taxicabs as such vehicles are defined in the "Act". - (27) "STREET" means any highway which is not a lane, which affords principal means of access to abutting property. - (29) "TRAFFIC COMMISSION" means those individuals appointed by the Council of the Municipality of Killarney - Turtle Mountain to assist and advise the Council in matters pertaining to the regulation of traffic and parking. - (30) "MUNICIPALITY" means the Municipality of Killarney - Turtle Mountain, Manitoba. - (32) "TRAFFIC CONTROL LIGHT" shall have the same meaning as defined in the "Act". - (31) "TRAFFIC CONTROL DEVISE" shall have the same meaning as defined in the "Act". - (33) "TRAFFIC CONTROL SIGNAL" shall have the same meaning as defined in the "Act". - (34) "VEHICLE" shall have the same meaning as defined in the "Act". ## 3. PROVISIONS TO APPLY UPON A HIGHWAY: Unless otherwise specified or unless the context otherwise requires, the provisions of this By-Law shall apply in respect of persons, horses, motor vehicles, buses and bicycles while upon in highway, in a public park or in a school ground or a parking lot to which the public has access. ## 4. PARKING EXEMPTIONS: The provisions of this By-Law prohibiting, standing and parking shall not apply to: (i) Vehicles of the R.C.M.P. - (ii) Vehicles employed by the Municipality while in use in connection with work being done on or near a highway. ## 5. TEMPORARY TRAFFIC SIGNS: - (1) The Foreman is authorized to place and maintain or cause to be placed or maintained, temporary traffic control devices for the purposes or prohibiting or regulating traffic and parking where highway construction, repair, painting, snow removal, street cleaning, or any emergency occurs. - (2) Unless otherwise directed by a Peace Officer, no person shall drive or park a vehicle or bus on any portion of a street or lane roped, barricaded or otherwise indicated as prohibited by the proper authority, as being closed to traffic or parking as the case may be for the time being. - (3) A vehicle left standing or parked in contravention of sub-section (2) of this Section may, by authorization of the Foreman or a Peace Officer, be towed away and impounded in a place to be designated by the Municipal Council. - (4) The costs and charges in towing, removing, impounding and storing a vehicle removed under this By-Law are a debt owed by the owner of the vehicle and creates a lien in favour of the Municipality to the same extent, and in the same manner as if the debt were incurred under the "Act". - (5) The costs and charges referred to in sub-section (4) above shall be those as outlined in Schedule "A" to this By-Law. ## TRAFFIC SIGNS: The Foreman is authorized to place and maintain or cause to be placed or maintained, all traffic control devices for the purposes of prohibiting or regulating traffic in accordance with the provisions of this By-Law or the "Act". ## GENERAL REGULATIONS ## 7. DRIVERS TO EXERCISE DUE CARE FOR SAFETY OF PEDESTRIANS: The Municipality of Killarney - Turtle Mountain shall have the power to designate crosswalks on any portion of a street, lane or highway as to them shall seem conductive to pedestrians' safety at any time and to change, alter or abolish the same. When the said crosswalk is established at an intersection of streets or highways it shall be designated by white parallel lines so as to be clearly visible on the pavement. When the said crosswalk is established at other than the intersection of a street or highway it shall be designated as in the preceding paragraph and shall in addition have posted on each side of the highway approaching the said crosswalk a clearly printed sign with appropriate words indicating the crosswalk. ## INTERFERENCE WITH TRAFFIC: No driver or operator of a vehicle or bus shall allow his vehicle or bus to occupy a street or lane so as to interfere with or interrupt traffic. ## 9. FOLLOWING FIRE APPARATUS: The driver of a vehicle shall not closely follow a vehicle of the Fire Department travelling in response to a fire alarm or drive into or park a vehicle within sixty (60) metres of any fire apparatus or equipment. For the purpose of this Section the words "closely follows" shall mean any distance less than ninety (90) metres. ## 10. DUTIES OF PEDESTRIANS AT FIRES: No pedestrian shall approach within thirty (30) metres of any fire apparatus, fire fighting equipment situated on any roadway at the scene of any fire unless his or her assistance has been requested by an Officer in charge of fire extinguishing operations, a Peace Officer or a member of an ambulance crew. ## 11. CROSSING FIRE HOSE: No person shall drive a vehicle or bus or bicycle over any unprotected fire hose without the specific direction of a Peace Officer or the consent of the person in control of the fire hose. ## 12. PARADES - (a) No person shall hold, take part in, or be a member of a parade unless: - (ii) the parade has been duly authorized by the Municipality Council or its duly authorized agent for that purpose. - the parade is under the direction of someone as marshal or organizer; - b) A person desiring to hold a parade shall apply to the Mayor or Chief Administrative Officer of the Municipality in writing for a permit therefore not less than forty-eight (48) hours before the time set out for the commencement of the parade. The application shall clearly state the date and hour at which it is to be held, the place of formation and dispersal, the exact route to be followed and the estimated time for the parade to pass a given point. - (0) While a parade is in motion, pedestrians, on the route to be followed, shall be restricted to the adjoining sidewalks or boulevards. ## 13. DRIVING THROUGH PARADES: Unless so directed by a Peace Officer, no person, other than drivers of ambulances travelling in emergencies, or police or fire department vehicles, shall drive a vehicle or a bus through a parade. ## 14. FUNERAL PROCESSIONS; The driver of every vehicle in a funeral procession indicated as such by the headlamps of all motor vehicles therein being lighted upon approaching a traffic control device showing a red traffic control light, or a stop sign, shall cause the vehicle to slow down or stop, as may be necessary for safety, but may then proceed cautiously past the traffic control light or stop sign. The driver of each of the other vehicles in the procession shall have the right-of-way over all other vehicles upon the highway at the intersection or place where the signal or stop sign is situated. ## 15. "U" or "REVERSE" TURNS: - (a) No person shall turn a vehicle upon a roadway so as to proceed in the opposite direction - - unless he can do so without interfering with other traffic; or - (i) at a place where a sign prohibits making a U-turn. ## 16. ONE WAY STREETS AND LANES: Drivers of vehicles and buses shall drive only in the indicated directions on the street or portions of streets and on the lanes and portions of lanes as shall be indicated by appropriate signs. ## 17. STOP OR YIELD SIGNS: Stop or Yield Signs may be erected by the Foreman at an appropriate intersection within the Municipality when authorized by Municipality and shall be designated in Schedule "B" attached hereto. ## 18. ENTRY: No person shall drive a vehicle into an intersection or highway at which he/she is required by a sign to stop or yield right-of-way unless traffic on the highway or intersection upon which he proposes to enter permits him/her to do so in safety. ## 19. TRUCKS - PARKING AND DELIVERIES: Without prohibiting the driving or standing of vehicles while making a delivery or on a service call, no person shall, at any time or times, drive a vehicle, the gross weight of which exceeds two hundred and fifty (250) pounds per inch of tire width upon any roadway within the Municipality of Killarney - Turtle Mountain other than upon a designated truck route or routes as set forth in Schedule "C" hereto, and gross weight shall have the same meaning as defined in the "Act". ## 20. ESTABLISHMENT OF PARKING STALLS FOR TAXICABS: The Council may designate in such locations as shall be determined by it, parking stalls for the exclusive use of such taxicabs as shall be assigned to each particular parking stall, and as set out in Schedule "D" attached hereto. ## 21. METHOD OF STANDING OR PARKING OF VEHICLES: Unless otherwise required by traffic signs or signals or by other provisions of this By-Law, no person shall stand or park a vehicle on any roadway other than parallel with the curb, headed in the direction of vehicular traffic movement, with the curb side wheels of the vehicle within thirty (30) centimetres of the curb and a clear space of one (1) meter ahead and one (1) metre to the rear. ## 22. GENERAL STAND PROHIBITIONS: Unless specifically required by other provisions of this By-Law or by traffic signs or signals to the contrary, no person shall stand or park a vehicle in any of the following places: - on a sidewalk or boulevard; - at the entrance to a lane or driveway or to an approach leading into public premises, so as to obstruct the ingress and egress of vehicles; - (4) within three (3) meters of a fire hydrant, or, when the hydrant is not located at the curb, within three (3) metres of the point on the curb nearest the hydrant; - (3) within an intersection; - (5) on a crosswalk; - (7) along side or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic; - (6) within three (3) meters of either side of any crosswalk; - (8) on the roadway side of any vehicle stopped or parked at curb on a street; - (10) spon a roadway facing a stop sign, within three (3) meters of the siop - (9) on the roadway with the left side of the vehicle to the curb except on a one-way street where standing or parking is not elsewhere herein prohibited on the left side; ## 23. GENERAL PARKING PROVISIONS: Unless specifically required by other provisions of this By-Law or by traffic signs or signals to the contrary, no person shall park: - (1) a vehicle upon a roadway in the Municipality of Killarney - Turtle Mountain in such a manner as to leave available less than ten (10) feet of the width of the roadway for free movement of traffic; - (2) a vehicle displayed for sale upon any roadway in the Municipality of Killarney - Turtle Mountain; - (3) a vehicle in front of a fire station or ambulance station whether on the same or the opposite side of the street or within such other distance as may be indicated by traffic signs; - (4) an unregistered vehicle upon any roadway in the Municipality of Killarney Turtle Mountain; - (5) Large Vehicle Parking limited to Two Hours; - (1) Subject to subsection (ii) no person may park any of the following vehicles on a street or boulevard for more than seventy two hours: - a) A truck weighing more than 3,000 kg (6,000 Ibs); - b) A truck tractor; - c) A trailer; - d) A motor home; - e) A bus or other vehicle, having more than 4 tires; - f) A bus or other vehicle originally having more than 4 tires which has been modified to have only 4 tires; or - g) A vehicle that exceeds 6.7 m (22 feet) in length; 14. (ii) Exceptions to Large Vehicle Parking Limitation Subsection (1) does not apply to: - a. A vehicle that is shown to be in active use by a tradesperson working on a premises in the immediate area. ## 24. SPECIAL PARKING PROVISIONS: The Foreman or any person so designated by him/her and under his supervision and direction are hereby given authority notwithstanding any traffic rules under this By-Law to conduct and carry out snow removal and/or cleaning of streets and when such measures are being carried out no person shall rely on the ordinary rules in the area of such measures. ## 25. AUTHORITY TO MOVE VEHICLES UNDER CERTAIN CONDITIONS: Where any vehicle is standing or parked: - (1) contrary to any section of this By-Law; - (2) in a position that causes it to interfere with the movements of men or machinery engaged in snow removal, cleaning operations as provided in Section 24 herein, or maintenance or construction work in the area as provided in Section 5 herein; - (3) in a position that causes it to interfere with the movement or operation of firefighting, ambulance or other emergency equipment. The Foreman or any person appointed by him, any member of the Royal Canadian Mounted Police, the Fire Chief of the Municipality of Killarney - Turtle Mountain, may move the said vehicle or cause it to be moved, or may require the driver or person in charge of the vehicle to move it to a position determined by the aforesaid party or parties, and any operator who allows any vehicle to stand or be parked in contravention of Subsections 1, 2, or 3 of this Section is guilty of an offence under this By-Law. ## SPECIFIC PARKING REGULATIONS ON CERTAIN HIGHWAYS ## 26. REGULATIONS NOT EXCLUSIVE: The Provisions of this By-Law dealing with restrictions of standing, parking and time limits on parking shall not relieve any person from the duty to observe other and more restrictive provisions prohibiting or limiting stopping, standing, or parking of vehicles in specified times. ## 27. GENERAL PARKING PROVISIONS: The Council may from time to time designate by resolution: - (b) portions of the streets and lanes within the Municipality whereon parking is limited to certain periods of time; and any such designated areas shall be clearly indicated by appropriate signs and shall be designated on Schedule "E" attached hereto. - portions of streets and lanes within the Municipality whereon parking is prohibited at all times; ## 28. SPECIFIC PARKING PROVISIONS: Parallel parking shall prevail on all streets and avenues within the Municipality of Killarney - Turtle Mountain except as follows: - (b) such other areas as Council may designate by resolution and indicate b appropriate signs and as may more particularly be set forth in Schedul "F" attached hereto. - (a) along all those portions of Lot 17 to 20, both inclusive, in Block 22, Plan 404, Killarney which front on Williams Avenue (West side of Williams Avenue, Killarney Hotel and Turtle Mountain School Division Office); ## 29. IRAFFIC CONTROL DEVICES: The Council may determine locations by resolution and cause to be installed in such locations, traffic control devices as herein defined, and located as designated in Schedule "G" attached hereto. ## 30. PROHIBITION OF TURNS: The Council may, from time to time, designate intersections within the Municipality by Resolution at which making right or left turns is prohibited but such intersections and such prohibitions shall be clearly marked with an appropriate sign and as designated in Schedule "H" attached hereto. ## 31. CREATION OF GENERAL OFFENCE: Any operator who violates, contravenes, disobeys, refuses, omits, neglects, or fails to observe, obey or comply with any of the provisions of this By-Law is guilty of an offence under this By-Law and shall be liable to the penalties herein provided. ## 32. GENERAL PENALTY: Any person who violates, contravenes, disobeys, refuses, omits, neglects, or fails to observe, obey or comply with any provision of this By-Law is guilty of an offence punishable on summary conviction. 33. Under the authority of The Municipal Act, the Council of the Municipality of Killarney - Turtle Mountain hereby authorizes any operator who has received a notice other than a Police Court Summons, to the effect that they have violated any of the provisions of this By-Law to pay to the Chief Administrative Officer of the Municipality of Killarney - Turtle Mountain, or his Deputy, the appropriate sum as hereunder set out and upon paying the said sum the said operator shall not be liable to be summoned to Provincial Judges Court thereafter for the said offence. Payment must be made within ten (10) days of the date set forth on the Notice of Offence. Failure to make payment within the time prescribed shall result in prosecution in Police Court and no payment may be made under this Section after issuance of a Summons to appear in Provincial Judges Court. Violations of this By-Law shall bear penalties as set forth in Schedule "" attached hereto. 34. The SCHEDULES attached hereto are incorporated into and form part of this ByLaw and shall have the same force and effect as if the wording of the Schedules was embodied in the By-Law proper. - By-Law No. 13 - 2011, By-Law No. 2 - 2009, and By-Law No. 4 - 2009 repealed in their entirety. - This By-Law shall come into full force and effect immediately upon approval and final passing thereof by the Council of the Municipality of Killarney - Turtle Mountain.
