## MUNICIPALITY OF MINITONAS-BOWSMAN By-Law No: 6/2015 ## A BY-LAW OF THE MUNICIPALITY OF MINITONAS-BOWSMAN TO ESTABLISH THE REQUIREMENT FOR BUSINESS LICENSES AND RELATED MATTERS; WHEREAS Section 232 (2) of the Municipal Act gives the Council of a municipality the power to establish requirements for business licenses, and the fees payable therefore; THEREFORE the Council of the Municipality of Minitonas-Bowsman doth enact as follows; 1. Any individual, firm or corporation carrying on business in the rural area of the municipality whose physical operations are located in the rural area of the municipality shall not be required to apply for an annual business licence nor pay a fee therefore. 2. Any individual, firm or corporation carrying on a business in the urban areas of the municipality whose physical operations are located in either urban area (Minitonas or Bowsman) of the municipality after January 1St, 2015 shall be required to obtain a license from the Municipality of Minitonas-Bowsman prior to the commencement of the business and the fee for all residents in the urban areas shall pay a fee in the amount of $25.00. 3. Any resident of the urban areas of the Municipality of Minitonas-Bowsman, carrying on business activity prior to the adoption of this By-law shall not be required to obtain a business license from the Municipality of Minitonas-Bowsman. 4. A Business License issued to a resident of the Municipality of Minitonas-Bowsman, under the authority of this By- Law shall be valid for the life of the business, unless the nature of the business changes significantly from the purpose for which the original license was issued. 5. That an annual fee of $50.00 shall be and is hereby levied upon all individuals, firms and corporations carrying on business in the Municipality of Minitonas-Bowsman, and whose physical operations are centered and based outside the corporate limits of the Municipality of Minitonas-Bowsman. 6. A Business License issued to any individuals, firms or corporation whose physical operations are not centered and not based within the boundaries of the Municipality of Minitonas-Bowsman shall be valid for the calendar year in which it was issued, and must be renewed in January of each year. 7. All business operating under authority of this By-law shall comply with all By-laws and regulations of the Municipality of Minitonas-Bowsman. 8. That any individual, firm or corporation found to be conducting business activity without a valid license as required in clause 1 and/or 5 of this By-law, shall on the order of the Municipality of Minitonas-Bowsman, immediately cease all such activity. 9. Every individual, firm or corporation that contravenes any provision of the By-law is guilty of an offense and shall, by resolution of Council, be referred to the municipality's solicitor for legal action. 10. Any individual, firm or corporation that is convicted of an offense is liable to a fine of not more that $500.00.
